Box 2668 Kirkland, WA 98083 RE: Klinker Boundary Line Adjustment L96 -0077 Dear Kit: The Short Subdivision Committee has completed review of your boundary line adjustment application and has granted preliminary approval subject to the conditions stated below. There are three basic steps in the boundary line adjustment approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the boundary line adjustment is consistent with the City's policies and regulations. PRELIMINARY APPROVAL CONDITIONS Storm Drain System A. To ensure that any individual Tots are not rendered "unbuildable" the recorded survey shall include a note that reads as follows: "Compliance with the Land Altering Ordinance (Chapter 16.54 TMC), the Storm and Surface Water Management Ordinance (Ordinance #1755), and the Flood Plain Management Ordinance (Chapter 16.52 TMC) shall be achieved for the development of the entire site rather than on a parcel by parcel basis. The sidewalks required for the project may be installed at the time of construction of the homes, on a lot by lot basis for all p-reperties adjacent to City R -O -W. Private Access Roads C. Reduction of the easement width for the five private access roads from 30 to 20 feet is approved with this letter. The length of each private access road shall be increased so that a minimum 20 foot easement directly abuts each lot. D. The five private access roads shall have a minimum 12' asphalt paving with 4' shoulders on both sides, which are capable of supporting the weight of the City's fire apparatus. These shall be installed prior to recording of the boundary line adjustment, unless appropriate financial guarantees have been provided to ensure they will be installed within one year. Appropriate financial guarantees may include: bond, cash deposit, letter of credit or assignment of account, in the amount of 150% of the estimated cost of completion. E. Language granting joint access easements to each lot which will use a specific easement must be developed. Public Works' preference is that all four lots adjoining an access easement use it rather than having additional curb cuts for lots with street frontage. Maintenance agreements must be drafted for each access and utility easement, specifying which lots will share the costs and responsibility for vehicular and /or utility access maintenance. Please contact Joanna Spencer of Public Works for approval of your joint easement and maintenance agreement language prior to submitting for final approval. Fire Protection F. Prior to development of the lots, the following will be required: If there is no fire hydrant within 250 feet of all building sites, then the developer shall either install a fire hydrant capable of pumping 1000 gallons per minute at 20 p.s.i. OR the future houses will be required to provide interior sprinklers, to be approved by the Fire Department. This requirement must be stated on the face of the recorded survey, and must be met prior to issuance of any building permits. Utilities G. The Tukwila Undergrounding Ordinance shall apply. House Encroachments Prior to approval and recording, the houses that encroach over property lines on lots 51/52 and 57/58, and the garage on lots 55/56, shall be moved to eliminate the encroachment. The Klinker site has been disturbed by past filling and this makes it difficult to determine whether "normal circumstances" are present. The question of "normal circumstances" can influence the wetland determination method for evaluating disturbed situations such as the Klinker site. If the identified fill soils could affect or alter the area hydrology so that the wetland criteria is not met then the area may not be a "normal circumstance ". As a result, the "Atypical Situation" method found in Section F of the 1987 Corps of Engineers wetland manual could apply especially if wetland soils hav been coved by fill material (Please see Wetland Analysis section of 2/26/97 Letter - Incomptete Application). I met on -site last week with Mr. Dale Snyder;-Certified Professional Soil Scientist to evaluate the potential wetland area previously identified. Dale and I investigated soils in the small depression area and discussed both of our concerns about the area. Mr. Snyder provided a second letter report, dated 3/6/97, to clarify the observations relative to past site disturbance and hydrology. I have reviewed Mr. Snyder's response letter and agree the identified area is not a jurisdictional wetland. The reasons for this wetland determination are listed below and include support from Dale Snyder. 1) It appears that "normal circumstances" exist on the site. Dale Snyder's evaluation concludes the fill material has been in place long enough to allow a newly formed surface soil horizon and that it can be considered a "typical" soil. This • is important when evaluating the hydrology criteria for wetland. It appears the hydrology is not significant enough for wetland criteria. For soil saturation to affect vegetation, it must occur within a major portion of the root zone (usually within 12 inches of the surface). On several occasions the depths to standing water in soil pits were below 12 inches and never saturated to the surface. Seasonal ponding was observed during winter months; however, hydrology observed prior to the growing season is not as reliable for wetland determination. Finally, the Atypical Situation method is applied to unauthorized activities, such as fill placed over hydric soils, if the activity was not permitted and occurred after the date of regulation. The date of regulation for the Seattle district is 1/1/87 for isolated wetlands. Per Dale Snyder's recent evaluation, the fill has been in place longer than 10 years and would have occurred prior to the date of regulation. You had requested a joint visit to the site so that I could personally show my rationale for reporting that an area suspected as a possible wetland should not be considered a jurisdictional wetland. We discussed the matter quite thoroughly; this letter presents my findings and conclusion. Conclusion: The suspect area is not a jurisdictional wetland, based on the findings presented below. Findings: We dug one pit with a spade to a depth of about 18 inches and found about 7 inches of a very dark heavy silt loam surface layer. Below that to a depth of 15 inches is grayish heavy silt loam with about 40 percent of the mass covered with redox concentrations. Below 15 inches is a dark grayish fine sandy loam that I believe is a buried A horizon (surface layer). The material above 15 inches is believed to be fill obtained from an area of hydromorphic soils, accounting for the redoximorphic features now present above 15 inches. Broken tree and wood fragments were found in pits adjacent to the pit excavated for the present examination; such fragments only occur in fill materials or other disturbed deposits. The fill has been in place long enough for the dark surface layer to form; probably 20 or more years. The presence of the newly formed A horizon can allow one to consider that the fill material is becoming a "typical" soil even though the redox concentrations above 15 inches represent hydric conditions at its source. The free water surface was at 13 inches after having the pit open for about 20 minutes. Please remember that approximately 1 inch of precipitation came to the site during the previous 36 hours. Commitment and a copy of two floor plans. Because the potential of a wetland was raised by Gary Schulz of the City, we hired Dale Snyder, Certified Professional Soil Scientist, to prepare a wetland reconnaissance of the subject area. Based on findings outlined in his letter, Mr. Snyder concludes that the suspect area is not a jurisdictional wetland. For this reason, we will not be submitting an application for a Administrative Planned Residential Development. In regards to the SEPA review, if a wetland doesn't exist on the subject site, we believe that a SEPA review should not be required with the Boundary Line Adjustment application. In all other jurisdictions where we have done a BLA, we have never been required to prepare a SEPA checklist. In your Subdivision Code under section 17.04.070 item 4, it states that a BLA is exempt from the normal subdivision requirements which we feel you are asking us to prepare with this application. We have also been told that half street improvements (atypical subdivision requirement) will be required as a condition for this BLA which is totally unheard of for this type of process an we adamantly oppose. These Tots are existing legal lots which can be built on today now that the area has sanitary sewer. We are not adding any new Tots, but merely relocating the lot lines to provide for a more typical style home. As you can see from the attached home drawings, we have a number of plans which would work on the existing 40' lots which would result in a street full of garage doors. We feel this is not in the best interest of Allentown to build this style home nor do we feel they will be very marketable. In addition, we have learned that the neighbor to the north of us recently did a lot line adjustment which did not require a SEPA review or street improvements. Therefore, we are requesting the elimination of the SEPA Checklist from our BLA application and the potential of half street improvements. If these are required, we would like to know under what City Code or ordinances authorizes the City to ask for these requirements. Regarding the legality of the Tots, we are submitting a copy of a Stewart Title's ALTA Commitment which show these lots were platted under the name C.D. Hillman's Meadow. Garden Addition to the City of Seattle, Division No. 1, according to the plat thereof recorded in King County. If you require any additional backup on this matter please let us know. Regarding any existing building or sheds, these structures will be removed or relocated to conform with the new lot lines. As you are aware, it is our intent to commence construction on this project once the Boundary Line Adjustments can be recorded. If the half street improvements are made a condition of the BLA, the economic viability of this project becomes very tenuous given the additional burden of the sewer and water hookup fees. Our objective all along was to provide affordable housing to what we believe is the current market level for Allentown. With the additional requirements the final sale price of our homes is being moved up to, the next price level which can't be supported by the Allentown market. You directed me to the area suspected as a possible wetland. This letter is intended to satisfy the City's request. Site Location: 46th Ave. South, Tukwila; Klinker Boundary Line Adjustment, L96 -0077. Purpose of Investigation: Respond to a notice from the City of Tukwila stating , "Because there is a potential wetland on the site, a reconnaissance level wetland analysis by a qualified wetlands expert must be provided." This letter provides what I believe should adequately satisfy their request. Conclusion: The suspect area is not a jurisdictional wetland, based on the findings presented below. See attached site map for approximate location of suspected wetland. Methodology: The site investigation was conducted using existing guidelines and techniques for identifying jurisdictional wetlands in King County and the US Army Corps of Engineers, 1987 Wetlands Delineation Manual as revised; Field Indicator of Hydric Soils in the United States, A Guide for Identifying and Delineating Hydric Soils, USDA, Natural Resources Conservation Service, 1996; and Redoximorphic Features for Identifying Aquic Conditions, Technical Bulletin 301 of North Carolina State University, 1996. Specifically, I examined soils and water levels at three locations believed to fairly represent the area suspected of having wetlands. Pits were excavated by spade to a depth of 24 inches and to a depth of about 40 inches with an Oakfield probe which permits the removal of an undisturbed core; soil characteristics were recorded. Each pit was open for 20 to 30 minutes to allow the water level to equilibrate. Findings: Excavations at the three location reveal silty fill material ranging in thickness from 12 to 14 inches. The surface layer of the fill is relatively dark indicating that the fill has been in place for several years. Below the surface layer is silty material that is replete with redox depletions and redox concentrations and intermingled with darker grayish colored 2205 226th Place N.E. Redmond, Washington 98053 (206) 868 -6107 IClinker, L96-0077 - page 2 soil material. These color patterns are indicative of disturbed material, and in this case, fill. The redoximorphic features were not developed in place at this site. Below the fill material is a very dark layer about 3 inches thick that was the original surface layer before the fill was placed. Very dark sandy soil is below the original surface layer. Probably the original soil would have been recognized as representing the Renton soil series; see Soil Survey of King County Area, Washington; Snyder, D.E., et., al.; 1973; USDA Soil Conservation Service. The free water surface on 1-29-97 was at 13 inches in one pit and 14 inches in the other two. The soil material above the free water surface was moist but not saturated. Saturation and anaerobic/reducing conditions are required for recognition of hydric soils. My sense is that when the "water table” is at the observed depth at this time of year following an extended period of unusually high precipitation, it most certainly will be lower during the growing season in most years; The point being that the redoximorphic features in the upper soil layers are not the result of contemporaneous saturation and reduction. Without stagnant water, i.e., saturation, in the near-surface layer, and the absence of contemporaneous reduction in that layer, the soils are not hydric, hence no jurisdictional wetland. Rants, Mayor Department of Community Development Steve Lancaster, Director MEMORANDUM TO: Steve Lancaster, DCD Director FROM: Gary Schulz, Urban Environmentalist DATE: January 13, 1997 RE: Wetland Site Visit - Klinker Boundary Line Adjustment L96 -0077. .41_ I met on -site today with Mr. Klinker to look at the potential wetland area I identified and recently showed to you. The site is directly west of Union Tank Co.'s facility. The standing water present when you and I visited the site is now drained. However, I dug a data plot soil pit and found hydric soil indicators (mottling) consistent with wetland criteria in the 1987 Manual. The soil pit also had water seeping into it with stronger hydric soil indicators at depth. I explained to Mr. Klinker that early spring is the "growing season" and the correct time to evaluate wetland hydrology which needs to be present to support wetland areas. The topographic position, and presence of hydric soil and shallow groundwater is fairly good evidence of the area being wetland. We also walked over to the east side of 46th Avenue S. on Lot 25. ' This arda exhibited a similar silty soil but lacked the hydric indicators of distinct gray color and mottling. This area is slightly higher in elevation and does not appear to have wetland. However, I informed the applicant that the entire project site would need to be investigated for wetland presence. In addition, our discussions included the sewer /water improvements along 46th Avenue S. Recent fill material, from construction activities, has been placed in ROW and probably on the applicant's site at the location of the depression assumed to be wetland. This location is approximately at Lot 12. So called "wasting" of excess soil may have been granted by the current owner; however, will need to be removed from any wetland area.
