Box 330310 Seattle, WA 98133 -9710 Attn. Bruce P. Farrar RE: L96 -0080 -- WSDOT Noise Variance for SR -518 Improvements. This letter serves as a notice of decision for a technical noise variance to allow an asphalt overlay and associated construction. This decision is issued pursuant to TMC 8.22.190 and .020 which authorizes the D.C.D. Director to approve a variance after a public hearing and consideration of specific criteria. PROJECT BACKGROUND a. Project file No.: L96 -0080 (WSDOT Noise Variance for SR -518 Improvements). 'Applicant: State of Washington Dept. of Transportation. c. Project Description: Technical noise variance to allow construction noise of up to 86 dB(A), at residential receiving properties for short durations, between 10 PM and 7:00 AM. The variance would be for the period beginning February 15, 1997 and ending on May 31, veA- d. Project location: Asphalt overlay and associated activities will occur along SR -518 east- bound lanes and on all access ramps between SR -99 and I -5, as shown in the staff report. e. No associated permits have been submitted concurrently with this noise variance application. f. Environmental threshold determination: This proposed action is SEPA exempt. h. A public hearing was held on the proposed variance on January 23, 1997 at 6 PM, at ` Suite 100, 6300 Southcenter Blvd., Tukwila WA. 2. The notice of the public hearing was published in the Seattle Times newspaper on January 13, 1997, and mailed to property owners and residents within 500 feet of the SR -518 right of way line. 3. An evaluation of the proposed variance was submitted by the Tukwila Planning Division in a staff report dated January 21, 1997. 4. WSDOT representatives asserted the following at the public hearing: A. the staff report accurately represented the proposed action, impacts, and proposed mitigating measures and B. discussions with other WSDOT construction engineers disclosed that no noise complaints were received during similar asphalt overlay activities on the west- bound lanes of SR -518 about 3 years ago. 5. The lack of complaints during the overlay of west -bound SR -518 lanes and a lack of complaints during similar I -5 lane construction over the past 3 years, does support the WSDOT estimate of minimal significant impacts. CONCLUSIONS The following conclusions are adopted based on information in the Planning Division staff report and received at the public hearing: CRITERIA 1: The balance between the relative interests of the applicant, other property owners and the general public will be served by granting the variance given the following: a. the SR -518 improvement is regionally needed and avoiding the extreme level of congestion associated with day -time lane closures is in the regional best interest, b. maximum noise levels will be significantly reduced indoors to an EPA noise level where some impacts may occur, but be of a short duration and c. WSDOT has incorporated significant noise mitigating measures into their proposed action (See Project Description). ,»,.. .10.,.,11..,.. z _ mow; .u6. J U;. O. co CY Nw;. w =' H N U. W0'. LL Q. CRITERIA 2: The noise occurring with the variance is not anticipated to significantly endanger public health and safety, given a comparison of EPA noise thresholds, the maximum anticipated indoor noise levels, WSDOT noise mitigating actions, the relatively short duration of maximum impact, and the lack of complaints during similar I -5 and SR -518 construction activities. Specific factors which were considered in this decision included: a. the applicant's description of noise generation (e.g., maximum 66 dB(A) interior levels of a short duration, 2 -3 times per night), b. proposed noise reducing and impact mitigating measures incorporated as construction practices, c. area -wide and case -by -case impact mitigating measures for noise sensitive individuals or situations, and d. agreement to suspend, modify or revoke the variance if a significant number of complaints are received. • CRITERIA 3: The proposed noise maximum, short -term noise level of 86 dB(A), would be 41 dB(A) above the 45 dB(A) which is allowed in the Tukwila Noise Ordinance. The above findings do not indicate an available, practical means to prevent, abate, or control the noise level below what is proposed. DECISION Based on the above conclusions and pursuant to TMC 8.22, the technical variance is APPROVED as proposed. Granting of this variance explicitly recognizes: 1. the rigorous enforcement of impact mitigating-actions as summarized in the Planning Division staff report, 2. the applicant's responsibility that: "Any technical variance shall be subject to the holder's taking of any alternative measures that the administrator may prescribe." (TMC 48.22.190(1)). Alternative measures may be developed in the unusual situation when the specified mitigating measures are determined by the Administrator as inappropriate. Measures shall be guided by the Planning Division staff report findings and conclusions. Alternatives may include sound insulation of residences where relocation may be a hardship or significant inconvenience (e.g., a disabled person with special requirements or one with animals which cannot be relocated) and 3. the ability to modify or cancel the variance upon non- performance or widespread noise impacts as discussed in the Planning Division staff report. Z; UJ Resurfacing is largely proposed between 7 P.M. and 6 A.M. U; 00. w= J H w O. Construction could only occur during regulated hours with a noise variance from the Director of the Department of Community Development (TMC 8.22.190 and N <! 8.22.020(1)). (TMC 8.22.160(4)), but otherwise regulated by TMC 8.22. The proposed construction noise would occur during regulated hours and exceed the allowed noise level of 45 dB(A) by a maximum of 41 dB(A). Pursuant to TMC 8.22.190, recipients of technical variances have certain responsibilities. This includes, but is not limited to: Any technical variance shall be subject to the holder's taking of any alternative measures that the administrator may prescribe." (TMC 8.22.190(1)) VICINITY /SITE INFORMATION 1. Project Description: The applicant's request for a technical variance is shown in AttachYnent> WSDOT proposes to asphalt overlay various sections of SR -518 between SR -99 and I -5, and complete other associated activities. Overlaying would occur during regulated hours on: a. all access ramps, b east bound (southern) lanes and shoulders in the western half of the improvement area, and c. the east bound shoulder in the eastern half of the improvement area. These areas are graphically shown in (trt. The specific equipment used for overlaying and their noise characteristics are shown in 1tt1lzr Maximum noise levels of 86 dB(A) may occasionally occur (e.g., noise :.::. :.:::...:.: : ...:..:.:.::..:..:. from a concrete delivery truck). The most significant longer term noise generator would be the pneumatic roller, which uses weight and vibration to compact the asphalt. The roller would pass over each section of overlay two or three times each night, at an extremely slow rate. Any one 3 Noise Variance Staff Report = L96 -0080 Washington State Dept of Transportation residence would be exposed to some roller noise for about an hour for each pass, with peak noise level for a much lesser period. The applicant has incorporated a number of actions to reduce the actual noise level generated and perceived impacts ( tta z e t A). A summary of these actions are listed below: Z gz I-:. w A. A list of facilities shall be submitted for City approval prior to night -time construction. Facilities shall be safe, clean, and have general equivalence to a residence. K. Receipt of 10 or more complaints within a 48 hour period shall justify modifying or revoking the provisions of this variance. 2. Existing Site Development: SR -518 is currently a five lane freeway, with 8 -12 ft. wide shoulders on each side and a center median strip. It's surface is partially concrete and partially asphalt. It is the asphalt surfaces which are being overlaid. Asphalt overlay areas are shown in Attdcrit 3. Surrounding Land Use: The affected area is currently developed for single and multi- family residences as shown in czti. Dense stands of trees are shown in some areas. However, these are largely deciduous and have limited impacts on noise reduction. DECISION CRITERIA A "technical noise variance" may be issued by the D.C.D. Director, acting as the "administrator," pursuant to TMC 8.22.180 ( "...at the reasonable discretion of the administrator. "I) The criteria to grant or deny a technical noise variance are shown in bold and italics and followed by staff discussion. The applicant's justification for a variance is presented in his application letter (AttcetA). CRITERIA 1: No variance shall be granted pursuant to this chapter until the administrator has considered the relative interests of the applicant, other owners or possessors or (sic) property likely to be affected by the noise, and the general public. (TMC 8.22.180(c)) Noise Standards Construction noise is exempt from regulation except between 10 p.m. and 7 a.m. During those times, the proposed freeway construction noise impacts on residential receiving districts is limited to 45 dB(A) per TMC 8.22.050(1). The comparison of estimated noise level with regulatory standards was based on an interpretation that SR -518 is a "residential" sound source district (as it is not in any land use district, but part of the prevailing, adjacent residential land use pattern) and recognizes that all receiving areas are residential. Such a situation allows a maximum 45 dB(A) noise level (TMC 8.22.050(1)). Alternatively, 47 dB(A) would be. allowed 1TMC 8.22.180(b) . 5 Noise Variance Staff Repor L96 -0080 Washington State Dept of Transportation from a "commercial" district and 50 dB(A) from an industrial district. "No sound source specifically exempted from a maximum permissible sound level by this chapter shall be a public nuisance noise or public disturbance noise..." (TMC 18.22.140). This applies to the proposed freeway construction during non - regulated hours. Noise Impacts: The noise levels in which human activities can reasonably occur have been estimated by the United States Environmental Protection Agency (EPA) and are shown in Attachment EPA thresholds of acceptable noise were recognized and incorporated into the "Tukwila Comprehensive Plan Environmental Impact Statement" (October, 1995:pg.47) as follows: 55 or less Levels are generally acceptable; no noise impact is generally associated with these levels. 55 -65 dB(A) Adverse noise impacts exist; this measurement represents the lowest level possible without adverse significant impact. 65 -70 dB(A) Significant noise impacts exist; allowable only in unusual cases where lower levels are not possible. over 70 dB(A) Levels of unacceptability for public health and welfare considerations. Occasional construction noise would reach 79 -86 dB(A) along the first line of residences along most of the occupied project length. These structures are largely 2 -3 story multi- family units and a few single family units, at the freeway's elevation. In general, residential buildings readily reduce outside noise by 20 dB(A), and 25 dB(A) with double pane windows. This would mean inside, occasional maximum noise levels as follows: Outside Construction Noise Level. 79 -86 dB(A) Inside noise level with single pane windows (20 dB(A) reduction). 59 -66 dB(A) Inside noise level with double pane windows (25 dB(A) reduction). 54 -61 dB(A) 6 z Z JU: OO co co al w =: J I; N LL, w }Or' J ¢: (O w. Z . F- 0 . Z - • o; w W' V ; cu z U N 0 z Noise Variance Staff Report - L96 -0080 Washington State Dept of Transportation The applicant's assertion that a 35 dB(A) noise reduction can be readily achieved with double pane windows does not seem to be supported in discussions with other noise experts. Attenuation above 25 dB(A) is possible, but a full 35 dB(A) reduction would generally require extensive, focussed effort. The overwhelming majority of area residences were built prior to 1984, before the requirement for double pane windows. They are unlikely to reduce noise significantly more than 25 dB(A). Maximum noise levels, if attained, would last for some fraction of an hour, 2 -3 times per night (see Project Description). The proposed construction noise is exempt during the day. These noise levels would impact receiving properties equally during the day, when residents are more likely to be outside. Residents would be either forced to seek relief indoors or endure full exposure outside. An alternative view is that residents would better tolerate high noise levels during daylight hours than at night, and may be away at work. This alternative view is supported by the night -time regulation of construction activities. WSDOT is now completing work on I -5, in this area. The night -time I -5 work had similar or greater noise impacts to the proposed action. A City of Tukwila technical noise variance was issued (L94- 0068). No noise complaints were received during the year of construction. Congestion Impacts: The overlay requires closing SR -518 to one lane in each direction and much slower vehicle speeds in each lane. This reduction in freeway capacity during the day would cause significant and dramatic traffic congestion. Late night closure would minimize congestion impacts. Day -time congested traffic movement would expose vehicle occupants to very high levels of noise from adjacent construction equipment, as they slowly traverse the construction zone see;ze t). CRITERIA 2: The noise occurring or proposed to occur does not endanger public health or safety; (TMC 8.22.180(c)(1)) It is explicitly recognized that higher noise levels are a health hazard and that some individuals are more sensitive to noise impacts than others. It may be appropriate for the applicant to mitigate noise impacts on sensitive individuals to a greater extent than is done for the general public, when the basic 45 dB(A) noise standard is exceeded, especially for noise sensitive individuals. 7 ". 1.112.. •.0 O: w = JF-. w O: u-a Ca • z . zI LLJ w; :O N, w w z U • Z Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation The applicant has asserted that: a. some complaints may occur, especially from noise sensitive individuals, b. all complaints will be resolved based on variance provisions, within 24 hours, c. resolution shall include, but not be limited to: site visits and monitoring, withdrawal of equipment not satisfying the identified maximum noise levels or characteristics (A. 1), and offering to move the resident to a City approved facility, and d. no wide - spread number of noise complaints are expected (e.g., 10 complaints in 48 hours). (Farrar concurs, 1/8/97) Other relevant findings are presented in Criteria 1. CRITERIA 3: There is not practical means known or available for the adequate prevention, abatement or control of the noise involved. (TMC 8.22.190(b) oCsNiE'A S In general, a change of 10 B(A is ne - • - d to notice a change in noise level. Only insignificant noise reduc ions • 2- 1 dB(A) are anticipated to be practically achieved (e.g., eliminating the vibration function from the pneumatic roller). This reduction would be at the cost of doubling the impact duration (see Project Description). The alternative of daytime construction (when the proposed freeway construction noise is exempt) would not reduce the noise levels experienced at receiving sites between 7 a.m. and 10 p.m., and cause an extreme level of traffic congestion. Several measures have been proposed to minimize night noise levels (see ), and the applicant agrees to abide by all City variance conditions. A summary, cumulative list of actions is presented in the Recommendation below. CONCLUSIONS General Conclusions: Noise impacts, especially as it reduces the area residents' ability to sleep, will commensurately reduce the level of area residents' health. The City of Tukwila has an overall, compelling responsibility for the health of its residents by, in part, ensuring them a reasonable opportunity to sleep at night. This commitment is reflected in Tukwila's adopting noise standards which clearly limit allowable night noise levels. Granting a noise variance to allow higher noise levels would carry a City responsibility to clearly demonstrate a regional need, no alternatives to the noise impact and impact minimizing actions. WSDOT's assurances that impacts, although notable, will be of short duration and largely 8 .z _1— U0: N I UW W =; J :CO u.. w 0: ta. z 1— 0 w~ D O U N( •0 .W H U W a ui z, I- ~+ z Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation tolerable, is supported by having received no noise complaints about its night -time I -5 work HOV work over the past year. CRITERIA 2: The noise occurring with the variance is not anticipated to significantly endanger public health and safety, given a comparison of EPA noise thresholds, the maximum anticipated indoor noise levels, WSDOT noise mitigating actions, the relatively short duration of maximum impact, and the lack of complaints during similar I -5 construction activities. Specific factors which were considered in this decision included: a. the applicant's description of noise generation (e.g., maximum 66 dB(A) interior levels of a short duration, 2 -3 times per night), b. proposed noise reducing and impact mitigating measures incorporated as construction practices, c. area -wide and case -by -case impact mitigating measures for noise sensitive individuals or situations, and d. agreement to suspend, modify or revoke the variance if a signficant number of complaints are received. 9 Noise Variance Staff Report' L96 -0080 Washington State Dept of Transportation CRITERIA 3: The proposed noise maximum, short-term noise level of 86 dB(A), would be 41 dB(A) above the 45 dB(A) which is allowed in the Tukwila Noise Ordinance. The above findings do not indicate an available, practical means to prevent, abate, or control the noise level below what is proposed. RECOMMENDATIONS The Planning Division recommends approval of the proposed technical noise variance as proposed. Staff would emphasize the need to rigorously enforce the proposed noise mitigating actions which are contained within the applicant's proposal. 1', • 10 ,ter k :;5y;.v,;,u- v71Washington State Department of Transportation Sid Morrison Secretary of Transportation Steve Lancaster City of Tukwila Director of Community Development 6300 Southcenter Blvd..Suite 100 Tukwila, WA 98188 Dear Mr. Lancaster: Northwest Region 15700 Dayton Avenue North PO Box 330310 Seattle, WA 98133 -9710 (206) 440-4000 November 20, 1996 x.76 -0 080 RECEIVED NOV 21 1996. COMMUNITY DEVELOPMENT Night Time Technical Noise Variance SR 518 Resurfacing SR 509 to I -5 Vic OL 2247 MP 0.00 to MP 3.51 The Washington State Department of Transportation (WSDOT) is currently planning to resurface SR 518 between milepost 0.00 and 3.51 through the City of Tukwila, the City of SeaTac, and the City of Burien. Per Vernon Umetsu's letter of November 8, 1996, and Joanne Welty's telephone conversation with Mr. Umetsu on November 12, 1996, the WSDOT is applying for a technical variance for the subject project. Mainline paving will occur as well as ramp paving. Four ramp closures will be requirecj, within the project limits. These four ramps are: Southbound SR 509 to SR 518 Northbound SR 509 to SR 518 Westbound SR 518 to SR 99 / 154th Eastbound SR 518 to Northbound I -5 The Des Moines Way on and off ramps will remain open during paving operations. The work in this project will also include replacement of loop detectors, removal and replacement of pavement, and signing and illumination improvements. For your convenience, we have attached a project vicinity map, detour routes, and plan sheets showing the work locations. SR 518 is a high volume highway and traffic restrictions will be necessary. Work will occur in narrow areas within and adjacent to the travel lanes, presenting a danger to the public and project workers. Lane restrictions are needed for the movement of equipment and materials and to allow enough room for equipment and workers to perform the work. • Acre .. ,e ATTACHMENT A z a Z ne J U: o 0.. to 0: to J i.. . w 0: g 1. co = d' I— 11.1 _.. zi- -o: Z I—; ELI w;. It is therefore necessary to do some construction work at night. Per Mr. Umetsu's letter, there are four issues that he wanted us to cover. We begin with number 1, establishing unacceptable noise levels at the receiving site. The equipment we anticipate our contractors to use for this work includes, but is not limited to, various trucks (flat bed, dump, concrete and asphalt), 60 ton and 100 ton cranes, generators, air compressors, jackhammers, street sweepers, trackhoes, front -end loaders, forklift, paint striper, paint stripe eradicator, asphalt paver and roller. Equipment varies in decibel output depending on many factors. Based on previous observations, the maximum projected nighttime construction noise levels from the equipment are 94 dBA'at 50 feet while removing and replacing pavement, 90 dBA at 50 feet while installing the loop detectors, 88 dBA at 50 feet while placing cantilever and bridge sign structures, and 83 dBA at 50 feet while removing and resetting traffic barriers. Noise levels will fluctuate during construction, but the maximum levels projected will not change. Noise levels diminish with distance. A 6 dBA noise level drop off will occur with the doubling of distance from a noise source. For example, a noise level of 70 dBA measured at 50 feet would be 64 dBA at 100 feet, 58 dBA at 200 feet, and 52 dBA at 400 feet. Sound also decreases if an object interferes with the receivers line of sight to the noise source. This attenuation depends on the relative elevations of the source and the receiver and the height and location of the intervening object. Analysis and projected worst case nighttime construction noise levels for residential neighborhoods adjacent to the project corridor (beginning at SR 99 and proceeding east) are as follows: The Riverton Heights area is adjacent to and north of the SR 518 corridor. Apartments and condominiums are found between 38th Lane South and 42nd Avenue South. Included are the Southwicke, West Colonial Village, and the Cottage Woods apartments /condominiums. Most of these complexes' units are shielded from SR 518 exposure by the front line buildings (receivers) of their respective managements. Second and third row buildings will achieve, at a minimum, 10 - 15 dBA of attenuation when compared to front line receivers. The front line buildings are located 125 to 200 feet from SR 518. Occasional peak noise levels, generated from nighttime construction activities, are expected to be 82 to 86 dBA for front line receivers. A single family residence is located on the northwest quadrant of the SR 518/42nd Avenue South undercrossing. The Cottage Woods Apartments are located on the north east quadrant of this undercrossing. Occasional peak nighttime construction noise levels of 78 to 79 dBA are projected or these two locations. On the south side of SR 518 in this locale are the Laurel Estates, Grand Terrace, Chalet South, and Lewis and Clark condominiums and apartments all of which are located between 38th Place South and 42nd Avenue South. Front line receivers of these apartment /condominium complexes are located approximately 175 to 200 feet from SR 518. Occasional nighttime construction generated noise levels of 83 to 84 dBA are expected for front line receivers. Three single family residences on the southwest quadrant and one residence on the southeast quadrant of the 42nd Avenue South and SR 518 overcrossing are below (SR 518) grade and are expected to experience occasional peak noise levels of 72 - 73 dBA. Proceeding again to the north side of the corridor and moving east towards SR 5 is the Park Place Apartment Homes complex. Located approximately between 42nd Avenue South and 51st Avenue South these apartments are at grade with SR 518 and approximately 150 to 250 feet from SR 518. Occasional peak nighttime construction generated noise levels of 80 - 84 dBA are expected to occur to front line receivers. To the south side of this corridor section is a single family residential neighborhood located between 42nd Avenue South and 47th Avenue South. Front line residences are 400 to 600 feet from the SR 518 corridor and many are protected by line of sight interruption to the project corridor as well as thick vegetation. Occasional . nighttime construction generated peak noise levels of 57 - 66 dBA are expected for front line receivers. Ramp resurfacing at the east end of the project corridor will take place in the area of the neighborhood between Klickitat Drive South and Crystal Springs Park. There is line of sight interruption between this neighborhood and the ramp resurfacing activities Occasional peak noise levels from nighttime construction activities, located 400 to 800 feet from this neighborhood, are expected to be 55 to 60 dBA to front line receivers. It should be noted that construction generate noise levels will actually be well below projected peak levels a majority of the time. Projected noise levels are for exterior sites (yards) of the respective receivers. These noise levels are anticipated to be of short duration. The projected noise energy levels are for receivers closest to the construction activity. As mentioned, receivers further from the activity will receive substantially lower noise levels. Issue number two is initial monitoring for unacceptable noise levels. The WSDOT will periodically monitor night noise levels, and will provide the City of Tukwila with periodic reports of the noise monitoring resluts. Reports will be in writing and will include noise levels, location, time and the primary construction activity at the time. Sound level measurements will be consistant with WAC Chapter 173 -60. All individual construction equipment will be measured to determine compliance with the attached equipment noise level listings. It is anticipated that there will be several of these individual checks made during the life of the variance, since there will be several months elapsed time between work operations, and it is possible that unchecked equipment could be brought to the site. An integral part of the monitoring program is Contractor interface. Some mitigative techniques may prove to be more effective than others. Likewise, it may be learned early that certain equipment cannot be used. The Contractor will need ready access to WSDOT findings, and WSDOT intends to cooperate with both the Contractor and the City in sharing the information as quickly as possible. Issue number three is an advertised, 24 hour complaint hot line. WSDOT will provide and monitor a 24 hour complaint hot line. The hot line telephone number will be prominently displayed by WSDOT on construction signs and will be distributed to area residents. Issue number four is a 24 hour complaint resolution procedure and possible corrective actions. The Construction Project Engineer (PE) will be alerted of all complaints. The PE will evaluate the complaint and the monitoring measurements and take appropriate action based on the above criteria. This action will include such things as further mitigation activities, removal of equipment from the job, or a work stoppage to develop an acceptable procedure. To ensure the reasonable safety and convenience of the public, we ask for technical noise variance from the requirements of Tukwila Municipal Code Chapter 8.22.180(b). The project is scheduled to be advertised in January of 1997. The project is expected to start in March of 1997 and continue into Fall of 1997. A total of 142 nights requiring variances will be needed to complete the work within the City of Tukwila as detailed below: • Approximately 96 nights in increments of 14 consecutive nights or less, separated by at least 7 nights of no activity for barrier and median work from stations 3 +800 to 5 +600. • Approximately 30 nights for mainline paving (eastbound stations 3 +800 to 4 +700) and for paving the 51st Avenue South ramp and I -5 ramps. • Approximately 16 nights for cleanup and miscellaneous activities. Due to scheduling, some of the above construction activities may occur simultaneously, lessening the actual number of nights requiring variances. As mitigation measures, the state will require the use of ambient sensitive backup alarms and the use of double mufflers on all equipment used at the site other than haul trucks and light duty vehicles. Rubber bed liners will be required for haul trucks between the hours of 10:00 PM to 7:00 AM Monday through Friday and 10:00 PM to 9:00 AM on' Saturday and Sunday. Lighting for the work will be directed, as possible, so as to be the least intrusive to nearby residents. Measured in decibels, noise represents a composite of the intensity, duration, and character of sound from all sources. The unit of measure for the decibel scale is the A- weighted decibel (dBA). Regulatory agencies use this scale as a means for gauging and evaluating noise impacts. scale accounts for the human perception of a doubling of loudness as an increase of 10 dBTA. For example, a sound measuring 70 dBA is double the loudness of something at the 60 dBA level. In addition, it should be noted that sound levels from multiple sources do not combine additively. Two sound sources each measuring 50 dBA combine to produce a level of 53 dBA. Doubling the amount of traffic on a street increases sound levels by approximately 3 dBA; representing an increase in loudness by 20 percent, not a doubling of the sound. Sound levels decrease with the distance from a sound source or where impediments to sound exist, i.e., buildings or walls. Typically, every doubling of the distance from a point source, such as engine, decreases the sound level by about 6 dBA. In an effort to associate the numerical factors used to measure noise with real -life sound sources, the table below presents typical indoor and outdoor sound level measurements for a variety of uses. The U.S. Environmental Protection Agency (EPA) has conducted studies to identify sound levels "requisite to protect the public health and welfare with an adequate margin of safety," specifying a day /night average sound level of 55 dBA for outdoor areas where quiet is a basis for use. The U.S. Department of Housing and Urban Development Recommends a maximum outdoor day /night average of 65 dBA in residential areas. In 1975, the EPA established the following 24 -hour average sound guidelines to assess the potential impacts which could be expected with increases in noise levels: TABLE 4 Illustrative Sound Levels for Outdoor and Indoor Uses Outdoor dBA Indoor B -747 Takeoff at 2 miles 110 Rock Band Diesel Truck at 50 feet 90 Food Blender Pneumatic Drill 80. Allowable maximum sound levels depend on the land use of the source of the noise and the land use of the receiving property. Generally, the lowest sound levels are required in residential areas, and the highest sound levels are allowed in industrial areas. Because of Tukwila's diverse mix of land uses, these maximum permissible daytime sound levels help define the acceptable conditions for environmental health. Table 5 below depicts the City's noise regulations. In Tukwila, the maximum permissible sound level is lower at night in residential areas. The levels listed in Table 5 are reduced by 10 dBA for receiving residential and rural properties between 10:00 pm and 7:00 am on weekdays and between 10:00 pm and 9:00 am on weekends. For any sources of sound of a short duration, the levels established by the code are increased over any one -hour period:: (a) 5 dBA for a total of 15 minutes; or (b) 10 dBA for a total of five minutes; or (C) 15 dBA for a total of 1.5 minutes. Higher noise levels are allowed for motor vehicles operating on public roads. Warning sirens /alarms and temporary daytime construction activity are typically exempt from these City environmental noise regulations. Receptor Land Use Residential Commercial Industrial Residential 55 57 60 Commercial 57 60 65 Industrial 60 65 70 SOURCE: Tukwila Municipal Code (Section 8.22.040) With respect to the City of Tukwila planning area, the primary sources of noise are derived from the presence of active multimodal transportation sources such as passenger and commercial aircraft from Sea -Tac International Airport and King County International Airport/Boeing Field, passenger and freight trains of railroad rights -of -way, and vehicles on regional freeways and local major arterials. In addition to these sources, typical urban and suburban noises come from construction activities, lawn mowers, weed cutters, and leaf blowers. Given the City's close proximity to Sea -Tac and King County Airports, aircraft noise represents a potential major consideration. In 1994, Sea -Tac International Airport accommodated more than 16 million passengers and 350,000 aircraft operations (takeoffs and landings). A six- to eight -year forecast indicates that these numbers will increase to 25 million passengers and 410,000 aircraft NOISE 9 }{ 47 m.,-,... While most of the City experiences some noise from this facility, residential neighborhoods west of Pacific Highway partially fall within the airport's 65 dBA noise contour for operations. In addition to Sea -Tac International, activities at King County Airport and Boeing Field affect sensitive land uses in the northern part of Tukwila. Sensitive rural/suburban - neighborhoods and multi- family areas are also affected by the noise emanating from the major highway corridors traversing Tukwila. With possible construction activities and increased capacity of the freeways with HOV lanes, increases in 24 -hour noise levels may occur. Environmental Health: Noise Impacts Aircraft- Related Noise With proposed expansion at both Sea -Tac International Airport and King County International Airport/Boeing Field, noise - related impacts may occur to sensitive Tukwila land uses. It should be noted that the Noise Advisory Board, for the proposed third Sea -Tac runway, has determined that airplane noise reductions, while measurable, are not readily perceivable by those directly affected. In order for the reductions to be meaningful, they must be both measurable and perceivable by those affected. In general terms, the Sea -Tac Airport Master Plan Update Draft EIS suggests that development of a new parallel runway would result in as much as a 6.1 percent increase in dwelling unit impacts over the No -Build alternative. However, as depicted in Table 6 and Figures 3 and 4, it also states that the future impacts would still be less than the current noise exposure.based on the configuration of the proposed runways. This and other information contained in the Airport Master Plan Draft EIS is currently undergoing public and agency review, and is therefore subject to revision. With respect to potential impacts to Tukwila sensitive areas, the parts of the City that would be most affected centers on sensitive land uses along the City's west hill plateau. With proposed development of a higher density, mixed -use environment along the Highway 99 corridor, possible conflicts may arise between airport flight paths and the desired built environment along Pacific Highway and its surrounding areas. Construction would occur between July 1, 1999 and October 15, 1999. Two previous "technical noise variances" to allow similar extensive road construction at night in this immediate area were previously granted in 1994 and 1997. Noise levels at receiving properties were higher than estimated in this variance application and were allowed to occur for over four months. No noise complaints were received. Construction noise is exempt from regulation between 7:30 A.M. and 10 P.M.' but otherwise regulated by TMC 8.22. The proposed construction noise would occur during regulated hours and exceed the allowed noise level of 50 dB(A) by 2 to 15 dB(A) at exterior areas.2. Construction could only occur during regulated hours with a noise variance from the Director of the Department of Community Development'. The requested "temporary variance" is a ministerial decision not requiring a public hearing'. VICINITY /SITE INFORMATION 1. Project Description: The applicant's request for a technical variance is shown in attachments A, B and C. WSDOT proposes to repave, reconstruct and add various safety improvements to three access ramps at the I -5 /SR -518 freeway interchange. Ramp work will be almost all confined by steep earth banks or concrete walls, as the ramps pass under various freeway sections. Construction would require a weekend closure of the B -line ramp and nightly closures of the B and G line ramps between July 1, 1999 and October 15, 1999. Work at the B -line and G -line ramps are expected to generate worst case noise levels of 90 dBA @ 50 feet (Attachment B). This construction noise would encroach into the night period when such noise is subject to maximum sound levels of 50 dBA (op. cite.). Maximum sound levels at residential receiving properties are estimated at 52 -60 dBA for 'TMC 8.22.160(4). 2Assumes that SR -518 is an "industrial" area and recognizes all receiving areas as residential. Such a situation allows a maximum 50 dB(A) noise level (TMC 8.22.040 and 050(1)). 3TMC 8.22.190(A) and 8.22.020(1). 4TMC 18.22.180. \ \TUK2 \SYS\ HOME \VERNON \99 \WSDTVAR \WS DTVAR. EPA thresholds of acceptable noise were recognized and incorporated into the "Tukwila Comprehensive Plan Environmental Impact Statement" (October, 1995:pg.47) as follows: 55 or less Levels are generally acceptable; no noise impact is generally associated with these levels. 5This assumes that the freeway is an "industrial" "District of Sound Source." A commercial district is limited to 47 dB(A) while a residential source is limited to 45 dB(A) (TMC 8.22.150(1)). No other adjustments per 8.22.150(2) or (3) seem to be appropriate. \ \TUK2\SYS\ HOME \VERNON \99 \WSDTVAR \WSDTVAR. DOC • ,*.s .ra.5■1- ;AP. In general, residential buildings with single pane glass windows readily reduce outside noise by 20 dB(A). Residences with double pane glass can reduce noise levels by 25 dBA. This would mean occasional maximum noise levels as follows: On -site Receiving Area Crystal Springs Neighborhood Macadam Road Neighborhood Outside Noise Level. 52 -60 dB(A) 55 -65 dBA Inside noise level with single pane windows (20 (1B(A) reduction). 32-40 dB(A) 35 -45 dBA Inside noise level with double pane windows (25 dB(A) reduction). 27 -35 dB(A) 30 -40 dBA c. The overwhelming majority of area residences were built prior to 1984, before the requirement for double pane windows. d. Maximum noise levels, if attained, would last for some fraction of an hour, 2 -3 times per night, based on similar road construction practices. e. The proposed construction noise is exempt during the day. These noise levels would impact receiving properties equally during the day, when residents are more likely to be outside f. The City of Tukwila has granted two technical noise variances issued (L94 -0068 and L96- 0080). Estimated noise levels at residential receiving sites were much higher than projected here. No noise complaints were received. Congestion Impacts g. The construction would require significant lane closures resulting in significant and dramatic traffic congestion. Late night closure would minimize congestion impacts. h. Day -time congested traffic movement would expose vehicle occupants to very high levels of noise from adjacent construction equipment, as they slowly traverse the construction zone. \ \TU K2 \SYS\ HOME \VE RN O N \99 \WS DTVAR \WS DTVAR. The noise occurring or proposed to occur does not endanger public health or safety; (TMC 8.22.180(C)(1)) The anticipated maximum noise levels are below the EPA guidelines for avoiding significant human health impacts, as shown in a comparison of Finding 1 c and ld. 3. The "...activity, use, process or equipment...in accordance with rules and regulations, the does not annoy a substantial number or the people.and does not endanger public health or safety." (TMC 8.22.18.22.180(C)(2) and 190(B)) a. It is explicitly recognized that higher noise levels are a health hazard and that some individuals are more sensitive to noise impacts than others. It may be appropriate fdr the applicant to mitigate noise impacts on sensitive individuals to a greater extent than is done for the general public, when the basic 50 dB(A) noise standard is exceeded. . b. In general, a change of 10 dB(A) reflects a doubling of the perceived sound level. c. The alternative of daytime construction (when the proposed freeway construction noise is exempt) would shift the noise levels from the night to the day, when occupants at receiving sites are more likely to be outside and be more likely to perceive significant impacts. The impacts of extreme traffic congestion may also spill over to residential and commercial areas. d. Staff conditions to monitor and implement mitigation programs as needed have been reviewed with the applicant. They have been accepted and incorporated into the construction documents. CONCLUSIONS A. The balance between the relative interests of the applicant, other property owners and the general public seem to be served by granting the variance given the following: a. maximum noise levels will be significantly reduced indoors to an acceptable EPA noise level and be of a short duration and b. not granting the variance would still subject the receiving properties to the same level of noise impact between 7 a.m. and 10 p.m., result in an extreme level of congestion between those hours, and the applicant has committed to a system of 24 hour complaint resolution. Preconstruction meeting discussion is summarized below: Utilities, Railroads, and Other Third Parties: No representatives were present from: - King County Water District #125 - WSDOT Signal Maintenance Mr.. Baker said he had been contacted by Mr. Russ Austin of Water District #125 (242-9547). Mr..Austin said their only facilities are in the vicinity of SR 518/1st Ave. S. and SR 518 /SR 99; he anticipates no conflict with our project. Mr. Baker asked if Maintenance had any specific concerns. Both .Mr. Komac and Mr. Dinges said they didn'.t have any. Both Mr. Adkinson (WSP) and Mr. Siesling (METRO) asked exactly what this project entailed; Mr. Jenks went on to describe . the project in more detail: Paving SR 518 from 1st Avenue South in Burien to approximately 51st Avenue South, including several on and off ramps - Removing guardrail and replacing with cast -in -place concrete barrier through certain areas of the project - Upgrading drainage through the area with new cast -in- place barrier - Illumination improvements s• . Mr. Jenks said there is another state project that is resurfacing SR 509 in the vicinity of 1st Avenue South. Mr. Siesling requested that METRO be given notice of ramp closures. Mr. Jenks explained that the contract requires the contractor to give five working days notice to WSP, METRO, etc. Mr. Komac said that Maintenance has an agreement with Ackerly Communications to keep the areas in front of the billboards free of overgrown vegetation. He also said they had referenced these areas, and didn't want to lose their reference points. Mr. Baker directed Mr. Carlson and Mr. DuBois to work with Mr. Komac to ensure that the reference points weren't lost. General Construction Discussion: Mr. Sturgis gave a brief description of their "plan of attack" for this project: - Prep work - Temporary lighting - Crack seal entire project - Prelevel entire project 2 - Temporary striping (all paint) - Pave majority of project - Median work, including drainage - Complete paving Adkinson asked what would happen after the guardrail was removed. Mr. Sturgis replied that temporary barrier will be placed in this location while construction continues on the cast in place barrier. All work will be done behind the temporary barrier, other than pouring concrete for the cast in place barrier, which will necessitate a lane closure. Mr. Sturgis said this project will have both daytime and nighttime work; daytime will be work that can be done behind barrier, etc., and nighttime work will 'involve lane closures (i.e., crack sealing, paving, etc.). Mr. Adkinson asked if there would be a speed reduction; Mr. Baker said there would not. Mr. Adkinson had concerns regarding how this SR 518 project might affect the already poor ramp merge at SR 518 to SB I -5. Mr. Sturgis said he didn't anticipate ramp work.at I -5 until fall, other than prep work. He also didn't think there would be any conflict with the I -5 project. Mr. Riley expressed concern regarding safety at the SR 99 to eastbound SR 518 collector /distributor during paving of the mainline; he said closing the ramp might be the best thing to do while this paving is going'on. Mr. Baker said this would be a possibility. Mr. Sturgis said they plan on using a grinder for asphalt.removal work. Mr. Sturgis said he wasn't sure what area they would use for staging. Mr. Carlson suggested the Des Moines Memorial Drive ramp area. Mr. Baker recommended that Mr. Sturgis get together with Mr. Carlson and review the project area in an attempt to determine what area might be usable. Mr. Sturgis also said they will need a waste stockpile area. Mr. Riley said this route is our "gateway" since it leads to the airport, and requested that the contractor keep it as clean as possible. Mr. Komac said the area should be left in "better than new" condition. Mr. Siesling asked if the contractor would be working seven days a week; Mr. Sturgis said no. Mr. Sturgis said they would be adopting the traffic control plans shown in the contract, but said they had some questions. He said these questions were being submitted today by letter. Mr. Baker asked if any subcontractors were at the meeting and, if they were, if they had any comments regarding the project. Mr. Wonner, from Totem Electric, just requested a copy of the schedule. Mr. Gonzales, from Northwest Boring, said he thought his work would take approximately three days. Mr. Sturgis said the following companies would also be subs on this project: 3 Z _ 1- H w CZ 2 6 D -J UO CO CI: w =; J w O`. g -J LL = =a - w Z 1- a Z H, III co .0 :C1 He MO. ill Zi U =' O H` Z - John Wayne Construction (Condition of Award)- barrier work - Apply A Line- striping - Petersen Brothers (Condition of Award)- guardrail - Chandler Construction -crack sealing - Rainier Steel -tie iron - Marshbank Construction - drainage IMr. Siesling requested that a copy of the contractor's schedule be sent to Mary Malcolm at METRO (Editor's note: copy of schedule sent to METRO 6/2/97). Mr. Gulley then covered the information shown on the attached EEO and Training Information /Questionnaire. Mr. Sturgis said that the training plan for this project has already been submitted to Mr. Baker's office. Mr. Gulley asked Mr. Sturgis who would be the person to contact for on -site interviews; Mr. Sturgis replied that it would be Hugo Elmendorf. Mr. Gulley asked if there would be any sharing of resources with the condition of award subs (John Wayne and Petersen Brothers); Mr. Sturgis said there would not. Mr. Jenkins and Mr. Baptiste explained the services are provided to the contractor through WSDOT /OJT Support Services; they also gave brochures to Mr. Sturgis for his use. Mr. Baker asked Mr. Sturgis if they would be proposing any CRIPS; Mr. Sturgis said there were none that he knew of. Mr. Sturgis said he did believe that the plan quantity of asphalt was high. ce • Mr. Jenks said that the grinding at the SR 509 ramps will be eliminated; paper joints will be used instead, since the ramps are being paved on another project. Ms. Alseth gave copies of the noise variances from the cities of Burien, SeaTac, and Tukwila to Mr. Sturgis. Mr. Farrar noted that the ending date shown on the Tukwila variance (5/31/97) was incorrect, and he handed out new copies with the correct date (5/31/98) shown. Mr. Estep had the following questions: - Will city streets be used for hauling? - Will there be any lane closures of city streets? Mr. Sturgis said that all hauling would be done on'freeways. Mr. Jenks said there were detour routes through each of the cities. Mr. Williams said detour permits had been obtained from all of the affected cities. Mr. Estep then requested copies of the detour routes and traffic control plans (Editor's note: copy of the plans given to Mr. Estep immediately following the meeting). A noise abatement class was presented by Mr. Farrar. He first routed a sign up sheet for anyone who would be out on the project site, and said a copy of this list must be sent to the City. Mr. Baker directed Ms. Alseth to send this list on. Mr. Farrar then 4 gave the contractor copies of the noise variances, and again mentioned the date change for the City of Tukwila. Mr. Farrar presented a brief history of noise variances, and reminded the audience that variances can be rescinded. He said the contractor must give notice before any nighttime work may begin, and they must also give notice to residents within 400 feet of the noise activity. He suggested that the contractor use leaflets left at homes and apartments to accomplish this. Mr. Farrar then distributed a handout, and discussed the following information it included: - Night work GSP - Typical noise levels of equipment - Noise propagation - Sound shields - dBA noise scale - Noise reduction over distance - List of noise reduction methods - Example of a handout to citizens on the need.for a project and .the noise it creates • - Copy of WAC - Literature on quieting construction equipment Mr. Farrar said the City of Tukwila requires submittal of equipment noise level measurements. These will be done by the WSDOT inspector when the equipment first arrives on the project; the reports will then be submitted to Mr. Vern Umetsu of .the City each month. The City also requires WSDOT to submit a report of construction activities. Ms. Berge asked if WSDOT could submit a copy of the contractor's two week schedule. Mr. Farrar said this would. be OK. After Mr. Farrar's presentation, Mr. Grading told Mr. Sturgis that the Materials section would need to be notified a minimum of 24 hours in advance of paving. He asked Mr. Sturgis if they would be coming out of their Kent plant; Mr. Sturgis said it would be Issaquah, and Kent would be the backup. Mr. Stephens asked if WSDOT was going to verify H1 heights. Mr. Baker said this was always a good idea, and directed Mr. Carlson to check the heights called out in the plans. Mr. Wonner was concerned that the poles might not be delivered in time (manufacture will take longer due to metric), and asked if there would be a shutdown if the poles don't come in time. Mr. Baker said it shouldn't be a problem if the temporary lighting is in place, but that the situation would have to be evaluated if it comes to that point. Mr. Sturgis asked if WSDOT is staking the locations of Class A signs. Mr. Walker will meet with the contractor on site to determine proper locations. Since there were no other comments, Mr. Baker adjourned the meeting at 11:00 a.m. 5 These minutes were prepared by Jody Alseth. 6 CONTRACTOR /WSDOT RELATIONSHIPS CONTRACT 5128 INFORMATION • SR 518, SR 509 TO 51ST AVE S The following is provided for the Contractor's information: There.will not be a formal partnering session for this project. City of Tukwila John W. Rants, Mayor Department of Community Development Steve Lancaster, Director NOTICE OF DECISION State of Washington Dept. of Transportation P.O. Project file No.: L96 -0080 (WSDOT Noise Variance for SR -518 Improvements). b. `Applicant: State of Washington Dept. of Transportation. c. Project Description: Technical noise variance to allow construction noise of up to 86 dB(A), at residential receiving properties for short durations, between 10 PM and 7:00 AM. The variance would be for the period beginning February 15, 1997 and ending on May 31, >< (8v d. Project location: Asphalt overlay and associated activities will occur along SR -518 east- bound lanes and on all access ramps between SR -99 and I -5, as shown in the staff report. e. No associated permits have been submitted concurrently with this noise variance application. f. Environmental threshold determination: This proposed action is SEPA exempt. h. There are no administrative appeals for this decision. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 431-3670 • Fax (206) 431-3665 L96 -0080: WSDOT Noise Variance for SR -518 Improvements Notice of Decision Page 2 FINDINGS A summary of relevant findings to this application is presented below and adopted. z 1— W` 1. A public hearing was held on the proposed variance on January 23, 1997 at 6 PM, at re w2. `Suite 100, 6300 Southcenter Blvd., Tukwila WA. 6 Di, U: 000 2. The notice of the public hearing was published in the Seattle Times newspaper on co w January 13, 1997, and mailed to property owners and residents within 500 feet of the ! SR -518 right of way line. An w w 0.. 3. An evaluation of the proposed variance was submitted by the Tukwila Planning Division g LL .ti . in a staff report dated January 21, 1997. . p. = 0; • 4. WSDOT representatives asserted the following at the public hearing: ~ _ z ;. 1-..0. A. the staff report accurately represented the proposed action, impacts, and proposed w ' F wa. mitigating measures and 2 D: D o B. discussions with other WSDOT construction engineers disclosed that no noise .131--; complaints were received during similar asphalt overlay activities on the west- . w bound lanes of SR -518 about 3 years ago. I-- LI 0, z; 5. . The lack of complaints during the overlay of west -bound SR -518 lanes and a lack of 0 N complaints during similar I -5 lane construction over the past 3 years, does support the 0 F WSDOT estimate of minimal significant impacts. . :z. L96 -0080: WSDOT Noise Variance for SR -518 Improvements Notice of Decision Page 3 d. not granting the variance would still subject the receiving properties to the same level of noise impact between •7 a.m. and 10 p.m., result in an extreme level of congestion between those hours, and free the applicant from any noise impact regulation /mitigation. CRITERIA 2: The noise occurring with the variance is not anticipated to significantly endanger public health and safety, given a comparison of EPA noise thresholds, the maximum anticipated indoor noise levels, WSDOT noise mitigating actions, the relatively short duration of maximum impact, and the lack of complaints during similar 1 -5 and SR -518 construction activities. Specific factors which were considered in this decision included: a. the applicant's description of noise generation (e.g., maximum 66 dB(A) interior levels of a short duration, 2 -3 times per night), b. proposed noise reducing and impact mitigating measures incorporated as construction practices, area -wide and case -by -case impact mitigating measures for noise sensitive individuals or situations, and • d. agreement to suspend, modify or revoke the variance if a significant number of complaints are received. CRITERIA 3: The proposed noise maximum, short -term noise level of 86 dB(A), would be 41 dB(A) above the 45 dB(A) which is allowed in the Tukwila Noise Ordinance. The above findings do not indicate an available, practical means to prevent, abate, or control the noise level below what is proposed. DECISION Based on the above conclusions and pursuant to TMC 8.22, the technical variance is APPROVED as proposed. Granting of this variance explicitly recognizes: 1. the rigorous enforcement of impact mitigating actions as summarized in the Planning Division staff report, 2. the applicant's responsibility that: "Any technical variance shall be subject to the holder's taking of any alternative measures that the administrator may prescribe." (TMC 8.22.190(1)). Alternative measures may be developed in the unusual situation when the specified mitigating measures are determined by the Administrator as inappropriate. Measures shall be guided by the Planning Division staff report findings and conclusions. Alternatives may include sound insulation of residences where relocation may be a hardship or significant inconvenience (e.g., a disabled person with special requirements or one with animals which cannot be relocated) and 3. the ability to modify or cancel the variance upon non - performance or widespread noise impacts as discussed in the Planning Division staff report. i L96 -0080: WSDOT Noise Variance for SR -518 Improvements Notice of Decision Page 4 This noise variance is herewith APPROVED, this 28th day of January, 1997. z. I- - 0 Z 0 — X Z NOISE ORDINANCE VARIANCE HEARING MINUTES JANUARY 23, 1997 z • W Steve Lancaster, Department of Community Development Director, called the hearing 6 = to order at 6:05 p.m. The variance request is by the Washington State Department of o Transportation to exceed the noise standards for night time activities for a construction w O'. project on SR -518. He added that he would take the testimony, together with the staff w i s report and other information provided and make a decision within the next five u: working days. Mr. Lancaster asked everyone planning to testify, to swear or affirm that w o any testimony they may give in this proceeding will be truthful. Everyone in ga Q; attendance indicated they would. d Vernon Umetsu, DCD staff; said that WSDOT proposes a noise variance to allow an z ` asphalt overlay along SR -518, as shown in the air photo. The work proposed is z shoulder work and mainline work to 1200 feet east of the 42nd Ave. bridge overpass. w w Beyond that it will all be shoulder work, except for the ramp work. D o- oI-- w w. U Mr. Umetsu indicated it was Attachment B. He continued by saying the request is to p: allow a noise variance between 10:00 p.m. to 7:00 a.m., construction noise is otherwise w z' U N: exempt from the Noise Ordinance. The equipment will generate sound levels of up to 86 dB(A), for short periods of time in residential receiving zones, which are located on z ~ either side of SR -518. The staff determines that the freeway is a residential district, pursuant to 8.22.050(1). That means that the allowable sound levels that can be generated from the freeway as measured at the residential zone is 45 dB(A). Eighty -six dB(A) would exceed the allowable noise levels by 41 dB(A), and that is the amount of noise variance that is being requested. Mr. Lancaster asked Mr. Umetsu to identify the attachment he was referring to. The location of highest sound levels are shown in Attachment C, which is an air photo showing these areas, apartments, and residences. Most of these residences were built prior to 1984, and are unlikely to have the double -paned windows that were required at the beginning of 1984. He said they could assume that interior noise levels would be lowered by 20 dB(A), possibly 25 dB(A) if they had double -pane windows. It is possible that noise could be reduced by up to 35 dB(A), as indicated by the applicant, however that would required extremely high levels of focused effort, and was unlikely in these developments. All of the apartments to the west side of the project are at grade. The wooded areas are almost all deciduous trees that would not significantly attenuate sound. That is reflected in the high sound levels at the receiving point, compared with the sound being generated. WSDOT Noise Variance Hearing Minutes - 1/23/97 The staff report says that the most significant , longer -term equipment noise is generated by a pneumatic roller. That should be changed to a steel drum roller that creates the highest long term noise levels. The change does not effect the estimated noise levels at the receiving point. There are three criteria for determining whether or not a noise variance should be allowed. Staff has gone through those criteria in its findings and conclusions. In general, staff finds under Criteria 1, that all interests would seem to be best served by granting the variance, given the amount of impact mitigation in general and specific, that WSDOT is proposing. The alternatives to granting the variance would be tremendous congestion and a similar level of sound over a longer period of time, just during different times of the day. Under Criteria 2, the noise occurring at interior levels is likely to be tolerable and not endanger public health and safety, given a comparison of interior noise levels with what the EPA has determined to be minimally acceptable noise thresholds, and the short term characteristics of those maximum noise levels. WSDOT has also provided for mitigation on a case -by -case basis, including offering to move the severely affected people to nice hotels. The applicant has agreed that wide - spread noise complaints, would be sufficient grounds for revoking or modifying the variance. Under Criteria 3, the maximum noise levels would be above the 45 dB(A) noise levels, but staff doesn't see any practical ways to abate this to any significant level. To notice significant decreases in noise levels, a reduction of 10 dB(A) would be needed. Staff doesn't see that being possible. Based upon the findings and conclusions in the staff report, the Planning Division recommends approval of the technical noise variance as proposed. Staff emphasizes the need to rigorously enforce the proposed noise mitigating actions which are contained in the applicant's proposals. Mr. Lancaster asked a representative of the applicant to make any presentation they want to make, preferably not duplicating the information in the staff report and what Mr. Umetsu has provided. Dave Scott, Design Team Leader for the Project: The project will re- surface the roadway and put safety improvements into the median by constructing a cast in place barrier down the center of the roadway from SR -99 to the exit to I -5 northbound. In talking with the construction office that did work in the past, they said they've already paved the westbound lanes (at night), and didn't have any complaints, two or three years ago. The apartments 1,000 feet east of SR -99, and just to the north, that area is all new pavement. Work won't be as close to them with this paving, as we were in 1994. 2 ...pwn. •11 70PmzfY'4AS 4 " 1 `AS'QF'YM'!a#twrt__ WSDOT Noise Variance Hearing Minutes - 1/23/97 Bruce Farrar, Acoustics and Air Quality, WSDOT: Mr. Farrar said Mr. Umetsu accurately described the projected noise climate due to the night time construction. He added that the nature of the project will be such that it will be a transient exposure to the noise. The operations will be constantly moving. There won't be an area that will experience night after night of the same activity. That will help make the noise more bearable to the residents nearby. The noise levels that are presented on the display are worse case scenarios and are peak levels. The majority of the time, the operations will generate less noise than what is on the display. Mr. Lancaster asked if there were any other questions. There were no other comments and Mr. Lancaster closed the hearing. He added that he would not be issuing a formal decision tonight. Based upon the testimony, the information in the staff report, the review of the noise standards and provisions of the code, and the fact that there were no objections to the proposal, he indicated he would probably approve the variance, and issue a decision on Friday. To be presented at hearing ; Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation FINDINGS BACKGROUND The Washington State Department of Transportation (hereafter referred to as WSDOT) proposes to resurface various asphalted portions of SR -518 between I -5 and SR -99. Resurfacing is largely proposed between 7 P.M. and 6 A.M. Construction noise is exempt from regulation between 7:30 A.M. and 10 P.M. (TMC 8.22.160(4)), but otherwise regulated by TMC 8.22. The proposed construction noise would occur during regulated hours and exceed the allowed noise level of 45 dB(A) by a maximum of 41 dB(A). Construction could only occur during regulated hours with a noise variance from the Director of the Department of Community Development (TMC 8.22.190 and 8.22.020(1)). The requested "technical variance" also requires a public hearing (TMC 18.22.180(c)). Pursuant to TMC 8.22.190, recipients of technical variances have certain responsibilities. This includes, but is not limited to: "Any technical variance shall be subject to the holder's taking of any alternative measures that the administrator may prescribe." (TMC 8.22.190(1)) VICINITY /SITE INFORMATION 1. Project Description: The applicant's request for a technical variance is shown in :a:011 • er • t> . WSDOT proposes to asphalt overlay various sections of SR -518 between SR -99 and I -5, and complete other associated activities. Overlaying would occur during regulated hours on: a. all access ramps, b east bound (southern) lanes and shoulders in the western half of the improvement area, and c. the east bound shoulder in the eastern half of the improvement area. These areas are graphically shown in specific equipment used for overlaying and their noise characteristics are shown in 1ttirlt. Maximum noise levels of 86 dB(A) may occasionally occur (e.g., noise :. .:..:........ :..:......:....::. from a concrete delivery truck). The most significant longer term noise generator would be the pneumatic roller, which uses weight and vibration to compact the asphalt. The roller would pass over each section of overlay two or three times each night, at an extremely slow rate. Any one 3 z mow; .J U U 0; cn w - w ='; (0w w 07. Asphalt overlay areas are shown in Attachment 1 3. Surrounding Land Use: The affected area is currently developed for single and multi - family residences as shown in A aehm nt< . "') The criteria to grant or deny a technical noise variance are shown in bold and italics and followed by staff discussion. The applicant's justification for a variance is presented in his application letter (Alta .... ) CRITERIA l: No variance shall be granted pursuant to this chapter until the administrator has considered the relative interests of the applicant, other owners or possessors or (sic) property likely to be affected by the noise, and the general public. Alternatively, 47 dB(A) would be allowed 1TMC 8.22.180 (b) . 5 Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation from a "commercial" district and 50 dB(A) from an industrial district. "No sound source specifically exempted from a maximum permissible sound level by this chapter shall be a public nuisance noise or public disturbance noise..." (TMC 18.22.140). This applies to the proposed freeway construction during non - regulated hours. Noise Impacts: The noise levels in which human activities can reasonably occur have been estimated by the United States Environmental Protection Agency (EPA) and are shown in ttir P. EPA thresholds of acceptable noise were recognized and incorporated into the "Tukwila Comprehensive Plan Environmental Impact Statement" (October, 1995:pg.47) as follows: 55 or less Levels are generally acceptable; no noise impact is generally associated with these levels. 54 -61 dB(A) Noise Variance Staff Report' L96 -0080 Washington State Dept of Transportation The applicant's assertion that a 35 dB(A) noise reduction can be readily achieved with double pane windows does not seem to be supported in discussions with other noise experts. WSDOT is now completing work on 1 -5, in this area. Day -time congested traffic movement would expose vehicle occupants to very high levels of noise from adjacent construction equipment, as they slowly traverse the construction zone ( t e1 m rtt = ). CRITERIA 2: The noise occurring or proposed to occur does not endanger public health or safety; (TMC 8.22.180(c) (1)) It is explicitly recognized that higher noise levels are a health hazard and that some individuals are more sensitive to noise impacts than others. It may be appropriate for the applicant to mitigate noise impacts on sensitive individuals to a greater extent than is done for the general public, when the basic 45 dB(A) noise standard is exceeded, especially for noise sensitive individuals. 7 moZ` 6 UO` w =' J w O. w =. cna w z.: • o z w w' 2 moo, O o F- LU w: • 0, O' U uj O z Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation The applicant has asserted that: a. some complaints may occur, especially from noise sensitive individuals, b. all complaints will be resolved based on variance provisions, within 24 hours, c. resolution shall include, but not be limited to: site visits and monitoring, withdrawal of equipment not satisfying the identified maximum noise levels or characteristics (AtacaiixeaA), and offering to move the resident to a City .. ....... :............ : : : :....... approved facility, and d. no wide - spread number of noise complaints are expected (e.g., 10 complaints in 48 hours). (Farrar concurs, 1/8/97) Other relevant findings are presented in Criteria 1. CRITERIA 3: There is not practical means known or available for the adequate prevention, abatement or control of the noise involved. (TMC 8.22.190(6) In general, a change of 10 dB(A) is needed to notice a change in noise level. Only insignificant noise reductions of 2 -3 dB(A) are anticipated to be practically achieved (e.g., eliminating the vibration function from the pneumatic roller). Several measures have been proposed to minimize night noise levels (see Attachment ), and the applicant agrees to abide by all City variance conditions. WSDOT's assurances that impacts, although notable, will be of short duration and largely 8 z Q • mow; 6 n • U Of Nc w =. . . u_. w 0,. g a. 9 Noise Variance Staff Report L96 -0080 Washington State Dept of Transportation CRITERIA 3: The proposed noise maximum, short -term noise level of 86 dB(A), would be 41 dB(A) above the 45 dB(A) which is allowed in the Tukwila Noise Ordinance. The above findings do not indicate an available, practical means to prevent, abate, or control the noise level below what is proposed. RECOMMENDATIONS The Planning Division recommends approval of the proposed technical noise variance as proposed. Staff would emphasize the need to rigorously enforce the proposed noise mitigating . actions which are contained within the applicant's proposal. 10 3 .11■ Wia Washington State Department of Transportation Sid Morrison Secretary of Transportation Steve Lancaster City of Tukwila Director of Community Development 6300 Southcenter Blvd..Suite 100 Tukwila, WA 98188 Dear Mr. Lancaster: Northwest Region 15700 Dayton Avenue North PO Box 330310 Seattle, WA 98133 -9710 (206) 440 -4000 November 20, 1996 e9(0-Diau) RECEIVED NOV 21 1996. ooMuNrnr DEVELOPMENT Night Time Technical Noise Variance SR 518 Resurfacing SR 509 to I -5 Vic OL 2247 MP 0.00 to MP 3.51 The Washington State Department of Transportation (WSDOT) is currently planning to resurface SR 518 between milepost 0.00 and 3.51 through the City of Tukwila, the City of SeaTac, and the City of Burien. Per Vernon Umetsu's letter of November 8, 1996, and Joanne Welty's telephone conversation with Mr. Umetsu on November 12, 1996, the WSDOT is applying for a technical variance for the subject project. Mainline paving will occur as well as ramp paving. Four ramp closures will be require& within the project limits. Qti ,.4 :.7 18 ATTACHMENT A For public safety, lane restrictions on SR 518 are only allowed between 10:00 PM to 5:00 AM and 7:00 PM to 6 :00 AM depending on location and day of the week. It is therefore necessary to do some construction work at night. . Occasional peak nighttime construction noise levels of 78 to 79 dBA are projected for these two locations. On the south side of SR 518 in this locale are the Laurel Estates, Grand Terrace, Chalet South, and Lewis and Clark condominiums and apartments all of which are located between 38th Place South and 42nd Avenue South. Front line receivers of these apartment /condominium complexes are located approximately 175 to 200 feet from SR z _. re LAI 6 O 0 • o: CO w w I. J . N u_ w 0 Q; -d w = ? Occasional nighttime construction generated peak noise levels of 57 - 66 dBA are expected for front line receivers. It is anticipated that there will be several of these individual checks made during the life of the variance, since there will be several months elapsed time between work operations, and it is possible that unchecked equipment could be brought to the site. t`t xr rr. : +rraXIWIt..' r Tiftt .+rwee.4.s+41".”...... Due to scheduling, some of the above construction activities may occur simultaneously, • lessening the actual number of nights requiring variances. As mitigation measures, the state will require the use of ambient sensitive backup alarms and the use of double mufflers on all equipment used at the site other than haul trucks and light duty vehicles. Rubber bed liners will be required for haul trucks between the hours of 10:00 PM to 7:00 AM Monday through Friday and 10 :00 PM to 9:00 AM on Saturday and Sunday. Lighting for the work will be directed, as possible, so as to be the least intrusive to nearby residents. z mow. Measured in decibels, noise represents a composite of the intensity, duration, and character of sound from all sources. The unit of measure for the decibel scale is the A- weighted decibel (dBA). Regulatory agencies use this scale as a means for gauging and evaluating noise impacts. This scale accounts for the human perception of a doubling of loudness as an increase of 10 dBA. ATTACHMENT D 46 NOISE TUKWILA COMrrtEHENSIVE PLAN DRAFT EIS • Levels are generally acceptable; no noise impact is generally associated with these levels 55 or less • Adverse noise impacts exist; this measurement represents the lowest noise level possible without adverse significant impact 55 to 65 • Significant noise impacts exist; allowable only in unusual cases where lower levels are not possible 65 to 70 • Levels of unacceptability for public health and welfare considerations over 70 The Tukwila Municipal Code (Section 8.22.040) also establishes limits on the level and duration of noise crossing property boundaries. TABLE 5 Maximum Permissible Daytime Sound Levels in Tukwila Sound Source Receptor Land Use Residential Commercial Industrial Residential 55 57 60 Commercial 57 60 65 Industrial 60 65 70 SOURCE: Tukwila Municipal Code (Section 8.22.040) With respect to the City of Tukwila planning area, the primary sources of noise are derived from the presence of active multimodal transportation sources such as passenger and commercial aircraft from Sea -Tac International Airport and King County International Airport/Boeing Field, passenger and freight trains of railroad rights -of -way, and vehicles on regional freeways and local major arterials. A six- to eight -year forecast indicates that these numbers will increase to 25 million passengers and 410,000 aircraft NOISE 47 z z mow. Sensitive rural/suburban neighborhoods and multi - family areas are also affected by the noise emanating from the major highway corridors traversing Tukwila. With possible construction activities and increased capacity of the freeways with HOV lanes, increases in 24 -hour noise levels may occur. Environmental Health: Noise Impacts Aircraft- Related Noise With proposed expansion at both Sea -Tac International Airport and King County International Airport/Boeing. Field, noise - related impacts may occur to sensitive Tukwila land uses. However, as depicted in Table 6 and Figures 3 and 4, it also states that the future impacts would still be less than the current noise exposure .based on the configuration of the proposed runways. Rants, Mayor Department of Community Development Steve Lancaster, Director PUBLIC NOTICE City of Tukwila Notice is hereby given that the City of Tukwila Noise Ordinance Administrator will hold a public hearing at 6:00 P.M., on January 23,1997; in the Dept. of Community Development Conference Room. No. 1, located at Suite 100, 6300 Southcenter Blvd. to discuss the following: PUBLIC HEARING CASE NUMBER: L96 -0080 APPLICANT: Washington State Department of Transportation REQUEST: Approve a technical noise variance per TMC 8.22, to allow night -time repaving and associated activities on SR -518, between February 15,1997 and October 15, 1997. Fourteen consecutive nights where activities may generate periods of 84 dB(A) may occur. Maximum sustained noise is primarily from a pneumatic (vibrating) roller. Any one residence may experience higher noise paving activities along its freeway frontage for about six nights over some period, with maximum noise levels for an hour during each of three passes with the roller. LOCATION: SR -518, between SR -99 and I -5 CITY PLANNER Vernon Umetsu (431 -3684) Persons wishing to comment on the above case may do so by written statement, or by appearing at the public hearing. Information on the above case may be obtained at the Tukwila Planning Division at 431 -3670. The City encourages you to notify your neighbors and other persons you believe would be affected by the above item. Published: Seattle Times January 13, 1997 Distribution: . WA 98133 -9710 lohn.W. Rants, Mayor Steve Lancaster, Director -Night Time Noise Variance for';SR -518 Resurfacing. Dear Ms. Welty: I have reviewed your letter of November 4, 1996, to Steve Lancaster. Based on your analysis, .I must conclude that a noise variance is ' required per TMC 18.22 (attached) . An 'initial review indicates that a temporary or technical noise . variance may be appropriate, after ;a public hearing. A technical noise. variance would require reviewing feasible available alternatives to percussive noise generators such as jack hammers e.g., water cutters) and noise' abatement measures. Upon receipt of the application, a public hearing will be scheduled before the Administrator. Mailing labels for property owners and residents within 500 feet of the work site will be 'required with your application. Please call me at 431 -3684, to discuss other issues might be resolved as part of your application. These issues include, but are not limited to: establishing unacceptable noise levels at the receiving..' site,.. r . initial monitoring for unacceptable noise levels, an advertised, 24 hr. complaint hot line and. a 24 hr. complaint resolution procedure and possible corrective actions. rely, ernon. Per Vernon Umetsu's letter of November 8, 1996, and Joanne Welty's telephone conversation with Mr. Umetsu on November 12, 1996, the WSDOT is applying for a technical variance for the subject project. Mainline paving will occur as well as ramp paving. Four ramp closures will be requiretj, within the project limits. Lane restrictions are needed for the movement of equipment and materials and to allow enough room for equipment and workers to perform the work. p s:",- t8 ..,..,.,.,,... : x:•rr:iv.-::I.;xa;.5a :.: a+. aur,+ F, witrn;.w&sssa•,:;r3:.>.:.... w.k ..,.... Front line receivers of these apartment/condominium complexes are located approximately 175 to 200 feet from SR .T, uxaaa&itiiSSfks uusa .aacr716JJasr . - t al ..4, ♦S1Y:f(JdY V.bn.1Win. Occasional, nighttime construction generated peak noise levels of 57 - 66 dBA are expected for front line receivers. It is anticipated that there will be several of these individual checks made during the life of the variance, since there will be several months elapsed time between work operations, and it is possible that unchecked equipment could be brought to the site. z a • F=-zi mow; QQom. Rubber bed liners will be required for haul trucks between the hours of 10:00 PM to 7:00 AM Monday through Friday and 10:00 PM to 9:00 AM on Saturday and Sunday. Lighting for the work will be directed, as possible, so as to be the least intrusive to nearby residents. Please invoice the variance application fee to: Washington State Department of Transportation Attn.: Audrey Schmidt, MS 138 15700 Dayton. Avenue North P. O.
