Mayor Rants explained that a motion was made at the April 21st Regular Meeting and postponed until tonight's Special Meeting to allow adequate time for Council to be provided additional information to assist in their decision of a funding source and the total dollars needed to award the base contract and alternates #1 & #3. The motion under consideration: MOVED BY HAGGERTON, SECONDED BY HERNANDEZ, TO AWARD THE CONTRACT FOR THE TUKWILA COMMUNITY CENTER PHASE II CONSTRUCTION PROJECT TO GOLF LANDSCAPING, INC., IN THE AMOUNT OF $389,331 WHICH INCLUDES THE BASE BID, ADDITIVE ALTERNATIVES #1 AND #3, AND 8.6% SALES TAX.* Alan Doerschel, Finance Director, clarified that there are $70,000 in unanticipated 1996 Real Estate Excise Tax revenues, plus an additional $103,000 in unanticipated 1997 revenues. The 1 §96 revenues are within the Estimated Beginning Fund Balance of the 301 Fund. Actual 1997 revenues so far this year are $146,000 with only $160,000 estimated in the 301.317.340 revenue budget for the full year. If the 1996 additional revenues of $70,000 are combined with the additional anticipated 1997 revenues, there may be as much as $173,000 to be utilized for TCC Phase II and/or other park and trail projects. *MOTION CARRIED (7 -0). mow; 00 u) f=1 ' u)uJ w= N LL: w o: co J �- is o. z D rtC) CO = w 10: w z' UN f= 17i 'Z te Special Meeting Minutes April 28, 1997 Page 2 Award contract for TCC Phase II construction Consideration of Comp Plan amendments NEW BUSINESS Authorization to apply for CDBG Flood Relief Funds Doerschel said it should be pointed out that since there's a shortfall of approximately $66,000 in the TCC Phase II account, the 301 Fund would be an appropriate place to utilize funding to make up the shortfall. He cautioned the Council, however, that out of the total $173,000, it may be necessary to offset other revenue shortfalls such as sales tax. MOVED BY HERNANDEZ, SECONDED BY EKBERG, TO MOVE $66,000 FROM THE 301 FUND TO THE PHASE II COMMUNITY CENTER ACCOUNT SO THAT ADDITIVE ALTERNATES NUMBER ONE (SHELTER) AND NUMBER THREE (TWO COURTS) CAN BE INCLUDED WITH THE AWARD OF THE BASE BID TO GOLF LANDSCAPING, INC. MOTION CARRIED (7 -0). DCD Director Steve Lancaster reiterated that the Council is charged with deciding if a proposed amendment is consistent with the current Comprehensive Plan policies, and whether it should be: 1) dropped from further consideration; 2) deferred for one or more years; or, 3) forwarded directly to the Planning Commission for further review. He said the Council is not limited to the three options. They can take action on one or more tonight. Others could be processed according to the Council's internal procedures. He said if any of the amendments are rejected by Council, they could come back before the Council upon reapplication. That reapplication could occur for consideration either at the end of this year, a year from now, or any subsequent year. It would be up to the applicant to decide whether to reapply or not. It was the consensus of the Council to reject numbers 1, 2, 3, 5 and 6 of the proposed Comprehensive Plan/Zoning Code amendments, and forward number 4 - -- "Allow Senior Citizen Housing 50 & 100 units per acre in various Comprehensive Plan designation" to the Community Affairs and Parks Committee for further consideration. Councilmember Mullet stated that this item had been discussed at the April 22nd Utilities Committee meeting and the Committee recommended a formal motion authorizing application for grant funding. None. Al Spencer, Internal Operations Manager, gave a brief summary of the operating instructions on the Council Chambers microphones. Steve Lancaster explained that the Council held a public meeting on April 7, ,W97 and heard presentations from both staff and applicants. Many community members commented on the proposals at that time. It is now within the Council's purview on how to proceed from this point regarding further input on the Comprehensive Plan /Zoning Code amendments. Councilmembers were in agreement that further public comments would be welcomed as long as the comments were kept to a minimum. Lancaster clarified that at this point in the process, the Council is charged with deciding if a proposed amendment is consistent with the current Comprehensive Plan policies, and whether it should be: 1) dropped from further consideration; 2) deferred for one or more years; or, 3) forwarded directly to the Planning Commission for further review. In response to a question posed by Councilmember Hernandez, Lancaster stated that the Council is not limited to the three options noted above. They can take action on one or more tonight. Others could be processed according to the Council's internal procedures, which would include referral to a subcommittee of the Council. U• Z co J- O z Committee of The Whole Meeting Minutes April 28, 1997 Page 2 Comp Plan Zoning amendments (Cont'd) Public comment Public comments Public comments Comprehensive Plan/Zoning Code amendment #1: Extend the current building height exception area to permit potential development of up to 10 stories at 15820 Pacific Highway South Michael Aippersbach, Post Office Box 95429, Seattle, Wa., 95429, commented on behalf of Sterling Realty Organization (SRO -Lewis & Clark). He said his client did not propose the building height exception area amendment without consideration of the impacts of neighboring properties. Unfortunately, their knowledge of the changes of the August 15, 1995 Draft Comprehensive Plan did not surface until just before they were informed of the approaching submittal deadline for proposed amendments to the adopted Plan. From that point they simply rushed to complete the submittal. He's requesting to have the setback distance issue for structures above three stories discussed with the Planning Commission. Placing the issue on the Planning Commission's agenda simply allows a reasonable time period for discussions between SRO, the neighbors and the Planning Commission before action is taken. Council President Haggerton announced that two additional letters have been received regarding the six proposed Comp Plan/Zoning Code amendments since the last Council meeting: one from Secure Capital and the other from Michael Aippersbach & Associates. Kathy Solter, Property Manager, Sunnydale Apartments, main objections to amendment #1 is the blockage of light to the apartments and condominiums.. She urged the Council to adhere to the staff recommendations and reject these proposals. Diane Rogel, 3810 South 158th Street (Laural Estates), said the proposals do not reflect the spirit of the neighborhood. Comprehensive Plan/Zoning Code amendment #2: Change LDR (Low Density Residential to MDR (Medium Density Residential) to construct a 32 -unit condominium project between Pacific Highway South and 40th Avenue South at 38th Avenue extended. Gary Greer, representing Secure Capital, Post Office Box 25127, Seattle, Wa., 98125, commented that he still believes that a residential townhouse condominium development is the best development solution for all involved. Greer submitted modifications to his application that address most of the concerns raised in the public meeting held on April 7th. Comprehensive Plan/Zoning Code amendment #5: Amend certain Transportation and Natural Environment policies per Puget Sound Regional Council recommendation. Comprehensive Plan /Zoning Code amendment #6: Clarify definition and siting process for Essential Public Facilities. It was the consensus of the Council to forward the proposed Comprehensive Plan /Zoning Code amendments to the Special Meeting following tonight's Committee of The Whole meeting. Disposition of old Council President Haggerton pointed out the numerous meetings /discussions, community center as chronicled in the agenda packet, that have been held regarding this issue. City Administrator McFarland explained that the stipulation in the 99 -year ground lease with the South Central School District was that when the property ceased to be part of public use, it would revert back to the District. Therefore, as long as the City intends to use it for public purposes, it will remain in our ownership for the duration of the 99 -year ground lease. A discussion ensued with most of the councilmembers favoring a complete demolition of the building while others suggested demolishing all except the enclosed area of the gymnasium. Some Councilmembers thought it might be feasible to open the four walls of the gym and use it as a covered shelter for recreational purposes. Council President Haggerton reminded the Council that this issue will also be on the agenda for discussion at the joint Council /School Board meeting scheduled for May 6th. After a lengthy discussion, it was the consensus of the Council to have staff provide them with rough parameters of costs associated with various options, including total demolishing verses saving the gym portion of the old community center. z • z re f, 6 oo: co 0 cnw J = w w O LL Q`. McFarland explained that the City has used the Board of Adjustment for many of Adjustment years to hear certain appeals on land use issues rather than a hearing examiner, which has been a more popular form of resolution of these disputes and differences. However, he stated that the Board is currently non - operational due to lack of a quorum. Only two members remain of the five positions that constitute the Board. Additionally, the depth of complexity and range of knowledge necessary to assess and rule on many of the above described actions, create significant challenges to the Board in their deliberations. The City's liability insurance carrier has strongly recommended the use of a professionally trained hearing examiner to decide these matters, rather than a volunteer citizen's board. REPORTS Mayor • l After a brief discussion, it was the consensus of the Council to forward the ordinance dissolving the Board of Adjustment and creating the Office of Hearing Examiner to the next Regular Meeting for further consideration. Council President Haggerton requested that should the Council pass the ordinance to dissolve the BOA, that a letter of appreciation be sent to the current and previously retired Board of Adjustment members (and/or the family of members, if it applies) expressing the City's gratitude for their many years of dedicated service. Mayor Rants reported that to date the City has handed out 857 dump passes and the final count isn't in yet. Pacific Energy Institute handled the recycling day at Foster for items such as refrigerators, tires and various other rubbish. He said a total of 95.94 tons of materials were collected on that one day for recycling. Rants updated the Council that the Regional Task Force has outlined its regional needs regarding the Green River basins. Some of the issues being discussed are flooding, levees maintenance, habitat restoration, and habitat acquisition. Council Councilmember Duffie reported that Tukwila Elementary School raised 500 fish in their fish hatchery this year. Duffie complimented the City's Police Department for responding so well in the case of a recent incident where an attempt was made to abduct a Tukwila Elementary School student. Councilmember Hernandez reported she attended the Foster Community Club meeting on Wednesday, April 23rd. Councilmember Linder reported she attended the Metropolitan King County Council Commerce Trade and Economic Development Committee meeting on Thursday, April 24, where the Boeing /King County Airport issues were discussed. Carter announced that the Showalter Culture Fair will be held Wednesday, April 23, 6:30 - 8:00 p.m.. Young Author's Day is Friday, April 25th at all three elementary schools - -a day -long celebration of writing and creativity. A SKCATBd meeting is scheduled for June 17, 9:00 - 11:00 a.m. at the WSDOT building in Kent. DISCUSSION The subject property is 4.6 acres of land located at Pacific Avenue South and 40th Avenue South at 38th Avenue South Extended. (Exhibit B -2) The applicant proposes to change the property's Comprehensive Plan designation from LDR (Low Density Residential) to MDR (Medium Density Residential) in order to construct a 32 -unit townhouse condominium complex with ten two -story triplexes and one two -story duplex. Most of the property poses signficant environmental constraints and is subject to the Sensitive Areas Overlay (TMC 18.25). Per the City of Tukwila's Sensitive Areas map, which shows approximate locations of geologic hazards, watercourses and wetlands, approximately two - thirds of the property is a Class 3 Landslide Hazard Area, as rated Tukwila's Geologic Hazards Evaluation Report (May, 1990). On Class 3 areas, landslide hazard and erosion potential is high due to slopes and impermeability of the underlying soil or bedrock. The City's Watercourse Rating Date Sheets (October, 1990) and the Water Resource Rating and Buffer Recommendations (May, 1990) indicate that there is at least one Type 2 watercourse in the southeast corner. A Type 2 watercourse requires a 35 foot -wide buffer. (See Exhibit B -2) The applicant has prepared a survey of the property which gives specific information about the site's topography, including that portion which lies in the Sensitive Areas Overlay. The survey shows two watercourses in the southeast corner. Much of the Sensitive Area Portions of the property has slopes of approximately 28 %. The southern portion near the watercourses has slopes of 66 %. (Exhibit B -3) The site poses significant environmental constraints to development given the extent of the Class 3 slope, with its high landslide and erosion potential, and its watercourse(s). The applicant proposes to construct 32 units of attached housing. Without considering the specific sensitive areas issues and Planned Residential Development factors, the current, underlying LDR zoning allows approximately 30 single - family, detached housing units to be built. If the area is designated MDR and, for whatever reason, the current applicant does not develop the site according to the proposed plan, any subsequent owner would be legally able to develop the property to the higher MDR density, concentrating the allowed development on the buildable area, resulting in much higher traffic and other impacts. Signficance/Consistency with the Comprehensive Plan The proposal the change the LDR Comprehensive Plan and Zoning designation to MDR may be inconsistent with Residential Policy /Single - Family Residential Development Policies which support single - family in -fill, and maintaining existing land use patterns. • Policy 7.6.4 states: "Support single - family residential in -fill housing that is in harmony with the existing neighborhood as a means of achieving adequate, affordable, and/or diverse housing." • Policy 7.5.1. states: "Utilize both City and non -City funding to directly promote revitalization of residential neighborhoods." The implementation strategies which follow include: 1) emphasis on existing land use patterns; and 2) development of new single family homes. Changing the Comprehensive Plan designation and Zoning Code designation from Low Density Residential to Medium Density Residential would more than double the potential density, proportionately increasing the traffic and drainage impacts on the neighboring single - family areas. These impacts will need to be quantified and mitigated. Due to the property's slopes and watercourses, any development would need to be concentrated on the buildable portion of the lot. The increased density allowed by MDR designation would be emphasized since development would need to be concentrated on the buildable portion of the lot, which is the area nearest to existing single family homes. While the actual density of development would be MDR level, it would appear to be more like HDR. Substantially the same number of units (i.e. 30) could be built via a single - family PRD with the existing LDR(Low Density Residential) designation. IMPACT(S) OR PROPOSES CHANGE ON COMPREHENSIVE PLAN POLICIES, ZONING REGULATIONS AND CITY'S FUNCTIONAL PLANS: Several housing goals and policies contained on pages 37-42 of the City Comprehensive Plan support this application. In fact, it is the applicant's position that there are no goals or policies in the Housing Element which, in any way, would preclude the applicant's proposal. Natural Environment policies contained under Goal 4.3 are applicable and support our petition. Particular attention is drawn to policies 4.3.2 and 4.3.3 which seek flexibility in development options in geologic hazard areas and the minimization of potential hazards through appropriate site design and access altematives. The attached site plan accomplishes these objectives. Multi - family residential policy 7.6.9 on page 82 of the plan is applicable and supports our proposal. The site plan provides neighborhood design integration with abutting single - family residential through density control, sensitive area protection, generous setbacks and landscape /building design consistent with site topography. RECEI"ED CITY OF TIJKWIIA J1 "'.1 PERMIT CENTER Under the Transportation Corridors Element, the most applicable strategy requirement is policy 8.2.13 which states as follows: 8.2.13 Maintain the predominately residential use and character between South 128th Street and South 137th Street (if extended), with appropriate zoning and a significant component of vegetated hillside; allow a limited amount of neighborhood oriented retail activity in residential projects that front on Highway 99. This policy specifically recognizes that "appropriate zoning" is flexible and needs to be determined on a case by case basis for this segment of Pacific Highway South. Our proposal seeks to maintain residential use and character in the form of a change from LDR to MDR in order to preserve a significant portion of the vegetated hillside and provide low density townhouse condominium housing benched into the existing slope. Outright permitted zoning density will be maintained. D. IMPACT(S) OF PROPOSED CHANGE ON CAPITAL IMPROVEMENTS PLAN: No change or impact to the City's Capital Improvement Plan is anticipated. All services to the site are currently available and would be extended via private utility extension agreements. E. DEFICIENCIES IN EXISTING PLAN /CODE RESOLVED BY THE PROPOSAL: The LDR provisions of the Zoning Code (Chapter 18.10) is deficient in not allowing attached residential development at the same allowable density without having to apply for a Comprehensive Plan /Zoning Code Amendment. The PRD provisions (Chapter 18.46) should be amended to allow attached residential (condominium) development in LDR zones pursuant to strict criteria. The PRD is an overlay zone which provides exceptions to many of the requirements contained in the underlying zone. The PRD should allow flexibility in housing style and choice as well. • F. COMPLIANCE OF THE PROPOSAL WITH GROWTH MANAGEMENT ACT:. The Growth Management Act seeks densification of development in urban areas in order to preserve rural areas and farmlands. The GMA provides municipalities a number of ways to accomplish this. In this case, the City's adopted GMA Comprehensive Plan is presumed valid under the Act and provides these opportunities as discussed above. G. OTHER ISSUES PRESENTED BY THE PROPOSED CHANGE: The property was the subject of a Conditional Use Permit application for an assisted living facility when the property was in unincorporated King County. We understand that application proposed approximately 80 units of elderly care. This application was apparently withdrawn for reasons unknown at this time. COMPREHENSIVE PLAN /ZONING CODE AMENDMENT CRITERIA A. COMPREHENSIVE PLAN AMENDMENT CRITERIA: 1. Proposal is to reclassify an approximately 4.5 acre parcel from LDR to MDR. This change in the Comprehensive Plan /Zoning would allow the development of a 32 unit planned multi - family complex consisting of 10 triplex buildings and 1 duplex structure. Parking for 75 cars would be provided. The proposal is a planned residential development of a moderately wooded and sloped property that also contains a number of large drainage courses. Development in the cluster manner proposed is a superior to the strict, unimaginative lot by lot development that is the only permissible type of development allowed in the LDR zones. 2. No significant impacts are anticipated. The property is vacant and available for development. The proposed low density townhouse condominium development is compatible with the surrounding neighborhood in terms of height, scale and character. Significant setbacks and landscape buffering can be provided from abutting uses. 3. Development in accordance with existing zoning /comprehensive plan makes little, if any, accommodations for cluster development in an LDR zone. Cluster development to preserve natural features and reduce site disturbance is just as applicable in the LDR zone as it is in other residential zones of the City. 4. All utilities and public services are available to serve the site. Urban, infill development at appropriate densities is mandated by the Growth Management Act. 5. The City's GMA adopted Comprehensive Plan makes no mention of the specific Countywide Planning Policies used in its formation. It is assumed that the plan was adopted pursuant to these policies. 6. As previously indicated, all public services and utilities are available to serve the site. No changes to any functional plan is anticipated. 7. No city sponsored capital improvements are necessary. BACKGROUND: The Growth Management Act allows a city's Comprehensive Plan to be amended once each year except in emergency. Chapter 18.80 of the Tukwila Municipal Code outlines the process for submittal and review of proposed Comprehensive Plan and Zoning Code amendments. The Ordinance includes a two stage process: (1) proposed amendments are reviewed and the Council makes a threshold determination whether or not each proposal will be considered further, and ; (2) proposed amendments passing the initial determination are analyzed, environmental and public review are conducted, and a final decision is made by the Council regarding adoption of the amendment. The City has committed to considering proposed amendments and determining whether or not to go forward with any of them. REQUESTED AMENDMENTS: Two amendments, involving five map changes, were received in this initial threshold phase for 1998. The table below summarizes the requested amendments. PUBLIC NOTICE: The ordinance states that the City will hold a public meeting, rather than a hearing, to take public comments. The public meeting requires only that a notice be placed in the newspaper. We plan to exceed the public notice requirement by using "The Hazelnut" to notify all residents and businesses of the proposed amendments and meeting schedule. For those requests involving map amendments, we will also: 1) post the properties involved; and, 2)mail a notice of the proposed Comprehensive Plan amendment to owners of property which lies within the boundaries of the sites with proposed changes. PROPOSED BRIEFING /WORK SESSION/PUBLIC MEETING SCHEDULE: Notices of the potential Comp Plan amendments and public meeting will go out to residents and businesses on March 12 in the Hazelnut. Sites with potential map changes will be posted around that time. Notices will be mailed to affected property owners. The Council will receive its packets on March 16, with a briefing /work session on March 23. The public meeting will be held on April 13 at the COW meeting. The purpose of the public meeting is to provide the Council public comments to help it to decide whether or not the amendments meet the threshold and should be forwarded on for further consideration by the Planning Commission. Human Services Plan Review Evie presented a plan for reviewing and updating the City's Human Services Plan. She said it would update the demographics of the City, which have changed since the last plan was done in 1990. Jim said he liked the part that would review the direction of strategies and roles that human services would play in the City. He and Joe both supported seeing what would be good for Tukwila and for the people who use human services. Joan thought it would be interesting to compare the statistics gathered from the new study with the statistics from the 1990 study, especially regarding the impact of regional proposals being put forth now. She asked about the timing of the Plan, which Evie said would hopefully be done by early fall for budgeting for 1999. Jim said that would fit in well with the focus on core services the City may need to have for next year. Committee okay for proposal for study, 2 z Comp,Plan A ii inentsind Their Threshold Process : The Comp Plan process calls for applications for comp plan changes to come in by December 31st, and for the Council to then make a threshold decision about whether or not to seriously consider those for their comp plan. There are now two proposals to amend the comp plan. One is from the Port, and the other is from staff responding to requests for allowing some land uses changes. First the Council will have to decide whether to pursue those changes this year. A public meeting will be scheduled, and the Council will get a briefing and a packet on the two proposals. The Committee opted to have the public meeting not on the 5th Monday in March, but on April 6th (1st choice) or April 13th. Joe wanted to make sure the meeting was widely publicized. Steve said the only requirement is for newspaper notification, but they are proposing big signs near where the land use changes could have an effect. A schedule included notice in the Hazelnut, Council getting a packet and then getting briefed, and the public meeting. Once the public meeting is held, there won't be another opportunity for outside parties to request action on the comp plan unless the Council decides to pursue one or both current requests. Subdivision Ordinance Issues Scheduled on that evening's COW the Council was to consider some changes to the subdivision code, and Steve raised a couple of more issues the Council might want to consider which were not included in the COW packet. The issue was whether to allow developments not to have to count their access in figuring the land needed for putting in other houses. The Council had lowered the minimum lot size from 7,000 to 6,500, but the lot size excludes the land used for driveways and access to other properties. Staff had found 16 Tukwila sites where an additional house could be gotten off of a single family lot. He estimated there might be 50 places maximum in all, but that was only where one lot could be divided into two lots. From 2,000 - over 4,000 square fee could be saved by not having to count the access on a single lot divided into two legal lots. It could be a problem if applied to bigger lots that could accommodate several or many houses. None. ' Al Spencer, Internal Operations Manager, gave a brief summary of the operating instructions on the Council Chambers microphones. Steve Lancaster explained that the Council held a public meeting on April 7, 1997 and heard presentations from both staff and applicants. Many community members commented on the proposals at that time. It is now within the Council's purview on how to proceed from this point regarding further input on the Comprehensive Plan/Zoning Code amendments. Councilmembers were in agreement that further public comments would be welcomed as long as the comments were kept to a minimum. Lancaster clarified that at this point in the process, the Council is charged with' deciding if a proposed amendment is consistent with the current Comprehensive Plan policies, and whether it should be: 1) dropped from further consideration; 2) deferred for one or more years; or, 3) forwarded directly to the Planning Commission for further review. In response to a question posed by Councilmember Hernandez, Lancaster stated that the Council is not limited to the three options noted above. They can take action on one or more tonight. Others could be processed according to the Council's internal procedures, which would include referral to a subcommittee of the Council. However, the Planning Commission must review prior to the Council taking any final action to approve any of the proposed amendments. He said his client did not propose the building height exception area amendment without consideration of the impacts of neighboring properties. Unfortunately, their knowledge of the changes of the August 15, 1995 Draft Comprehensive Plan did not surface until just before they were informed of the approaching submittal deadline for proposed amendments to the adopted Plan. From that point they simply rushed to complete the submittal. He's requesting to have the setback distance issue for structures above three stories discussed with the Planning Commission. Placing the issue on the Planning Commission's agenda simply allows a reasonable time period for discussions between SRO, the neighbors and the Planning Commission before action is taken. Council President Haggerton announced that two additional letters have been received regarding the six proposed Comp Plan /Zoning Code amendments since the last Council meeting: one from Secure Capital and the other from Michael Aippersbach & Associates. Kathy Solter, Property Manager, Sunnydale Apartments, main objections to amendment #1 is the blockage of light to the apartments and condominiums. She urged the Council to adhere to the staff recommendations and reject these proposals. Diane Rogel, 3810 South 158th Street (Laural Estates), said the proposals do not reflect the spirit of the neighborhood. Comprehensive Plan/Zoning Code amendment #2: Change LDR (Low Density Residential to MDR (Medium Density Residential) to construct a 32 -unit condominium project between Pacific Highway South and 40th Avenue South at 38th Avenue extended. Gary Greer, representing Secure Capital, Post Office Box 25127, Seattle, Wa., 98125, commented that he still believes that a residential townhouse condominium development is the best development solution for all involved. Greer submitted modifications to his application that address most of the concerns raised in the public meeting held on April 7th. It was the consensus of the Council to forward the proposed Comprehensive Plan /Zoning Code amendments to the Special Meeting following tonight's Committee of The Whole meeting. Disposition of old Council President Haggerton pointed out the numerous meetings /discussions, community center as chronicled in the agenda packet, that have been held regarding this issue. City Administrator McFarland explained that the stipulation in the 99 -year ground lease with the South Central School District was that when the property ceased to be part of public use, it would revert back to the District. Therefore, as long as the City intends to use it for public purposes, it will remain in our ownership for the duration of the 99 -year ground lease. A discussion ensued with most of the councilmembers favoring a complete demolition of the building while others suggested demolishing all except the enclosed area of the gymnasium. Some Councilmembers thought it might be feasible to open the four walls of the gym and use it as a covered shelter for recreational purposes. Council President Haggerton reminded the Council that this issue will also be on the agenda for discussion at the joint Council /School Board meeting scheduled for May 6th. After a lengthy discussion, it was the consensus of the Council to have staff provide them with rough parameters of costs associated with various options, including total demolishing verses saving the gym portion of the old community center. w 00; N0. w= • J � LL. However, he stated that the Board is currently non - operational due to lack of a quorum. Only two members remain of the five positions that constitute the Board. Additionally, the depth of complexity and range of knowledge necessary to assess and rule on many of the above described actions, create significant challenges to the Board in their deliberations. The City's liability insurance carrier has strongly recommended the use of a professionally trained hearing examiner to decide these matters, rather than a volunteer citizen's board. l After a brief discussion, it was the consensus of the Council to forward the ordinance dissolving the Board of Adjustment and creating the Office of Hearing Examiner to the next Regular Meeting for further consideration. Council President Haggerton requested that should the Council pass the ordinance to dissolve the BOA, that a letter of appreciation be sent to the current and previously retired Board of Adjustment members (and/or the family of members, if it applies) expressing the City's gratitude for their many years of dedicated service. REPORTS Mayor Rants reported that to date the City has handed out 857 dump passes and the final count isn't in yet. Pacific Energy Institute handled the Mayor recycling day at Foster for items such as refrigerators, tires and various other rubbish. He said a total of 95.94 tons of materials were collected on that one day for recycling. Rants updated the Council that the Regional Task Force has outlined its regional needs regarding the Green River basins. Some of the issues being 'discussed are flooding, levees maintenance, habitat restoration, and habitat acquisition. Council Councilmember Duffie reported that Tukwila Elementary School raised 500 fish in their fish hatchery this year. Duffie complimented the City's Police Department for responding so well in the case of a recent incident where an attempt was made to abduct a Tukwila Elementary School student. Councilmember Hernandez reported she attended the Foster Community Club meeting on Wednesday, April 23rd. Each side is then allowed 5 minutes for rebuttal. 4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has'spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at this time. 6. After the Public Hearing is closed, the Council may discuss the issue among themselves without further public testimony. In fact, it is the applicant's position that there are no goals or policies in the Housing Element which, in any way, would preclude the applicant's proposal. Natural Environment policies contained under Goal 4.3 are applicable and support our petition. Particular attention is drawn to policies 4.3.2 and 4.3.3 which seek flexibility in development options in geologic hazard areas and the minimization of potential hazards through appropriate site design and access altematives. The attached site plan accomplishes these objectives. Multi- family residential policy 7.6.9 on page 82 of the plan is applicable and supports our proposal. The site plan provides neighborhood design integration with abutting single - family residential through density control, sensitive area protection, generous setbacks and landscape /building design consistent with site topography. .r RECEIVED CITY OF TUKWILA Ea 3 1 3 Under the Transportation Corridors Element, the most applicable strategy rece�TER is policy 8.2.13 which states as follows: 8.2.13 Maintain the predominately residential use and character between South 128th Street and South 137th Street (if extended), with appropriate zoning and a significant component of vegetated hillside; allow a limited amount of neighborhood oriented retail activity in residential projects that front on Highway 99. This policy specifically recognizes that "appropriate zoning" is flexible and needs to be determined on a case by case basis for this segment of Pacific Highway South. Our proposal seeks to maintain residential use and character in the form of a change from LDR to MDR in order to preserve a significant portion of the vegetated hillside and provide low density townhouse condominium housing benched into the existing slope. Outright permitted zoning density will be maintained. D. IMPACT(S) OF PROPOSED CHANGE ON CAPITAL IMPROVEMENTS PLAN: No change or impact to the City's Capital Improvement Plan is anticipated. All services to the site are currently available and would be extended via private utility extension agreements. E. DEFICIENCIES IN EXISTING PLAN /CODE RESOLVED BY THE PROPOSAL: The LDR provisions of the Zoning Code (Chapter 18.10) is deficient in not allowing attached residential development at the same allowable density without having to apply for a Comprehensive Plan /Zoning Code Amendment. The PRD provisions (Chapter 18.46) should be amended to allow attached residential (condominium) development in LDR zones pursuant to strict criteria. The PRD is an overlay zone which provides exceptions to many of the requirements contained in the underlying zone. The PRD should allow flexibility in housing style and choice as well. F. COMPLIANCE OF THE PROPOSAL WITH GROWTH MANAGEMENT ACT: The Growth Management Act seeks densification of development in urban areas in order to preserve rural areas and farmlands. The GMA provides municipalities a number of ways to accomplish this. In this case, the City's adopted GMA Comprehensive Plan is presumed valid under the Act and provides these opportunities as discussed above. G. OTHER ISSUES PRESENTED BY THE PROPOSED CHANGE: The property was the subject of a Conditional Use Permit application for an assisted living facility when the property was in unincorporated King County. We understand that application proposed approximately 80 units of elderly care. This application was apparently withdrawn for reasons unknown at this time. Develop under existing zoning. Development per approved conditional or unclassified use permit. III. COMPREHENSIVE PLAN /ZONING CODE AMENDMENT CRITERIA A. COMPREHENSIVE PLAN AMENDMENT CRITERIA: 1. Proposal is to reclassify an approximately 4.5 acre parcel from LDR to MDR. This change in the Comprehensive Plan /Zoning would allow the development of a 32 unit planned multi - family complex consisting of 10 triplex buildings and 1 duplex structure. Parking for 75 cars would be provided. The proposal is a planned residential development of a moderately wooded and sloped property that also contains a number of large drainage courses. Development in the cluster manner proposed is a superior to the strict, unimaginative lot by lot development that is the only permissible type of development allowed in the LDR zones. 2. No significant impacts are anticipated. The property is vacant and available for development. The proposed low density townhouse condominium development is compatible with the surrounding neighborhood in terms of height, scale and character. Significant setbacks and landscape buffering can be provided from abutting uses. 3. Development in accordance with existing zoning /comprehensive plan makes little, if any, accommodations for cluster development in an LDR zone. Cluster development to preserve natural features and reduce site disturbance is just as applicable in the LDR zone as it is in other residential zones of the City. 4. All utilities and public services are available to serve the site. Urban, infill development at appropriate densities is mandated by the Growth Management Act. 5. The City's GMA adopted Comprehensive Plan makes no mention of the specific Countywide Planning Policies used in its formation. It is assumed that the plan was adopted pursuant to these policies. 6. As previously indicated, all public services and utilities are available to serve the site. No changes to any functional plan is anticipated. 7. No city sponsored capital improvements are necessary. The proposal privately sponsored and all improvements will be privately funded in accordance with all applicable site development codes. 8. None to the applicant's knowledge. • B. ZONING AMENDMENT CRITERIA: 1. As previously discussed, we believe the proposal is consistent with the Housing, Natural Environment and Transportation elements of the plan. Under Washington law, it is not necessary to make a "strong showing" of changed circumstances. The changes that have occurred to support a rezone may have been relatively slight. The rule is flexible and allows for each case to be considered on its own facts. Also, if the rezone is intended to implement the City's comprehensive plan, you do not need to show a change in circumstances at all. We believe this is the case in this instance. BUILDING DIVISION The following is meant to be general information related to the requirements of the Tukwila Building Division for the processing of building permits. Specific code issues will be addressed through the normal plan review process after the permit is applied for. 1. Comply with the Uniform Building Code, 1994 Edition, as adopted and amended by the State (Table 10- B, Section 1607, and Section 3003 of the 1994 UBC are not adopted). 2. Comply with the Uniform Mechanical Code, 1994 Edition, as adopted and amended by the State. 3. Comply with the Uniform Plumbing Code, 1991 Edition, as adopted and amended by the State. 4. Comply with the Washington State Energy Code, Chapter 51 -11 WAC, 1995 Edition. Energy code specifications and data must be included on the building plans. 5. Comply with Washington State Regulations for Barrier Free Facilities or Design (State amendment replaces UBC Chapter 11. in its entirety). 6. All rack storage requires a permit and rack storage over 8' high must be designed for Seismic Zone 3. A Washington State structural engineers stamp will be required on plans and structural calculations submitted for rack storage over 8' high. 12. Construction documents shall include special inspection requirements as specified in UBC Sections 106.3.5 and 1701. The architect or engineer's inspection program required by Section 106.3.5 shall be included with plan submittal documents when permit application is submitted. Identity: The addresses for the individual residences should be visible from the street, both in daylight and darkness. Sticker shrubs may discourage crime activities. Low shrubs and umbrella trees (where the canopy is maintained above five(5) feet from the ground) will allow surveillance opportunities, hence reducing the potential for criminal behavior. 5. Lighting: Energy efficient security lighting is a relatively low -cost, yet extremely effective way to protect the homeowners and their visitors. 6.
