NOTICE OF DECISION
This is to inform you that the City of Tukwila has approved your
request, for an exemption from a shoreline permit for the proposal
to remove contaminated'soils from the storage yard at your facility
located at 8801 East Marginal Way South. This exemption is based
on plans and written description of the project on file at the
Tukwila Planning Department. The exemption is effective
immediately.

EXEMPTION FROM SMA SUBSTANTIAL DEVELOPMENT PERMIT
TO: S. Alm Plouff, Renworth Truck Company
The proposal by Kenworth Truck Company to undertake a proposal to
remove about 50 cubic yards of soils contaminated with hydraulic
fluid and replace with clean fill within a 420 square foot area and
repave said area with asphalt upon property located at 8801 East
Marginal Way South, (SW 1/4 Section 3, Township 33, Range 24)
within the Duwamish River and /or its associated wetlands is exempt
from the requirements of a substantial development permit because
the development constitutes normal repair and maintenance (WAC 173 -
14- 040(b).
No Corps Public Notice is Available.

Project Description: The project is located at the Kenworth Truck
Company site, 8801 East Marginal Way South. The proposal is to
remove soils contaminated with hydraulic fluid within a 420 square
foot area adjacent to the Duwamish River. The area is paved and
historically has been used to store surplus equipment. The
applicant estimates that fifty cubic yards of soil will be removed.
After removal, the site will be regraded and repaved to its prior
condition.
Category of Exemption: WAC 173- 14- 040(b) allows normal repair of
facilities to be exempt from shoreline permits. "Normal repair
means to restore a development to a state comparable to its
original condition within a reasonable period after decay or
partial destruction except where repair involves total replacement
which is not common practice or causes substantial adverse effects
to the shoreline resource or environment."
With this minor spill of hydraulic fluid, the environmental quality
of the soil on the site has been degraded. The proposal will
eliminate the contaminated soils thus restoring the soils on the
site to a more natural condition. Therefore, the proposal can be
exempted from obtaining a permit.
Policies of the Shoreline. Management Act: The proposal is
consistent with the policies of protecting the natural environment
and public health and will not adversely affect navigation or
public access to the shoreline. The character of the shoreline
will not be changed by the project.
Policies of the Shoreline Master Program: The site is within the
jurisdiction of the King County SMP. The proposal is consistent
with the policies of the conservation element that encourage
protection of the shoreline environment.
SEPA: The project is categorically exempt pursuant to WAC 197 -11-
800 (3) "Repair, remodeling and maintenance activities."
Recommendation: Concur that the project is exempt from a shoreline
permit.

Subject: Maintenance Activity within Shoreline Management Authority
Dear Mr. Pace:
I am writing this letter on behalf of Kenworth - Seattle to confirm our telephone
conversation of December 6, 1994, regarding proposed maintenance activity on
this site that is within the jurisdiction of the Shoreline Management Act.
We propose to excavate a small portion (approximately 50 cubic yards) of asphalt
cap and underlying soil recently stained by a small (3 -5 gallon) spill of hydraulic
fluid. The soil is contaminated with TPH at various depths and at various
locations. The contamination ranges from 62 to 813 ppm. After removal of the
contaminated soil, the excavation will be backfilled to natural grade with clean
material and re -paved with asphaltic concrete. The clean -up does not involve
expansion of the existing property.
The area in question is immediately adjacent to the Duwamish River and was
established in the mid seventies upon local fill material, run of quarry embankment,
and heavy loose rip rap. Historically, the area has been used for the storage of
retired parts and equipment. The Department of Ecology has been notified of the
proposed repair and has approved the intent and scope of the work. The project
is strictly a maintenance activity for the purpose of removing contaminated
material and repairing the property to the original condition. There will be no
efforts to expand the property in any manner.
