I asked Joanna to review and comment by July 22. N �; zo Between July 22 and August 3 - I met with Joanna, she indicated �" _ that none of the comments should be shoreline or sepa conditions, ?f June 27 - I followed up my request for the clarification of Public Works comments by sending an e-mail to Joanna Spencer. Between June 27 and July 19 - I verbally asked Joanna several times the status of the follow up...she indicated she would have to get back to me after reviewing with Ron Cameron. f- 0: but she was still unsure about the comment requiring street zf-: improvements. al _, August 3 - I emailed Joanna asking if she had an answer on the pt� street improvement issue. 0 H =uj. August 10 - Received email response to my August 3 email. This 1- �v—.' response provided the final clarification I needed. No street L O improvements were required thru either the shoreline or SEPA w process. Note: The net effect of these clarifications is that o- p ; Public Works had no comments! E August 10 - SEPA Threshold Determination Issued (DNS). Because there is another agency with jurisdiction (Ecology) there was a 15 day comment period. Shoreline Permit cannot be issued until the end of this period. Note: The DNS was issued the same day we received final clarification from Public Works. August 25 - SEPA Comment period ended. August 30 - Shoreline permit issued. Note: The permit was issued 3 working days after completion of the SEPA comment period. As a footnote, you will recall I drafted a new SEPA comment sheet with new instructions for the commenting department's reference. It was frustration of not receiving comments in a timely-manner and comments that were appropriate for the application that provided the incentive to provide additional direction to other departments. Y DEVELOPMENT I have followed up with the City regarding the parking lot permit and have found yet another delay. According to John Jimmerson, . Tukwila Planning, the SEPA comment period was up today (no comments received) however, now the application goes into the Shoreline Approval process with no work to be started for 21 days after DOE receives the package from the City. I was under the mistaken impression that Shorelines was a concurrent action. Now construction cannot commence until late September. Lets hope for continued good weather. I am disappointed in the process and timing of the approvals in the City on something that Mr. Jack Pace of the City Planning Department said was a simple, administrative process. We submitted for pre - development review in January of 1995 (Libby Hudson), with Environmental Checklist and Shorelines submitted 3/2/95 (file number L95- 0013). I believe the City has failed to respond in a timely manner to the SEPA and Shorelines, and has delayed us into a potential winter time construction sequence on a moisture sensitive site. I am copying this letter to Mr. Jack Pace, Mr. Steve Lancaster and Mayor John Rants, regesturing my complaints, since we were originally told the entire process was a maximum 4 months and this delay is not in keeping with their "stated goals" of pro- business, and expediting approvals. JNITY DEV ELOPMENT Dear JoAnna: Enclosed for your final review and approval are five copies of the parking lot improvement plans for the Penske Trucking Company. The plans have been revised to incorporate the plan review comments, which we received from your office. The following is a brief description of the changes. 1. A flood zone control permit application has been prepared and is enclosed with this submittal for your review and processing. 2. A slope stability letter can be provided, if required. By inspection, it is apparent that the existing side slopes are stable and do not show any indications of erosion or sloughing. The slope is graded at approximately 2:1 and is vegetated with existing grasses and brush. The edge of the proposed pavement is located a minimum of 40 feet from the top of the existing bank. Please let me know if a separate letter from the geotech is required. We have completed storage calculations, as required, to verify that the site will provide 100- year /7 -day storage prior to overflowing onto adjacent properties. Adjustments to the proposed parking grades were needed in order to satisfy this requirement. Please refer to the attached calculations and exhibit. 4. Biofiltration swale calculations have been completed to verify that the size is adequate based on the post - development runoff flows. Copies of the calculations are enclosed within this submittal. 5. An oil /water separator has been provided at the end of the bioswales prior to discharging into the 48th Avenue South storm system as requested. 6. We have completed capacity calculations for the existing storm drain line within 48th Avenue South to the discharge location in the Duwamish River. In addition, we have calculated the post- development runoff from the site to the existing system. The additional flows which will discharge into the existing storm system within 48th Avenue South are minimal compared to the overall capacity of this system. I forwarded the approval to the Department of Ecology today. Once they receive it, the appeal period will begin and it will last for 21 days. Construction on the site may be authorized following the 21 day •appeal period. I have reviewed the information regarding the evergreen screening for the parking area and find it to be acceptable. However, the plans show that fence and landscaping to be done by WSDOT. Regardless of who does it, it needs to be done at the time the new parking area is created. Before we can authorize work on the site, we need revised plans showing that the fence and landscaping will be completed as a part of this project. POLICIES OF THE SEA/SMP: The site is within the jurisdiction of the City of Tukwila SMP and is consistent with the goals and policies of that SMP. It will not adversely affect land use, economic development, public access, circulation or recreation along the shoreline. 3. TURWILA SHORELINE REGULATIONS: Following are the relevant review criteria as contained in the City of Tukwila Shoreline Zone (TMC 18.44): 18.44.110 - General Shoreline Regulations All uses within the shoreline zone must conform to the following general regulations: (1) The use in conformance with the regulations of the underlying zone district. Response: The property is zoned Light Industrial (M -1). The . business is for lease and rental of trucks. Although the use is not explicitly identified in the zoning code, it is permitted under the category of "Other Retail Business of a Regional Character...." (TMC 18.30.020(37)). The M -1 zone requires fifteen feet of landscaping along the front property line, which is the amount proposed along 48th Avenue South. (2) The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations. Response: See No. 2 above. (3) No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. Response: No such structures are proposed. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit. Response: With a substantial development permit, the public access trail and some of the perimeter landscaping would be located within the 40 foot river environment. The trail will be constructed under separate permit by WSDOT. (5) No effluent shall be discharged into the Green River which exceeds the water quality classification... Response: The project will not discharge effluent into the river. Stormwater treated through a bioswale and oil /water separator will be discharged into the river. (6) All State and federal water quality regulations shall be strictly complied with. Response: Responsibility of the applicant. (7) Wildlife habitat in and along the river should be protected. Response: There is limited habitat in the vicinity...blackberry bushes that provide habitat for small birds and animals will be removed. (9) All necessary permits shall be obtained from federal, State, County or municipal agencies. Response: Responsibility of the applicant. 18.44.130 - Specific Shoreline Regulations - River Environment (1) The river environment....shall contain no uses or structures other than the following: (a) Public and /or private footpaths or trails... Response: Within the river environment is proposed a public recreation trail and associated landscaping. (2) River environment uses shall conform to the following standards: (a) Access roads, parking or storage areas, the closest edge of which shall be a minimum of 40 feet from the mean high water mark.
