All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. 2.Collection facilities to control and separate contaminants shall be required where stormwater runoff from impervious surfaces would degrade or add to the pollution of recipient waters or adjacent properties. File No. L95 -0021 1. PROJECT DESCRIPTION: The proposal is to .construct a 25,000 square foot concrete tilt -up building in the Gateway North Business Park. There will be 70 parking spaces and landscaping provided on three sides of the 1.92 acre site. The Duwamish River abuts the property to the north. The site address is 11521 East Marginal Way South. 2. POLICIES OF THE SMA/SMP: The site is within the jurisdiction of the King County SMP and is consistent with the goals and policies of that SMP. It will allow for economic development with a land use that is consistent with the existing pattern of the vicinity and will facilitate public access and recreation along the shoreline. 3. SHORELINE REGULATIONS: Following are the relevant review criteria as contained in the King County Shoreline Regulations as applied by the City of Tukwila: 25.16.030 General Requirements: A. Nonwater related development...shall not be permitted waterward of the OHWM. Response: The project is located upland from the OHWM. B. ...No structure shall exceed a height of 35 feet... Response: The proposed structure is 27 feet high. C. All development shall be required to provide adequate surface . water retention and sedimentation facilities during the construction period. Response: Surface water retention has been previously addressed with the development of the industrial park. Normal erosion control practices will be followed. E(1). Parking areas must be located beneath or upland of the development of the development... Response: This requirement is met. E(2). Any outdoor parking area perimeter...must be maintained as a planting area with a minimum of five feet. Response: This requirement is exceeded. E(3). One live tree ...shall be required for each thirty linear feet of planting area. Response: This requirement is met. E(4). One live shrub...for each 60 inches of planting area shall be required. Response: This requirement is met. E(5). Additional perimeter and interior landscaping of parking areas may be required...when large parking areas are proposed. Response: The parking area is setback 70 feet from East Marginal Way South. The 50 foot setback from narrow orientation to the Duwamish River limits the visibility of the parking from the river trail. F. Collection Facilities to control and separate contaminants shall be required,where stormwater runoff from impervious surfaces would degrade or add to the pollution of recipient waters or adjacent properties. Response: Public Works indicated that an oil separator will be required. H. Development ...shall maintain setbacks, provide easements or otherwise develop the site to permit a trail to be constructed or public access to continue... Response: An easement has been granted for public access on the waterward side of the improvements. The City of Tukwila is presently improving the trail. 25.16.170 Industrial Development: B. Industrial development may be permitted. ..provided that: (1) The industrial activity is permitted in the underlying zone classification; (2) The industrial activity shall utilize the best techniques...to prevent release of contaminants into the adjoining water... Response: (1) The site is zoned Light Industrial (M -1) which allows office and warehouse uses. (2) The use itself does not result in effluent being released into the water, however, an oil - water separator will be required for parking lot runoff. E. Outside storage...shall maintain a shoreline setback of twenty feet from the OHWM. Response: There is no storage proposed within 20' of OHWM. H. Nonwater related industrial development shall maintain a shoreline setback of either fifty feet from OHWM or twenty feet from the edge of the floodway, whichever is greater...This shoreline setback may be reduced to ten feet from the OHWM or the edge of the floodway, whichever is greater, if the ...development provides limited public access... Response: Landscaping is roughly 30 feet and the building 50 feet from the OHWM. Public access is provided on an existing gravel road along the shoreline. 4. SEPA: A determination of non - significance was issued on June 6,1995. The comment period expired without receipt of any comments. 6. RECOMMENDATION: Approve the shoreline substantial development permit.
