RE: Boundary Line Adjustment #L95 -0023
Dear Mr. Halbert:
The. Department of Community Development (DCD) has completed
preliminary review of your proposed boundary line adjustment (BLA).
A waiver from the requirement for a Planned Residential Development
(PRD) has been granted as requested.
As you are aware, land altering was conducted without first
obtaining an approved permit. The land altering is also subject to
the Sensitive Areas Ordinance (TMC 18.45) due to the close
proximity of a stream. The Public Works Department has requested
that an approved land altering permit be obtained and the DCD has
requested that a vegetative buffer be planting where the stream is
impacted. These issues have been brought to your attention in
previous letters and meetings with the City, but have yet to be
resolved. In order to approve the proposed BLA these issues need
to be settled.
The Boundary Line. Adjustment has been granted conditional approval
with the following conditions:
Prior to recording the Boundary Line Adjustment the owner
shall complete the following:
1. The owner shall plant a buffer of trees along the east
property line to enhnace a sensitive area buffer. The
species and spacing of the trees must be approved by the
Department of Community Development (DCD) prior to
planting and inspected by the DCD upon completion of
planting.
2. The owner shall obtain a land altering permit from the
Public Works Department.

Final approval of the Boundary Line Adjustment will be effective
when the above conditions have been met, documents have been
recorded with King County, and a copy of the recorded documents
have been provided to the Department of Community Development.
To record the documents, please submit the enclosed original
documents and copies to the King County Department of Records for
recording. After recording, please return the copies of the
recorded documents to me. The BLA is not considered complete until
we receive a recorded copy.

Dear Mr. Halbert:
Attached is the September 20, 1994 Notice of Violation of the Land
Altering Ordinance #1591. You responded with. your November 10,,
1994 letter to me after your meeting with Gary Schulz (Department
of Community Development) on November 3, 1994.
In your November 10, 1994 letter you said you had reached an
agreement with your neighbor to buy the land and would file for the
necessary boundary line adjustment. Also, you indicated you were
working on a planting plan for review by the City's Urban
Environmentalist, Gary Schulz.
To date I'm unaware of any actions you've taken to bring this
matter to a close.
The last paragraph on page one of my September 20, 1994 Notice of
Violation, beginning with "To come into compliance..." is revised
as follows:
The actions to be in compliance with the code are:
Remove the fill and restore your neighbor's property within 30
days after the date of this letter; or
Provide your neighbor's approval and planting' plan in
accordance with enclosed Sensitive Areas Ordinance #1599.
within 21 days after the date,of this letter and carry out
your proposed construction 30 days after the City has notified
you of plan approval. The goal of this plan is to add
supplemental plantings in the infilled stream buffer area in
accordance with requirements under TMC Section 18.45.040,
c(4)A(ii).
Failure to comply with the above requirements can subject you to
penalties outlined in Section 6.6 of the enclosed Land Altering
Ordinance.
