The deadline has been extended to July 13, 1996. As you and I discussed, this means the short plat needs to be approved by the City and recorded with King County. It is my understanding that you are aiming.to submit to the City for final approval by June 13. If the plat is submitted and in order on that date, the one month extension should provide sufficient time for City approval and release for recording. Regarding the setbacks, it is understood that the south property lines on the two eastern lots of the short plat will be the front property lines. On a related note, the City is amending the subdivision ordinance. Given your experience as a subdivider in Tukwila and other communities, I am interested in receiving your input for improving our process. In order to do so, one of the requirements is that the road and utility improvements are installed prior to the approval of the short plat. The subdivider is provided the option, however, to post a bond or other financial guarantee in lieu of completing the improvements. The value of the bond must be equal to 150% of the estimated cost of the work to be done. If the improvements are not installed by the subdivider in the agreed upon time frame, the City will make a claim on the bond for completion of the work., Attached is Section 17.08.080 of the Tukwila Muncipal Code (TMC) which authorizes acceptance of bonds in lieu of improvements. (d) SUBDIVISION COMMITTEE MEETING: A ling of the Short Subdivision Committee, attended y the applicant at his option, shall be held no later than 20 calendar days froth receipt of a complete application. The meeting shall be open to the public. (1) Quorum — All members of the Short Subdivision Committee or their representative must be present in order for action to be taken. (2) Action — The Short Subdivision Committee may approve, approve with modifications, or deny the application for a short subdivision. The decision of the Short Subdivision Committee shall be made at the meeting and the applicant notified in writing of such decision within three working days. An additional meeting may be called if a decision is not reached at the first meeting. The second meeting should be no later than seven days after the first meeting. An appli- cant may request to have an application on which the Short Subdivision Committee has taken action reopened by the committee if it is found by the Direc- tor of the Office of Community Development and the applicant that new information has come to light that might affect the action taken by the Short Subdivision Committee. (3) Appeal — The decision of the Short Subdivi- sion Committee shall be final, unless an appeal by any aggrieved party is made to the Planning Commission within ten calendar days of the date of decision of the Short Subdivision Committee. The appeal shall be in writing to the Planning Commission and filed with the Office of Community Development. The Planning Commission shall act on the appeal within 40 calendar days unless an extension thereto is agreed to, in writing, by the applicant. The decision of the Planning Commission shall be final and conclusive. unless, within ten calendar days, any aggrieved party files with the City Clerk a written appeal addressed to the City Council. The City Council shall act on the appeal within 20 days of the date of appeal. (Ord 1599 §6(3), 1991; Ord. 1014(part), 1977) 17.08.070 Required improvements. (a) Prior to recommending approval for any short subdivision, the Short Subdivision Committee shall determine that the following improvements are avail- able for each parcel created by the division of land: (1) Adequate water supply; (2) Adequate method of sewage disposal; • (3) Storm drainage improvements and storm sewers; . (4) Fire hydrants; (5) Adequate access to all parcels. Streets, alleys, and sidewalk it wements may be required by the Short Subdivision committee; (6) Provision for appropriate deed, dedication, and /or easements. (b) Any and all improvements required pursuant to subsection (a) shall be as per the respective requirements of Chapters 17.20, 17.24 or 17.28 as appropriate for either the residential or commercial industry design standards. (c) Other improvements not specifically men- tioned herein but found necessary due to conditions found on the site may be required. (d) Finished plans of all public improvements as installed shall be required before the City will accept the improvements. (Ord 1014(part), 1977) 17.08.080 Filing of short plat. (a) All required improvements must be con- structed by the applicant and accepted by the City, or a bond posted by the applicant for construction of same, prior to the short plat being filed. Said bond shall be in an amount equal to 150° of the estimated cost of complete construction of such . improvements as determined by the Director of Public Works. (b) A short plan must be certified for filing by the chairman of the Short Subdivision Committee before it is filed. (c) Short plats shall be .filed by the applicant with the Department of Records and Elections, and a copy of the recorded instrument shall be returned to the Office of Community Development prior to issuance of build - ing permits. If the short plat is not filed within six months of the date of approval, the short plat shall be null and void. The city has been involved jurisdictionally and as a neighbor. Several issues couldn't be resolved until the city completed the adjacent road and storm drainage improvements. Critical engineering drawings were not readily available, moved, misplaced or out for transfer to CD ROM. Also the Planning and Public. Works Departments office areas were remodeled disrupting your staff and adding another 30 to 45 days delay. Several issues were set aside and overlooked while we focused on finding a suitable route for sewer. We just received an approval of the storm sewer design on the 31st of May. We are not trying to place blame for the length of time to complete this S.P.. John Jimerson and Ross Heller and the rest of the staff have diligently responded to questions, held the appropriate meetings when necessary., etc. A lot of time has been spent just answering questions and organizing meetings. And the same has been true for the applicants' side. Everyone involved has needed some lead time and each with their many projects require time. Weather has also played a part. Worst rains in 100 years and unable to get work started without risk of dire consequence to the project and neighborhood. (see "Proposed Force Main Location" drawing, "Side Sewer Permit" drawing No. 02995 date 5 -17 -82 and 2 partial copies of Val Vue Sewer Districts "as built" drawings - attached). It is not possible to construct a "gravity flow" type system at any point along this route. Gravity flow begins at the existing side sewer service stub located at a depth of three feet. The design of this system would be by AHBL Civil & Structural Engineers who have designed several successful similar systems for other communities in the area. Class 1 grinder pumps manufactured by "Crane Pumps & Systems" and design approved by Underwriters Laboratories Inc. would be used and required as an integral part of the design. (design info drawings attached). After months of research, subsequent engineering and impute from many engineers (including yourself), contractors and Val Vue Sewer District staff it has been determined that the only viable route for sewer service is as proposed. Any other route would require the direct accessing of the existing main under the newly paved 42nd Avenue South either by street cut and/or boring or jacking to reach the main and or side hill excavation along the west side of the newly formed storm water retention pond (difficult, unstable and dangerous). H VI 0; • z;. z It would also be in the best interest of public health to facilitate the installation of sewer service to the subject property as the existing home has an old and antiquated private sewer system and its potential for failure increases with age. We are aware that as a requirement for approval a "no protest" agreement and covenant be recorded to run with the land requiring the subject properties to hook -up to a gravity flow type system within a specified period of its availability and pay the additional related charges for hook -up. We ask that this proposal be considered and approval granted as soon as possible so that we may complete this project and Mr. Holly and the City of Tukwila can put this behind them. My comments and recommendations for the two short plat proposals are listed below. Both properties have sensitive area slopes as regulated by the SAO. The L95 -0025 property has the North Fork of Gilliam Creek and an adjacent steep slope area. A site meeting with the applicant was conducted on September 18, 1995 to discuss geotechnical requirements for the L95 -0042 property. L95 -0025: The 1993 Boundary Line Adjustment for this site avoided sensitive area impacts and allowed for development away from any sensitive slopes. However, the new shortplat proposal has reconfigured the lots so that development of proposed Lot 1 is very close to the steep slope above Gilliam Creek. A septic drainfield easement further complicates the situation because Lot 1 cannot be developed until the septic is abandoned on Lot 2. In addition to not having geotechnical recommendation for a building setback from the top of slope there may be problems with building on an old septic drainfield. Per the SAO, there is a map note that identifies the probable need for a geotechnical study for any new development in this area. The eastern lot (Lot 3) faces a sensitive slope and the eastern portion of the lot appears to have a 15 to 25 percent slope gradient. I recommend waiving the geotechnical requirement on this shortplat for the following reasons: 1) The area that is the steepest will have a required septic drainfield permitted by King County Health Dept., 2) Soil conditions appear well- drained and are likely the more stable Class 2 slope, and 3) this is a marginal sensitive area that has already been cleared and will be used to build only one single- family home. If you have questions, lets discuss the projects. The 30 feet easement requirement means the loss of yard area of 30 percent of Lot 3 and 37 percent of Lot 2 to a private road verses for a 20 feet easement a loss of 19 percent for Lot 3 and 25 percent for Lot 2 This means the loss of lot area more suitable for other uses, such as gardens, landscaping, off street play areas and this can reduce the value of each lot as well 2. Physically a 30 foot easement would only be 7 feet from the existing home on Lot 2. the front yard would be wiped out and all the holly trees would have to be destroyed This would deprive the property owner of a front yard 3. 30 foot wide dead end easements, because of the extra width, tend to be used more for extra parking for the extra family vehicle (Le. RV, boat & trailers, etc.) further restricting access and creating unsafe conditions 4.. The wider and better the paving the faster people tend to drive even when the road is only a driveway. Again, a less safe situation, especially for children. 5. A smaller paved area also means less problems with water retention and less potential for problems down stream. 6. The Fire Marshall has reviewed the accompanying drawing and suggested a 20 foot easement with 12 feet wide paved and 4 feet shoulders with 131/2 feet vertical clearance as acceptable to the Fire Districts needs. We are also requesting that the front, side, and rear yard designations for Lots 1 and 2 be oriented to the access easement where the front yard would be the south side of those lots. Lot 3 is obviously fronting on 42nd Ave South, but not so the others. With this orientation it would allow a new home to be constructed closer to the west line of Agak lot one to the minimum side yard set back allowed and leave a greater and safer set back from the top of the slope to the east In the case of Lot 2, the existing home, originally addressed as "4216 South 152nd", was built with the front yard to the south. The front door is located on the southeast corner of the home. Therefore, the natural and logical choice would be for a reduced easement width leaving more yard area with the front yard designated to the south side of the house. The greater distance of the buildings on Lots 1 and 2 from 42nd Ave South versus the private access also add to the confusion in yard designations. There is no consistent uniformity possible in this neighborhood, as this is an old plat with large long lots. The granting of both these requests would be consistent with other properties in the neighborhood and would not be detrimental to the public welfare nor create a hardship or be injurious to other adjacent properties or properties in the area. Usually, the Committee imposes conditions of approval. • 2.) Final Approval: Short plat documents (survey, plat map, and other required paperwork) must be completed as required by the Subdivision Code and conditions of Preliminary Approval, and you must install the required site improvements or bond the cost of the improvements. After the City has accepted the required site improvements or a bond for the installation costs has been accepted, the Chairman of the Short Subdivision Committee signs your short plat, granting final approval. 3.) Recording: You must submit the City- approved short plat documents to King County Department of Records for recording. The Short Plat is not considered complete until the documents are recorded, and a recorded copy is provided to the City. The following are the conditions of preliminary approval by the Short Subdivision Committee. PRELIMINARY APPROVAL CONDITIONS Utilities: 1. Show existing and proposed water and sewer lines, and the connection to the public lines (location, size, and material of utility pipes) for all lots, Lot 1, Lot 2 and Lot 3. 2. Prior to development of either Lot 1, or Lot 3, the following will be required: If no fire hydrant is located within 250' of the closest point of proposed buildings, measured by line of vehicular travel, than the developer shall either install a fire hydrant (capable of flowing 1,000 gallons per minute) located within 250' of all future houses, OR the future houses shall be required to install an interior fire sprinkler system. This requirement must be stated on the face of the recorded plat, and must be met in conjunction with issuance of any building permits for Lot 1, or Lot 3. Access 6. The access /utility easement is located in an existing wetland protection easement area which was established with the previous Boundary Line adjustment (BLA #L93 -0019, recording #9404270767) and extends from the south (Lot C.) onto Lot 3 of the subject short plat. This buffer easement is no longer necessary but still is in place. You have the option to either have the easement removed or relocate the access /utility easement. 7. The Subdivision Code requires that an access easement must be a minimum of 30 foot wide unless an exception is granted by the Short Subdivision Committee. (Please see the exception criteria listed later in this letter.) Please provide a revised access /utility easement agreement and indicate on the plat map the location of the access which serves Lot 1. and Lot 2. The access road must be paved to a minimum width of 20 feet beginning from the edge of the pavement of 42nd Ave. S., which will have the ability to support a fire protection vehicle and have 13.5 foot vertical clearance. Access roads exceeding 150 feet in length are required to have an approved fire truck turn - around. Building Sites 9. To alert future buyers to the possibility of additional requirements , a note shall be added to the survey map which states that 'Future development may require a geotechnical report and additional setback from the slope prior to issuance of building, land altering or tree removal permits.' Other 10. The legal description submitted with the short plat application does not describe the three new lots. Please submit a legal description for each of the new lots being proposed. FINAL APPROVAL REQUIREMENTS 1. Complete the items listed for Preliminary Approval, and submit the requested revisions to me for review. a. Submit a revised survey map as described in the application checklist and which meets all the conditions of approval. The original surveyor's signature must be on the face of the plat. An approved tree cutting permit must be obtained prior to cutting significant trees within the sensitive areas of the site (TMC 18.54, Tree Regulations). When these items have been completed to required standards, the Chairman of the Short Subdivision Committee can give final approval to your short plat. This usually occurs within approximately one week of notice that conditions are completed. RECORDING REQUIREMENTS Recording the approved short plat and documents is the applicants responsibility. The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. You will need to pay the recording fees and submit your approved original short plat to the King County Department of Records (296- 1570). After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to me. Please note that a copy of the recorded short plat (or original) must be returned to the Department of Community Development prior to issuance of any building permits for the new lots. EXPIRATION A request for final approval of the short plat must be submitted within six months from the date of preliminary approval, or by , r11tr3 "1.. I also told him that there was no legal description for each of the newly created short plat lots and that I needed that. I said I would put that as a condition of the short plat letter of preliminary approval I would be able to get that out this week. Mr. Holly said that he would get the legal to us later this week. We then ended the conversation. I met with Joanna Spencer and Ross Heller on this short plat late wednesday aftemoon, 5/31/95. We discussed the existing septic drain field and how that would be abandoned. I explained that the owner would like to delay sewer hook -up until the roadway construction is completed along 42nd Avenue. It was agreed that the septic system could continue until either lot 3 or lot 1 are developed. An easement for the drainfield is necessary for the drainfield to exist on lot 1 to serve lot 2 until the sewer hook -up.
