On September 26, 1997, the City of Tukwila approved the Port of Seattle's request that the
provisions of WAC 173- 27- 090(2)(b) be applied to the referenced shoreline permit for restoration
of intertidal fish and wildlife habitat at Turning Basin Number Three in the Duwamish Waterway.
Aquatic habitat restoration at this site is linked with construction of new container cargo pier
facilities at the port's Southwest Harbor Cleanup and Redevelopment Project, Terminal 5, in
southwest Elliott Bay.
As you know, in -water construction such as the proposed aquatic habitat restoration project
requires permit authorizations from state and federal agencies, in addition to approval from the
City of Tukwila. The port is grateful for the splendid cooperation and assistance from the City of
Tukwila to obtain the substantial development permit approval for the project. This letter is to
note several minor revisions to the project's design, requested by state and federal agencies,
subsequent to the City of Tukwila's shoreline permit decision.
During review of the Corps of Engineers permit application, the Washington Department of Fish
and Wildlife requested several changes in the Mitigation Monitoring and Contingency Plan
prepared for the restoration project. A copy of the revised plan, dated October 1997, is attached.
The port has also worked with the U.S. Fish and Wildlife Service, Environmental Protection
Agency, and the Washington Department of Fish and Wildlife to improve three elements of the
project's design as a result of comments received during federal permit review. The enclosed
drawings reflect the design changes requested by these agencies, specifically:
1. Decreased excavation area waterward of the existing shoreline to avoid disruption of existing
intertidal area
2 . Reduce excavation of existing upland area in order to increase area available for planting of
emergent vegetation
3 Re- configure the riparian margin of the excavation to expand area available for planting of
riparian and emergent vegetation

The federal permit, combining approval of the intertidal restoration activities at Turning Basin
Number Three with new dock construction at Terminal 5, was issued in January 1998. The federal
permit includes the revisions and improvements noted above.
These changes improve the environmental resource attributes made possible by the intertidal
restoration project. The port submits that these beneficial project design revisions are minor
changes, reducing the volume of excavation required in favor of creating an opportunity for
increased marsh and riparian vegetation at the site, and are not significant with respect to the King
County Shoreline Master Program. It is hoped that you concur.

Previous environmental analyses for the Southwest Harbor Cleanup and
Redevelopment Project (including draft and final environmental impact
statements prepared under joint lead agency supervision and technical
appendices to the final EIS) have identified an intertidal fish and
wildlife habitat restoration site at Turning Basin Number Three in the
Duwamish Waterway as appropriate compensation for intertidal area altered
due to the proposed estension of container cargo pier at Terminal 5 in the
West Waterway. The following provides additional detail regarding the
methods for evaluating the performance of the proposed Turning Basin
Number Three mitigation action. Reference to existing environmental
analyses prepared for the Southwest Harbor Project is made to avoid
repetition of previous environmental evaluations and analysis of
alternatives.
(1) Summary of proposed mitigation action
The present Corps of Engineers public notice (Project Reference:
95 -2- 00970) for the Southwest Harbor Project indicates dredging and
fill required for construction of 400 linear feet of new container.
apron connecting to the north end of existing container cargo dock at
Terminal 5. Construction of 400 feet of new dock will alter
approximately 0.28 acres of existing intertidal habitat (area
measured between minus eight feet and plus 12 feet MLLW).
The public notice includes a proposed fish and wildlife habitat
restoration action at Turning Basin Number Three as compensation for
intertidal habitat disturbed by extension of the container dock in
the West Waterway. Approximately 1.3 acres of intertidal habitat
restoration would be accomplished at the turning basin site.
The proposed turning basin restoration action would include
excavation in an existing 1.5 acre upland site. The existing
- construction equipment storage and maintenance operation would be
removed. Existing structures and utilities would be demolished and
approximately 33,000 cubic yards of upland fill material excavated.
The existing upland elevation (approximately 12 to 22 feet above
MLLW) would be reduced to intertidal elevations, yielding
approximately 1.3 acres of intertidal mud flat with elevations
between approximately four feet to 11 feet above MLLW. Elevations at
the excavation site between 11 feet and 13 feet above MLLW would be

vegetated with native emergent plants (total emergent plant area is
approximately 16,400 square feet). Bankline above 13 feet MLLW-to the
top -of -bank would be planted with native riparian shrubs and trees
(total riparian planting area is approximately 29,000 square feet).
The proposed intertidal restoration area will be monitored and
evaluated over a five year period to determine the success of the
mitigation action. At a minimum, the 1.3 acre area is anticipated to
provide intertidal fish and wildlife habitat resource values
appropriate for compensation of intertidal resources altered due to
construction of the proposed 400 feet long extension of the existing
container pier at Terminal 5 in the West Waterway. Based on the
performance of the proposed mitigation action, as documented through
monitoring and evaluation efforts described below, it is expected
that intertidal resource values meeting the minimum threshold level
for compensation of intertidal resources altered due to construction
of the proposed container dock extension will be present at the
Turning Basin Number Three restoration site. Because the proposed
intertidal restoration site includes approximately 1.3 acres, in
contrast to approximately 0.28 acres of intertidal area that would be
altered by the proposed 400 feet long Terminal 5 container pier
extension, the resource values created at the 1.3 acre intertidal
restoration site also represent estuarine biological functions that
would offset potential temporal losses in fish and wildlife habitat
function due to disturbance of existing aquatic habitat at the West
Waterway pier extension site and the period of time required for the
intertidal habitat at Turning Basin Number Three to achieve full
functional development as a fish and wildlife habitat site.
A technical committee, as described in Appendix F -7 of the final EIS
for the Southwest Harbor roject, comprised of reprsentatives from
state and federal agencies and Tribes, will review biological and
physical monitoring data describing the status of the proposed
restoration site and evaluate the performance of the restoration
action based on the goals and objectives described in item (4) below.
(2) Existing conditions
The general site history of the proposed mitigation site and specific
existing site conditions are described in the final EIS for the .
Southwest Harbor Project, Chapter 4, Fish and Wildlife, Section
4.1.3.2, pages 4 -95 through 4 -115. Final EIS Technical Appendix F -7,.
Fish and Wildlife Habitat Mitigation, further describes conditions at
the turning basin site and in adjacent areas, including existing
upland and aquatic vegetation, soils conditions, and fauna.

(3) Rationale for selecting Turning_ Basin Number Three
The turning basin site was selected as the preferred mitigation
action as a result of the draft and final EIS for the Southwest
Harbor Project. Chapter 4, Fish and Wildlife, Section 4.1.3.2, pages
4 -95 through 4 -115, of the final EIS describes existing intertidal
habitat conditions at the Southwest Harbor Project. Technical
Appendix F -6, Epibenthic Evaluation, describes intertidal epibenthic
conditions in the area of potential container dock development at the
Southwest Harbor Project and associated intertidal resource effects.
Three alternative mitigation actions were described in the final EIS:
(1) on -site intertidal restoration at the Southwest Harbor Project
(Project North Shoreline, pages 4 -101 through 4 -103); (2) off -site
mitigation in the area of Terminal 107 and Kellogg Island (Kellogg
Island Area, pages 4 -103 through 4 -115); and, (3) off -site mitigation
at Turning Basin Number Three (pages 4 -103 through 4 -115).
Based on this analysis and evaluation in the final EIS, the turning
basin restoration site was determined to be the most appropriate site
for intertidal fish and wildlife habitat mitigation work, from the
perspective of the Southwest Harbor Project and in the context of the
Duwamish Waterway and estuarine resources throughout the waterway.
(4) Mitigation Plan

Goals and Objectives
The goals and objectives for intertidal fish and wildlife habitat •
mitigation at Turning Basin Number Three were articulated in
Technical Appendix F -7, Fish and Wildlife Habitat Mitigation,
distributed with the final EIS (Sections 3.2 and 3.3, pages 9 through
10). The mitigation site goals and objectives are repeated and
further defined below.
General Mitigation Habitat Performance Goals
Mitigation actions at Turning Basin Number Three are intended to meet
the following goals:
(1) Provide habitat compensation consistent with an ecosystem or
landscape approach which promotes integration of the mitigation
action with the surrounding environment, and which promotes an
"aquatic green belt" through the lower Duwamish River connecting
Elliott Bay for movement and use by fish and wildlife species.
(2) Protect the intertidal mitigation area in perpetuity and design
the mitigation site to contribute to a functioning and

sustainable environment that adds to the diversity of habitat
types in the industrialized estuary of the Elliott Bay / Duwamish
River environment.
(3)''Restore habitat components of the Elliott Bay / Duwamish system
that benefit natural resources lost or damaged through past
development of the bay and estuary, such as tidal shallows,
mudflats, emergent vegetation, off - channel sloughs, tidal creeks,
and naturalized river channels.
(4) Integrate as many important habitat functions as possible,
including the following: nesting, nursery, and feeding, food
production, nutrient cycling, perching, resting, shelter, cover,
and refuge from predators, migration routes and acclimation to
fresh and salt water, physical shoreline protection, and water
quality including storm water runoff treatment, such as water
filtering and biological purification.
(5) Building on the historic functions and current physical
conditions of the estuary, meeting the needs of a variety of
selected species or groups of species, providing for
strategically located habitats in the estuary, and addressing the
concept of diversity on an ecosystem basis -- rather than from a
limited site perspective.
(6) Include a process for measuring results and ensuring compliance
with performance goals.
(7) Include a contingency process to respond to adverse monitoring
results and /or changed physical, chemical, and biological
conditions.
Habitat Mitigation Obiectives
Provide compensatory intertidal habitat sufficient to offset
intertidal aquatic area altered in the West Waterway by restoring
functioning intertidal habitat at Turning Basin Number Three.
Intertidal habitat area at the turning basin should provide the
following estuarine resource values:
(1) Provide habitat for fish and wildlife species commonly found in
the Duwamish estuary.
(2) Allow colonization of the site by epibenthic and benthic
invertebrates and vascular and non - vascular plants and allow use
of the site by fish.
(3) Minimize distruption of the hydrology and vegetation in existing
upland and aquatic areas, with particular emphasis on providing
an intertidal habitat complement to the recently constructed
Coastal America restoration project at Turning Basin Number Three.
(4) Construct upland buffer areas adjacent to the intertidal
restorationa area for use by wildlife and as a source of living
and nutrient resources for the restoration area.
(5) Construct the mitigation features in a way that will reduce or
eliminate temporal impacts.

Implementation Plan
The Turning Basin Number Three intertidal fish and wildlife habitat
mitigation action described and evaluated in the Southwest Harbor
Project final EIS and associated appendices meets the goals and '
objectives described above. The present Corps of Engineers permit
application for the Southwest Harbor Project describes construction � H,

Method of verification: Yearly survey data during five years
following construction will determine: (1) any changes in
sediment level (survey accuracy of 0.1 inches); (2) areas of
elevation change due to accretion or erosion; (3) any changes in
the project shoreline above the level of tidal influence.
Physical survey information will be complemented with
photographic documentation during the first five years following
project construction. Post- construction survey data will also
verify the status of adjacent shoreline and intertidal areas,
allowing for evaluation of potential off -site accretion /erosion
conditions.
(3) Habitat structure: The following post- construction assesement
measures will be implemented yearly during the first five years
of the project:

Epibenthic and benthic invertebrates- method of verification:
Modified epibenthic /benthic sampling will be conducted to
determine the diversity and abundance of invertebrate attritute
species present at the intertidal mitigation area. The methods
used will combine sampling guidelines presented in the 1991
Estuarine Habitat Assessment Protocol (copy attached) with data
and experience obtained through recent habitat monitoring
conducted as an element of construction of Coastal America
restoration sites in the Duwamish Waterway. The sampling
strategy, described below, includes obtaining intertidal (wet)
core samples in place of epibenthic suction pump techniques. This
allows for analysis and evaluation of epibenthic sediment
dwelling invertebrates as well as benthic invertebrates.
The attribute species include harpacticoid copepods, gammarid
amphipods, cumaceans, isopods, and additional invertebrate
organisms shown to be important candidate attribute species by
recent Duwamish Waterway sampling (species described in Coastal
America restoration site technical reports).
Two control sampling transects are located immediately adjacent
to the proposed restoration site. These control transects have
been evaluated previously as part of the Coastal America
demonstration project at Turning Basin Number Three. The control
transects, C -1 and C -2, are identified on the attached plan view
sheet. Transect C -1 follows the zero MLLW contour and Transect
C -2 occupies the center of the Coastal America demonstration
site, as indicated. Two elevation strata within the proposed
restoration site will be established for epibenthic /benthic
sampling, as noted on the attached plan view sheet. Transect R -1
will follow the plus four feet MLLW contour and Transect R -2 will
be coincident with the plus six MLLW contour. Eight wet core
samples will be obtained from each of the control and restoration
site transects. Analysis of the wet core samples will be be
consistent with previous monitoring investigations conducted for
the Coastal America restoration site and will focus on the
attribute species listed above.
Monitoring of the 1.3 acre turning basin restoration project
will, therefore, include micro and macro -fauna evaluations
designed to verify performance of the particular mitigation
action measured against previous and ongoing data derived from an
adjacent 0.4 acre Coastal America intertidal restoration area and
associated control sites. The objective is to provide comparative
data and extend data collection for a longer period of time,
covering an expanded area. Additional implementation details for
the epibenthic /benthic sampling actions, including sample timing,
precise sample strata locations, and identification of additional
attribute species, will be as determined by participating state
and federal agencies and Tribes.

Fish use -- method of verification: Sampling will be conducted
using the 1991 Estuarine Habitat Assessment Protocol guidelines.
Attribute species will be salmonids. Beach seine sampling will.be
*accomplished immediately following completion of the intertidal
wet core sampling. Please note that beach seine sampling will be
conducted at the restoration site at high water. The beach seine
will be deployed to capture juvenile fish inside the site,
blocking the mouth of the restoration site before being pursed.
Salmonid fry will be analyzed for size, species, and gut contents.
Salmonid attribute species sampling will be in coordination with
and conducted as a complement to previous Coastal America
restoration site evluations.
Vascular and non - vascular plants -- method of verification:
Restoration site construction will include planting of emergent
vegetation (sedge plants will be placed on one foot centers and
enclosed with low protective fencing to prevent grazing by
waterfowl) between plus 11 and plus 13 feet MLLW and riparian
trees (spacing approximately 10 feet) and shrubs (spacing
approximately three to five feet) above plus 13 feet MLLW to the
top- of- bankline. Please note that emergent plants at the
intertidal restoration site will be surrounded by low wire
fencing (approximately three feet high), held in place by small
steel posts, to protect the plants from grazing by waterfowl
during the first three years following site construction and
planting. The fencing proposed for use at the site is identical
to that in place at present at the existing Coastal America
demonstration intertidal restoration site. The success of the
emergent vegetation plantings and potential recruitment from
adjacent off -site locations will be evaluated yearly during the
first five years following completion of the site.
Because of the small area of plantings, approximately 14,000
square feet for emergent plants and 17,500 square feet for
riparian shrubs and trees, vegetation survey map plots will be
prepared for the .finished site, precisely locating each of the
plantings. These plots will be verified and referenced in each
monitoring period. Please note that riparian planting areas will
be irrigated as a temporary measure throughout the first three
years following construction of the proposed restoration project.
Because the proposed restoration site is located in an urbanized
estuary, emphasis is placed on creating a robust riparian buffer
as quickly as possible. Therefore, irrigation is expected to be
used to sustain plantings and encourage growth during dry weather
months (typically July, August, and September).

(5) Mitigation Plan -- Contingency
During the monitoring period the following verification tests will
be applied and results presented to the Corps of Engineers for
review. The Corps of Engineers will make the monitoring information
available to agencies and Tribes participating on the technical
review committee for review and comment. Based on comments
received, the Corps of Engineers will be responsible for
determining the performance of the restoration site with respect to
the monitoring elements listed below. The Corps of Engineers will
stipulate any changes in monitoring or corrective actions, with the
review of participating agencies and Tribes.
Water regime: An innundation profile of the constructed restoration
site will be prepared. Post- construction physical survey data,
based on two feet contour intervals, will be plotted against tidal
level information, creating a graph identifying the percentage of
daily water cover at the restoration site. If the innundation
profile, measured against the constructed elevations of the
restoration site as determined by post- construction site survey
data, alters by more than ten percent, particpating agency and
Tribal represenatives will conduct a situation analysis and
evaluate potential corrective actions to be performed by the port,
including re- configuring the site contours.
Accretion /erosion: If post- construction physical survey data
reveals greater than 1.0 inches of erosion or sedimentation in the
intertidal restortation site, measured between succeeding
monitoring years, particpating agency and Tribal represenatives
will conduct a situation analysis and evaluate potential corrective
actions to be performed by the port, including stabilizing erroding
banklines or aquatic area construction designed to ensure stable
site conditions.
Habitat structure: If post- construction assesement measures
indicate epibenthic and benthic invertebrate or fish use of the
area at levels twenty -five percent less than measured at adjacent
reference /control sites, particpating agency and Tribal
represenatives will conduct a situation analysis and evaluate
potential corrective actions to be performed by the port, including
expanding restoration area in the estuary to provide additional
intertidal fish and wildlife habitat area.
Emergent and riparian plants lost due to waterfowl grazing and /or
transplant mortality will replaced. If post- construction assesement
measures indicate less than eighty -five percent survival of plants
placed at the site, particpating agency and Tribal represenatives
will conduct a situation analysis and evaluate potential corrective

(6) Construction Schedule
It is anticipated that construction of the proposed intertidal
restoration site will begin in the winter of 1997/1998. Removal of
the derelict ferry hull at Turning Basin Number Three is expected
to be completed by March 1, 1998. Final excavation and planting at
the restoration site is expected in June 1998.

As you know, the port is preparing to construct the intertidal fish and wildlife habitat restoration
activities approved by your °Ince (reference File Number L93-0032). The project includes a
shoreline excavation site measuring approximately 1.5 acres. Existing filled upland area would be
excavated in order to restore approximately 1.3 acres of intertidal fish and wildlife habitat. In
addition, the project includes removal of an existing storage building on upland area at the excavation
site and removal of a derelict, burned ferry hull located on adjacent tideland. Removal of the ferry
hull is an important element of the port's intertidal restoration project. Demolition of the derelict hull
will restore Intertidal conditions in approximately 10,800 square feet in addition to the 1.3 acre
restoration excavation.
The port has worked closely with the Corps of Engineers and the Washington Department of Fish and
Wildlife to plan and design the fish and wildlife habitat restoration actions at Turning Basin Number
Three. Copies of the Corps of Engineers and Department of Fish and Wildlife permits for the project
are attached. In particular, actions necessary for demolition and reprove] of the derelict, burned ferry
hull have been approved by the Washington Department of Labor and Industries and the Puget Sound
Air Pollution Control Agency. Review of demolition activities by these agencies was necessary to
ensure that all aspects of demolition are fully controlled and meet with health and safety
requirements.
Removal of the ferry hull is clearly beneficial froth the perspective of aquatic fish and wildlife habitat
restoration. The demolition activity, as indicated in the attached state and federal permits, Is linked
with the larger Intertidal restoration excavation on the adjacent site. 11 is hoped that demolition permit
and haul route approvals front the City of Tukwila can be obtained by the port's contractor In order to
accomplish removal of the ferry hull. Since the ferry hull removal is part of a site-wide fish and
wildlife habitat restoration action, it is appropriate that demulition activities can be considered In light

provisions of the shoreline master plan.

The Port of Seattle proposes to restore approximately 1.3 acres of fish and wildlife habitat at Turning
Basin No. 3 to compensate for unavoidable impacts to a total of up to 1.1 acres of fish and wildlife habitat
that may be altered due to cleanup dredging and new dock construction, proposed in connection with the
Port's Southwest Harbor Cleanup and Redevelopment Project at Terminal 5 in West Seattle.
The current use, a construction equipment storage and maintenance operation, will be removed. The
existing building, concrete footings, paving, and utilities will be demolished. Existing upland, consisting of
fill material placed in former aquatic area of the Duwamish estuary, at the southwest margin of Turning
Basin No. 3, will be excavated to restore intertidal conditions at the site. Approximately 33,000 yd3 of
sand and soil fill material will be excavated landward of MHHW (11.5 feet MLLW), and approximately
2,400 yd3 will be excavated waterward of MHHW. Existing upland elevations of +12 to +22 feet MLLW
will be reduced to intertidal elevations of approximately +11.3 to +5 feet MLLW. Excavated materials,
consisting primarily of alluvial sands dredged from the former bed of the Duwamish estuary, will be placed
at approved off -site disposal locations. The total excavation area will be approximately 1.7 acres, yielding
approximately 1.3 acres of new exposed fine- grained intertidal sediment. Upper elevations of the intertidal
area (between +11 and +13 feet MLLW) will be planted with emergent marsh vegetation native to the
Duwamish estuary, and adjacent shoreline areas above the level of tidal influence will be stabilized using
native riparian plants.
A limited amount of structural shoreline stabilization is proposed. Approximately 260 yd3 of riprap and
crushed rock will be buried in a trench 1.5 feet deep between +9 and +10 MLLW. This will provide a toe
foundation for the bankline landward of +10 MLLW. The rock will be buried in the excavation slope and
the top level of the riprap will be flush with the excavation slope.

The Port will apply to the Corps of Engineers for a Section 10 and 404 permit immediately. The permit
application will include both the in -water work needed for the 400 -foot wharf extension at Terminal 5,
which has triggered the need for the off -site mitigation proposed in Item 1, as well as the in -water work at
Turning Basin No. 3. Separate applications for Water Quality Certification and Hydraulic Project
Approval are not needed, but are handled by the Corps in connection with the Section 10/404 permit
application. The Port is preparing to apply to the City of Tukwila for a Land Altering Permit/Utility
Permit for Flood Zone Control.

Nearby uses include barge moorage and loading operations to the north; waterborne transportation in the
Duwamish Waterway to the north and east; fabrication and manufacturing activities on the east shoreline
of the Duwamish Waterway; State Route 99 and an adjacent greenbelt further west of the site; and
construction equipment and vehicle storage south of the site.
