l95-0041 singh joe short plat TUKWILA MUNICIPAL CODE 17.04.050 Dedications. A. ACT OF DEDICATION: The intention to dedicate real property to the public shall be evidenced by showing the dedication on the plat prepared for approval. All dedications, including easements, rights - of -way and real property shall be clearly and precisely indicated on the face of the plat. Unless specifically noted otherwise on the plat, approval of the plat for recording shall constitute acceptance of the dedications. B. PUBLIC STREETS: All streets and parcels of land shown on the final plat and intended for public use shall be offered for dedication for public use, except the approving entity may allow the conveyance of certain public improvements to be conveyed to a homeowner's association or similar non - profit corporation. C. CERTIFICATE: If the subdivision includes a dedication, the final plat shall include a certificate of dedication or reference to a separate written instrument which dedicates all required streets and other areas to the public. The certificate or instrument of dedication shall be signed and acknowledged before a notary public by every person having any ownership interest in the lands divided and recorded as part of the final plat. D. TITLE REPORT: Every proposed final plat containing a dedication must be accompanied by a title report confirming that the title of the lands as described and shown on the plat is in the name of the owners signing the certificate of dedication. (Ord. 1833 §1(part), 1998) 17.04.060 Survey content. A. INFORMATION - Whenever a survey is submitted for a short plat or subdivision, the following information shall be included: 1. The name of the plat, City of Tukwila file number, graphic scale and north arrow. The survey shall be done to a scale of one inch equals 100 feet unless otherwise approved by DCD, and shall be drawn with black drawing ink in record of survey format. 2. Existing features such as rivers, streets, railroads and structures. 3. The lines and names of all existing or platted streets or other public ways, parks, playgrounds, and easements adjacent to the final plat, subdivision or dedication, including municipal boundaries, township lines, and section lines. 4. In the event the plat constitutes a replat, the lots, blocks, streets, etc., of the previous plat shall be shown by dotted lines in their proper positions in relation to the new arrangement of the plat, the new plat being shown in solid lines so as to avoid ambiguity. 5. Legal description of the subdivision boundaries. 6. A complete survey of the section or sections in which the plat or replat is located, if necessary, including: a. All stakes, monuments or other evidence found on the ground and used to determine the boundaries of the subdivision. Location and monuments found or reset with respect to any established centerline of streets adjacent to or within the proposed subdivision. All other monuments found or established in making the survey of this subdivision or required to be installed by provisions of this title. b. City or County boundary lines when crossing or adjacent to the subdivision. c. The location and width of streets and easements intersecting the boundary of the tract. d. Tract, block and lot boundary lines and street rights-of-way and centerlines, with dimensions, bearings, radii, arcs and central angles, points of curvature and tangent bearings. Tract boundaries, lot boundaries and street bearings shall be shown to the nearest second with basis of bearings. All distances shall be shown to the nearest one - hundredth foot. e. The width and location of existing and proposed easements and rights -of -way. 7. Lot and block numbers beginning with the number one (1) and numbered consecutively without omission or duplication. 8. Tracts to be dedicated to any public or private purpose shall be distinguished from lots intended for general development with notes stating their purpose and any limitations. B. STATEMENTS - The plat shall include the following statements: 1. A statement to be signed by the Public Works Director approving the survey data, the layout of the streets, alleys and other rights-of-way, design of bridges, sewage and water systems, drainage systems and other structures. 2. A certificate bearing the printed names of all persons having an interest in the subdivided land, signed by the persons and acknowledged by them before a notary public, consenting to the subdivision of the land and reciting a dedication by them of all land shown on the plat to be dedicated for public uses, and a waiver by them and their successors of all claims for damages against any governmental authority arising from the construction and maintenance of public facilities and public property within the subdivision. 3. The project site is located on the north side of 148th behind 4032 S. 148th Street. The first F-.D z time I was on the property was for a pre - application meeting in early 1995. Prior to the adoption of a new Zoning Code in December 1995, the City was using the 1989 Federal Manual (FICWD D On 1989). The new code requires the use of the 1987 wetland delineation manual in use by the U.S. .o co-- Army Corps of Engineers and U.S. Environmental Protection Agency since 1/1/95. ~` w w; I vi Using the 1989 manual, it appeared the subject depression had hydric soil characteristics as p: observed during my 1995 site visits. As reported by Bredberg & Assoc., the area does not iii z U exhibit hydric or wetland soil characteristics necessary to meet the 1987 manual wetland criteria. The primary difference in this case is the lack of hydric soil indicators occurring in the upper 10 z inches of the soil horizon or immediately below the A horizon, whichever is shallower. The submitted data indicates there is seasonal hydrology influencing this area but the hydric or wetland soil is not present. In summary, under the new Zoning Code requirements of the Sensitive Areas Ordinance there are no wetland areas on the subject property. Per our telephone conversation, a letter documenting conditions and verifying that no wetlands are present is provided. In addition, a soil test log and a data sheet for the area in question is provided. The site is located on the north side of 148th Street behind 4032 So. 148th Street. The site is a vacant lot with considerable historic disturbance in the surrounding areas. The lot is the last area in the neighborhood to be developed, with single family houses surrounding it. The disturbance affecting the subject property includes a substantial cut to the east downslope. The cut downslope intercepts ground water and tends to draw the water down from the subject property lowering the water table of the property. Upslope from the property, the area is urbanized with impermeable surfaces covering much of the area, being roads, roofs, and driveways, or lawns, likely compacted with minimal infiltration. P. 0. H Do o WW. = V, w N, o � Schultz Page 2 The result of the urbanization upslope is that during periods of rainfall large amounts of runoff reach the subject property. The area in question on the subject property occupies a slight concave position in the landscape. This further aggravates the surface runoff situation as urban runoff from the surrounding vicinity eventually reaches the area in question. Further aggravation to the surface runoff problem comes from the lack of adequate storm drainage along 148th Street. The storm drains are positioned that they do not catch the runoff and the neighbor occupying 4032 So. 148th Street complains that water sheet flows down the street and ends up on his property such that he has created gentle swales diverting it back to the subject property. Surface water is further noted as a problem by the people living downslope. During the winter months of rainfall, they have water in the backyards and according to the Public Works Department complain, and a solution is being sought to their winter high water table troubles. It should be noted that the houses to the east are 5-10 feet lower than the subject property. The construction of the houses many years in the past was done by leveling a building site which involved making a cut at the back of their lots. The cut at the back of their lots is the previously mentioned cut that intercepts ground water lowering the hydrology of the subject area. Additional disturbances to the area come from the on -site drainfields of the surrounding properties. When the houses were originally built in this area, each house was served by on -site septic drainfields.. Sometime in the recent past, sewer serviced these homes, they were disconnected from their drainfields and connected to city sewer. Drainfields are still in place and act as french drains by delivering water to the end of the drainfield. In speaking with the owner of the property directly south at 4032 So. 148th Street, he has indicated that his drainfield goes approximately 40 feet onto the subject property and ends at the edge of the area in question. From his description, the drainfield was repaired approximately 20 years ago and the subsurface line acts as a french drain collecting water from his lawn and around his house and discharges it into the area in question. There is probably a similar situation occurring with houses upslope. At the time I 936 V a j b/s m h/3/ 15/98 Schultz } Page 3 these drainfields were installed, they would have been gravity drainfields, and as the subject area is in a concave landscape position and downslope from several of the houses to the west, their drainfields would likely culminate in a position that would discharge into the area in question. The result of the drainfields discharging water would be the added hydrology to the area in question. This would be most evident during winter weather and periods of rainfall. VEGETATION Vegetation of the site is dominated by reed canarygrass in the area of concern. Around the fringes of the area of concern are fir trees, non- native pines, red alders, and Himalayan blackberry vines. According to the neighbors, this area has historically been maintained as a garden and mowed as a lawn. SOILS Accompanying test hole 1 shows there is a thick, dark A horizon underlain by a dark BW with a dark C horizon farther below. The thick, dark soils present are a result of the landscape position being a concavity providing for deposition from the surrounding area. This area has historically been used as a garden explaining high organic matter build -up as 50 or more years this area was heavily gardened. The dark black soils would also provide for excellent garden material providing further incentive to work the. area. From the test pit, it should be noted that no common distinct mottles were observed. The lack of distinct mottles indicates the water table is not in place long enough to form distinct mottles, rather it is there for short periods during the colder winter months to form faint mottles. As the water table may be high in the winter months, it is not high enough during the growing season to meet wetland criteria. The silt loams of the upper horizons have moderate permeability with moderately rapid permeability in the gravelly sandy loam subsoil. This is important to understand as the deeper one goes in the soils, the more rapid the permeability. Therefore, the surface has lower permeability than the subsurface which allows for drawdown. Hydrology observed in the field has water sitting on the surface and detained by the upper several inches of the horizon, but the subsurface is not saturated. ,Therefore, water observed in the field in the upper part is present for a short period, while the deeper one digs, the less water present due to the better permeability. Keep in mind the permeability of the soils in understanding hydrology and the previously discussed cut bank at the east side of the property. HYDROLOGY Hydrology of the subject area has been altered by the 2-5 foot cut bank along the east property edge. As mentioned in the soils section, the soils are gravelly sandy loam at depth providing moderately rapid permeability. The moderately rapid permeability provides a flow of water to the cut bank, pulling water from underneath the subject area. Several test holes were dug in the area of which a representative test hole is attached to this letter. The soils tended to be uniform with an intermittent saturation of the soil in the upper part. The intermittent saturation refers to water moving through the macropores but not occupying the micropores, thus lack of saturation. Also, there are 1 or 2 inch lenses in the upper part that are saturated with unsaturated areas between. According to the 1987 and 1989 Federal Manuals, a 6 inch water table in the upper part is required to meet wetland hydrology criteria. During our site evaluation, we did not find a 6 inch thick water table; it was 2 inches thick or less, which does not meet wetland hydrology criteria. • The intermittent saturation is confusing to evaluate in the field. If a hole is dug, water will move through a worm hole or macropore and fill the hole to near the surface. However, in digging the hole it will be quite evident that the majority of the soils in the hole are not saturated and we are just observing water from the recent rainfall. 1936Uajb/smh/3/15/96 ,•• Schultz Page 5 The site was evaluated on March 12 and 14, 1996. On March 12, the site was considerably wet as it had rained within the previous 36 hours, whereas on March 14, it was considerably drier with less water moving through the macropores. This is as one would expect with the approximately 1 inch of rainfall on March 10 and 11, and the moderate and moderately rapid permeability that carries the water down through the profile. SUMMARY From the site evaluation on March 12 and 14, taking into account hydrology and recent rainfall conditions, it is determined the area is not a wetland. It does not meet wetland criteria as it lacks hydrology and hydric soils. No water table was present within 18 inches of the surface. Furthermore, the soils contain no contemporaneous redoximorphic features. This includes common distinct mottles and /or oxidized root channels. The project site is located on the north side of 148th behind 4032 S. 148th Street. The first time I was on the property was for a pre- application meeting earlier this year. The small depression area is identified as a potential wetland because it has vegetation dominated by wetland tolerant plants (reed canarygrass). The soil conditions in this area also appear influenced by seasonal wet conditions. I sampled soil in the subject area and to the north about 30 feet. I observed some change in vegetation that . could indicate the reed canarygrass area is much wetter from surface inundation or groundwater saturation. The significant change in soil characteristics between the two areas also indicates possible wetland conditions. It appears the area in question could exceed the 400 square -foot exception size for wetland use and would be subject to the Sensitive Areas Ordinance (TMC Chapter 18.45.115 & 18.45.08(c)). The SAO requires studies on sites with sensitive areas and these may only be waived by the Director of Community Development. Since the potential wetland is within a lot to be developed, a wetland study is required. On August 8, 1995 we had a telephone conversation and you informed me a wetland study would be conducted for the short plat application. This only needs to be a reconnaissance level study to determine wetland area.
