The maker of this instrument, Jeffrey Naughton, is the owner of all of
the following described Real Property:
The South 70 feet of Lot 2, measured on the East line of Block
6, RIVERTON ACRE TRACTS, according to the plat thereof
recorded in Volume 11 of Plats, Page 100, in King County,
Washington;
EXCEPT that portion thereof conveyed to King County for road
by deed recorded under Recording Number 2649131.
Together with an easement for ingress, egress and utilities as
disclosed and delineated by instrument no. 810 5110 3 0 5.
Whereas the maker desires to provide for the sharing of the costs of
maintenance and construction of the easement for ingress, egress,
and utilities delineated by instrument no. 8105110305 and for the
additional easement areas shown in the Survey Map and legally
described therein under PRIVATE EASEMENT for the Naughton Short
plat which is attached hereto and a part of this covenant; the maker
declares a covenant upon lots 2 & 3 of the Naughton Short Plat for

Dear Mr. Walsh:
Thiis to respond to your written communications to Jack Pace on May 6,1996, to Jack
Pace and Ron Cameron on May 9,1996, and to Steve Lancaster on May 9,1996.
In these documents and in your discussions with various City staff, you have raised two
general concerns. The first pertains to the short plat appeal process, the second pertains .
to the granting of exceptions to the minimum road width and access easements.
Appeals
As John Jimerson recently told you in a telephone conversation, the short plat letter of
approval was issued on march 13, 1996. That letter represented the official approval of
the short plat and of the exceptions to the roadway easement and pavement width
standards. Title 17 allows for this decision to be appealed within ten days of the date of
decision. Since no appeals were received by March 23, 1996, the approval became final
on that date.
You have indicated that your wife was given inaccurate information as to the status of
the approval. To our knowledge, the only time you or your wife called and received
incorrect information was about two weeks ago, and that was corrected later that day
when you spoke to John Jimerson. We have received no written communications from
you, and the City staff has no recollection of any verbal communication with you or
your wife prior to the day mentioned above.
Finally, we have no record that indicates you ever requested to be notified of the
decision. After reviewing the situation with our attorney, we have concluded your
request for the decision to be reconsidered was not filed in a timely manner and
therefore, does not constitute a valid appeal.

Easement and Pavement Width Exceptions
I would like to address your substantive concerns with respect to the granting of the
exception. The Short Subdivision Committee, which consists of the Fire, Community
Development and Public Works Departments, approved a reduction to allow a 15 -foot
wide easement and paved access road.
The first point is to clarify the private access roadway standards. The easement width
standard is 30 feet. The reason for the 30 feet is to accommodate potential future public
roads. However, reductions have been granted to this width in situations where we do
not expect the need for a public road at that location.
The twenty foot standard is for the roadway paving width, which is usually narrower
than the easement in which it is located. In this case the roadway was reduced to 15 feet
because of the structure and tree constraints located on the Naughton property. You
have indicated that the shed has since been moved and now there is room for widening
the paving. However, that was not the circumstance that existed at the time of
approval. The Subdivision Ordinance does not authorize the City to prevent the owners
from moving the shed nor to change the conditions of the short plat approval after the
fact.
We too are concerned with site distance and safety issues. In making field visits during .
our review, City staff did not identify any visibility problems at this site. Even with
your fence extending five feet into the Military Road right -of -way, there is adequate
room between your fence and the edge of Military Road which provides the visibility
needed for safe turning movements.

Mr. Walsh explains that Mr. Naughton mis- represented hardship in his request

The 15 foot pavement provides the 12 foot minimum and assumes utilities are
provided within the 15 feet.
Mr. Walsh requests a full 20 foot improved easement with Mr. Naughton providing

written•to provide access to the Naughton property.
Our approval of waiver was conditioned on Fire approval, that utilities are
included...Mr. Walsh explains that sewer has been located on the Naughton side,

At the time of the original Short Plat application and the request for an

the road in question. I made the determination that it was adequate as an
exceptional case.
I understand from Mr. Walsh that the shed and tree have been removed since the
original application. However, this does not change my original assesment
based on the conditions at the time of application. The 15' road leads to a
20' wide road with a turnaround that meets the intent of our requirements.
You might want to see if Public works gave him an exception to their turning
radius requirements for street access and their sight distance requirement.

Mr. Walsh and his wife have been extremely distraught about
the development of my land since sometime before I even made an
offer to purchase the property in September of 1994.
Susan Walsh welcomed me to the neighborhood by hustling out
of her back door with a red face - talking loudly, quickly, and most
rudely about her perceived status of this very access easement. I
made her aware then, of my intentions to research the easement and
to use it as originally intended for access to new homes which would
likely increase her home's value.
Relations since have not improved, in fact, after multiple
threats to dial 91.1 for using the easement, one actual visit by
Tukwila police for using the easement, a frivolous complaint to Val
Vue Sewer District, the closing off and posting of one of my gates, the
accosting of the US West Serviceman who was trying to install an
additional line, the obstructing and idling of one heavy equipment
operator, and almost weekly lesser interludes, relations have
deteriorated to mostly a shouting and cussing match of which I am
not proud but not ashamed of either. Most normal people would be
at their wits ends too.
Now I find myself responding to frivolous and unfounded
eleventh hour pleas by this fully informed neighbor after going
through all the proper channels, receiving preliminary approval, and
having invested thousands of dollars to install the required
improvements, and after unilaterally incurring significant extra
expense to try and keep the complaining party at bay. Here are the
facts as I see them relating to Mr. Walsh's recent complaints and

challenge to the road width exception. I hope they will help you
defend the City's position as communicated to me.
My Kennel, 7 cemented posts, 2 gates, and a small cement
retaining wall (scheduled to be a much more substantial wall later
today) exists just as it did before, except that two pieces of mesh
have temporarily been removed in order to, as carefully as possible,
dig a utilities trench through the area in an unsuccessful attempt to
keep Roger Walsh from going ballistic.
I reckoned that with the Walsh's history of complaining, my
headaches would be less if I simply granted a few extra feet of
- utilities easement only- to the new owners, Bill and Claudia Buttler.
We opted not to dig in the paved area to avoid confrontation. Even
after this, Mr. Walsh objected and phoned Tukwila City police.
My trees are still here as well, and I still like them and don't
have the money to move them. While $800.00 may be pocket
change to Mr. & Mrs. Walsh, it is still real money to me. I do not
have the luxury of "eating in" for just a few extra days to adjust my
budget. I am tapped.
True my very large "immobile" shed was successfully moved,
but three of the four bedrooms in my house are still next to the
access road and do not need to be any closer.
I moved the shed to accommodate Mr. Walsh even though it
required a 6000 LB Fork lift and construction of two retaining walls.
One using 3 tons of quarry rock so as to have another out of the way
place to set it and the second which will be two+ yards of poured
concrete to keep the easement road from sloughing into my yard
which is of a different grade. (The previous rock retaining wall had
to be destroyed to set the sewer lines outside of the existing
easement so as to minimize Mr. Walsh's wrath but near enough to
meet set back requirements from my own home for the sewer
district).
This all could have been avoided by digging in the paved
utilities easement but I did not want to upset Mr. Walsh anymore.
He still is not happy.
Mr. Walsh claims "near accidents" which are a result of the
"blind" 90 degree corner where his short triple car width driveway
meets the easement roadway. I am aware of no such near accidents
and cannot attest as to weather or not he is blind, but his corner does
not appear to be unreasonably so. However, if he is actually
concerned about this, perhaps he should alter his solid 6'+ fence
which he built to create the corner around which he claims he cannot
see.
Additional road width on the far side of the easement would
not alter this condition anyway since we are accustomed to driving
on the right hand side in this country. The approaching cars about
which Mr. Walsh is complaining would always be on the "blind" side
of the road.
As for fire access, I am already providing a hammerhead
turnaround where there was previously none, and Chief Alderson
assured me months ago when I asked him to help me layout the new
turnaround, that the first section of roadway which is fully paved 15'
wide would be plenty of room to get his equipment in and out, in
case of an emergency. In addition the city is requiring that any
structures built on the new lots be sprinkled thus lessening the
likelihood of even needing large fire vehicles down the easement at
all. Mr. Walsh's brick home will be status quo, plus turnaround, and
Still on Military Road within 200' of a fire hydrant.
A picture says a 1000 words about whether or not two cars can
pass each other in the narrowest part to the access road, so I will
leave it to you to draw your own conclusions. (See enclosed picture.)
Before I conclude and because a copy of this is being sent to
Mr. Walsh, I would also like to address Mr. Walsh's cruel use of Tony
Lo. Mr. Walsh is a judgment creditor of Tony's over another dispute
involving this very easement between those two. And Tony Lo,
although a restaurant owner, has a difficult time with English and I
doubt very much he can fully comprehend Mr. Walsh's letter but has
communicated to me that he is happy to be my neighbor.

The intent of this document is to show clear discrepancies in the "Request for Exception
to Road Width Requirement ", letter submitted to Tukwila's planning by Jeffrey Naughton.
Point 1)
Mr. Naughton states, "Both sides of the exception area now have fences. ".
In order to connect his required sewer systems, Mr. Naughton has already
removed a large majority of his fence. Only three galvanized poles and one
wooden post remains on the south side of his property.
Point 2) Mr. Naughton states, "In addition, there exists a large shed and ".
The "large shed" that Mr. Naughton refers to has already been pickup and
moved to another area of his property.
Point 3) Mr. Naughton states, "In addition, there exists a large shed and trees with
double trunks, each with diameters greater than 10 inches which would be
in the roadway even if the fences were removed to widen this section of
easement. ". I have contacted a company that specializes in moving trees.
The "trees" in question would cost $350 to $400 a piece to be moved.
Point 4) Mr. Naughton states, "Without this exception to the roadway width
requirements the newly proposed lots would essentially be landlocked. ".
Why must there be a total exception to the 30 foot requirement? He can
give an excess of seven feet.
Point 5) Mr. Naughton states, "It would be an exceptional hardship to grant
additional width to the easement. ". Does moving two trees (at most $800
+tax in cost), taking down a few poles and a wooden post really constitute.

Request for Exception to Road Width Requirement.
Planning Director:
I am asking to use a 15' right -of -way easement which has been in
existence for many years to partly serve two lots. All of the newly
proposed easements for access are 20' wide and have corners
rounded by a 20' radius to make it easier for fire trucks to turn
around.
However, the access to these new and larger roadways is via 120'+/ -
existing and fully improved (paved to 15' wide) roadway. No eves or
branches obstruct any section of the roadway. Many adjacent
improvements have been made however since the easement was
granted in May of 1981. It would now be an exceptional hardship to
grant additional width to the easement.
Both sides of the exception area now have fences. In addition, there
exists a large shed and tree with double trunks, each with diameters
greater than 10 inches which would be in the roadway even if the
fences were removed to widen this section of easement.
The logical alternative would be to access the new lots on the north
side, however, the foundation and north wall of the existing house is
only 12 feet from the property line and is obstructed by overhangs
from a tree just across the line with a trunk of greater than 30 inches
in diameter.
The best alternative is to use the existing 15' roadway to get to the
newly proposed section of access road. Without this exception to the
roadway width requirements the newly proposed lots would
essentially be landlocked.

I am writing this letter to express my concerns pertaining to the approval of short plotting
property owned by Jeffrey Naughton at 13216 Military Rd South ,Seattle, WA, 98168. I
have a direct interest in the approval since the easement property that Mr. Naughton is
planning to use for the additional houses is owned by my wife and I.
As soon as my wife and I became aware of Mr. Naughton's intentions to short plot his
property, in January of 1996, we actively pursued voicing our concerns to Tukwila's
planning office. We did this by calling the office every week to check its status. Each
time, we were told that the short plot had not been approved and that no engineer had
been assigned to the project. 4Today, I even spoke with Ann Siegenthaler to inquire on its
status and was told that the short plot had not been approved. Later, I learned that this
was incorrect, as the information system used for status visibility had not been entered
correctly. Since the status was entered correctly today, I should be granted the customary
ten day appeal period.
Prior to Mr. Naughton's purchase of the property, the easement supported two single
family homes. Mr. Naughton has since removed a section of his fence to allow his multi-
family- dwelling access to the easement and now plans on adding two additional homes.
All of this without increasing the width of the original easement.
My concerns pertain to the topics of both safety and convenience. Increasing the number
of dwellings using the easement will indisputably increase the amount of traffic. We have
already had a number of near accidents due to people attempting to pull off of a busy road,
Military, into the easement while another vehicle is moving up towards it. There is also a
blind 90 degree corner coming out of my drive onto the easement which presents a
potential hazard. To facilitate a safe and speedy access to homes, Tukwila Fire Protection
requires a width of twenty feet. Finally, since fifteen feet is not wide enough for two
vehicles to pass, we often have to back down to our driveway to allow cars to go by.

By simply widening the easement, vehicles entering and exiting Military Road could be
given their own lane and cars traveling past my drive could be given a wider berth. This
would significantly reduce the hazard potential and comply with Fire Protection
guidelines.
Mr. Naughton has requested an exemption of Tukwila's standard easement width of thirty
feet. True, he does not have fifteen feet between his house and the current easement, but
*he does have an excess of seven feet to give.
In conclusion, I am formally requesting: 1) reconsideration pertaining to Mr. Naughton's
approval to short plot his property without increas ?ng the width of the existing easement.
2) that you inform Mr. a ghton to cease his required improvement work until our right
to influence thi •'short Frprocess has been fully exercised.

The Short Subdivision Committee has completed review of your short
plat application (No. L95- 0071), and based on the submittal,
preliminary approval is granted subject to the conditions stated
below.
There are three basic steps in the short plat approval process:

1. Preliminary Approval
This letter constitutes your preliminary approval. The..
application was reviewed, by the Tukwila Short Subdivision
Committee and approved with conditions. The conditions
imposed are to ensure the short plat is consistent with the
City's policies and regulations.
PRELIMINARY APPROVAL CONDITIONS
Utilities
1. Drainage design for Lot 2 and Lot 3 shall meet City of Tukwila
Surface Water Ordinance Requirements. Contact Joanna'Spencer.
at 433 -0179 for submittal and design requirements.
2. Pursuant to the Tukwila "underground ordinance ", all utilities
shall be placed underground.
3. Extension of the sewer and water lines to the lots shall be
approved by the appropriate utility. As -built plans shall be
provided to the Public Works Department.
Access
4. The access easement and fire turnaround shall be paved for a
minimum of 15 feet wide to Public Works and Fire Department
standards.

Fire Protection
5. The Prior to development of either Lot 2 or Lot 3, the .
following will be required: If there is no fire hydrant within
250 feet of all building sites, then the developer shall
either install a fire hydrant capable of pumping 1000 gallons
per minute OR the future houses will be required to provide
interior sprinklers, to be approved by the Fire Department.
This requirement must be stated on the face of the recorded
plat, and must be met prior to issuance of any building
permits for Lot A, Lot B, or Lot C.

8. Submit a legal description of the access /utility easement.
This easement shall also be included in the Joint Maintenance
Agreement.
9. Install all required site improvements, including those
proposed in the short plat application and those identified
above as a conditions of approval.
You will need to obtain all required permits prior to beginning any
construction. For water and sewer permits, contact the individual
provider District. For City of Tukwila utilities, contact Joanna
Spencer of Public Works at 433 -0173.
Expiration
10. The final approved short plat must be filed with the King
County Department of Records within six months from the date
of this preliminary approval, September 13, 1996, otherwise
the application will expire. The City may grant one six month
extension if requested in writing prior to the expiration
date.
2. Final Approval
The next step is to submit the necessary short plat documents
(survey, plat map, and other required paper work), comply with
the conditions of approval and install the required site
improvements. Installation of the site improvements may be

delayed up to six months beyond final approval when a
financial guarantee is provided to ensure installation.
After the documents have been found to be in order, and the
all of the requirements of the short plat have been met, the
Chairman of the Short Subdivision Committee signs your short
plat which constitutes a grant of final approval.
Recording
It is your responsibility to record the City approved short
plat documents with the King County Department of Records. The
short plat is not complete until the recording occurs and
copies of the recorded documents are provided to the
Department of Community Development.
The signature of the Chairman of the Short Subdivision
Committee certifies that your short plat application is ready
for regarding. You will need to pay the recording fees and
submit your approved original short plat to the King County
Department of Records (296- 1570).
After recording, the County returns the recorded original to
the City of Tukwila within 4 -6 weeks, at which time your short
plat is considered complete. You can shorten this processing
time by hand - delivering a copy of the recorded short plat to
me.
In many circumstances, building permits on the short platted
property may not be issued until a copy of the recorded short
plat (or original) is returned to the Department of Community
Development.

The Engineering Division has reviewed the submittal and has the following comments:

Military Rd. S. in the vicinity of the proposed short plat currently has
eight foot paved shoulders and no further improvements are planned
or required at this time.
2. Should the short plat applicant need to improve the access road to the
short plat within the right -of -way of Military Rd. S. the applicant will
need to supply drawings of such improvements to the City of SeaTac
Engineering Division for review and approval and obtain a right -of-
way construction permit from the Engineering Division for their
construction.

Planning Director:
At my pre-application meeting, I was told that I should obtain a
"Road Use Permit" from the City of SeaTac because my proposed
short subdivision is near Military Road.
At the City of SeaTac I consulted with Dixie Hallenberger, Engineer
Technician, in the Public Works Department Engineering Division,
241-1996. Professional business card attached.
Mr. Hallenberger has informed me that I will not need a City of
SeaTac "Road Use Permit" because the access to the proposed (read
extra) lots is via an existing private driveway on the Tukwila side of

Additional Parameters for Public Sewer Hookup
Location of Sewer discharge pipes from the proposed lots has been
denoted on the Surveyor's Map.
Discharge pipe will be 2" diameter PVC (one from each pump station)
or other material as specified per Val Vue Sewer District, to achieve
minimum scrubbing velocities. Pipe from future houses to each
pump station will be 4" or better DVW or other material as specified
at that time by Val Vue Sew District. Pipe will have a minimum
depth of 24" from the surface and cleanouts at the stub. Both
discharge pipes will connect with the existing 6" stub in Military
Road at a Depth of 12'.
Each pump station will be equipped with an SK60 or larger pump
and each pump station will be attached to two separate breaker
switches, one for pump operation and the other for the alarm, per
Val Vue Sewer District standards. Details of identical pump stations
and pump performance data sheet is attached.
