This Road Right -of -Way Dedication is made and given this

separate estate (GRANTOR), to and for the b t of the CITY OF
TUKWILA, a Washington municipal corporation (the "City").
In recognition of the benefits we receive as users of the improved
facility, the sufficiency of which is hereby acknowledged, Grantor hereby
conveys and quitclaims to the City, right -of -way for the purpose of
construction and perpetual maintenance of roadway improvements and
perpetual use by the public of public sidewalks over that property referred
to as Dedication_Parcel MOD, and more particularly described in
Exhibit A attached hereto and incorporated herein by reference (the
"Right -of -Way Dedication ") as shown on Exhibit B attached hereto and
incorporated herein by reference.
Together with the right of entry upon the abutting land for the
purpose of reconstructing existing driveway approaches, minor
construction and regrading as required for constructing sidewalks, curb
and gutters,. sloping banks, retaining walls, adjusting existing fences, and
other property restorations that are required to match the proposed
improvements. Upon completion of the improvements, the abutting
property will be restored to its original condition as near as may be done.
The terms and conditions of this right -of -way dedication shall be
binding upon and inure to the benefit of the City, Grantor, and their_

However, Jim has not submitted a Statutory Warranty Deed. Do you
need this?
Public Works did not previously require Jim to sign a Statutory
Warranty Deed as a condition of short plat approval. Now we are
near to final approval of the plat. If you do need a Statutory
Warranty Deed, you will need to make separate arrangements with Jim
asap, so that it does not delay his short plat approval.

Dear Mr. Johnson:
The Department of Community Development has completed a preliminary
review of your Short Plat (subdivision) application. Prior to
approval, your proposal must comply with the Subdivision Code,
Zoning Code, and other Tukwila code requirements. There are three
basic steps in the short plat approval process:
1) Preliminary approval: Your application materials (survey
and other short plat documents) are reviewed by the Tukwila
Short Subdivision Committee;
2) Final approval: After preliminary approval, the Chairman
of the Short Subdivision Committee certifies (by signing
your short plat) that all documents and necessary site
improvements are in order; and
3) Recording: You submit all documents to King County for
recording.
Below are the requirements for a complete application and
preliminary approval by the Short Subdivision Committee. Following
this list are the requirements for final approval and recording.
REQUIREMENTS FOR PRELIMINARY APPROVAL
Structures:
1. The existing shed appears to be located on the same
lot as the existing house. The proposed short plat
would locate the shed on a lot by itself (Lot 2) .
However, the Zoning Code does not allow a shed on a
lot by itself. Under the code, a shed is not a
"principally permitted use" on a single - family lot.
A shed is considered an "accessory use" to the primary,
use of the lot for a single family home. An accessory .
use must be "located on the same lot as the principal

use and is subject to the regulations affect ng the
main building" (TMC 18.12.040; also TMC 18.06 870).
Based upon these code requirements, we cannot approve
a short plat which places the shed on a lot wi hout a
single - family home. To obtain City approval .f your
proposal, you will need to do one of the foll. wing:
• Option A:
Relocate the proposed lot line such tha the
shed is on the same lot as the existing house.
• Option B:
Your other option would be to have your su eyor
add a notation to the survey map as fo lows:
"shed to be demolished, unless new home
constructed on Lot 2 within 1 year of approval
of the short plat." If a house is not
constructed, the City will require y'u to
demolish the shed. If you choose this option,
you will need to post a bond (or cash
assignment, or letter of credit) for 150% .f the
cost of demolition (see Requirements for Final
Approval, below).
• Option C:
Demolish the shed prior to approval of your
short plat.
Streets /access:
2. Your survey map should show the access drive to the
existing house and the location of the drivewa to Lot
2. Please note that driveways must be a minim of 20
feet wide, with a paved "apron" for a distanc- of 20
feet from the back of the 42nd Avenue sidewalk line.
Public Works requires that you show on your survey
that future driveways will meet these require ents .
Utilities:
To ensure adequate provision of utility servic s, our
Public Works Department requires revisions t• your
application, as noted below.
3. Your short plat application must demonstra e that
adequate water and sewer service will be p•ovided.
Therefore, your survey map must show for each lot the
location and size of water and sewer lines, 1•cation

of water meters, and how water and sewer lines will
connect to the mains. Show existing and proposed
improvements, and any necessary utility easements.
For example, you will need to show on your survey the
easement for the sewer main which is located south of.
Lot 2, and details for the side sewer stub. Include
any necessary easements in your legal descriptions
also. Please note that the minimum width for
utilities easements is 10 feet.
4. Your short plat must also provide for storm drainage
for all lots. This will require a storm drainage
plan, drawn by a licensed engineer, showing existing
and proposed storm drainage improvements and
easements, including detention or conveyance systems..
Detention must be adequate to meet pre-development
conditions, and must be designed consistent with the
King County Surface Water Design Manual and Tukwila
drainage basin studies. For more information on storm
drainage requirements, please contact Phil Fraser in
our Public Works Department at 433 -0179.
5. Show the lowest floor elevation of any future home on
each lot, based on the NGVD datum of 1929.
6. If utility or access easements are needed, a Joint
Maintenance Agreement is required to identify which of
the properties will have responsibility for
maintaining commonly used utilities (i.e. storm,
water, sewer, any shared access). This Agreement can
be written into your easement descriptions, or
included as a separate document. A sample form is
attached.
Please contact John Pierog in our Public Works Department
(433 -0179) for further information on utilities
requirements.
Survey revisions:
7. As noted on the application form, your survey map'
should show the total area (in square feet) for both
lots. Revise your survey to include this, and any
other revisions s noted above. Submit this revised
survey map with a original surveyor's signature.
To complete your application and obtain preliminary .
approval, the items listed above must be completed, and the
requested revisions submitted to me. Your application will

then be forwarded to the Short Subdivision Committee for
preliminary approval. The Committee will review your
application at a public meeting, and may approve, approve
with modifications or deny the application (TMC
17.08.060(d)(2)).
The decision of the Short Subdivision committee is final,
unless an appeal is filed. Any appeal must be made in
writing to the Department of Community Development within
10 (ten) days of the Committee decision date, and should
include an explanation of the basis of the appeal. The
Planning Commission will review the appeal within 40 days
(TMC 17.08.060(d)(3)). .
REQUIREMENTS FOR FINAL APPROVAL
After preliminary approval by the Short Subdivision
Committee, you must demonstrate that all required site
improvements are complete. To do this, you will need to do
the following:
1. Install all required utility service improvements.
This includes water and sewer lines up to each lot
with lot stub -outs, and any storm drainage elements.
Please note that the Tukwila "undergrounding
ordinance" requires that all utilities be placed
underground.
2. Demolish the shed on Lot 2, if you choose that option.
3. Obtain all required permits prior to beginning any
construction or demolition. For sewer and water line
permits, contact the individual provider District.
For information on demolition permits, you may contact
Ken Nelson in our Building Division at 431 -3670.
Please note that driveway construction should be
consistent with improvements planned for the upcoming
42nd Avenue street improvement project. Please
contact the project manager, Ross Heller of Public
Works at 433 -0179 to ensure coordination.
4. Provide me with copies of water meter receipts and
side sewer permit from the individual provider
Districts for serving all lots.
5. Notify me when all of these items have been completed,
so that the City can conduct a final inspection.
Alternatively, you may provide assurances for .future
completion of these improvements through posting of a bond

(or Assignment of Account, or Letter of Credit) for 150% of
the .construction cost. This requires a contractor's
written estimate of work to be completed. If you choose
this option, please contact me for information regarding
necessary forms.
Please note that, from the time the Short Subdivision
Committee gives preliminary approval, you will have a
maximum of six months to complete the . above items.
Otherwise, your current application will expire and a new
application will be required.
When these items have been completed to required standards,
the Chairman of the Short Subdivision Committee can give
final approval to your short plat. This usually occurs
within approximately one week of notice that conditions are
completed.
REQUIREMENTS FOR RECORDING
The signature of the Chairman of the Committee certifies
that your.short plat application is ready for recording.
You will then need to submit your approved short plat to
the King County Department of Records (296- 1570).
The County returns the recorded original to the City within
4 -6 weeks after recording, at which time your short plat is
considered complete. You can shorten this processing time
by hand - carrying to us a copy of the recorded short plat.
A copy of the recorded short plat (or original) must be
returned to the Dept. of Community Development prior to
issuance of any building permits for the new lots.
