Public Works staff reviewed this matter and brought it to the attention of the Utilities Committee with a recommendation to declare an emergency, stabilize the river bank •supporting the US West pole /fiber optic cable and vault; carry out a permanent fix for the affected area; and, apply for CORPS SECTION 14 FUNDS to have other sections of the.E Marginal Way S river bank restored through the CORPS. At the April 4, 1994 Council meeting, Resolution 1295 was passed, declaring an emergency to deal with the river bank erosion repairs and authorizing emergency expenditures based on an initial estimate of $50,000. ANALYSIS: The following activities have occurred as the City's response to this emergency: 1. Public Works maintenance. staff carried out temporary stabilization of the river bank using ballast, small rocks and sandbags to protect the US West pole, fiber optics cable, vault and E Marginal Way roadway shoulder. 2. Public Works engineering staff contracted with Entranco Engineers to carry out necessary survey and provide base maps and sections in the slough area. 3. The survey, base maps and sections were completed by Entranco Engineers last week. 4. Public Works staff have developed a preliminary plan which is now being circulated for comment. 5. Last week Public Works engineering and CORPS took a boat tour at low tide ( -2.7) and went up the river to assess the slough and the entire river bank from the Ox Bow Bridge (S 102.St) to RECEIVED MAY 1 01994 COMMUNITY DEVELOPMENT Info Paper May 4, 1994 page two the Boeing Access Road (video of this section will be shown at Utilities Committee Meeting). The purpose of this trip was to further evaluate the scope and nature of the slough out at US West pole; and, to provide CORPS representatives with an assessment of erosion and unstable soils problems along the east river bank from the Ox Bow Bridge to Boeing Access Road. 6. Based on the field investigations, including the recent boat ride, staff have developed a preliminary estimate for the immediate fix. The cost of this fix is $100,800 (see attached preliminary estimate). The reason for increasing our original estimate is that the riprap that we had observed from across the river, upon closer inspection at low tide, turned out to be only small rocks which needed to be replaced with larger structural size riprap for an additional 60 feet. This doubled the amount of riprap and river bank to be rehabilitated. '7. Public Works staff have submitted requests for waivers for environmental and shoreline to the Department of Community Development. Once the environmental process is complete, submittal for the HPA to State Fish and Wildlife and submittal for the Nationwide Permit to the CORPS will take place. The HPA and CORPS process takes six to eight weeks. It is not anticipated that the permits will be required and the construction contract will be bid July 15, 1994. RECOMMENDATION: Continue with the design' and permitting process. Refine estimate and report back to the Utilities Committee with budget transfer for final estimate. WHEREAS, a substantial amount of erosion has occurred on the Duwamish River on the west side of East Marginal Way South, approximately 300 feet north of the Boeing Access Road within the last week to ten days; and WHEREAS, the erosion undermined a portion of East Marginal Way South roadway shoulder and threatened the stability of U.S. West fiber -optic cable, pole and vault; and WHEREAS, another rain storm or high river and draw down event may further undercut East Marginal Way South and may topple the pole; and WHEREAS, the pole may fall into traffic of East Marginal Way South, a high volume traffic corridor, and the transmission line which serves the Boeing Aircraft Company may be broken and services disrupted; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: Section 1. Heavy rains have accelerated erosion of the Duwamish River's east bank approximately 300 feet north of the Boeing Access Road, necessitating immediate emergency repairs to stabilize river bank and preserve existing utilities. Section 2. Competitive bidding requirements are hereby dispensed with and the Mayor is authorized to expend an estimated $50,000 from the Surface Water Management Fund to construct erosion controls and provide temporary stability. March 1994. The cave -in has de- stabilized adjacent portions of the riverbank, and threatens the right -of -way, a utility pole and fiber optic cable. To pursue immediate repair, Public Works is requesting an "emergency" exemption from SEPA and Shoreline permit requirements. This is similar to the emergency exemption DCD approved last year for the South 104th street riverbank. Without immediate action by Public Works, there is a risk of further riverbank sloughing and damage to infrastructure. Public Works needs an emergency permit from the Army Corps of Engineers. To obtain that permit, Public works must demonstrate that they have the Fisheries HPA and appropriate SEPA. and Shoreline "approvals." The HPA cannot be issued until SEPA and Shoreline review is complete. The normal review processes for SEPA and Shoreline permits will prevent timely remedial action. EMERGENCY EXEMPTION PROVISIONS: SEPA allows exemptions for "actions that must be undertaken immediately or within a time too short to allow full compliance with this chapter, to avoid an imminent threat to public health or safety....or property..." (WAC 197 -11 -880). Shorelines Mgmt. Act exempts "emergency construction necessary to protect property from damage by the elements..." or to correct imminent threat to public health, safety...within a time too short to allow full compliance...(WAC 173 -14 -040). SHORELINE AND ENVIRONMENTAL IMPACTS: The project meets the criteria for SEPA and shorelines exemptions. It appears to meet the intent of SEPA and shoreline policies. It EMWS Riverbank repair 5/18/94, Page 2 addresses the major issues, similar to what we have approved on past riverbank repair projects. To address habitat issues, the bank will be repaired using bioengineering techniques: rip -rap below OHWM (Fisheries requirement), with geogrid matting and live cuttings. The best "window" for harvesting and planting of live cuttings is past; therefore, the project will need to be carefully planned and monitored. As a thorough review is not possible now, we should specify some conditions. RECOMMENDATION: I recommend conditional approval of the two emergency exemptions. Conditions are based on potential impacts, discussion with Phil and Gary Schulz' recommendations on the 1993 South 104th bank stabilization project. Recommended conditions are as follows: 1. All emergency exemptions are subject to revocation, suspension or revision if additional information indicates that the project does not constitute an emergency. 2. Equipment management vegetation 3. About 650 tons of rock and 475 CY of geogrid /backfill will be needed. The cost range of this work is estimated between $85,000 and $100,000. E., Director M E M O R A N D U M Rick Beeler, (SEPA Official) via Ann Siegenthaler SUBJECT: E Marginal Way S at Associated Grocers River Bank Slough (500' North of Boeing Access Road) Project No. 94 -DRO4 Recently, a 20 foot wide strip of the Duwamish river bank sloughed away next to E Marginal Way S, about 500' north of the Boeing Access Road. PW staff reported this issue to the 3/29/94 Utilities Committee, recommending an emergency fix to protect the US West pole and fiber optic cable, and also E Marginal Way S, a public road. The Utilities Committee referred the issue to the 4/4/94 Regular Council, which passed Resolution No. 1295, declaring an emergency. Corps of Engineers staff informed me that application to the CORPS is required for this type of emergency fix for CORPS approval. Public Works staff field reviewed this matter with state Department of Fisheries personnel last month; we were requested to provide the three small peninsulas shown on the plans for fish habitat. To meet Fisheries time restraints, the CORPS emergency permit process requires this information right away (to be part of the HPA and CORPS applications now being prepared by Public Works). As shown on the attached plans, the fix includes riprap from the toe of the river to the OHWM; then vegetated geogrid layered with live cuttings from the OHWM to the top of bank. This repair is in keeping with King County's Guidelines for Riverbank Stabilization, Tukwila's Shorelines permit requirements, and the State Department of Fisheries requirements. Both Fisheries and the CORPS require the SEPA Official's input on SEPA determinations for this project as part of their permit application. I've also included some other design features that were required as part of the willow layer installation. 1) Measures to reduce erosion would include scheduling the toe of bank /river bottom work during low flows and low tide. This would allow at least 4 hours each day for excavation and rock placement work below the mean high water mark. 2) A silt loam topsoil should be used as fill material for the portion of the new bank that will be installed wit$ vegetated geogrids. An organic- mixture should help with providing nutrients and retaining moisture.. 3) Per King County SWM recommendations, the harvesting and planting of the live willow cuttings should occur within the same 24 hour period or sooner to promote survival and sprouting. Several species can be used together and known salt - tolerant species are appropriate for the lower layers. Hooker (Salix hookeriana) and Pacific . willow (Salix lasiandra) are reportedly known to tolerate some brackish conditions. Red osier dogwood (Cornus stolonifera) is also a highly recommended shrub to incorporate into this plan. Other species for dryer conditions may be used to vegetate the upper portion of the restored bank. These can be planted as rooted nursery stock and could include snowberry (Symphoricarpos alba), Oregon grape (Mahonia spp.), wild rose (Rosa gymnocarpa). Using local willow species is very important for adaptability and minimizing the amount of time needed to harvest the cuttings and transfer them to the site. It is • very important during dry weather to keep the willows wet and cool. Watering needs to be provided at the construction site. 104th Street Memorandum September 8, 1993 Page 2 Attached are the specifications that were recommended for the Boeing bank project. I haven't condensed them into a format that the City can send out but they are useful and should be incorporated into your construction plan. I would not advise sending them out in your bid package as Raedeke Associates' planting specifications. For best results; this work should occur during the dormant season (■ovember - March). Therefore, the utmost care and adherence to these planting specifications are critical to maximize the success of this project work. In addition? limited success • should be expected and replanting activities should be planned for in the fall, as necessary. Harvest/Transport of Live Cuttings Location: Black River Pumping Plant, Renton, Washington Raedeke Associates, Inc. to flag specific areas as where contractors may harvest cuttings. Cutting specifications: 5 -7' cuttings of selected willow species, 112" - 2" diameter. •Cut bottom of stein at 45 degree angle; top of stem should be blunt cut. _ Cut all stems approx. 8-10" above ground level. Cut only 50% of existing plants (subject to modification). Leave vegetative screen along river bank intact. Stern Preparation: Cuttings should be immersed in water tank immediately after cutting and during preparation. Cleanly remove leaves. Leave side branches and bark intact. . Bundle similar lengths•together, 4" diameter bundles, using untreated twine. Stack bundles in transport; keep moist and covered with a tarpauline. Installation: Install all cuttings on the same day as when cut. Keep moist and covered until just before planting. Do not allow to lie in direct sunlight at any time. Place bundles horizontally on prepared, well - compacted soil bed, with basal ends contacting compacted or native soil and top ends approximately 6" above finished grade. Basal ends should be angled so to be lower than top ends. Arrange bundles between and above facing rocks. Space approximately 2 -3 feet on center, diagonal spacing. Be sure soil is tamped firmly around the bundles for good soil -stem contact. M E M O R A N D U M TO: Rick Beeler FROM: Ann Siegenthaler RE: EMERGENCY REP ,1R OF RIVERBANK ON EAST MARGINAL WAY SOUTH SEPA Exempt File #L94 -0029; Shoreline Exempt File #L94 -0031 DATE: May 18, 1994 BACKGROUND: The riverbank along East Marginal Way South at the Boeing Access Road caved in ca. March 1994. The cave -in has de- stabilized adjacent portions of the riverbank, and threatens the right -of -way, a utility pole and fiber optic cable. To pursue immediate repair, Public Works is requesting an "emergency" exemption from SEPA and Shoreline permit requirements. This is similar to the emergency exemption DCD approved last year for the South 104th street riverbank. Without immediate action by Public Works, there is a risk of further riverbank sloughing and damage to infrastructure. Public Works needs an emergency permit from the Army Corps of Engineers. To obtain that permit, Public works must demonstrate that they have the Fisheries HPA and appropriate SEPA• and Shoreline "approvals." The HPA cannot be issued until SEPA and Shoreline review is complete. The normal review processes for SEPA and Shoreline permits will prevent timely remedial action. EMERGENCY EXEMPTION PROVISIONS: SEPA allows exemptions for "actions that must be undertaken immediately•or within a time too short to allow full compliance with this chapter, to avoid an imminent threat to public health or safety....or property..." (WAC 197 -11 -880). Shorelines Mgmt. Act exempts "emergency construction necessary to protect property from damage by the elements..." or to correct imminent threat to public health, safety...within a time too short to allow full compliance...(WAC 173 -14 -040). SHORELINE AND ENVIRONMENTAL IMPACTS: The project meets the criteria for SEPA and shorelines exemptions.. It appears to meet the intent of SEPA and shoreline policies. It EMWS Riverbank repair 5/18/94, Page 2 addresses the major issues, similar to what we have approved on past riverbank repair projects. To address habitat issues, the bank will be repaired using bioengineering techniques: rip -rap below OHWM (Fisheries requirement), with geogrid matting and live cuttings. The best "window" for harvesting and planting of live cuttings is past; therefore, the project will need to be carefully planned and monitored. As a thorough review is not possible now, we should specify some conditions. RECOMMENDATION: I recommend conditional approval of the two emergency exemptions. Conditions are based on potential impacts, discussion with Phil and Gary Schulz' recommendations on the 1993 South 104th bank stabilization project. Recommended conditions are as follows: 1.
