The HPA permit was issued on July 7 without a SEPA exemption. Evidently you requested permission to do the work prior to that date. Please explain/document in writing why an emergency exists today, and not in July. •Today was the first Gary, Jack or I were aware of this project. Now we are asked to take formal action on SEPA by tomorrow. Why were we not brought on board in July or earlier? Why are we being surprised at the very last minute? The river bank has caved in. Public Works is pursuing repair of the bank as an "emergency." Phil needs to get an emergency permit from the Army Corps of Engineers. Phil must submit permit application, Friday. September 3rd or his Fisheries HPA may expire. To submit Corps permits Phil needs "emergency" exemption for SERA and shorelines. The repair is necessary to keep the road from washing out.- To address habitat issues, the bank will be repaired using bioengineering techniques: rip -rap below OHWM, with geogrid matting and live cuttings. Emergency exemption provisions: SEPA allows exemptions for "actions that must be undertaken immediately or within a time too short to allow full compliance with this chapter, to avoid an imminent threat to public health or safety....or property..." (WAC 197 -11 -880). Shorelines Mgmt. Act exempts "emergency construction necessary to protect property from damage by the elements..." or to correct imminent threat to public health, safety...within a time too short to allow full compliance...(WAC 173 -14 -040). RECOMMENDATION: I. believe the project meets the criteria .:for .:SEPA and shorelines, exemptions. It addresses the major issues, while minor details can be worked out later through permits. If you do not agree with this recommendation, please respond by Friday, September 3rd in the morning. M E M O R A N D U M TO: Rick Beeler (SEPA Official) via Ann Siegenthaler FROM: Phil Fraser DATE: 8/2/93 SUBJECT: S 104 St Duwamish Riverbank Slough Emergency Repair (Project No. 93 -DR06) Recently a 10 ft wide strip of the Duwamish riverbank sloughed away next to S 104 St about 150' S of Boeing's Oxbow Bridge. PW staff report (attached) recommending an emergency fix to protect S 104 St, a public road, went to the 8/24/93 Utilities Committee. The Utilities Committee referred the issue to the 9/6/93 Regular Council with a recommendation to transfer monies to allow the emergency repair. In my recent discussion with Corp of Engineers staff informed me that application to the COE is required for this emergency fix for COE approval. The COE may issue a COE emergency permit, but 'require indication of the local SEPA official on environmental determination in the application. To meet Fisheries time restrains, the COE emergency permit process requires this information right away (to be part of the 9/3/93 COE application now being prepared by PW). As shown on the attached plans the fix includes rip rap from the toe of the river to the OHWM (5.0 ft. elevation); then vegetated geogrid layered with live cuttings from the OHWM to the top of bank. This repair is in keeping with King County's Guidelines for Riverbank Stabilization, Tukwila's Shorelines permit requirements, and the State Department of Fisheries requirements. The State Dept of Fisheries has issued their requirements in the attached Hydraulic Permit Approval (expires October 15, 1993). The COE requires the SEPA Official's input on SEPA determinations for this project by 9/3/93 so this. information may be communicated to the COE for their review process. Until that meeting, staff was unsure Council members would concur with the Alt. 2 emergency fix. An emergency repair to.the riverbank was recommended because a 10 ft wide strip of the Duwamish riverbank sloughed away next to S 104 St. To preserve S 104 St roadway for use by the travelling public. Loss of supporting riverbank is possible at the next high river flow and drawdown event. If loss of part of this roadway occurs the safety of the travelling public may be jeopardized. In the past I have informed DCD staff how I would proceed with the project. cc. MEMORANDUM TO: Phil Fraser, Senior Engineer FROM: Gary Schulz, Urban Environmentalist DATE: September 8, 1993 RE: South 104th Street/Duwamish Bank Stabilization As you requested, willow harvesting and planting criteria used in the Boeing project SEPA checklist comments and conditions are listed below. I've also included some other design features that were required as part of the willow layer installation. 1) Measures to reduce erosion would include scheduling the toe of bank /river bottom work during low flows and low tide. This would allow at least 4 hours each day for excavation and rock placement work below the mean high water mark. A silt loam topsoil should be used as fill material for the portion of the new bank that will be installed with vegetated geogrids. An organic mixture should help with providing nutrients and retaining moisture. Per King County SWM recommendations, the harvesting and planting of the live willow cuttings should occur within the same 24 hour period or sooner to promote survival and sprouting. Several species can be used together and known salt - tolerant species are appropriate for the lower layers. Hooker (Salix hookeriana) and Pacific willow ( Salix lasiandra) are reportedly known to tolerate some brackish conditions. Red osier dogwood (Cornus stolonifera) is also a highly recommended shrub to incorporate into this plan. Other species for dryer conditions may be used to vegetate the upper portion of the restored bank. These can be planted as rooted nursery stock and could include snowberry (Symphoricarpos alba), Oregon grape (Mahonia spp.), wild rose (Rosa gymnocarpa). 4) Using local willow species is very important for adaptability and minimizing the amount of time needed to harvest the cuttings and transfer them to the site. It is very important during dry weather to keep the willows wet and cool. Watering needs to be provided at the construction site. 104th Street Memorandum September 8, 1993 Page 2 Attached are the specifications that were recommended for the Boeing bank project. I haven't condensed them into a format that the City can send out but they are useful and should be incorporated into your construction plan. I would not advise sending them out in your bid package as Raedeke Associates' planting specifications. However, you may want to include copies of King County's Guidelines Bank Stabilization - Chapter 8 Construction Procedures. ' July 10, 1993 ,Duwamish River Bank Stabilization 93040 PLANTING: SPECIFICATIONS Limitations: Summer harvesting and planting of live:cuttings are not generally recommended. For best results; this work should occur during the dormant season (November - March). Therefore, the utmost care and adherence to these planting specifications are critical to maximize the success of this project work. In addition? limited success should be expected and replanting activities should be planned for in the fall, as necessary. Harvest /Transport of Live Cuttings Location: Black River Pumping Plant, Renton, Washington Raedeke Associates, Inc. to flag specific areas where contractors may harvest cuttings. On -site pre- construction meeting: Raedeke Associates, Inc. to conduct brief overview. . Cutting specifications: 5 -7' cuttings of selected willow species, 1 /2" - 2" diameter. Cut bottom of stemi at 45 degree angle; top of stem should be blunt cut. Cut all sterns approx. 8 -10" above groun-d level. Cut only 50% of existing plants (subject to modification). Leave vegetative screen along river bank intact. • Stem Preparation: Cuttings should be immersed in water tank immediately after cutting and during preparation. Cleanly remove leaves. Leave side branches and bark intact. . Bundle similar lengths.together, 4" diameter bundles, using untreated twine. Stack bundles in transport; keep moist and covered with a tarpauline. Installation: Install all cuttings on the same day as when cut. Keep moist and covered until just before planting. Do not allow to lie in direct sunlight at any time. Place bundles horizontally on prepared, well- compacted soil bed, with basal ends contacting compacted or native soil and top ends approximately 6" above finished grade. Basal ends should be angled so to be lower than top ends. Arrange bundles between and above facing rocks. Space approximately 2 -3 feet on center, diagonal spacing. Be sure soil is tamped firmly around the bundles for good soil -stem contact. If compacted backfill soil is dry, carefully soak planted area at the end of the working day. Do not allow irrigation water to erode'soil or super - saturate the bank. Do not use any cuttings or live stakes that are split. Keep all cuttings moist and covered at all times, Raedeke Associates, Inc. will be on site at appropriate times. Inspect 1 -2 times per week for the first 2 months, or as appropriate. Be prepared to perform replanting operations in the fall. South of Boeing Oxbow Bridge adjacent to S 104 St DESCRIPTION OF ISSUE/INCIDENT: For Mayor's Office Only Mayor _ City Admin _ Mayor _ For Your Information Response Requested A 10 ft wide strip of the Duwamish riverbank sloughed away next to S 104 St about 150' S of the Boeing's Oxbow Bridge. The westerly edge of S 104 St section is now exposed to an 8 ft vertical drop about 10 feet in width; thereafter the slough plain flumes out to the river bed at a 1:1 slope 35 ft in width (see attached cross section). According to Rick Lowthian of King County Surface Water, the next high river flow and drawdown event may cause additional sloughing, with possible loss of a portion of the S 104 St roadway. King County quarter section maps and our surface water management records indicate John F. Roach owns a narrow strip of land between the S 104 St RIW and the river. No as- builts of the 24' wide paved road have been provided by King County under recent annexation. The location of S 104 St within the 40' right -of -way isn't known. S 104 St receives a moderate amount of car and truck traffic, but is not used for primary access for properties adjacent to S 104 St. Boeing traffic from the Oxbow can travel along S 102 St to E Marginal Way S. ANALYSIS: Public Works Staff have reviewed the S 104 St slough in the field with Andy Levesque of K.C.S.W.M., Joe Robel of State Department of Fisheries also. Andy said this section of river is not in the G.R.F.Z.C. District, nor maintained by King County. , Joe Robel said he will expedite the HPA approval on an emergency basis once he receives the HPA application. John F. Roach faxed the attached documentation indicating past work on his property for river bank stabilization was carried out by the county, using a one year river protection easement. The attached August 23, 1990 letter of King County Surface Water Management attempts to limit King County SWM liability for future maintenance /repairs. Staff observed the riprap placed along the S 104 St bank isn't keyed into the toe of the riverbed. This structural deficiency may have contributed to the slough. Eventually, the King County built riprap north of the current slough may also drop into the river unless it is retrofitted with a keyed buttress. The attached schematic cross section proposes a fix as described in Alternative 2 below. A cost estimate for Alternate 2 fix is attached. ALTERNATIVES: The action alternatives identified are as follows: Info Paper July 22, 1993 page two Alt. 1. Close S 104 St. Properties adjacent to S 104 St between the Oxbow Bridge and East Marginal Way S do not use S 104 St as a primary access. Alt. 2. Carry out fix on emergency basis now, which includes: Provide riprap buttress at 2:1 slope to OHWM/above OHWM geogrid at minimum 175.1 (requiresmove toe out, as currently less than 1:1). About 450 CY of rock and 250 CY of geogrid/backfill will be needed. The cost range of this work is estimated between $25,000 and $35,000 (excludes contingencies). Alt. 3.. Alternate construction fix: Build gabion wall or concrete retaining wall. The cost for a gabion/concrete retaining wall is significantly more expensive than Alternative 2. • Alt 4. Longterm solution: Provide a buttress riprap along 100 feet of riverbank north of existing slough to prevent future sloughs along S 104 St riverbank. RECOMMENDATIONS: Alternate 2 is recommended. This is the least costly fix. To delay a fix now will mean a more costly remedy when S 104 St fails. Mr. Roach does not accept any liability for any repairs or maintenance of the riser bank. An arrangement needs to be worked out with the property owner for access and to fund for costs the property is liable for. After completion of the emergency work, responsible parties need to pursue shoreline and other permits /approvals retroactively. Alternative 4 (long term fix) is also recommended. Alternate 4 provides riprap buttress into the toe of the river for a 100 foot section of river bank just north of the current slough. Until the long term fix is carried out, this section should be monitored. ".sa ,� Channel bed • Rock toe key Height varies While geogrids in smaller projects can be shaped by hand, building larger, longer geogrids is facilitated by using construction jigs and batter boards (Figure 8.8). The jigs, which are con - structed of angle iron, hold the batter boards that shape the-face of the lift to match the exist - ing slope contours. Shorter batter boards (three to our feet long) and sufficient jigs will facilitate this process. After completing the lift. the jig are removed with a backhoe. Begin construction by excavating and shaping the bank for the rock toe. The bench created hY the toe should have a 10 to 15 degree back- slope. Place at least six inches of fill material -.over the rock followed by a layer of live branches.
