RIVERBANK r�� ���f —oa31 CITY OF TUKWILA DETERMINATION OF SEPA EXEMPTION DESCRIPTION OF PROPOSAL: Carry out fix on an emergency basis now, which includes: Provide riprap buttress at 2:1 slope to OHWM /above OHWM geogrid at minimum 1.75:1 (requires move 'toe out, as currently less than 1:1) . About 450 CY of rock and 250 CY of geogrid /backfill will be needed. The cost range of this work is estimated between $25,000 and $35,000 (excludes contingencies). The river bank has caved in. Public Works is pursuing repair of the bank as an "emergency." Phil needs to get an emergency permit from the Army Corps of Engineers. Phil must submit permit application Friday, September 3rd or his Fisheries HPA may expire. To submit Corps permits Phil needs "emergency" exemption for SEPA and shorelines. The repair is necessary to keep the road from washing out.• To address habitat issues, the bank will be repaired using bioengineering techniques: rip -rap below OHWM, with geogrid matting and live cuttings. Emergency exemption. provisions: SEPA allows exemptions for "actions that must be undertaken immediately or within a time too short to allow full compliance with this chapter, to avoid an imminent threat to public health or safety....or property..." (WAC 197 -11 -880). Shorelines Mgmt. Act exempts "emergency construction necessary to protect property from damage by the elements..." or to correct imminent threat to public health, safety...within a time too short to allow full compliance...(WAC 173 -14 -040). • RECOMMENDATION: I believe the project meets the criteria for SEPA and shorelines exemptions. It addresses the major issues, while minor details can be worked out later through permits. If you do not agree with this recommendation,' please respond by Friday, September 3rd in the morning. LOCATION: South of Boeing OxBow bridge.* 52.01.9:lh REV::10 /16/E M E M O R A N D U M TO: Rick Beeler (SEPA Official) via Ann Siegenthaler FROM: Phil Fraser DATE: 8/2/93 SUBJECT: S 104 St Duwamish Riverbank Slough Emergency Repair (Project No. 93 -DR06) Recently a 10 ft wide strip of the Duwamish riverbank sloughed away next. to S 104 St about 150' S of Boeing's Oxbow Bridge. PW staff report (attached) recommending an emergency fix to protect S 104 St, a public road, went to the 8/24/93 Utilities Committee. The Utilities Committee referred the issue to the 9/6/93 Regular Council with a recommendation to transfer monies to allow the emergency repair. In my recent discussion with Corp of Engineers staff informed me that application to the COE is required for this emergency fix for COE approval. The COE may issue a COE emergency permit, but require indication of the local SEPA official on environmental determination in the application. To meet Fisheries time restrains, the COE emergency permit process requires this information right away (to be part of the 9/3/93 COE application now being prepared by PW). As shown on the attached plans the fix includes rip rap from the toe of the river to the OHWM (5.0 ft. elevation); then vegetated geogrid layered with live cuttings from the OHWM to the top of bank. This repair is in keeping with King County's Guidelines for Riverbank Stabilization,•Tukwila's Shorelines permit requirements, and the State Department of Fisheries requirements. The State Dept of Fisheries has issued their requirements in the attached'Hydraulic Permit Approval (expires October 15, 1993). The COE requires the SEPA Official's input on SEPA determinations for this project by 9/3/93 so this, information may be communicated to the COE for their review process.
