The applicant also requests the Planning Commission approve a deviation to parking standards. Project Description: Ebenezer Church of God (The Church) proposes to convert an existing 2,521- square -foot building to a church. In the past, a variety of uses occupied the building including a community center. The current Church membership is 65. Location: The existing building is located on a split -zoned site. The front 100 feet is zoned C -2 and the steeply sloping portion to the rear (approximately 165 feet) is zoned R1 -7.2. The site is located at 14275 Interurban Avenue South, south of the Interurban/ 58th Avenue South Intersection on the west side. Access and Parking: A single driveway accesses the property from Interurban Avenue. A gravel parking area is located on the south side of the building and will accommodate 11 parking spaces. Landscaping: Low shrubs exist along the north side property line and some groundcover along a portion of the front. No landscaping exists on the south side. Surrounding Land Uses and Zoning: North: Single- family C -2 South: Single- family C -2 East: Office M -1. West: Steep vegetated slope R1 -7.2 Staff Report to the Planning Commission DECISION CRITERIA L94 -0038: Ebenezer Church Page 3 The Planning Commission is guided by the following decision criteria for Conditional Use Permits a church and for off - premise parking. The applicant's response and the staff's response follow: (A) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. Applicant's Response: 'We plan to help not only in spiritual ways, but also naturally. Such as upgrading the building and grounds, and making sure orderly conduct and conversation is maintained along with safe operations by each member." Staff's Response: The building has not been occupied for over two years. Consequently, the building has not been maintained: windows are boarded and a section of the roof is in need of repair. The Church proposes to pave and stripe the parking area to accommodate 11 parking spaces within two months after occupying the building. A total of 38 parking spaces are required for the Church. Quinten Control Systems N.W., Inc., and Northwest Source Group, both located approximately 3/10 mile (1,584 feet) north of the Church, have agreed to allow the Church to use a total of 35 parking spaces after business hours (8:00 a.m -5:00 p.m Mon.- Fri.). The Church proposes to shuttle people from the two off - premise parking areas to the Church in their 12- person van which will be parked on site when not in operation. The Church's hours are Wednesday through Friday from 6:30 p.m. to 9:30 p.m., and Sunday from 9a.m. to 3p.m., and from 6:30p.m. to 9p.m.. (B) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy; Applicant's Response: "We are willing to comply with the performance standards at all times and set good examples by striving to exceed them.:" Staff Report to the Planning Commission Page 4 Staff's Response: L94 -0038: Ebenezer Church The amount of combined parking would be 46 spaces and exceeds the parking required by 8 spaces. The orientation of the existing building make it impossible to meet current performance standards related to on -site parking. The TMC requires 5 feet of landscape area along side property lines and ten feet along the front. The applicant proposes to install shrubs and two trees along the street front and shrubs along the south side property line. The applicant has indicated that the Church does not have adequate resources to install landscaping and pave the on -site parking lot at the time of occupancy. The Planning Director can authorize a letter of credit for 150% of the cost of improvements. The applicant has indicated that improvements will be installed two months after occupancy. (C) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. Applicant's Response: "Since we will usually be in church during off -peak traffic hours, there should be little or no problems but ever we can do to ensure general compatible we are willing." Staff's Response: Based upon the hours, conflict between peak -hour traffic will be minimized. Shuttling members from the Quinten and Northwest Source Group sites to the Church site is acceptable to both the City Engineer and the Department of Community Development for the following reasons: the City Engineer will not support parking across Interurban Ave. since there is no signalized cross -walk opposite the site on the east side of Interurban Avenue. Secondly, additional parking spaces have not been made available to date closer to the site. (D) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Staff Report to the Planning Commission Applicant's Response: "Yes" Staff's Response: L94 -0038: Ebenezer Church Page 5 The following goals and policies of the Comprehensive Land use Policy Plan are applicable: Commerce and Industry Objective 1: Encourage a smooth, steady and planned growth of the .business community. Policy 4. Encourage the use of live landscaping in all developments. New landscaping is proposed along the property frontage and will meet landscape requirements of the Zoning Code. Policy 5. Promote renovation of areas which are not aesthetically pleasing. See response to Policy 4. Policy 7. Promote adequate provisions for parking for all land uses. On- and off - premise parking Tots will exceed the number of required parking spaces for this use. There will be no time conflict for parking lot usage between businesses and the Church. (E) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. Applicant's Response: "Yes, and it not again we are willing to do what is necessary. We assure you we are and will not be a problem, but an asset to the community." Staff's Response: Potential adverse impacts will be avoided by providing a shuttle to the two off - premise parking lots to prevent parking within the nearby residential area and to avoid pedestrians crossing Interurban at non - signalized locations. Staff Report to the L94 -0038: Ebenezer Church Planning Commission Page 6 CONCLUSION General Review Criteria (A) The proposed use will not be materially detrimental to the public welfare... In terms of land -use, the Church is a compatible use within the C -2 zone. The proposed is more compatible with the abutting residential land uses as compared to a commercial use which is permitted outright intensive commercial use. Site improvements including window replacement alone will significantly enhance the visual appearance of the site making it more harmonious with its immediate neighbors. The remote parking area combined with the shuttle will help avoid impacting the surrounding neighborhood. A shuttle has not been made part of a project proposal in the past. For this reason, the Planning Commission should consider re- evaluating the proposal if there are parking impacts to the nearby residential area, or on the east side of Interurban Avenue. (B) The proposed use shall meet or exceed the performance standards... Off- premise parking and a shuttle from the off- premise locations to the Church site is proposed for this project. The total number of parking spaces provided exceeds TMC requirements for churches. The proposal will comply with landscape standards. (C) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The site plan reflects the site's ability to maximize parking and safe pedestrian and vehicular circulation. Due to the distance of the Quinten and Northwest Source Group parking lots, staff feels the shuttle is the best solution for bringing members safely to the site. It will prevent an unsafe crossing on Interurban Ave., and prevent members from having to walk during inclement weather. (D) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The Comprehensive Land Use Policy Plan does not specifically address church uses in commercial zones. The Conditional Use Permit decision criteria provides clearer direction to staff and the Planning Commission when evaluating the appropriateness of conditional uses in their relative environments. Staff Report to the • Planning Commission L94-0038: Ebenezer Church Page 7 If left unoccupied, the building may continue to deteriorate. Although this portion of Interurban is zoned C -2, residential uses exist on each side of the Church site. Given the existing land uses and site constraints, promotion of the church use will result in site , enhancement and a use Tess • intensive than any number of commercial uses allowed outright in the C -2 zone. (E) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. No adverse impacts are anticipated with this proposal, however, if church members park within the residential area to the west or on the east side of Interurban Avenue, the Planning Commission should re- evaluate the project for possible revocation. RECOMMENDATION Staff recommends the Planning Commission approve the Conditional Use Permit with the following condition: 1. It was determined that, prior to PW approval of this conditional' use, additional information needed to be provided by the applicant. This information would include pedestrian volumes between the proposed church facility and remote parking. Also, adequate provision for parking needs . to be identified. Parking on the east side of Interurban Avenue South is not acceptable due to safety considerations. These comments are consistent with those provided by PW at the March 31st DRC. Temporary erosion control measures shall be included on plans. Normally, no site work will be allowed until erosion control measures are in place. 11. Rockeries are not permitted over 4' in height. Retaining structures over 4' in height must be engineered retaining walls, and require a permit. 12. All rack storage requires a permit and rack storage over 8' high must be designed for Seismic Zone 3. A Washington State structural engineers stamp will be required on plans and structural calculations submitted for rack storage over 8' high. 13. Construction documents shall include special inspection requirements as specified in Sections 302(c) and 306 of the Uniform Building Code. Notify the Building Official of testing lab hired by architect or owner prior to permit issuance date. The contractor may not hire the testing lab. 14. Construction documents shall contain soils classification information specified in Table 29 -B of the Uniform Building Code, stamped and signed by Washington State licensed architect or engineer in responsible charge of the structural design work. 15. Demolition permits are required for removal of any existing buildings or structures. 16. Comply with UBC Appendix Chapter 35, Sound Transmission Control (R -1 occupancy group). 17. Obtain approvals and permits from outside agencies: `ELECTRICAL PERMIT /INSPECTIONS are obtained through the Department of Labor and Industries : (248 - 6630). FIRE DEPARTMENT - Construction information . The City of Tukwila has adopted the 1991 Uniform Fire Code. This and other nationally recognized standards will be used during construction and operation of this project. (TMC 16.16.120) 2. Fire hydrants will be required. (City Ord. #1626) 3. Required fire hydrants shall be approved for location by the Fire Department, approved for purity by the Water Department, and fully in service prior to start of construction. By line of vehicular travel a fire hydrant must be no further than 150 feet from a structure; and no portion of a structure to be over 300 feet from fire hydrant. (UFC 10.301 and City Ord. #1646) 4. Automatic fire sprinklers are required for this project. Sprinkler systems to comply with N.F.P.A. #13. Sprinkler plans shall be submitted to Washington State Surveying and Rating Bureau, Factory Mutual or Industrial Risk Insurers for approval prior to being submitted to Tukwila Fire Marshal for approval. The greenhouse will not be open to the public and will be used strictly for nursery stock. The proposed quonset greenhouse is similar in appearance to the existing greenhouse on Lot 8. The new greenhouse will be approximately 25 -feet wide and 18 feet high covered by white translucent panels. Site Description: Bonsai Northwest occupies two Tots (Lot 8 and Lot 9). Lot 9 is a 19,278- square -foot terraced site and is located at the southwest corner of S. 144th St. and 51st Avenue South. Two storage buildings exist on site and a retail shop and private residence and greenhouse occupy Lot 8, immediately north of the subject property. Access and Parking: A total of twelve parking spaces are provided on lot 8. Parking is accessed from S. 144th St. A second access from 51st Ave. onto Lot 9 is will be closed as part of this application and no additional parking is proposed on the subject site. Landscaping: A rockery will be installed along the eastern edge of the greenhouse similar to the rockery adjacent to the existing greenhouse on Lot 8. Perimeter landscaping is proposed along 51st. Ave S. which includes flowering Cherry trees and Ivy. Additional landscaping will be installed on -site including plantings on the sloped areas (see Attachment E). Surrounding. Land Uses and Zoning: North: Single- family R -1 -7.2 South: Single- family R -3 East: Single- family /Interstate 5 C -1 West: Single- family R -1 -7.2 DECISION CRITERIA Because the proposed project is within a C -1 zone and within 300 feet of a residential district, Design Review is required. Relationship of Structure to Site. The terraced site allows for the building to be setback and elevated from the street, thus reducing the massing at the street level. Vegetation on the slope behind and surrounding the greenhouse will offer screening and an enhanced appearance. 2. Relationship of Structure and Site to Adjoining Area. A nursery is not an intensive commercial use. For this reason, it is appropriate within a predominately residential area. The greenhouse requires only one employee and will not be open to the public. Therefore, little impact to parking is expected. • 3. Landscape and Site Treatment. Existing and new landscaping will surround the proposed greenhouse.
