Gentlemen: On June 27, 1995 we spoke with Bob Wiley with Fidelity Associates, the owner of the property to the south of our site. Bob indicated that he nor the Tenant of his building required the use of the driveway connection between the two sites, and the connection could be eliminated. Bob had seen the dramatic grade change between the two properties and was aware of the problem. We discussed the option of constructing a planter island between the two sites to close off the access point and adjust for the grade transition. Bob supported this approach. Bob indicated that he did not wish to relinquish the easement at this time, but was willing to accept the cost of any future grading revisions required to make the driveway connection workable. He indicated that we should grade this area in a manner that best suits our needs. To document our discussion, Bob provided us with written documentation of his understanding. Please find attached his June 27, 1995 Fax Message addressed to Entranco. We requested that Bob send us a signed hard copy of his Fax for our records. To adjust the grade transition, we suggest that a planter island be constructed to'accommodate the 2 - 3 foot grade change in this area. Please refer to Entrance's plans dated 3/10/95 by Revision #3 for proposed grading and planter island revisions for this area. For convenience, we have attached a sketch that generally shows the proposed work in this area. On a separate side note, Bob indicated that several sprinkler heads within the landscaping between the two properties were damaged by construction activities. He.would like to see the heads repaired and the landscaping between the two sites better coordinated. We suggest that either Andy or Frank contact Bob at 232 -6465 to determine his needs and resolve any issues he may have. In an Easement Agreement dated October 4. 1994 Circuit City ganted Fidelity access to the southerly 50' of Circuit Citys southwest corner for the exclusive purpose of truck maneuvering by and for the tenants of Fidelity. In the easement; Circuit City does not have the right to cross over or use ' any Fidelity property on this portion of the easement. Circuit City is now putting in the final grade for its development. Fidelity does not intend to use the easement at this time, and thus agrees with Circuit City that it should put in the grade best .suiting its needs. without • regard for this easement. If Fidelity wishes to activate this easment in the future. it would . work this out with Circuit City at the time and bear the direct costs of connecting the properties. RECITALS 1. Best is the lessee of certain real property described in Exhibit A, which is incorporated herein by reference (the "Best Property "). 2. McConkey is the owner of the real property described in Exhibit B, which is incorporated herein by reference ( "McConkey Property "). 3. The Best Property and the McConkey Property are contiguous to one another. The parties desire to set forth terms by which each may use an easement for ingress and egress, which easement will lie partially on the property of each. NOW THEREFORE, in consideration of the mutual covenants of the parties contained herein, the parties now agree as follows: 1. Grant to Best. McConkey hereby grants and conveys to Best a non- exclusive easement for ingress and egress across, upon, and over the portion of the McConkey Property as depicted in gxhibit C. The easement granted in this Section is appurtenant to the Best Property only. 2. Grant to McConkey. P.02 No. 6460 P. 3/13 This Easement shall be subordinate to any present mortgage upon . the property of the parties, and upon foreclosure any mortgagee or purchaser at foreclosure sha3l have the right to assume and enjoy the rights of the mortgagor, and upon such assumption this Easement shall continue in effect. If such mortgagee or purchaser fails, within sixty (60) days after such request to execute such documents as may be reasonably requested by the other party to confirm such assumption, the other party shall have the right to terminate this Easement. Upon the termination or expiration of this Easement, the parties will execute and deliver to the other such agreements as may be reasonably required to evidence such termination of record. 4: Mutual Easementa/Permitted Use. The easements created herein are mutual, reciprocal easements, and may be used by each party for ingress and egress from their respective properties as well as to allow each party to turn semi - tractor /trailers around to back into their respective loading docks. Neither party shall do anything that will unnecessarily or unreasonably impede or obstruct the other party in the exercise of the rights and use of the easements granted herein, or in the use of their respective properties for any purpose, or which may cause damage to the property of the other. Neither party shall maintain any public or private nuisance on the property of the other, or take any other action on the property of the other which may interfere with or disturb the quiet enioymAnt by others of anv surrounding rrorerty. Either earty may change the location of the easement on its property so long as the other party derives a Substantially similar benefit to that contemplated hereby. 5. Maintenance and Renalr. Each party shall be responsible for repairing and maintaining that portion of the easement that rests on their respective property, so as to insure that it is in good condition. In undertaking such maintenance or repaid', the repairing party shall take reasonable care to assure that the other party's use of the easement is not adversely affected thereby. The repairing party will give the other party at least ten (10) days prior written notice of any repair activities likely to interfere materially with the use of the repairing party's property by the other party. 6. Duration. The easements herein granted shall terminate upon L11e exN£i.aLivu of that c. Xtmirl. base agreement between Best and Seattle Fur Exchange, Inc., dated February 4, 1994 (the "Seattle Fur Exchange Lease "), which has an initial term of twenty (20) years plus an additional thirty (30) years of option periods (fifty (50) years total). If the term of the Seattle Fur Exchange Lease is extended, the term of this Easement will be extended accordingly, or shall' become perpetual if Best acquires the fee ownership of the Best Property. Such termination shall be in addition to, and not in substitution of, such other rights and remedies as the terminating party may have at law or in equity. Any other provision in this Easement notwithstanding, this Easement shall terminate upon the termination of the Seattle Fur Exchange Lease whenever occurring, unless caused by acquisition of the fee by Rant, and Boot cha11 hay* no liability by roacon of ouch termination occurring prior to the natural termination of the Seattle Fur Exchange Lease. 7. Warranties. Each party warrants to the other that: (i) it has sufficient right, title, power, and authority to enter into this Easement and grant the rights contained herein; provided, the parties recognize that Best may only grant such rights as perYnitted by a tenant with this uaLf.woLrictea i•iyhL Lu assign or sublet; (ii) the execution of this Easement does not violate the terms of any other lease or agreement by which the warranting party is bound and (iii) Beet shall make such physical changes to the Best Property (including but not limited to fence removal and change in building configuration) as is necessary for the full use of the easement as depicted on Exhibit D by McConkey. As a condition of the effectiveness of this Easement, Hest shall, concurrently with the execution hereof, cause Future Shop, Inc., a Washington corporation, to acknowledge its consent to the grant of easements contained herein. 8. Successors and Assigns. The easements created herein are intended to run with the land and to be binding upon,' and running to the benefit of, the parties, their heirs, successors, and assigns. Upon the sale, assignment or other transfer of the interest of either party under this agreement, the transferring party shall be relieved of any obligations under this agreement thereafter accruing. Neither party shall commit or suffer any act or neglect whereby the property of the other shall at any time become subject to any attachment, judgment, lien, charge or encumbrance whatueever, and each will indemnify and hold the other harmless against all loss, costs and expenses, including reasonable attorneys fees with respeot thereto. 12. tmnrovements. Neither party shall have the right to make any improvements to the property of the other. 13. legal Action. If either party defaults in any obligation hereunder and the other parry is require to retain an attorney to enforce its rights under this Easement, the nondefaulting party shall be entitled to reasonable attorneys fees and costs. 14. Remedies. Each party agrees that, in the event of a breach horeof, the nondpfaulting party will suffer irreparable harm, and shall be entitled to have this Easement specifically enforced by injunctive relief. Such right and remedy shall be cumulative and shall be in addition to every other right or remedy available to Lhe parties at law or in equity. 15. Governing ;.,aw. This grant of easement shall be governed by the laws of the State of Washington. 16. Entire Agreement. This is the entire agreement of the parties with respect to the subject matter hereof and . supersedes all prior or contemporaneous agreements with respect thereto. 17. Not1pes. Exercise of R.ahts. The parties may not exercise their rights under this Easement until Best takes possession of the Best Property pursuant to the Seattle Fur Exchange lease, removes the fence and completes its initial construction on the exterior of the building on the Best Property, including the configuration of the building, to reflect a configuration substantially similar to that shown on Exhibit 1r, or another configuration 00 song as the contemplated easement is still feasible and both parties derive s substantially similar benefit as contemplated herein: provided McConkey may use the easement over the Best Property during said initial construction on the Best Property so long as such use will not unreasonably or materially interfere with Best's construction. Project Description: The applicant will demolish an existing building on a 3.4 acre parcel, improve the site for two buildings, and construct a 41,220 s.f. building. The proposed development is shown in attachments A through G. 2. Existing Development: The site is currently developed as an 87,000 s.f. warehouse, with minimal passenger car parking and many truck loading bays. Use of the site has been minimal over the past few years. 3. Surrounding Land Use: The project site is in an area where buildings originally built for wholesale /industrial uses, are being converted to retail and office uses. The immediate vicinity is developed in office /retail uses to the east, and a mix of warehousing and redeveloping retail to the north, south and east. 4. Terrain: The vicinity is flat, with no significant grade changes. 8. Access: Andover Park East provides the primary site access. Truck access to Strander Blvd. is also provided by a joint access driveway at the southeast corner (Attachment A). A 12 ft. wide access easement also runs along the western property line. This easement area is joined to a reciprocal easement on the property to the immediate west (Attachment C). BACKGROUND The BAR recently approved a different design proposal for this site (L93- 0068). The owner has since sold the property to Circuit City Stores, who is now proposing the present design concept. .DECISION CRITERIA This project is subject to Board review due to its location in the C -M zone and exceeding 10,000 s.f., per TMC 18.60.030(2)(A)(ii). Staff Report to the Planning Commission Page 3 L94 -0043: Circuit City Stores Board review criteria are shown below in bold, along with a staff discussion of relevant facts. Applicant responses to the criteria are presented in Attachment H. 18.60.050: General Review Criteria. (1) Relationship of Structure to Site. a. The site should be planned to accomplish a desirable transition with streetscape and to provide for adequate landscaping and pedestrian movements b. Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas. c. The height and scale of each building should be considered in relation to the site. The streetscape consists of Andover Park East, a 6 ft. curbline sidewalk and a 15 ft. wide front landscape strip (attachments A, B and C). Front landscaping consists of colorful ground cover and a shrub hedge, with medium -sized deciduous Tulip trees, spaced 35 ft. apart. The proposed building is located 280 ft. from the sidewalk, through a parking area and a future building site. Visual transition from street to building is softened by the front landscaping, a treed landscape island for every 8 to 10 spaces, and trees and shrubs at the site of a future building (Attachment B). Pedestrian movement from the street sidewalk system to the building is provided by a 6 to 9 ft. wide sidewalk (Attachment A). This pedestrian path is enhanced by a line of shrubs and trees at the future building site, which provides a sense of enclosure. It could be significantly further enhanced with the future building's additional sense of enclosure, weather protection and pedestrian oriented scale and design. Treed landscape islands break up paved parking areas and define access /maneuvering aisles except in the northwest parking area (Attachment B). A parking island was omitted in this area due to the applicant's desire to establish a 40 ft. wide maneuver aisle. A seven foot wide landscape island would reduce this to a 33 ft. wide aisle. The minimum circulation aisle width is 25 feet. (2) Relationship of Structure and Site to Adjoining Area. a. Harmony on texture, lines and masses is encouraged. b. Appropriate landscape transition to adjoining properties should be provided. c. Public buildings and structures should be consistent with the established neighborhood character. d. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged. e. Compatibility of on -site vehicular circulation with street circulation should be encouraged. Staff Report to the Planning Commission Page 4 L94 -0043: Circuit City Stores The proposed structure's overall 24 ft. building height, 0.35% building site coverage, and concrete walls; are similar to the mass, lines and texture of buildings in the immediate vicinity. Many of these buildings have been, or are being, renovated in varying design styles. The bold burgundy lines formed by the proposed canopy and 45 ft. high tower set the building apart from most other buildings in the immediate area. The tower is the most striking building element. The 45 foot tower height is similar to the height of several structures within a block of the project. This includes Southcenter Mall buildings and the central parapet of the Strander Retail complex to the west, the Tempo 20 office building to the south, and the Andover office buildings to the east. The tower will be visible from I -405, Southcenter Boulevard, and possibly 1 -5. Closer views of the tower (e.g., from Southcenter driveways) are largely blocked by intervening buildings, except along Andover Park East. The smaller scale future building is anticipated to provide an important architectural transition from the street to the large primary structure, based on preliminary discussions with the applicant. These preliminary discussions describe a single story building with the scale and design details which provide the pedestrian orientation needed to balance the current auto - oriented site design l. Vehicular access has been discussed in Vicinity /Site Information, while pedestrian access has been discussed in Criteria 1. (3) Landscaping and Site Treatment a. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced. b. Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance. c. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade. d. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. f. Screening of service yards, and other places which tend to be unsightly, should be accomplished by use of walls, fencing, planting or combination. g. In areas where general planting will not prosper, other materials such as fences, walls and pavings of wood, brick, stone or gravel may be used. 1 Per Criteria la, lb, 2d and 3b. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. Site landscaping is shown in Attachment B. The landscape design for this flat site focusses on softening the paved parking area (see Criteria 1), enhancing the pedestrian connection between street and building (see Criteria 1) and providing transition to adjacent areas. Transition is provided by a combination of mid- sized trees and shrubs. Emphasis has been given to colorful landscaping at the street and along the interior sidewalk. Exterior trash collection areas are proposed at the building's rear (west) and along the south perimeter. Both areas are screened. No detail of the southern screen wall has been provided. Recycling areas will be located inside the building. The applicant has proposed area lighting by 25 to 30 ft. high, parking area light poles and unshielded wall mounted lighting. The proposed pole height exceeds the 24 high building wall. (4) Building Design a. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings. b. Buildings should be to appropriate scale and in harmony with permanent neighboring developments. c. Building components- such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure. d. Colors should be harmonious, with bright or brilliant colors used only for accent. e. Mechanical equipment or other utility hardware on roof, ground or buildings should be screened from view. f. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design. g. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. Building design has been largely discussed in Criteria 1. It is a cost - effective design approach to satisfying the Board's architectural criteria. It relies upon an integration of site landscaping and the fine -grain architectural detailing of the future building to implement the overall design concept. East and south building elevations have been presented in Attachment D. Creating new openings on the north and south sides Staff Report to the Planning Commission L94 -0043: Circuit City Stores Page 6 of the tower would allow free access from the sheltered canopy areas to the south, and merchandise pick -up areas to the north. West and North elevations will mirror the south elevation's concrete block pattern. Primary construction materials are colored block, dryvit and Alucobond. Alucobond is a high gloss, burgundy colored aluminum sheathing used as the entry's primary exterior component. The canopy will be made of a fabric which has the same color and reflectivity as the tower. A colored elevation and a colors and materials board will be presented at the hearing. Roof -top HVAC units are proposed with a total base and unit height of about four feet. The four foot high parapet walls would adequately screen these units. No colors have been proposed for the units. Exterior building lighting will focus on a line created by under - canopy lights and the lighted areas under the tower'. The tower walls will not be lighted. The future building is anticipated to be smaller in scale and provide more glass frontage to accommodate pedestrian access and visibility. (5) Miscellaneous Structures and Street Furniture A free - standing trash enclosure is proposed along the south perimeter (Attachment A). No details of the eight foot high concrete wall have been provided. A freestanding sign has been proposed at the front driveway (Attachment D). No information on sign colors has been provided. CONCLUSIONS General 1. This project should be considered a "work -in- progress," which anticipates development of a second building. This second building is essential to: a. a high quality architectural transition of building mass and scale from the streetscape to the structure (criteria la and 4b), b. providing a structural balance to the auto- oriented site design, by enclosing and thereby reducing the front parking area's perceived mass (Criteria lb) and Staff Report to the Planning Commission L94 -0043: Circuit City Stores Page 7 c. providing the rich detail needed to enhance design harmony with the streetscape (Criteria la) and pedestrian movement through the site (Criteria 3b). Preliminary discussions with the applicant indicate that the future building will have a scale and richness of design to accomplish these objectives, and that development of this building is anticipated in the short -term future. Staff has relied upon these applicant statements and preliminary designs in its review of this project. Many Staff conclusions and recommendations are based upon this building. The designation and landscaping of this future building area have been determined to be acceptable short - term surrogates for actual building construction. Relationship of Structure to Site. 2. Landscaping is used to achieve an adequate transition between the streetscape and structure, and islands have been used to break up the front paved area. 3. The breaking up of paved areas with landscaped islands (Criteria lb), and the design of safe vehicular parking and circulation areas (Criteria 2d) indicates the need for a landscape island at the northwest corner of the primary parking area. The proposed design reflect's the applicant's desire for maximum maneuvering area. Both these needs could be largely accommodated by modifying this area's design as shown in Attachment H. 4. The building's height and scale is consistent with surrounding developments and site access is compatible with the area -wide circulation system. Landscaping and Site Treatment 5. The landscape design effectively softens the transition between the proposed project and adjacent properties. 6. Free - standing light poles should have a maximum 20 ft. height in order to be proportionate in size to the building and retain a fixture height with a pedestrian orientation per criteria la, 3h and 4f. 7. Additional data on the southern dumpster screen wall is needed in order to evaluate its consistency with Board criteria 3f. Building Design 8. The burgundy super - graphic building design creates an architectural statement and visual excitement which contrasts with the beige /white and neutral colored buildings Staff Report to the Planning Commission L94 -0043: Circuit City Stores Page 8 in the general area. Staff believes that this may create a visual presence that could begin to create north Andover East as identifiable area and should be encouraged. Staff's support should not be interpreted as an overall endorsement of this general building design. Rather, it is an endorsement of creating a visually exciting district, and this project's architecture in its overall development context (see Conclusion 1). 9. The 8 ft. wide canopy demonstrates how shelter can be architecturally integrated into a building's design as a striking accent strip and relief element. 10. The building is otherwise consistent in scale and color with buildings in the immediate vicinity. Miscellaneous Structures and Street Furniture 11. Additional information is needed on the dumpster wall design. 12. Additional information is needed to evaluate design consistency of the freestanding sign. RECOMMENDATIONS The Planning Department recommends approval of the proposed project with the following conditions: 1. Future building design, in satisfying BAR design criteria, shall be guided by the following architectural design orientation: a. a high quality architectural transition of low building mass and scale from the streetscape to the primary structure, b. providing a structural balance to the auto - oriented site design by enclosing and thereby reducing the front parking area and c. providing the rich detail needed to enhance pedestrian movement through the site and with the streetscape. 2. Director, who shall ensure that both structures are architecturally integrated with the building. file:94 \circut \bar ATTACHMENT G BOARD OF ARCHITECTURAL REVIEW DESIGN REVIEW APPLICATION FOR 223 ANDOVER PARK E., TUKWILA,WA 1. RELATIONSHIP OF STRUCTURE TO SITE INTRODUCTION: This site will consist of two buildings built on 3.4 acres located at 223 Andover Park East in Tukwila, WA. The larger building, approximately 41,000 square feet, will house a Circuit City Store which sells consumer electronics and appliances through a full service retail environment. The second building will be approximately 9,000 square feet and house 1 or 2 specialty retailers. These tenants have not yet been determined. The site is currently fully built out for industrial use and contains an abandoned 87,000 +1- square foot warehouse. Due to the condition of the building and incompatibility with the new proposal, the existing structure will be fully demolished and will be replaced by new construction. A. A fully landscaped sidewalk will be built along the length of Andover Park E to the City's specifications. Street trees will be in a planter adjacent to this sidewalk. Sidewalks will also be provided along the front of both buildings. Pedestrian connections have been designed to enhance pedestrian access from Andover Park E. to both buildings. A customer pick up area is designed into the facade of the store. As many items sold are too heavy to carry long distances, customers can walk to their cars unencumbered by these heavy items and return to this staging point. As well as the necessary street trees, landscaping will be provided in planters in the primary parking field. B. In response to staff comments, the visual impact of the parking field will be moderated by the following. i) The smaller building has been pulled closer to Andover Park E. In the original design, the lease space was in -line with the Circuit City Store and all parking was directly in front of the two stores. ii) The site is long and narrow and flanked on both sides by buildings - as such, the view corridor to the site is minimal iii) Landscaping in planters will serve to moderate the visual impact. Truck loading will be in the rear of the primary building via access through the alley off of Strander. This will consolidate truck traffic with the adjacent retailers while separating truck traffic from pedestrian and customer vehicle traffic. Access via a Reciprocal Easement Agreement has already been secured. C. The height and scale of the primary building complements the site. Visual monotony is broken up by a burgundy entrance feature which clearly identifies the customer entrance and avoids "a big box" look by rising above the lower wall. This design is critical to the store design as it is a recognisable icon closely linked with Circuit City's regional identity. The other building will be smaller in scale and provide more glass frontage to accommodate pedestrian access and visibility. 2. THE RELATIONSHIP OF STRUCTURE AND SITE TO ADJOINING RETAIL A. The majority of the adjacent abutters are currently or have recently been converted from industrial buildings to retail buildings. As such, there is some . variety in the architectural treatments of each. This provides for pleasant visual relief as there is no monotony of styles. The proposed primary building will complement these buildings through maintaining similar scale and providing primary construction in a similar tone complemented by distinctive red accents. B. Landscape buffers and sidewalk are designed to complement the adjacent sites by distinguishing property lines while providing access via sidewalks. C. The intersection of Strander and Andover Park E is currently undergoing significant redevelopment converting abandoned industrial space to retail. Many of the proposed projects will serve the same customer base. As such, there will be synergy of use. The proposed Circuit City Store will certainly be in character with the current redevelopment of this neighborhood. D. Truck access will be shared with several adjacent sites through an alley off of Strander. Pedestrian access will be achieved from adjacent retailers via the rebuilt sidewalk on Andover Park E.. Pedestrian circulation through the rear of the site will not be encouraged to avoid mixing pedestrians with the significant truck traffic to the rear of the building. 2 E. Customer vehicular traffic will be conveniently contained and serviced via curb cuts off and on to Andover Park E.. 3. LANDSCAPE AND SITE TREATMENT The site is currently fully developed as an industrial warehouse. There is very little topographical variance and minimal grade deviations. The new landscape and site treatment has been designed to achieve the city's goals, including rebuilding the sidewalk and providing street trees. The service yards will be to the rear of the buildings. The primary building will have truck loading and waste disposal in an alley behind the building and will be obscured from sight from Andover Park E. 4. BUILDING DESIGN The building design and use will be harmonious with the adjacent retail redevelopment. The design will be in similar tones and scale as the various buildings in proximity. In terms of overall square footage, this project will be of medium size. i.e.; Smaller than the Segale Project on Strander yet larger than the Office Depot building at the intersection of Andover Park E and Strander. Primary construction materials are colored block, dryvit and Alucobond. Alucobond is a burgundy colored aluminum clad material used for accents and is the primary exterior component of the entrance feature. The entrance feature is a design unique and critical to Circuit City's store design. It rises up from the lower walls and accentuates the customer entrance while providing visual relief to the facade. Its color is a distinct warm burgundy. Both the color and design are critically linked with Circuit City's regional identity. Screening and lighting will be provided to present a clean harmonious image to Andover Park E. 5. MISCELLANEOUS STRUCTURES AND STREET FURNITURE A. NA B. NA INTERURBAN SPECIAL REVIEW DISTRICT 1. This is an existing fully developed industrial site, it has no natural amenities. 2. NA 3 • 3. On site pedestrian circulation will be provided by constructing a new sidewalk along the width of the site on Andover Park E.. Both buildings will have sidewalks along their front facade and pedestrian walkways will be clearly marked to provide connection from the sidewalk on Andover Park E. to the smaller building and then from the smaller building to the primary building. It is not the intent of the site design to encourage pedestrian circulation through the rear of the site, as this area will be primarily used for truck turnaround and loading by Circuit City and some of the adjacent retailers. 4. The proposed use as a retailer of consumer electronics and other specialty goods is certainly in line with 1) The CM zoning; 2) The immediate neighbors i.e: Computer City, Office Depot, Best Products and the Segale Center; and 3) The general area of the Southcenter Mall - one of the best retail areas in terms of diversity, quality and quantity of shops in the Pacific Northwest. 5. The proposed use of this redevelopment will generate few adverse environmental impacts particularly when the previous industrial use is considered. While peak vehicle trips may increase slightly, truck trips will be reduced. Overall building size will be reduced as will the volume of space which requires heating, electricity and other services. Storm water treatment will be upgraded and landscaping will be enhanced. 6. There is nothing of historical significance on this site. This change requires Circuit City to make minor design revisions to allow trucks to access the site from Andover Park East. In conjunction, Circuit City is requesting the three (3) following minor modifications: 1. Reduce the size of the outparcel building. 2. Provide 2 curbcuts onto Andover Park. 3. Change the building wall construction materials. The reduction of the outparcel building was done for three reasons. First, the space needed for a complimentary business was determined to be smaller than originally thought. Second, the new location and size of the outparcel is scaled to Andover Park frontage and overall site. The size and location do not visually compete with the Circuit City building. And last, the smaller outparcel building allows a more efficient site layout for truck maneuvering. The double curbcuts onto Andover Park allow Circuit City truck deliveries to enter and exit the site without multiple truck maneuvers. This provides an unencumbered circulation route for the delivery trucks. The change in building material is to the main exterior walls. Circuit City proposes changing from split face concrete block to precast tiltwall. This change is an economic as well as time driven in order to meet Circuit City's opening dates. The fabric awning, burgundy entry feature and exterior wall colors will remain. Keep in mind the existing building on site was built of smooth tiltwall panels. As Entranco discussed, Circuit City is under a critical time schedule to begin the final design and initiate the construction process. Each party warrants to the other that: (i) it has sufficient right, title, power, and authority to enter into this Easement and grant the rights contained herein; (ii) the execution of this Easement does not violate the terms of any other lease agreement by which the warranting party is bound and (iii) Best and Fidelity shall make such physical changes to the Seattle Fur and Fidelity Properties, respectively, (including but not limited to fence removal, change in building configuration, paving, curbing, curb -cuts and landscaping) as is necessary for the full use of the easement as depicted on diagram SK -8. 10. Release. Indemnity and Insurance. Each party does hereby release, indemnify, and agree to defend and hold the other parties harmless from and against any and all liability, loss, damage, expense, actions, and claims, including reasonable attorneys' fees and costs incurred by the other parties in the defense thereof, arising directly or indirectly as a result of the acts or omissions of the indemnifying party, its servants, agents, licensees, invitees, employees, and contractors in connection with its use of the property of any other party pursuant to this Easement; provided, however, that this paragraph does not purport to indemnify any party for damages arising out of or resulting from the sole negligence of the indemnified party, its agents, or employees. No party to this Agreement shall be barred or prevented from enforcing the terms of this Agreement by failure to take enforcement action on prior breaches of the Agreement. 12. Successors and Assigns. The easements created herein are intended to run with the land and to be binding upon, and running to the benefit of, the parties, their heirs, successors, and assigns. Upon the sale, assignment or other transfer of the interest of any party under this agreement, the transferring party shall be relieved of any obligations under this agreement thereafter accruing. 13. Recording. This document will be recorded in the records of King County, Washington. 14. Liens. No party shall commit or suffer any act or neglect whereby the property of any other party shall at any time become subject to any attachment, judgment, lien, charge or encumbrance whatsoever, and each will indemnify and hold the other(s) harmless against all loss, costs and expenses, including reasonable attorneys' fees with respect thereto. 15. Improvements. No party shall have the right to make any improvements to the property of any other party. 16. Legal Action. Remedies. Each party agrees that, in the event of a breach hereof, the nondefaulting party will suffer irreparable harm, and shall be entitled to have this Easement specifically enforced by injunctive relief. MERYHEW MOVED TO APPROVE THE PUBLIC HEARING MINUTES OF THE AUGUST 25, 1994. MR. NEISS SECONDED THE MOTION AND THE MOTION WAS UNANIMOUSLY APPROVED. L94- 0043: Circuit City Jack Pace presented the staff report and provided details of the project. The height of the project is in keeping with other buildings in the area. The staff has a few concerns with the project. One of them deals with the landscape islands, another deals with the lack of a luminaire plan, another deals with screening of the dumpster and the last deals with a plan for the sign. Mr. Meryhew asked if they need to address the HVAC units and how they will appear from other buildings. Mr. Pace said they couldn't address that now because that's not included in the current Comp Plan. Mr. Malina asked if there would be secondary signage for the other pad on the site? Mr. Pace said they could share a freestanding sign and they are entitled to one wall sign. He also noted that the applicant has agreed to all the conditions. Mr. Malina asked if the signage would come back before the Planning Commission or go before the DCD Director. Mr. Pace indicated that was up to the Commission, it can go either way. Page 2 Mike Bank, Consultant for the project: Mr. Bank said they have had some personnel changes. He also said that they are committed to having their signage be compatible with the building. Mr. Malina asked for clarification as to where the dumpster siting would be. Mr. Bank noted that the dumpster noted on the plans is for the future pad and its tenants, and that Circuit City generates very little trash. Mr. Malina asked if there would be a recycling area provided. Mr. Bank said that there was none proposed at this time because they don't generate very much trash. Mr. Malina said that he would like to add a condition requiring a recycling area because the said is encouraging all businesses to participate in the recycling program. Mr. Neiss asked what the life of the color on the canopy is. Mr. Bank the color life of any fabric usually isn't very long, but they would replace the awnings as needed. Mr. Neiss asked if the fabric had a warranty. Mr. Bank said he did not know. Mark Young, Entranco Engineers: Mr. Young indicated he would answer any. questions. Mr. Meryhew reiterated his question about the "note" on attachment A, and what impact, if any, that would have on the parking. Mr. Young said there would be no impact and they would just widen the aisle. Mr. Meryhew asked if there would be any impacts to ingress and egress. Mr. Young said there would be 'no impact to turning movements. Mr. Haggerton asked what the estimated completion date of the project is. L OA Si Arrr BOARD OF ARCHITECTURAL REVIEW DESIGN REVIEW APPLICATION FOR 223 ANDOVER PARK E., TUKWILA,WA 1. RELATIONSHIP OF STRUCTURE TO SITE INTRODUCTION: This site will consist of two buildings built on 3.4 acres located at 223 Andover Park East in Tukwila, WA. The larger building, approximately 41,000 square feet, will house a Circuit City Store which sells consumer electronics and appliances through a full service retail environment. The second building will be approximately 9,000 square feet and house 1 or 2 specialty retailers. These tenants have not yet been determined. The site is currently fully built out for industrial use and contains an abandoned 87,000 +1- square foot warehouse. Due to the condition of the building and incompatibility with the new proposal, the existing structure will be fully demolished and will be replaced by new construction. A. A fully landscaped sidewalk will be built along the length of Andover Park E to the City's specifications. Street trees will be in a planter adjacent to this sidewalk. Sidewalks will also be provided along the front of both buildings. Pedestrian connections have been designed to enhance pedestrian access from Andover Park E. to both buildings. A customer pick up area is designed into the facade of the store. As many items sold are too heavy to carry long distances, customers can walk to their cars unencumbered by these heavy items and return to this staging point. As well as the necessary street trees, landscaping will be provided in planters in the primary parking field. B. In response to staff comments, the visual impact of the parking field will be moderated by the following. i) The smaller building has been pulled closer to Andover Park E. In the original design, the lease space was in -line with the Circuit City Store and all parking was directly in front of the two stores. ii) The site is long and narrow and flanked on both sides by buildings - as such, the view corridor to the site is minimal iii) Landscaping in planters will serve to moderate the visual impact. Truck loading will be in the rear of the primary building via access through the alley off of Strander. This will consolidate truck traffic with the adjacent retailers while separating truck traffic from pedestrian and customer vehicle traffic. Access via a Reciprocal Easement Agreement has already been secured. C. The height and scale of the primary building complements the site. Visual monotony is broken up by a burgundy entrance feature which clearly identifies the customer entrance and avoids "a big box" look by rising above the lower wall. This design is critical to the store design as it is a recognizable icon closely linked with Circuit City's regional identity. The other building will be smaller in scale and provide more glass frontage to accommodate pedestrian access and visibility. 2. THE RELATIONSHIP OF STRUCTURE AND SITE TO ADJOINING RETAIL A. The majority of the adjacent abutters are currently or have recently been converted from industrial buildings to retail buildings. As such, there is some variety in the architectural treatments of each. This provides for pleasant visual relief as there is no monotony of styles. The proposed primary building will complement these buildings through maintaining similar scale and providing primary construction in a similar tone complemented by distinctive red accents. B. Landscape buffers and sidewalk are designed to complement the adjacent sites by distinguishing property lines while providing access via sidewalks. C. The intersection of Strander and Andover Park E is currently undergoing significant redevelopment converting abandoned industrial space to retail. Many of the proposed projects will serve the same customer base. As such, there will be synergy of use. The proposed Circuit City Store will certainly be in character with the current redevelopment of this neighborhood. D. Truck access will be shared with several adjacent sites through an alley off of Strander. Pedestrian access will be achieved from adjacent retailers via the rebuilt sidewalk on Andover Park E.. Pedestrian circulation through the rear of the site will not be encouraged to avoid mixing pedestrians with the significant truck traffic to the rear of the building. 2 E. Customer vehicular traffic will be conveniently contained and serviced via curb cuts off and on to Andover Park E.. 3. LANDSCAPE AND SITE TREATMENT The site is currently fully developed as an industrial warehouse. There is very little topographical variance and minimal grade deviations. The new landscape and site treatment has been designed to achieve the city's goals, including rebuilding the sidewalk and providing street trees. The service yards will be to the rear of the buildings. The primary building will have truck loading and waste disposal in an alley behind the building and will be obscured from sight from Andover Park E. 4. BUILDING DESIGN The building design and use will be harmonious with the adjacent retail redevelopment. The design will be in similar tones and scale as the various buildings in proximity. In terms of overall square footage, this project will be of medium size. i.e.: Smaller than the Segale Project on Strander yet larger than the Office Depot building at the intersection of Andover Park E and Strander. Primary construction materials are colored block, dryvit and Alucobond. Alucobond is a burgundy colored aluminum clad material used for accents and is the primary exterior component of the entrance feature. The entrance feature is a design unique and critical to Circuit City's store design. It rises up from the lower walls and accentuates the customer entrance while providing visual relief to the facade. Its color is a distinct warm burgundy. Both the color and design are critically linked with Circuit City's regional identity. Screening and lighting will be provided to present a clean harmonious image to Andover Park E. 5. MISCELLANEOUS STRUCTURES AND STREET FURNITURE A. NA B. NA INTERURBAN SPECIAL REVIEW DISTRICT 1. This is an existing fully developed industrial site, it has no natural amenities. 2. NA 3 3. On site pedestrian circulation will be provided by constructing a new sidewalk along the width of the site on Andover Park E.. Both buildings will have sidewalks along their front facade and pedestrian walkways will be clearly marked to provide connection from the sidewalk on Andover Park E. to the smaller building and then from the smaller building to the primary building. It is not the intent of the site design to encourage pedestrian circulation through the rear of the site, as this area will be primarily used for truck turnaround and loading by Circuit City and some of the adjacent retailers. 4. The proposed use as a retailer of consumer electronics and other specialty goods is certainly in line with 1) The CM zoning; 2) The immediate neighbors i.e: Computer City, Office Depot, Best Products and the Segale Center; and 3) The general area of the Southcenter Mall - one of the best retail areas in terms of diversity, quality and quantity of shops in the Pacific Northwest. 5. The proposed use of this redevelopment will generate few adverse environmental impacts particularly when the previous industrial use is considered. While peak vehicle trips may increase slightly, truck trips will be reduced. Overall building size will be reduced as will the volume of space which requires heating, electricity and other services. Storm water treatment will be upgraded and landscaping will be enhanced. 6. There is nothing of historical significance on this site.
