Dear Mr. Browne, Per our earlier discussions, I have reviewed'this project with Jack Pace and find the following: 1. The proposed act:-n consists of removal of an underground oil tank and oil /water separator, removal and replacement of 1,200 cu. yds. of contaminated soil and a storm drain line, and,a temporary shoring system for adjacent structures during construction. Work is being done in coordination with an EPA remediation plan. 2. The tank contains 9,000 gals., which is less than the SEPA exempt level of 10,000 gallons. 3. Underground tank removal, if consistent with the Shoreline Master Plan, can be considered a maintenance action which is exempt from Shoreline Permit requirements per WAC 173-14 - 040(b) (Mark, DOE Shorelines, 8/18/93). 4. The specific tank removal has been found to be consistent with the site's Shoreline Master Plan policies. Based on the above findings, the Planning Division determines that the proposed action is exempt from both SEPA and Shoreline Permit requirements. Your application fee is herewith returned.
