Temporary Noise Variance
The Washington State Department of Transportation (WSDOT) is
planning to construct ramp HOV bypass lanes on several on
ramps to SR 405. In Tukwila, the northbound SR 405 on ramp
from SR 181 will be widened to provide a HOV bypass.
Attached is a vicinity map showing the project location and
plan sheets showing the ramp widening.
Due to the current levels of traffic on SR 405, closing a
lane or ramp during the day in order to perform construction
work would have significant impacts on traffic flow.
Construction related lane closures could cause backups on
other state and city routes, cause delays to the traveling
public, and jeopardize worker and public safety. It is
therefore imperative that the work requiring lane closures
be performed at night.
The major items of work that would require lane or ramp
closures are the asphalt overlay of the on ramp, girder
placement for the bridge overcrossing, and the import /export
of haul material. During the resurfacing operations the
ramps will be closed and traffic rerouted.
The types and sizes of the contractor's equipment to be used
on the site are at the discretion of the contractor. We
anticipate the contractor will require graders, rollers,
dump trucks, pavers and boom trucks.

The mitigation measures we will implement to minimize noise
levels are as follows:
1. All use of impact or impulse tools or pavement grinders
shall be restricted to the hours of 7 a.m. to midnight
Monday through Friday and 9 a.m. to midnight on Saturday
and Sunday;
2. All trucks performing export haul shall have rubber bed
liners between the hours of 10 p.m. to 7 a.m. Monday
through Friday and 10 p.m. to 9 a.m. on Saturday and
Sunday;
3. All backup warning devices shall be the least intrusive
ambient sensitive type or the contractor may use a backup
observer in lieu of backup warning devices as allowed by
WAC 296 -155 -610 (2) (e).
We are requesting a 14 day noise variance from the Tukwila
City Code pursuant to subsection 8.22.190 (a), allowing our
contractor to work between 10:00 p.m. and 7:00 a.m. These
14 days will be interspersed throughout the contract. The
proposed start of construction is May 15, 1995 with an
estimated project completion of September, 1996.

FINDINGS AND DECISION
APPLICANT: Washington State Department of Transportation
LOCATION: SR 405 at the intersection with SR 181.
APPLICATION: Temporary Variance from TMC 8.22
DECISION: Approval
FINDINGS:
1. The Washington State Department of Transportation (WSDOT) wants to add
an HOV bypass lane onto SR 405 at the intersection with SR 181. Excavation,
hauling, grading, girder placement and paving work is to be performed at night
during a 14 day period between May 15, 1995 and September 1996. This work
generates noise exceeding TMC requirements between 10:00 pm and 5:00 am,
thereby a temporary noise variance is sought per TMC 8.22.190.
2. TMC 8.22.190(a) provides the Administrator the exclusive authority to grant
Temporary Variances from TMC 8.22 if the following criteria is met:
A. Does not annoy a substantial number of people, and
B. Does not endanger public health and safety.
3. A Temporary Variance is limited to 14 days per TMC 8.22.190(a).
4. The construction activity will produce noise levels of 74 - 92 dBA 50 feet from
the noise sources.
5. A significant hillside, some of which is heavily vegetated, exists along the north
side of the project site. On top of, or along, the hillside are located single family
residences. Other single family residences exist east of the site, across interurban
Ave. Commercial zoned and developed property lies west, .east and south
of the site.

6. WSDOT was granted a noise variance for significant heavy construction over a
three year period at this location.
CONCLUSIONS:
1. The project will not annoy a significant number of people (TMC 8.22.190(a)).
Most, if not all, of the residents adjacent to the project site will likely not be
.adversely impacted, judging from the Renton "S- Curves" project and the
Tukwila Strander Boulevard project now under construction. The number of
residents impact should not be significant.
2. The project will not endanger the public health and safety (TMC 8.22.190(a)).
Night -time construction will increase public health and safety by minimizing
interference with daily traffic movement.
DECISION:
Based upon the above, the Noise Ordinance Administrator approves the Temporary
Variance.
Entered October 10, 1994, per authority granted by TMC 8.22.200.

NOTICE OF RIGHTS TO APPEAL:
Any party aggrieved by the decision of the Noise Ordinance Administrator may appeal
that decision to the Board of Adjustment by filing that appeal in writing with the City
Clerk within ten (10) calendar days of the date of that decision. An appeal must be made
in the form specified in TMC 8.22.280(b).
