intent of the original permit," a Shoreline Permit Revision is hereby granted to: CITY OF
TUKWILA PUBLIC WORKS to undertake the following development:
Project Name: Tukwila Community Center:
Street Improvements for 42nd Avenue South
Project Description: The project implements curb /gutter /sidewalk improvements required
under Tukwila codes for previously - permitted Tukwila Community Center. Work will be
located within existing right -of -way and sidewalk easement. Proposed work will not extend
closer to the shoreline than existing paved areas; heavy equipment used in construction will
not adversely impact archaeological site on Community Center site to the east. The project
includes separated sidewalks and landscape strip planted with shade trees. Project plans
contained in File #L94 -0105 located at Tukwila Dept. of Community Development provide
further details of the proposed work.
Location of Project: 42nd Avenue South, Tukwila, WA, SE 1/4 Sec. 10, Twn. 23, Rge. 4;
within the area of the Green/Duwamish River, which is a shoreline of statewide significance
and is designated as an Urban Environment.

DEVELOPMENT PURSUANT TO THIS PERMIT SHALL BE UNDERTAKEN
PURSUANT TO THE TERMS AND CONDITIONS: Attached to this Permit
No conditions •
This Permit is granted pursuant to the Shoreline Management Act of 1971 and nothing in
this Permit shall excuse the applicant from compliance with any other Federal, State or local
statutes, ordinances or regulations applicable to this project, but not inconsistent with the
Shoreline Management Act (RCW 90.58). This Permit may be rescinded pursuant to RCW
90.58.140(8) in the event the permittee fails to comply with the terms or conditions thereof.
CONSTRUCTION PURSUANT TO THE REVISED PERMIT MAY BEGIN
IMMEDIATELY (EXCEPT CONDITIONAL USES OR VARIANCES, WHICH ARE
NOT EFFECTIVE UNTIL DEPT. OF ECOLOGY APPROVAL PER WAC 173 -14-
064(5)). ANY APPEALS TO THIS PERMIT DECISION MUST BE FILED WITHIN
TWENTY -ONE (21) CALENDAR DAYS FROM THE DATE OF DECISION (below)
WITH THE STATE SHORELINES HEARINGS BOARD, PURSUANT TO THE

NOTICE OF REVISION TO SHORELINE PERMIT
issued for Tukwila Community Center (File #L94 -0105) for additional
42nd Avenue Street Improvement
DATE: July 10, 1996
I have completed a preliminary review of your plans for the 42nd Avenue improvement project. I
find that the proposed work meets the criteria for a revision to the original shoreline permit for the
Tukwila Community Center. These findings are based on information contained in the project file, as
noted below:
Project Name: Tukwila Community Center
Applicant: City of Tukwila
Location of Project: Green/Duwamish River, 42nd Avenue South, Tukwila, WA
SE 1/4 Sec. 10, Twn. 23, Rge. 4
Permits required:
Based on the information contained in the file, the 42nd Avenue street improvements project meets
the categorical exemption level for "minor road and street improvements" (WAC 197- 11- 800(2)(c)).
Therefore, no SEPA review is required.
State shoreline regulations provide for limited revisions to original shoreline permits, where the
"proposed changes are within the scope and intent of the original permit" (WAC 173 -14- 064(1)). To
be considered within the original scope and intent, revisions must meet 7 criteria
(WAC 173 -14- 064(2)). After reviewing project plans, it appears that the project meets these 7
criteria. Therefore, the work can be covered under a revised shoreline permit for the Community
Center.

Project Description:
The nature and extent of proposed improvements are as follows:
Project implements curb /gutter /sidewalk improvements required (Tukwila codes) of
previously - permitted Tukwila Community Center;
Project consists of reconstruction of existing roadbed, including asphalt overlay and
curb /gutter /sidewalk along Community Center (east) side;
All work is to be completed within existing right -of -way and sidewalk easement;
Project will not significantly increase vehicle capacity;
Work will not extend closer to shoreline than existing paved areas; heavy equipment used in
construction will not adversely impact archaeological site on Community Center site to the
east;
Sidewalks will be separated, with a minimum 5 -foot wide landscape strip planted with
appropriate shade trees; temporary or permanent irrigation will be provided;
The number of street trees approved in the Community Center plans will not be reduced;
The proposed bus shelter will be located at back of sidewalk, on the Community Center site.
Project plans contained in the file provide further details of the proposed work.
Once the revised shoreline permit is issued, construction may commence immediately. However,
please note that there is a 30 -day appeal period, during which time construction may proceed at the
applicant's own risk. As required by State regulations, we will also "notify parties of record" of this
action (WAC 173 -14 -064).

RE: TUKWILA COMMUNITY CENTER- - Shorelines permit scope
DATE: September 1, 1995
I have reviewed your letter of August 29, 1995 regarding
archaeological trenching for the Community Center site.
This trenching work was not specifically mentioned in the Shoreline
Permit. However, I understand it is required for the federal (Army
Corps) permits, which are required before riverbank and site work
can begin.
You indicated in your letter and our discussion that the trenching
will be entirely contained within the area already approved for
excavation in the City's Shoreline Permit. Moreover, the trenching
work will further the goal of monitoring and protecting any
potential archaeological materials.
Based on this, I believe the proposed trenching work is within the
original scope and intent of the City's Shoreline and SEPA permits.
Therefore, new permits or revisions are not necessary.

RE: Unplanned Work on Tukwila Community Center Site
Shoreline Substantial Development Permit #L94 -0105
Dear Mr. Jimerson
As you know, the Tukwila Community Center project is working with the Muckleshoot
Indian Tribe and the Army Corps of Engineers to finalize the requirements for the Corps
of Engineers Permits. It is anticipated that additional archaeological investigation may be
needed along the shoreline. We will not know if this work is required until the actual
C.O.E. permit is issued about the first week of October.
However, the City has elected to proceed with the archaeological trenching now so that
when the Corps permit is issued the project can proceed directly into the riverbank
stabilization work. The riverbank work must be completed within the Washington State
Department of Fish and Wildlife window, which is now set to expire the 15th of October,
but may be extended to the 1st of November. Given this tight time line we feel that we
can not wait for a decision on whether the archaeological work will be required, but must
proceed under the assumption that it will.
This trenching was not covered in the above referenced Shoreline permit. However the
trenching will only occur in areas that are slated for excavation under the shoreline permit.
This work does not expand the total amount of area to be disturbed. The trenching will
look for evidence of artifacts within the area proposed for excavation.
The area of the proposed trenching is shown on the attached plan.

6. The toe shall be installed to protect the integrity of bank
protection material.
7. Bank sloping shall be accomplished in a manner that avoids release
of overburden material into the water. Overburden material
resulting from the project shall be deposited so it will not
re -enter the water.
8. Bank protection material shall be clean, angular rock and shall be
installed to withstand 100 -year peak flows. River gravels or
other round cobbles shall not be used as exterior armor.
9. Bank protection and filter blanket material shall be laced from
the bank. Dumping onto the bank face shall be permitted only if
the toe is established and the material can be confined to the
bank face. An excavated trench for the toe shall not be used.
10. Fish habitat components such as logs, stumps, and /or large
boulders are required as part of the bank rotection project to
mitigate project impacts. These fish habitat components shall be
installed to withstand 100 -year peak flows.
11. Alteration or disturbance of the bank and bank vegetation shall be
limited to that necessary to construct the project. Within seven
(7) calendar days of project completion, all disturbed areas shall
be protected from erosion using vegetation or other means. Within
one (1) year of project completion, the banks, including riprap
areas, shall be revegetated as shown on the lanscape plan and
maintained as necessary for three (3) years to ensure 80 percent
survival.
12. The stream bank at the point of discharge shall be armored to
prevent scouring.
13. Erosion control methods shall be used to prevent siltation from
entering the stream. These may include, but are not limited to,
straw bales, filter fabric, temporary sediment ponds, check dams
of pea gravel- filled burlap bags or other material, and /or
immediate mulching of exposed areas.
14. All waste material such as construction debris silt, excess dirt
or overburden resulting from this project shall be deposited above
the limits of flood water in an approved upland disposal site.
15. Extreme care shall be taken to ensure that no petroleum products,
hydraulic fluid, fresh cement, sediments( sediment -laden water,
chemicals, or any other toxic or deleterious materials are allowed
to enter or leach into the stream.

The Tukwila Department of Community Development (DCD) has completed
its review of the Shoreline Permit for the above project. Findings
and conclusions are discussed below. Any conditions of approval of
the permit follow.
A. BACKGROUND
1. Project description
The City of Tukwila proposes to construct a 48,000 sq. ft.
multi - purpose recreational facility on a 12.8 -acre site along
the Duwamish River. This new Community Center will include
a gymnasium, racquetball courts, offices, crafts rooms, child
care area, meeting rooms, and senior adult activity center.
Outdoor recreation facilities will include softball and
soccer fields, events plaza, public river trail, and picnic
shelter. An area on the northwest portion of the site has
been identified as archaeologically significant, and this
area will be protected from development.
Other site improvements include a 327 -car parking lot,
sidewalks and landscaping. The site will be fully
landscaped, with an automatic irrigation system. The
project's stormwater requirements will be addressed through
a combination of increased in -river flood storage capacity,
and a series of parking lot biofiltration swales with
oil /water separators.

To protect site improvements, and to provide public access
and flood storage, the Duwamish River riverbank which fronts
on the site will be stabilized, re- contoured, and re-
vegetated. The riverbank will be restored with native
vegetation and large woody debris. A 15- foot -wide "bench"
for maintenance access and a public trail will also be
provided. The river through this reach is subject to tidal
influences.
Construction of the above improvements is anticipated to
begin in summer 1995, with completion approximately one year
later.
2. 1978 King County Shoreline Master Program & regulations
The Community Center site is located northward of the 42nd
Avenue bridge, in an area annexed by Tukwila from King County
(KC) in 1978. As no new shoreline master program has been
adopted for this area, the project is subject to 1978 King
County Shoreline Master Program and regulations.
The KC Master Program and shoreline regulations are treated
as a comprehensive shoreline use plan, "consisting of the use
regulations and procedures contained in this title, and the
goals, objectives and policies of the King County shoreline
management master program...." (25.08.290). Tukwila is the
agency responsible for administering these KC requirements.
3. Variance to building height limits
The proposed Community Center has a 46 -foot building height.
KC shorelines regulations limit building height to a maximum
of 35 feet. Therefore, the project will require a KC
shoreline variance. KC height regulations, variance
procedures and variance criteria are discussed further under
the project's "Variance Permit #L94 -0087 State Supplement."
4. Conditional Use Permit approval
Under the Tukwila Zoning Code, the project must meet criteria
for a Conditional Use Permit (CUP) . This was reviewed by the
Tukwila Planning Commission at a public hearing on 2/23/95.
Under the KC Shoreline Master Program and regulations, state
review of the Conditional Use Permit is not required.

B. SHORELINE ISSUES
Below is a discussion of the main KC shoreline master program
policies which are applicable to this project, and how the project
responds.
1. Urban Environment policies: The project will be located on
a currently vacant site within an already urbanized area.
The Community Center responds to its shoreline setting by
orienting the building toward the water, and providing a
river trail and outdoor recreation areas next to the river.
Visual and physical access to the river will be included in
the project; pedestrian water -front activities will be
provided for a wide range of citizens in the community. The
Tukwila community will ensure a high quality architectural
and landscape design, through established, public design
review and conditional use permit review processes. The
riverbank along the site will be protected from erosion, re-
vegetated with native plants, and improved for habitat. The
project will further shoreline policies through the
development of an under - utilized urban site for a multiple -
use facility.
2. Shoreline Use Element policies: The proposed Community
Center will satisfy community needs . while providing an
appropriate level of protection for the long -term carrying
capacity of the shoreline. Under proposed new Tukwila
shoreline policies, a community center would be considered a
"water enjoyment use" which brings a broad segment of the
public close to the river. As such, the community center is
a very appropriate use for the shoreline area. There are no
unique or particularly fragile shoreline areas on site,
although some enhancement of the natural features of the
shoreline is proposed.
3. Public Access Element policies: The Community Center will
include a trail, picnic areas and other features which
improve public access to the shoreline, but which are
designed with public health and safety in mind. The trail
will eventually become part of the regional Green River
Trail. The surrounding area and the large, vacant site are
relatively flat, therefore, the project will not obscure any
important views of the river. The riverbank at this site is
not pristine nor fragile, so no adverse affects from public
access are expected. The entire project will respect private
property rights by buffering public uses on site from
surrounding residential areas.

4. Conservation Element policies: There are no unique or
fragile areas along the project's shoreline. The shoreline
has been previously cleared of vegetation, and has no
significant existing trees. The site is virtually flat. To
the degree possible, trees and other landscaping will be
added throughout the site. There will be a net increase in
tree canopy cover after project completion.
Approximately 30% of the site will be covered in impervious
surfaces. Storm water from the building will be discharged
directly to the river. Runoff from the parking lot will be
gathered in a series of biofiltration swales located within
the parking lot, run through an oil /water separator and
discharged to the river. Approximately 20,000 cubic feet of
storm water detention will be supplied on site. A control
manhole will release water from the parking area into the
river only when the river volume is below flood stage.
Protection of the new Community Center improvements will
require stabilization of the riverbank. In addition,
approximately 110,000 cubic feet of flood storage capacity
will be added to the river. Original plans for re-
construction of the riverbank have been modified after
extensive review with King County Surface Water Management,
Dept. of Fisheries, and the Muckleshoot Tribe. Approximately
480 linear feet of the total 950 linear feet of river bank
which fronts on the site will be stabilized and re- contoured.
Existing steep banks will be regraded to a 2:1 slope and
armored with rip -rap below the ordinary high water mark. A
15- foot -wide "bench" is required for maintenance access, and
this also provides a platform for the public trail. To
improve aquatic habitat, the line of the river bank will
undulate to create pockets of quiet water, and the completed
bank will be fully re- vegetated using small- stature, native
riparian species. In addition, large, woody debris in the
form of logs with root balls attached will be anchored along
the bank below the ordinary high water mark.
5. Recreation Element policies: There are currently no formal
opportunities on the site for shoreline - related recreation.
The proposed Community Center will provide public access to
the shoreline through a river trail and views of the river,
as well as benches and picnic tables for passive recreation
along the river. In addition, other outdoor recreation
facilities are proposed (e.g. softball), which have the
potential to bring visitors closer to the shoreline.
6. Historical /Cultural Element policies: A portion of the site
has been identified as having archaeological significance.
That portion (outlined on the site plan) qualifies for, but

has not received, placement on the national register of
historic places. The entire site has had a subsurface survey
done to determine the limits of the archaeologically
significant area. Site improvements have been planned to
avoid any sub - surface disturbance of the identified
archaeological area, preserving this area for future
investigation. The Muckleshoot Tribe and the State Office of
Public Archaeology have been given an opportunity to respond
to the project plans.
C. CONCLUSIONS
The development of a vacant site for a large -scale public
facility cannot provide full protection for the riverbank or
potential unidentified archaeological resources. However,
the proposed Community Center will enhance shoreline public
access, while providing an adequate level of long -term
protection for natural and cultural resources, and an
appropriate balance between multiple, competing uses.
Therefore, the project complies with State and KC shoreline
policies.

In order to provide necessary facilities, a proposed gymnasium
will contain a set of competitive volleyball courts.
Recognized standards for gymnasia require a minimum interior
clearance of 28 feet, which permit volleyball. This standard
ceiling height for the gym of 28 feet, plus the necessary

18 -foot roof structure, results in a 46 -foot height for the
facility. The proposed 46 -foot building height is 11 -0" above
the 35 foot limit established in KC shoreline regulations. A
proposed entry rotunda is also designed at this height, which
provides the necessary scale for a civic facility, and allows
the visitor to immediately identify it as being the main
entrance. This rotunda will display the old school bell from
the City's historic Duwamish school house, previously located
four blocks away.
2. Existing Land Uses and Surrounding Character
The 12.8 -acre site is presently vacant. To the west and south
is the Duwamish River, with industrial uses beyond. To the
east and across the road to the north is a residential area.
The northwest corner of the site is occupied by a small
neighborhood convenience store.
3. Tukwila Board of Adjustment Variance Approval
On November 3, 1994, the Tukwila Board of Adjustment approved
the City of Tukwila's request for a Zoning Code Variance. The
variance was requested to allow the proposed gymnasium and
main building entry to exceed the 30 -foot single - family
residential district height limit. While the peak of the
facility's sloped roof is at 46 feet, the Tukwila Zoning Code
uses "mean building height" for a sloped roof, establishing
the roof height at 38 feet.
Following due public notice and a public hearing, the Board
found that the Community Center variance proposal satisfied
all Tukwila Zoning Code variance criteria. A copy of the
Staff Report for Variance #L94 -0087, with findings and
conclusions adopted by the Board, is attached.
4. Other Tukwila Permit Reviews
The Tukwila Community Center has undergone four additional
public reviews. A Conditional Use Permit and Design Review
Permit were reviewed by the Tukwila Planning Commission and
Board of Architectural Review on February 23, 1995. The
Mitigated Determination of Non - Significance was issued on
2/18/95. The Shorelines Substantial Development Permit
( #L94 -0105) documentation is included under separate cover.
During these reviews, citizens had several opportunities to
review and comment on the facility. No comments regarding
proposed building height, setback, or bulk were received.

B. APPLICABLE CRITERIA AND REGULATIONS
1. 1978 King County shoreline master program & regulations
As the above project is located northward of the 42nd Avenue
bridge, it is subject to the 1978 King County (KC) shoreline
master program and regulations. Until Tukwila adopts a new
shoreline master program, the City is the agency responsible
for administering the KC requirements.
2. Building height limits
The maximum height of the proposed community center building
is 46 feet, based on County regulations, which measure height
"from average grade level to the highest point of a
structure..." (KCC 25.08.240) (see drawings included in
Variance Staff Report 10/24/94).
Under the County's General Regulations, the maximum building
height permitted within the shoreline zone is 35 feet. This
height limit may be modified, provided that the project does
not obstruct residential views, is permitted in the underlying
zone, AND is agricultural, water related or water dependent
(KCC 25.16.030). The proposed project meets the first two
criteria. It is not agricultural nor water related /water
dependent. Therefore, the proposed 46 -foot building height
will require a variance from KC shoreline requirements.
3. Variance review process
The KC master program and shoreline regulations are treated as
a comprehensive shoreline use plan, "consisting of the use
regulations and procedures contained in this title, and the
goals, objectives and policies of the King County shoreline
management master program...." (KCC 25.08.290).
The WAC requires that, after approval by the City of Tukwila,
any permit for a variance under an approved master program be
submitted to the Department of Ecology for its approval,
approval with conditions, or denial (WAC 17 -14 -130; RCW
90.58.140(12). To obtain a KC Variance Permit, the applicant
must demonstrate that the proposal meets certain criteria
specified in the WAC. State variance criteria and the
project's response are discussed below.

C. STATE SHORELINE VARIANCE APPROVAL CRITERIA
Any variance to the KC shorelines performance standards is
authorized "only under the conditions enumerated in
WAC 173 -14 -150 (Review Criteria for Variances)" (KCC
25.32.040). Those conditions, or criteria, are noted below in
bold, along with staff's response as to how the proposal meets
the criteria.
I. Variance permits should be granted in a circumstance
where denial of the permit would result in a thwarting
of the policy enumerated in RCW 90.58.020. In all
instances extraordinary circumstances shall be shown
and the public interest shall suffer no substantial
detrimental effect.
The proposed Tukwila Community Center will enhance public
recreational opportunities, and maintain valuable open space
within the shoreline environment for residents and workers in
Tukwila and neighboring communities. Through development of
the site, special populations, such as seniors and children,
will have greater opportunities for access to the river.
While some disturbance of the riverbank will occur during
construction of flood storage capacity for the project,
re- vegetation and enhancement is proposed. The net result is
the resources and ecology of the shoreline will be enhanced.
For these reasons, the project will result in such long term
public benefits as envisioned in RCW 90.58.020.
2. Variance permits for development that will be located
landward of the ordinary high water mark may be
authorized provided the applicant can demonstrate all
of the following:
a) That the strict application of the bulk, dimensional
or performance standards set forth in the applicable
master program precludes or significantly interferes
with a reasonable use of the property not otherwise
prohibited by the master program.
The proposed Tukwila Community Center is an allowed use on
this site, as are schools, fire stations, libraries, and other
public facilities. Often, an integral part of such public
facilities is a gymnasium, campanile, hose tower, or other
tall design element. Moreover, these types of facilities have
different functions, layout and structural requirements, and
different users than single family residences or commercial

uses. Therefore, strict application of a residential -scale
height limit unnecessarily interferes with a normal use of the
site and diminishes the potential public benefit from such a
use.
b) That the hardship described (above) is specifically
related to the property, and is the result of unique
conditions such as irregular lot shape, size or
natural features and the application of the master
program, and not, for example, from deed restrictions
or the applicant's own actions.
The need for a building height variance stems directly from
conditions related to the property and the specific
application of KC shoreline regulations.
1) Regulations applicable to this site allow certain public
facilities, but preclude their construction by establishing
unreasonable height limits. For example, a building height
limit of 35 feet is not practicable for a competition -sized
gymnasium or a fire station hose tower. Unlike residential or
commercial uses, a public facility like the community center
has an obligation to the public welfare. This public
obligation is not recognized in typical code requirements.
2) While a 35 -foot height limit might generally protect
shoreline views, its application to this specific project
results in no measurable benefit to surrounding properties or
the public. Given the 12.8 -acre size of the property, the
remoteness of nearby residences to that portion of the
shoreline, and the flatness of the surrounding terrain, there
are no significant views that may be affected. The potential
benefit to the public, however, is great. While not actually
defined by KC as a "water related" use, the community center's
recreational and river access features provide a water - related
public benefit.
3) Development codes require the facility's floor elevation
to be a minimum of 1 foot above the FEMA 100 -year flood level,
with a strong recommendation for 2 feet above the 100 -year
flood level. Flood hazard reduction is particularly important
for a public facility like the proposed community center.
However, the low existing ground elevation of the property and
the high flood elevation greatly limit options for setting the
building below grade. In addition, the flood - proofing of
structures and provision of handicapped access would become a
major hardship.

c) That the design of the project is compatible with
other permitted activities in the area and will not
cause adverse effects to adjacent properties or the
shoreline environment.
The proposed community center is an important civic facility,
with functions and characteristics distinct from residential
and commercial uses. While not a residential use, the Tukwila
Community Center is designed to fit into its residential
neighborhood. An essential part of the concept is the use of
sloped roofs, wood siding and brick, which give the proposed
structure a more residential appearance. The large size of
the site, and the siting of the building a minimum of 300 feet
from residences, also reduce the apparent height and scale of
the gymnasium and entry rotunda. The entire complex is set
back a minimum of 55 feet from the shoreline. In these ways,
the proposed facility is compatible with the area. During
other City public review processes, the proposal was reviewed
and approved as compatible by the community.
Through its public programs and services, the proposed
community center has the potential to enhance the immediate
neighborhood and overall community. Shoreline improvements
planned for the project will result in an increase of
riverside vegetation and public access opportunities. For
these reasons, the granting of the variance will not be
detrimental to the public welfare or to nearby properties, and
will result in an improved public facility.
d) That the requested variance does not constitute a
grant of special privilege not enjoyed by the other
properties in the area, and is the minimum necessary
to afford relief.
Public facilities are allowed uses in the shoreline zone,
under both KC and Tukwila regulations. Further, the Tukwila
Zoning Code permits churches, fire stations, water towers,
schools and community centers to locate in residential
districts as conditional uses.
Many of these public facilities may have functional elements
or design features that exceed standards normally used for
single - family homes. Unlike a commercial structure whose bulk
is dictated by market forces, a public facility's height and
bulk requirements are a direct response to a public need. A
school, for example, may require a gymnasium that exceeds the
usual height limitations in order to provide necessary
activities such as volleyball. A fire station often requires
a hose tower. Also, unlike other uses, public facilities

typically undergo several rigorous public reviews, thus
ensuring the public's interest is protected.
A public facility such as the community center should be
allowed to develop under the same substantial property right
that is available to schools and other types of public
facilities in the shoreline and residential zones. The
11 -foot height variance is the minimum variance needed to
construct the gymnasium. Only the proposed rotunda /gallery
space and the gymnasium will exceed 35 -foot height limit.
Granting the variance would provide a privilege consistent
with that granted to other public facilities, including the
right for a gymnasium that meets established standards.
e) That the public interest will suffer no substantial
detrimental effect.
The proposed Tukwila Community Center embodies the concept of
benefitting the public welfare. It will provide recreational
and community services not otherwise available to the public,
and provide a range of shoreline and recreational benefits
that further add to the public benefit.
On such a large property as the 12.8 -acre proposed site, an
11 -foot height increase in some elements of this building will
provide a better relationship between the structure and its
site. Potential adverse visual impacts are minimized by
locating the rotunda /gallery and the gymnasium several hundred
feet from nearby residences.
In addition, the public welfare has been addressed and
protected through several public review processes. Planning
Commission review of the Conditional Use Permit, Board of
Architectural Review of the project design, and public and
agency review under the State Environmental Policy Act (SERA)
have ensured that the project's effect on the property-and the
neighborhood is positive. During these different public
reviews, citizens have had opportunities to request changes to
the project to minimize any potential impacts.
3. In the granting of all variance permits, consideration
shall be given to the cumulative impact of additional
requests for like actions in the area. For
example...the total of the variances shall also remain
consistent with the policies of RCW 90.58.020 and
shall not produce substantial adverse effects to the
shoreline environment.

It is unlikely that a similar variance request will ever occur
within the portion of Tukwila's shoreline covered by KC
regulations.
1) It is expected that different height and use regulations
will apply to the site once it comes under Tukwila's shoreline
jurisdiction, after a new shoreline master program and
regulations are adopted in 1996.
2) The proposed Tukwila Community Center is probably the only
large -scale public facility that will be developed in the
Tukwila- administered segment of the KC shoreline zone.
3) Granting the 11 -foot height variance is unlikely to
trigger cumulative impacts, as the variance relates strictly
to the unique function and needs of a public facility, and the
unique characteristics of the site. Residential and
commercial uses do not have a similar need for a building
height increase to serve a public function. Further, there
are currently no other 12 -acre sites in the area developable
as a large public facility. Due to the site's low elevation
relative to the 100 -year flood, the structure cannot be set at
a lower grade without violating Federal standards or incurring
immense costs. As a public project, the building has a
greater burden to protect the public health and safety.
4) A height variance will not adversely affect the
public welfare, because of several safeguards built into the
design and permit processes. The facility's design provides
a residential appearance, and provides open spaces totalling
over 90% of the site, thus minimizing visual impacts. No
significant residential views of the river will be
compromised. The public's interest is further protected
through several additional public reviews of the project.
D. CONCLUSIONS
The additional 11 -foot building height sought by the variance will
allow the Tukwila Community Center to provide an attractive and
functional facility for the public. A height variance is necessary
because of special circumstances related to the site, its elevation
relative to the flood plain, and the specific application of KC
regulations to a unique public project. A height variance allows
construction of a full - service community center, which contains
features (rotunda and gym) that are normal functions of such a
facility.
The community center should be allowed to be developed under
the same conditions as apply to other public facilities, such
as schools and fire stations, which often require structural

elements taller than 35 feet. These public facilities also
typically undergo several public reviews, thereby providing
additional safeguards for the public welfare. Granting the
variances thus do not represent a grant of special privilege.
A height variance does not adversely affect the
public welfare, because of the facility's residential
appearance, and its location several hundred feet from nearby
residences. No views of the river will be blocked, due to
flat terrain and the fact that existing residences are located
far from that portion of the shoreline.
The proposed center's use and activities will foster
neighborhood preservation, and will constitute a compatible
land use for the adjoining residential area. The facility
directly benefits the neighborhood and the larger public as it
provides services and recreational facilities not readily
available in the area, and shoreline restoration and access
not otherwise provided.

Project Na_rative
The City of Tukwila proposes to construct a multi - purpose
recreational facility on a 12.8 acre site along the banks of the
Duwamish River. The site is located on 124th Ave. S. and S. 42nd
St. in the Allentown neighborhood of Tukwila.
The proposed Tukwila Community Center building is planned as a
48,000 square foot facility housing a full size gymnasium, 2
racquetball courts, a fitness and weight training room, locker
rooms, administration and recreation offices, youth and teen
center, arts and crafts space, child care area, general meeting
space, multi- purpose banquet space and a senior adult activity
center.
Site improvements planned to accompany the new Community Center
will include a 327 car parking lot. When completed the parking lot
and building will cover about 30% of the site in impervious
surface. Storm water from the building will be discharged directly
to the river. Storm water runoff from the parking lot will be
gathered in biofiltration swales, ran through an oil water
separator and discharged to the river. Approximately 110,000 cubic
feet of flood storage capacity will be added to the Duwamish river.
An additional 20,000 cubic feet of storm water detention will be
supplied on site. A control manhole will only release water from
the parking area into the river when river volume is below flood
stage. The river through this reach is subject to tidal
influences.
480 lineal feet of the total 950 lineal feet of Duwamish River bank
which fronts on the subject site will be stabilized. Existing
steep banks will be regraded to a 2 to 1 slope and a 15 foot wide
access bench will be placed just above ordinary high water to
accommodate future river bank maintenance needs. The stabilized
bank will be armored with rock rip -rap, and woody debris in the
form of logs with root balls attached. The line of the river bank
will undulate to create pockets of quiet water, improving the
aquatic habitat. The completed hank will be fully revegetated
using native riparian species.
Site landscaping will include perimeter trees and shrubs to screen
the parking area and athletic fields, with lawns and planting beds
around the building. Parking lot interior landscaping will include
sedges and reeds so that planting areas can also serve as
biofiltration swales.

Construction of the improvements mentioned above is planned to
begin in summer of 1995 with completion planned in summer of 1996.
The proposed park and athletic field improvements are scheduled for
a second phase of construction in Spring of 1997. The athletic
fields, picnic shelter, children's play area, outdoor basketball
court and tennis court are planned to be constructed in this phase.
When completed the site will be fully landscaped and a complete
irrigation sprinkler system will be included.
A portion of the subject site has been identified as being of
archaeological significance. This area is identified on the site
plan. The entire site has had a subsurface survey done to
determine the limits of the archaeologically significant area.
This area does qualify for placement on the Federal Register of
Historic Places. Site improvements have been planned to avoid any
sub - surface disturbance of this area, preserving the site for
future investigation.

The City of Tukwila has been sent a copy of the letter from the Muckleshoot Indian Tribe
Fisheries Department dated July 6, 1995 concerning the above referenced project. In that
letter the Muckleshoot Tribe asks that this project be denied a Nation Wide Permit, and
instead the project be subject to individual pennit review.
This request comes at a bit of a surprise to the City of Tukwila, since we have been
working with the Tribe in designing the shoreline enhancements. We first met with the
Tribal Fisheries on November 16, 1994. We revised the shoreline design in several areas
based on the comments received from the Muckleshoot Fisheries representative, Roderick
Malcom. We have since sent the Tribal Fisheries several drawings of the revisions, and we
were under the impression that they were supportive of our shoreline project.
The City of Tukwila has also kept Walter Pacheco, the Mukleshoot Tribe Community
Services Coordinator, apprised of the project. We have sent him drawings of our plans for
the site as we have updated them. We have continually asked to meet with him to discuss
any concerns he may have concerning the development of the site. We have been
disappointed that he has not found the time to meet with us. We had hoped for his input
on interpretive signage we are planning to include in the project which will address the
historic use of the site by Native Americans.

The extent of the historically significant portion of the site is limited to the area designated
as Archaeological Site 45KI431. This area is shown on the attached site plan. The
historic site was delineated in a Study by Larson Anthropological/Archaeological Services,
and confirmed in further studies of the site by Historic Research Associates. We have
avoided any disturbance of this area, and are providing 18 inches to 24 inches of fill over
this area to protect subsurface artifacts from any possible damage. The methodology of
delineation was confirmed as valid by Dr. Robert Whitlam of the Washington State
Department of Historic Preservation. A letter from Dr. Whitlam also concurs with the
City's plans to protect, in place, Archaeological Site 45KI431.
It is worth pointing out that Metro has recently placed a 48 inch sewer main through the
subject property. This pipe was placed about 20 feet below the surface. It actually passed
through historic site 45KI431, at which time Metro was required to do a full inventory of
artifacts found within the area. However, where the pipe was placed outside of the
historic area, but still within the subject site, no mitigating measures were required. It is
certain that the placement of this pipeline had much more impact on subsurface artifacts
than the proposed construction of the community center. The Metro project was granted
both a Corps of Engineers permit, as well as other state and local permits.
As a fmal point, it should be pointed out that timing is critical to this project. The site
soils are such that foundation work will have to be completed during the dry season. The
City hopes to begin construction in August and have much of the foundation, and
riverbank work completed before October. This will beat the rains of winter, and allow
the riverbank work to be completed within the time window set by the Washington State
Fish and Wildlife Department. Any lengthy delay will cause the project to be set back one
full year. Given the measures that the City has taken to deal with any possible negative
impacts it seems unfair to postpone this project which is being built in the public interest,
and which has strong public support.
The City of Tukwila feels the project qualifies for a Nation Wide permit. Subjecting the
project to the individual permit process will cause unjustified delays. The letter from the
Muckleshoot Indian Tribe states no clear reason to delay the project All of the points in
the letter have been addressed in the project design. We remain willing to meet with and
work with the Muckleshoot representatives to address any concerns they may have.

Dear Mr. Lewis:
The City of Tukwila has received a copy of the letter sent to the Corps by the
Muckleshoot Indian Tribe dated July 6th referencing the above project. This letter
references a sentence taken from the findings of the Shoreline Substantial Development
Permit (L94- 0105). This sentence states: development of a vacant site for a large -scale
public facility cannot provide full protection for the riverbank or the unidentified
archaeological resources. What the Tribe's letter fails to say is that the following
sentence goes on to state: However, the proposed community center will enhance
shoreline public access, while providing an adequate level of long -term protection for
natural and cultural resources, and an appropriate balance between multiple, competing
uses. The quote in the Muckleshoot Indian Tribe's letter is taken out of context and casts
a more pejorative light on the project than was intended in the Shoreline Substantial
Development findings.
The City of Tukwila has worked with local agencies and the Muckleshoot Tribe to
minimize adverse impacts and maximize habitat enhancement resulting from the shoreline
improvements. The City met with Washington State Fish and Wildlife, King County
Storm Water Management, and the Muckleshoot Tribal Fisheries November 16, 1994. At
that meeting the City presented its plans to recontour and armor the riverbank against
future erosion. Feedback from Tribal representatives resulted in several changes to the

City's plans. The total amount of armoring was reduced from about 900 feet of riverbank
to 480 feet of riverbank. This was considered the least amount which would offer
adequate protection for the community center site.
In addition, the City agreed to place large woody debris in the rip -rap to enhance fish
habitat. The Muckleshoot representative also asked that the newly contoured riverbank be
undulated to create pockets of quiet water to offer juvenile salmonoids an area to rest and
feed. This too was incorporated into the final design. At that time Muckleshoot Fisheries
indicated that they would not oppose the project.
The other issue related to the Tribal letter is the presence of underground cultural artifacts
on the site. This site has been thoroughly investigated and surveyed by Larson
Anthropological/Archaeological Services in preparation for work planned by the King
County Department of Metropolitan Services. In anticipation of future work, the 12.8
acre site of the proposed community center was surveyed using test pits to determine the
extent of the archaeologically significant area. The result of this testing identified
Archaeological Site 45KI431, which does qualify for placement on the Historic Register.
The extent and location of this site is identified in the drawings submitted to the Corps
pursuant to this permit.
The City of Tukwila hired Dr. Gail Thompson of Historic Research Associates to further
investigate the extent of artifacts on the subject site. Her work confirmed the limits of the
archaeologically significant area. Her firm was then contracted to work with the design
team to insure that the City's plans did not adversely affect the historic site. On their
recommendation, the City chose to avoid any subsurface disturbance of this area. In
addition, the City decided not to allow any paving of the area to avoid any possible
damage to any buried artifacts. As a last safeguard, the proposed plans for this area
include placement of 18 inches to 24 inches of fill over the site and landscape the area with
ground covers and shallow rooted shrubs, again to avoid subsurface disturbance.

confirming the validity of our methodology, and concurring with the development plans
for this site.

In the fall of 1993, the City of Tukwila contracted with Historical Research Associates,
Inc., to conduct a subsurface cultural resources survey of the City's Allentown property,
where-.we propose to begin construction of a community center in the next few months.
We arranged -for this survey because archaeological site 45KI431 is located on a portion
of the property.
Larson Anthropological Archaeological Services (LAAS) discovered this archaeological
site during work for the METRO Alki Transfer /CSO Facilities project, determined that it
is eligible for listing in the National Register of Historic Places, and conducted data
recovery excavations to mitigate• adverse effects of the METRO sewer line .project on the
site.
The City arranged for HRA's work on the property to determine. that additional
archaeological deposits did not occur outside the boundary of site 45KI431. The enclosed
report presents the results of I- A's subsurface survey. The City has retained BRA to
view construction plans and assist us in consulting with your office to avoid disturbance
to site 45KI431.
Through an inadvertent oversight, the City did not forward HRA's report for your review
at the time it was completed. At present, the City needs to file a SEPA Environmental
Checklist for the project, and we must have your review of the enclosed report by noon
on Wednesday, February 8, 1995.

I received this fax from Evan Lewis, the project manager from the Corps of Engineers, on
Sunday. The statement in the fax about beginning the 30 day review period comes as a
surprise. After meeting with the Corps on June 12, and June 22, it was my understanding
that the 30 day review period started with the submittal of the revised drawings on June
22. The Corps permit application was dated April 28, 1995.
As far as the cultural resources issue, I have talked to Gail Celmer, the Corps'
Archaeologist. Her initial indication is that the City has done a good job in dealing with
the archaeological issues. I have mailed her all of the studies relating to this issue, and
wait for her review of this material.
The memo from the Corps discusses a Nation Wide Permit, and an Individual Permit. If
we are granted a Nation Wide permit we should be able to proceed on schedule, even if
the 30 day review clock is restarted. We have been planning on breaking ground about
mid August, and that should still be doable. If we are required to go through the
individual permit process it is doubtful we will get any work done before the Washington
State Fish and Wildlife window for river work closes in October. We will therefore not be
able to begin construction until next spring at the earliest.
I have had phone conversation with the Muckleshoots. They have indicated that the
project has been moving too fast. They did not state any actual concerns other than the
speed of the development. I am not sure what they will ask for by way of mitigations.

COMMENTS: I have completed some revisions, clarifications, and
consolidation of the project drawings for the Tukwila Community Center bank
protection project. I may have to fax the drawings in two different transmissions since
there are a lot of them. Please review the completed set and let me know if they are
acceptable and if not, any changes that are needed. The 30 -day review period will
commence when we get a set of drawings that both Tukwila and the Corps approve.
With regard to project timing, the Corps must consider e cultural resources in
the area in its review process. For a nationwide permit,'va aght issue the nationwide
permit conditional upon completion of a cultural resources evaluation nd aPPrpriate
mitigation. Alternately, a standard individual permit may be required. °this time, I
am still treating this application as a potential nationwide but there is still a possibility
that we will kick it into the standard individual permit process depending on agency
comments and our cultural resources evaluation.

The Environmental Division of the Muckleshoot Indian Tribe has been involved in the
review of plans for the City of Tukwila's proposed community center on the Duwamish River.
The proposed community center is adjacent to the Duwamish River to which the Muckleshoot
Tribe has treaty rights to fish in. Furthermore, much of the site has considerable
archaeological significance, containing a Native American cultural site that qualifies for
placement on the National Register of Historic Sites.
The City (ref. page 5) has stated development of a vacant site for a large -scale public
facility cannot provide full protection for the riverbank or the potential unidentified
archaeological resources. To ensure federally guaranteed cultural and natural resources as
well as treaty rights are fully considered during the Corps review of the project, we request
that neither a Letter of Permission nor a Nation Wide Permit be issued for the proposal.
Instead, the individual permit review process should be used.

Dear Mr. Fritzen:
For your review, enclosed are shoreline permits for the proposed
Tukwila Community Center.
In addition to the Shoreline Substantial Development Permit, included
is documentation for a Shoreline Variance Permit. The roof peak on two
portions of the proposed Community Center building has a height of 46
feet. This height exceeds the 35 -foot height limit established by the
underlying (King County 1978) shoreline regulations. The Tukwila Board
of Adjustment has approved the height variance; the City now requests
state approval of the variance per KCC 25.32.040 and WAC 173 -14 -150).
The City has worked closely with the Dept. of Fisheries, King County
Surface Water Management, the Muckleshoot Tribe and other agencies in
designing a facility that minimizes disruption of the riverbank, and
results in an enhanced shoreline environment at the site. Riverbank
work is scheduled to commence the first week of August. This work must
be timed to fit into the construction "window" established by
Fisheries, or our overall project schedule will be jeopardized.
Therefore, it is imperative that the City receive Ecology's approval of
the enclosed permits by August 4, 1995.

facility on a 12.8 -acre site along the Duwamish River.
The project will include indoor and outdoor recreation
facilities, offices, child care area, meeting rooms, and
senior adult activity center, softball and soccer fields,
events plaza, public river trail, and picnic shelter. Other
site improvements include a 330 -car parking lot,
biofiltration swales, sidewalks and landscaping. Along
the riverbank, approx. 110,000 cu. ft. of flood storage
capacity will be added to the river, with a 15 -foot wide
"bench" for maintenance access. Approx. 480 linear
feet of riverbank will be regraded, armored with rip -rap,
and re- vegetated to improve habitat. An existing area
of archaeological significance will be protected from
development.

Dear Resident and Property Owner:
The new Tukwila Community Center is coming to your neighborhood!
Plans have been drawn up to transform the vacant lot at South 124th and 42nd Avenue
South into a new 45,000 square -foot, multi- purpose Community Center. What is still being
decided is how the outside of the Community Center will look and feel. Does the building
have a hish quality architectural design? Is the landscaping attractive? These and other
questions about the Community Center's design will be answered at an upcoming Planning
Commission/Board of Architectural Review hearing.
The Community Center will be an important focal point for the city as a whole, and
especially for your neighborhood. We want to know what you think of the proposed design.
You can bring your questions and comments about the new Community Center to two
upcoming meetings:
• Public information meeting to answer your questions and to get your
suggestions on the design. Comments received at this meeting will be
forwarded to the Planning Commission.
• Planning Commission public hearing to make a final decision on the
design. You can make comments in person at the hearing.

What's in the new
Community Center?
Throughout the early stages of design,
involved citizens helped determine the
types of activities to be offered at the
Community Center. The Center will
include facilities for a variety of indoor
and outdoor sports, arts and crafts, and
activities for children, teens and seniors.

the river, the Community Center will
provide a waterfront trail and river views.
Plans also include a 350 -car parking lot,
sidewalks and landscaping.

The next step is to determine how the
Community Center will look and feel.
This involves careful consideration of
the outside appearance — building exte-
rior, colors and materials, landscaping,
and location of features throughout the
site —which help provide a high quality
design. These issues will be considered
at the Planning Commission's public
hearing.
How can you add your ideas to
the Community Center design?
Tukwila's new Community Center will
be an important focal point for the com-
munity. It's important that it be a
facility that you're proud of. Does the
Community Center look and feel
"right "?
There are several ways you can help
answer this question. Come to the
Open House in February. The architect
and City staff will be available then to
show you the Community Center draw-
ings, and answer any questions you may
have. You can also write down or mail
in your ideas, which will be forwarded
to the Planning Commission before their
final decision. Or, you can give the
Planning Commission your comments
at the February Public hearing. This is
your opportunity to let the Planning
Commission know what you think.

1. To restore the shoreline environment and long -term health
of salmonid habitat, a minimum of 6 large stature shade
trees shall be added to the shoreline, spaced along the
length of the project shoreline.
2. Prior to completion of construction, the project shall
contribute its proportionate share of the costs for the
following street improvements: curb, gutter, sidewalk, and
undergrounding of utilities along 42nd Avenue South and
South 124th.
3. To meet the requirements of the Green River Flood Control
Zone District, the City shall:
a. Obtain approval of the riverbank plan from the
District prior to beginning construction.
'b. Provide the District with a riverbank /levee
maintenance access easement in a form acceptable
to the District within one year after construction
completion.

MITIGATED DETERMINATION OF NON- SIGNIFICANCE
Conditions of approval 4/18/95
The Mitigated Determination of Non - Significance for the above
project, dated 2/8/95, has been modified to reflect public and
agency comments. Additional conditions of approval are noted
below, in Items 4 through 12.
1. To restore the shoreline environment and long -term health
of salmonid habitat, a minimum of 6 large stature shade
trees shall be added to the shoreline, spaced along the
length of the project shoreline.
2. Prior to completion of construction, the project shall
contribute its proportionate share of the costs for the
following street improvements: curb, gutter, sidewalk, and
undergrounding of utilities along 42nd Avenue South and
South 124th.
3. To meet the requirements of the Green River Flood Control

4. There shall be no "fire truck turn - around" along river as
noted on plans (shaded area sheet L -1); all existing
vegetation in southwest corner of site along river shall be
retained
5. All landscaped areas except lower riverbank stabilization
area shall have automatic irrigation.
6. The archaeological site shall be adequately protected
during construction with a sturdy construction barrier
around its perimeter.

7. To protect the archaeological site, the project shall
retain an archaeologist to: a) make periodic inspections
during construction to assure that the site remains
protected; b) develop a monitoring, discovery and treatment
plan in the event that archaeological materials are
discovered elsewhere on the site during construction.
8. Riverbank stabilization: Rose and western crabapple
plantings shall be bare root (versus cuttings).
9. Riverbank stabilization: Salix hookeriana shall be
replaced with a more saline- tolerant species, such as
Pacific willow or Sitka willow.
10. Upper riverbank planting: Willows shall be replaced with
native shrubs more typical of upland conditions, such as
native hazelnut and oceanspray.
11. Erosion control seed mix (or other groundcover) shall be
applied to the upper riverbank area.
12. Bioswale plantings: Hardstem bulrush shall be replaced
with a species more suited to intermittent and shallow
inundation, such as Juncus, spp. or bentgrass (Agrostis
stolonifera or alba).
