Dear Mr. Powell:
On March 9, 1994, Seafirst Bank established an Assignment of
Account in favor of the City of Tukwila, in the amount of
$58,027.50 on behalf of Greg Vandenberg. The Assignment of Account
was required by the City to guarantee completion of site
improvements for the Parsons Short Plat at 4646 South 160th,
Tukwila, Washington.
The required site improvements have been completed to the
satisfaction of the City. Therefore, we hereby request that you
release the above described Assignment of Account, and return the
funds to the account depositors.
If you have any questions regarding this release request, please

Dear Mr. VandenBerg:
The Department of Community Development (DCD) has reviewed your
written request of March 10, 1994 for an exception to the Zoning
Code building front yard setback requirements for the above short
plat. Based upon a review of your lots and the Code's exception
criteria, DCD has approved your request. The basis of our decision
on your request is summarized below.
The Zoning Code states that the front of a lot is "that portion
nearest the street..." (TMC 18.06.470). A street is defined in the
Code as a "public thoroughfare which affords the principal means of
access to abutting properties" (TMC 18.06.790). Thus, the front
yard of each of your lots would be that portion closest to 40th
Avenue South, or the easternmost portion of the lot.
However, the Code 'provides for exceptions to front yard
requirements (TMC 18.50.070). Under this provision, DCD may make
an exception as follows:
a) "Where the front yard that would normally be
required on a lot is not in keeping with the
prevailing yard pattern;"
b) the requirement for the normal front yard may
be waived and substituted with "a special yard
requirement;"
c) and such yard requirement "shall not exceed
the average of the yards provided on adjacent
lots."
Three of your four lots do not abut a public street, but are served
by a private access road. For similar lots elsewhere in Tukwila,
the portion of the lot closest to the private access road functions
as the front yard. Therefore, the normal front yard requirement
for these interior lots would not be consistent with "the
prevailing yard pattern."

As you have designed your plat, Parcel B is the only interior lot
where proposed setbacks are not consistent with the prevailing yard
pattern. Given this, and the exception criteria, the front yard
setbacks for your lots are as follows:
a) The front yards for Parcels A, C and D are the
areas closest to the public street. No
setback exception is made.
DCD waives the normal front yard requirement
for Parcel B. The normal front yard for
Parcel B is to be substituted with a 6.5'
setback, with the following conditions:
i. The east side yard (that area
closest to the private access

feet; and

Dear Ms. Parsons:
The Department of Community Development (DCD) has completed a
preliminary review of your short plat (subdivision) application.
Your property appears on our maps and in your survey as having steep
slopes (slopes greater than 15% grade). Under our Sensitive Areas
Ordinance, development of property with a steep slope requires an
additional Planned Residential Development Permit. However, we have
waived this requirement. This is based on the fact that your parcel
has been previously cleared and developed. Also, it is evident from
site inspections that the only area with a steep slope is a small
area in the northeast corner of proposed Lot D. It appears that your
proposed development will not affect this area.
Prior to final approval, your short plat must meet the requirements
of the Short Subdivision Ordinance and other Tukwila codes. Below
are the additional items which need to be completed for final
approval of your short plat.
REQUIREMENTS FOR PRELIMINARY APPROVAL
Lot configurations:
1. The Tukwila Zoning Code requires that your new lots have a)
a minimum lot width of 50 feet; and b) a minimum area of
7200 square feet. Your proposed "Tract X" does not meet
these code requirements. Therefore, the area of land now
called !Tract X must be incorporated into the boundaries of
your proposed lots, and changed into a 30 -foot easement for
ingress, egress and utilities.
2. Short plat lot configurations must meet the minimum
50 -foot width requirement and provide an appropriate
30 -foot front yard area for each lot. Your proposed lots
must be revised to meet these requirements. Attached are

configurations and front yard setbacks. You can use these
as a guide in revising your survey.
3. Your legal descriptions must also be revised to reflect new
property boundaries and the 30 -foot easement which serves
each lot.
Streets /access :
4. As explained above, your survey and legal descriptions must
show a 30 -foot easement for access and utilities. In
addition, the survey and legal descriptions must include a
fire truck turn - around (see Item #8 below).
Utilities:
5. Your short plat must provide for storm drainage for all
lots. This will require a storm drainage plan, drawn by a
licensed engineer, showing existing and proposed storm
drainage improvements and easements, including detention or
conveyance systems.
Alternatively, if soils and grades allow stormwater
infiltration, you may use soil infiltration rather than new
storm improvements. If you can use this method, your survey
should note that "Due to soil conditions on site, storm
drainage will be addressed through infiltration."
6. A Joint Maintenance Agreement is needed to identify which of
the properties will have or share responsibility for
maintaining commonly used utilities (i.e. storm drainage,
water and sewer facilities, and access road). This
Agreement can be written into your easement descriptions, or
included as a separate document. A sample maintenance
agreement is attached.
7. Our water maps show that your water main is 60" rather than
72" as shown on your survey. Your survey needs to be
revised to show a 60" main.

Please note the following items which apply to your site

Your access drive will require an all- weather
surface (gravel or paved), capable of supporting
50,000 lbs., with a minimum width of 20 feet. The
slope of the access drive may not exceed 15 %. The
first 20 feet, or "apron," of the driveway must be
paved. Given that South 160th is currently under
construction, the City may be able to install the
20 -foot paved apron for you. As we've discussed,
you will need to coordinate this with Bob Giberson
in.Public Works (433- 0179).
The Tukwila "undergrounding ordinance" requires
that all utilities be placed underground.
c. You will need to obtain all required permits prior
to beginning any construction. For sewer and
water line permits and new fire hydrant, contact
the individual provider District. For roadway
construction, contact John Pierog of Public Works

WATER SYSTEM NO— PROTEST AGREEMENT
The proposed development at:
adds to the cumulative need for domestic and fire flow water service. The
result of continuing development will be the need to provide water system
improvements that provide adequate service.
The proposed development property is obligated to participate in funding future
system improvements and the owner waives the right to protest water L.I.D. or
U.L.I.D. formation. This agreement runs with the property.
This agreement shall be binding upon the parties, their respective heirs, legal
representatives, assignees, transferees and successors. This agreement runs
with the land.
This agreement shall be recorded by the City Clerk with the King County Auditor
as required by Chapter 35.91 RCW and the cost of said recording will be paid by
the City.
So that the Owner can remove encumbrances from the property caused by this
requirement, the Owner can pay the City the Owner's pro -rata share for
projected costs. These costs will be made available to the Owner upon written
request to the Public Works Director.
