Morgan , C & M Properties, Inc. 5190 South 166th Street Tukwila, WA 98188 SPE #L93 -0024 RE: Building Permit Applications #B93 -0044, -0045, -0046, 0047 Dear Ms. Morgan: The Department of Community Development (DCD) has reviewed your written request dated April 1, 1993 for an administrative exception to the Zoning Code building front yard setback requirements for the above building permits. Based upon a review of your lots and the Code's exception criteria, DCD has approved your request. The basis of our decision on your request is summarized below. The Zoning Code states that the front of a lot is "that portion nearest the street..." (TMC 18.06.470). A street is defined in the Code as a "public thoroughfare which affords the principal means of access to abutting properties" (TMC 18.06.790). Thus, the front yard of each of your lots would be that portion closest to 40th Avenue South, or the easternmost portion of the lot. However, the Code provides for exceptions• to front yard requirements (TMC 18.50.070). Under this provision, DCD may make an exception as follows: a) c) "Where the front yard that would normally be required on a lot is not in keeping with the prevailing yard pattern;" the requirement for the normal front yard may be waived and substituted with "a special yard requirement;" and'such yard requirement "shall not exceed the average of the yards provided on adjacent lots." 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • (206) 431-3670 • Fax (206) 431-3665 Ms. N. Morgan Exception request 4/2/93 Page 2 Three of your four lots do not abut a public street, but are served by a private access road. For similar lots elsewhere in Tukwila, the portion of the lot closest to the private access road functions as the front yard. Therefore, the normal front yard requirement for these interior lots would not be consistent with "the prevailing yard pattern." As you have designed your plat, Lot 2 is the only interior lot where proposed setbacks are not consistent with the prevailing yard pattern. Given this, and the exception criteria, the front yard setbacks for your lots are as follows: a) The front yard for Lot 1 is the area closest to the public street. No exception is made. b) DCD waives the normal front yard requirement for Lot 2. The normal front yard for Lot 2 is to be substituted with the side yard required by the Code, i.e. 8 feet. Thus, the front yard is that area closest to the private access road. This special yard requirement is consistent with the yards provided on adjacent lots. c) The front yard for Lots 3 and 4 is the area closest to the public street.' Coincidentally, this is also the area closest to the private access road. No exception is made. A diagram of the front building setbacks which you must meet on all four lots is attached. Your building permit applications, where inconsistent with this diagram, have been "red- lined" to expedite review. The Planning Division has approved your red -lined applications and forwarded them to Public Works for review. As we discussed, the zoning code defines a front yard as the part of a home facing a public street, even though the home does not abut that street. Our planned homes face a private street and prevailing yard patterns generally require that the front of those homes be considered the side of the house facing the private street. Therefore, we request that the setback rules be applied to treat the side of the homes facing the private street as the front yard. We believe this will be in everyone's best interest, including the pending subdivision of the lot to the south which will share our street. Thank you for taking the time to consider this.
