RE: Generator Fuel Tank Replacement.
Dear Mr. Bennett,
I.have reviewed the proposed emergency replacement of an existing
4,000 gallon underground fuel tank with an above ground fuel tank
and discussed this issue with State Dept. of Ecology Shoreline
staff (Rankin, 8/18/93). Based on this information, I make the
following conclusions:
1. Total replacement with an above ground tank is a "normal
maintenance or repair" procedure for a suspected leaking
underground tank. The proposed replacement could be exempt
per WAC 173- 14- 040(b) if otherwise in conformance with the
Shoreline Master Plan.
2. The State Department of Ecology Shorelines Section, in
consultation with its other sections, has concurred with
this interpretation.
3. The proposed replacement is consistent with Shoreline Master
Plan policies subject to screening. The new tank is
"outside storage" which must be screened by a minimum eight
foot sight obscuring screen, per Zoning Code chapter
18.52.040(2).
I therefore determine that theproposed tank replacement is
exempt from a shoreline substantial development permit per WAC
173 -14 -040. This is an individual situation. Each situation's
exempt status and consistency with the Shoreline Master Plan will
be evaluated on a case -by -case basis.
I understand that Boeing has a program of underground tank
replacements. .I urge you to apply for a shoreline permit covering
all tank replacement actions for the next two years. This will
allow reso1ption of all permit uncertainties in a timely manner.

Subject: The Emergency Replacement of the Emergency Generator Fuel Tank for
the Autoclave at the 9 -101 Building
Dear Mr. Umetsu,
Boeing Defense and Space Group at the Developmental Center has a 4,000 gallon
underground tank that is the fuel tank for the emergency generator to the autoclave test
unit in the 9 -101 Building. The Chemical management group at our Division has been
doing test on our underground tanks at the Development Center site. The tank in question
may have a leakage problem. We have the approval from the City of Tukwila Fire
Department to install an above ground 4,000 gallon dike tank at the area of the existing
tank after soil samples have been tested. If there is a problem, remove the tank or drain
and fill the old tank with sand in place. This area we are referring to is located in the
200 ft shoreline area.
The problems we are encountering are becoming numerous. The autoclave has an
important test September 7, 1993 and the emergency generator has to be on line for
backup. I submitted this plan to Jack Pace on July 7, 1993. Mr. Pace requested a
shoreline submittal, which he thought could be ready in 45 days. This fit the time schedule
we had for the replacement through an outside contractor. If the shoreline permit process
takes longer, the time schedule will be impacted by the Fisheries Department, Indian
fishing as well as Mother Nature. It is imperative Boeing meets this schedule test for the
Military as well as the importance of maintaining a safe environment due to a possible leak
in the tank.
Please see what you can do to expedite this process flow so we can meet the schedule
dates.

Notification of persons of certain types of pending applications is required in order to encourage
citizen participation in the land use process. Applicants are required to submit a mailing matrix
and one photocopied set of labels which show:
1. The name and address of all owners of property lying within 300 feet of the boundaries of
the property for which a permit is sought; and
2. The address of all residents of property within 300 feet of the boundaries of property.
Property owner names and addresses can be obtained from the King County Department of
Assessments located on the 7th floor of the King County Administration Building, Room 700,
500 Fourth Avenue, Seattle. To compile the information:
1. Obtain the assessor's map(s), which contains your property and all abutting property
within 300 feet. (See diagram.) You may use the maps on file in the Assessor's Office or they
can be purchased from the King County Department of Public Works Map Counter on the
9th floor of the Administration Building. It is suggested that assessor's maps be ordered
several hours in advance of the time you would like to pick them up.

2. Then, obtain a computer batch order form from the Department of Assessments, list on the
batch order form the property tax account numbers shown on the assessor's map(s) and
submit the batch order form to the Department of Assessments together with the required
fee for a printout of the information. Assistance with the tax account numbers may be
obtained through the Assessor's Office or the City of Tukwila Department of Community
Development (DCD). King County labels are not acceptable because they cannot be
duplicated.
Resident names and addresses are researched by the applicant. Kroll maps located in the DCD
have buildings and street names and addresses. The information on the mailing matrix may refer
to "Resident" or "Tenant ", with the proper mailing address, if the specific name is unknown.

Subject: Shoreline Permit Application for Dike Tank near 9 -102 Building
We talked earlier about the replacement of an underground tank with an above ground
dike tank. On July 9, 1993 the decision was made to have a shoreline permit. At that
time, you said you thought you could give us a 45 day turn around time. Attached is an
application for a shoreline permit. If this could happen it would be greatly appreciated due
to the fact this tank is for diesel fuel to an autoclave that has a crucial test the first week
of September.
