This review is required by the Sign Code for a special size increase (TMC 19.32.140). The Planning Commission adopted the findings and conclusions contained in the Staff Report (October 18, 1993), and denied the proposal. In our discussion following the hearing, you asked about the process for appeal of the Planning Commission decision. We agreed that any appeal would be postponed until you received a Notice of Decision explaining the appeal process, and that the appeal period would begin on the date of the Notice of Decision. The delay in this Notice is due to some discrepancy in the Sign Code. The Sign Code does not specifically provide for an appeal of a Planning Commission decision, which is inconsistent with our review process for other land use actions. This matter has been reviewed with our City Attorney. Our Attorney has advised us that the Sign Code appeals provisions are expanded to include appeals to Planning Commission decisions, following the process outlined in the Zoning Code appeals section (TMC 18.90.020). Under the Zoning Code, you have the right to appeal the Planning Commission's decision. Any appeal must be made in writing to the City Clerk within 10 days of the date of this letter and shall state the reasons for the appeal. The City Clerk will schedule a review for you before the City Council within 90 days of the filing of the appeal. The Planning Commission denied the request. The Bank has eta€ its intention to appeal, but the Sign Code is silent on the appeal process. The Director of DCD has permit authority under the Sign Code (19.32.010). Decisions by the Director may be appealed to the Board of Adjustment; Board decisions may be appealed to King County Superior Court (TMC 19.12.040). For certain types of signs, the Code requires Planning Commission approval (TMC 19.28.010; 19.32.020, .080, .100, .120, .130, .140, .150, .180). However, the Sign Code does not provide for appeals to these decisions. ISSUE: What is the appropriate process for appeals of Sign Code decisions made by the Planning Commission? While the Sign Code is silent on the subject, the Zoning Code is instructive. The Zoning Code requires that appeals from the Planning Commission go to the City Council. Planning Commission decisions on Sign Code issues are similar to other land use decisions. Absent any other specific provision, we should follow the process typically used in the Zoning Code. Therefore, appeals of Planning Commission decisions under the Sign Code should be made to the City Council. The typical appeal period for land use decisions, i.e. 10 days, would also apply. The site is bordered by commercial uses to the south, offices and retail (under construction) to the north, and offices to the east. The proposed wall sign will be on the located on the north facade, visible to these uses and traffic southbound on Andover (see Attachment B). An existing freestanding sign, located next to the street, will remain. PROJECT DESCRIPTION First Interstate Bank proposes to install a wall sign of 62.38 square feet (s.f.), which is in excess of the 48 square -foot area allowed in the Sign Code (TMC 19.32.140). Under the Special Permission provision in the Sign Code, the Planning Commission may approve this increase in sign area (TMC 19.32.150). The sign will be located on the north facade of the building, which is of brick construction. White channel letters, 24" high, are proposed, along with the First Interstate logo in red - orange and yellow (see Attachment D). The sign will be internally illuminated. BACKGROUND The key in the Sign Code's special provision for a size increase is the "required minimum setback." In the original application, the applicant's setback calculations are based on the wall's distance from the side property line (see Attachment E). However, staff based its review on the wall's distance from the street (front yard building setback). In response to this staff interpretation, First Interstate revised its proposal. The new request for a larger sign is based upon the sign's distance from the street. The sign will be located on the same wall, but shifted to a location 100 feet from the street (See Attachment C). The applicant's approach to calculating sign size results in a conclusion which is much different than the staff's conclusion. This is due, in part, to the fact that the Sign Code does not clarify the term "setback." This is also due to the applicant's premise that the sign setback is equivalent to the wall setback. First Interstate Sign Staff Report 10/18/93 Page 3 The criteria for approval of a special size increase are given below. In addition, the Planning Commission is being asked to evaluate two aspects of the First Interstate proposal: 1. Whether the "sign setback" is intended to be equivalent to "wall setback;" and 2. Whether the "setback" is intended to be measured from a) the street, or b) from any other property line. The Planning Commission's decision regarding the measurement of setbacks for sign area calculations will be used as a guideline for staff and future applicants for Special Permission signs. DECISION CRITERIA Under the Sign Code, there are four criteria for determining the maximum size allowable for the proposed sign. First, the Sign Code establishes a maximum size for commercial signs. With this maximum as a base, the Code provides a Special Permission process in which the Planning Commission may approve a larger size. Third, the Code limits the size which the Planning Commission may approve. Finally, the intent of the Sign Code must be considered in evaluating an increase in the base size of a sign. These four approval criteria are noted below, along with a discussion of the relationship of the proposal to the criteria. 1. "Commercial Zones Where Signs Will Face or Abut other Commercial or Industrial Zones" (TMC 1932.140). As the First Interstate site faces other commercial /industrial zones, a wall sign would normally be required to meet the maximum size allowed under this section. Using the formula provided in this section, for an "exposed building face" of 1,080 square feet, First Interstate could have a wall sign with a maximum area of 48.2 square feet. However, the Sign Code allows an applicant to increase this maximum size with approval by the Planning Commission, under the conditions noted below. "Upon application to and approval by the Planning Commission, the permitted sign areas provided in Table 1 may be increased no more than fifty percent for each doubling of the required minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed that permitted in Section 19.32.150" (TMC 19.32.140). The applicant's request is based on their conclusion that the setback of the wall sign will be greater than the minimum required (see Attachment E). By doubling the required setback, the First Interstate sign could be enlarged by 24.1 square feet (50% of 48.2 s.f.) up to 6% of the wall area, for a maximum of 64.8 square feet (6% x 1,080 s.f.). The proposed sign is 62.38 s.f. The Sign Code refers to the "setback distance for the wall," but does not define "setback" as front, side or rear. This can lead to confusion. Technically, any given wall of a building will have setbacks from two property lines (one parallel, one perpendicular). In a CM zone, the required minimum side yard setback is 5 feet, while the front yard setback is 50 feet. The wall on which the sign will be mounted has a setback from the street of approximately 84 feet, less than the 100 -foot "doubling" of the required setback. However, in the revised proposal, the sign itself is located 100 feet from the street. The wall's setback from the side property line is more than double the minimum. 3. "Building Identification Signs -- Businesses in a planned shopping center shall be allowed signing equal to 6% of the exposed building face area on which the sign is to be placed up to a maximum of 500 square feet" (TMC 19.32.150). Under this Section, the maximum sign area allowed by for the First Interstate sign would be 64.8 square feet (six percent of the exposed building face). The proposed sign, at 62.38 s.f., is under this maximum. 4. "The purposes of this code are to establish standards and guidelines for the design...of signs...so that the streets of Tukwila may appear orderly and safety may be increased by minimizing clutter and distraction" (TMC 19.04.020(A)). First Interstate Sign Staff Report 10/18/93 Page 5 The proposed sign is designed to reflect First Interstate's "corporate colors." These proposed colors are compatible with the existing freestanding sign on site. The use of illuminated white channel letters on the brick facade makes the sign clear and legible from a distance. CONCLUSIONS Based upon the above discussion, staff concludes that the proposed sign meets the all but one of the basic criteria for approval of a Special Permission sign. With the exception of the setback calculations, the proposal is consistent with what has been approved for other, similar commercial signs. The design of the proposed sign is in harmony with the building facade and site, and is legible from a distance. These characteristics make the sign consistent with the intent of the code to "minimize clutter and distraction." However, the sign does not meet the criteria for a "doubling" of the required setback. The reasons are as follows: 1. The Sign Code states that the special size increase applies where there is a "doubling of the required minimum setback distance for the wall upon which a particular sign is to be placed (TMC 19.32.140). The Code is clear that the "wall" is the object to which the setback applies, not the "sign." Therefore, where the sign is located on the wall is irrelevant to this special review. 2. Staff has based its review on the wall setback measured from the street. Staff used this approach for the following reasons: a) The ,purpose of the Sign Code is to reduce clutter and distraction which might cause safety concerns. The sign will have the greatest visual impact from the street; therefore, provisions to control the visualimpacts of signs were likely intended to address the relationship of the sign to the street. b) The intent of the size exception allowed by Section 19.32.140 is to recognize the possibility of hardship for businesses which are located far from the street. This occurs in many locations in Tukwila where businesses are located some distance from the street, behind large parking lots or in large retail complexes. This site condition has been First Interstate Sign Report 10/18 Page 6 typical of previous requests for special permission signs, such as for Toys R Us and Home Depot. These applicants usually did not have the option to locate a wall sign closer to the street. Intentionally • locating a sign further from the street, in order to obtain a size increase, does not seem to meet the "hardship" intent of the code. c) The Sign Code provides First Interstate a sign allowance similar to other commercial /industrial sites. A 48.2 s.f. sign is allowed on the north facade, which will be visible from the street and elsewhere. In addition, the site has a freestanding sign near the street, which is visible to north and southbound traffic on Andover. Based upon the wall's setback from the street, the First Interstate sign does not meet the criteria for "doubling" of the setback. In addition, the Sign Code provides an adequate and equitable sign allowance for the First Interstate site, without a special increase in sign size. We are requesting approval of a wall sign exceeding the square footage allowed from Table I but less that 6% of the building face, the maximum sign area allowed by Sec. 19.32.150. The proposed sign is to be located on the North elevation with an E.B.F. (Exposed Building Face) of 1080 square feet and a setback of 140 feet. The proposed sign is 62.38 square feet requiring a setback of 100 feet and not exceeding 64.8 square feet which is the 6% maximum for this elevation. Located on the East elevation is a single faced wall sign which will be removed upon approval of the new North elevation signage. Our request for the larger sign is based on Sec. 19.32.140 (A) "Upon application to and approval by the planning commission, the permitted sign area may increase no more than fifty percent for each doubling of the minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed that permitted in Sec. 19.32.150." The proposal meets the requirements for this approval and the design of the sign with a 31 % increase remains in keeping with the intent of the code. The proposed sign is to be located on the North elevation with an E.B.F. (Exposed Building Face) of 1080 square feet and a setback of 140 feet. The proposed sign is 62.38 square feet requiring a setback of 100 feet and not exceeding 64.8 square feet which is the 6% maximum for this elevation. Located on the East elevation is a single faced wall sign which will be removed upon approval of the new North elevation signage. Our request for the larger sign is based on Sec. 19.32.140 (A) "Upon application to and approval by the planning commission, the permitted sign area may increase no more than fifty percent for each doubling of the minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed that permitted in Sec. 19.32.150." The proposal meets the requirements for this approval and the design of the sign with a 31 % increase remains in keeping with the intent of the code. Staff cannot recommend approval. 1) Intent of code is that doubling of setback is to be measured from the street, not from the side. Setback in CM is 50 feet, so wall must have 100 -foot "doubled" setback. Pam did not disagree with this. 2) Pam suggested that they might move the sign further back on the same wall, so that even though wall does not have "doubled setback," the sign would be 100 feet back from street. I did not think this would meet the intent of the code. Bank has allowance for sign just like other businesses. There is not a hardship due to site characteristics. If the bank chooses to move the sign further back from street it is a different situation than a building which is located far from the street where there are no options. Intent of code provision is to balance out the difficulties of a large setback with increased sign size. It's intended to be used in special situations where keeping with allowed size might create hardship for business. In past, we've used for businesses located far away from road, such as Toys R Us, or others where large parking lot in front. However, I will look at an alternative proposal and review the issue again. Pam will talk to First Interstate and see what they want to do. She will fax me a site plan with new sign location, if the bank decides on this. She will do this by 10/15/93 (she is on vacation 10/18- 10/22).
