Wetland Delineation Report Caldwell Property, Tukwila, Washington . INTRODUCTION The project site consists of nine parcels totaling approximately 1 to 2 acres. A single family dwelling is located at the south end of the property. This area has been cleared and graded. Himalayan blackberry (Rubus discolor) and red alder (Alnus rubra) dominate the north portion of the property. The site sloes to the north with steep slopes (approximately 15 to 30 %) in the north P P P (PP half of the property. A stream runs from the middle of the property to the north property boundary where it enters a roadside ditch. The water source for the stream appears to be a groundwater seep that occurs throughout the north half of the property and portions of the adjacent property to the east. The south portion of the property is upland. The U.S. Soil Conservation Service (SCS) has mapped the site as Urban Land (SCS 1973). Areas included in this map unit are obscured or altered by urban development, so identification of the underlying soil unit was not possible when the soil survey was published. Soil observed onsite was sandy loam. Two wetlands were identified on the property. Wetland A is approximately 0.3 to WETLANDS 0.5 acre. Wetland B is approximately 0.002 to 0.005 acre. Based on the U.S Fish and Wildlife Service Classification scheme (Cowardin et al. 1979), wetland habitat at the site would be classified as palustrine forested and scrub - shrub. These wetlands were not identified in the City of Tukwila Sensitive Areas Inventory. Table 1 lists plant species and their relative abundance in the wetlands. Data sheets for the wetlands are included in Exhibit B. Wetland A Hydrology Wetland A is a groundwater seep located on a steep slope (15 to 30 %) in the north portion of the site. Groundwater emerges from the hillside at an inflection point of the slope and flows north at or near the surface over an area approximately 50 feet wide. A stream forms in the southeast portion of the wetland and flows through the middle of the wetland to the north property boundary. The wetland and stream narrow at the north end of the property and are bisected at the north property boundary by a driveway. Water from the wetland and stream enters a roadside ditch and is culverted under the driveway near 42nd Avenue South. The stream at this site was not categorized in the Washington Stream and Salmon Utilization Catalog or the King County Sensitive Areas Map Folio (Williams et al. 1975, King County 1990). An undefined drainage swale is located in the southwest portion of the wetland. No surface water was present in the drainage during the site visit; however, groundwater was present at a depth of 4 inches. Groundwater was observed throughout the wetland at depths between 12 inches and the surface. Vegetation Wetland A is dominated by red alder and Himalayan blackberry. Oregon ash (Fraxinus latifolia) also occurs throughout the canopy layer. The canopy cover ranges from 0% in the southeast portion of the wetland to approximately 80% in the north end of the wetland. Indian plum (Oemleria cerasiformis), willow (Salix spp.), and salmonberry (Rubus spectabilis) occur occasionally throughout the wetland. A single holly shrub (Ilex aquifolium) was observed in the understory in the middle area of the wetland. Herbaceous vegetation occurs occasionally throughout Wetland A. Species observed include skunk cabbage (Lysichitum americanum), common horsetail (Equisetum arvense), and lady -fern (Athyrium filix femina). Water parsley (Oenanthe sarmentosa) occurs in the stream channel. Creeping buttercup (Ranunculus repens), stinging nettle (Urtica dioica), and mannagrass (Glyceria elata) occur in the drainage area in the southwest portion of the wetland. Soils Soils observed in the wetland were sandy loams. Soil color varied throughout the wetland from black (10YR2/1 and 7.5YR2/0) to very dark gray (10YR3/1). Soils were saturated at depths between 12 inches and the surface throughout the wetland. Wetland B Hydrology Wetland B is located in the northeast comer of the property. Wetland B is separated .)1from Wetland A by an upland berm. Wetlands A and B are approximately 15 to 20 feet J apart. However, because Wetland B was located down- gradient from Wetland A where the slope levels out, the wetlands appear to be hydrologically connected by subsurface - .flow. Standing water is present in Wetland B to a depth of 1 inch. Water from Wetland B flows north into the roadside ditch. Because of the proximity of Wetland A and Wetland B and the possible subsurface groundwater connection, these wetlands can be considered part of the same wetland system. - Vegetation Wetland B is dominated by red alder. Western red cedar (Thuja plicata) is rare in the canopy in the north portion of Wetland B. The canopy cover is approximately 70 to 80 %. Vine maple (Acer circinatum) is an occasional species in the understory of Wetland B. The herbaceous layer is dominated by skunk cabbage, common horsetail, and lady -fern. Soils Soils observed in Wetland B were black (10YR2/1) sandy loams. Soils were saturated to the surface; in some areas in the wetland, inundation occurred to a depth of 1 inch. WETLAND FUNCTIONS AND VALUES Wetlands provide a variety of functions and values, many of which directly or indirectly benefit society. Commonly assessed functions and values include water quality improvement, flood storage and floodflow moderation, groundwater exchange, shoreline protection, wildlife habitat, and cultural values. Cs0A ---- Although v h several methodologies have been developed to quantify wetland functional values, this task is difficult and requires detailed studies. Alternatively, wetland functions and values can be assessed in a qualitative or semi- quantitative fashion. The relative amount of any given function provided by a particular wetland will depend on many factors. Primary functions provided by the wetlands at this site include water quality improvement, groundwater discharge, wildlife habitat, and cultural values. These functions and values are described below. Water Quality Improvement Wetlands serve to maintain good water quality and improve degraded water through a variety of chemical, physical, and biological processes. Wetlands function as pollution filters, removing pollutants and sediments from surface waters (Tiner 1984). Sedimentation of soils, metals, and other pollutants occurs as a result of reduction in water velocity. Other water quality improvement processes include decomposition of organic substances by microorganisms and uptake of pollutants and nutrients by plants. Wetland characteristics important to these processes include size, vegetation density, hydroperiod, flow patterns, substrate, climate, water chemistry, geological location, and proximity to pollutant sources (Reppert et al. 1979). Because the potential pollution sources to the wetlands are minimal, and because the wetlands are located on a steep slope and do not have a dense herbaceous layer, the wetlands probably do not currently provide significant water quality improvement functions. Groundwater Discharge Some wetlands recharge groundwater. Others depend on the discharge of groundwater to the surface (Sather and Smith 1984). In glaciated areas, such as the Puget Sound region, most wetlands are located at groundwater discharge sites or local intercept zones (Reppert et al. 1979, Erwin 1990). Wetlands in the Puget Sound area may recharge streams and other surface water systems. Wetlands A and B provide important hydrologic support for lower streams. The wetlands at this site are located in the headwaters of an unnamed stream that flows into the Green River near Southcenter (Roble pers. comm.). Because the wetlands are fed by groundwater, they help maintain streamflows in lower streams through the dry summer months. This is an important benefit for maintaining fish habitat. Salmon are present in the lower reaches of the unnamed stream (Roble pers. comm.). ww &CALnwEL nvKWUA 07i08i93e 3) 6 Wildlife Habitat Many wetlands are highly productive and support numerous, complex food chains which represent valuable sources of energy to plants and animals. In addition, wetlands provide general and specialized habitat for a wide variety of aquatic and terrestrial animals. Species may depend upon wetlands for all or part of their life cycles. The wildlife habitat value of a wetland depends in part on the structural complexity and species richness of plant communities, the proximity of desirable upland habitat, and surrounding land uses. Wetlands may provide essential foraging, breeding, cover, and rearing habitat for many species. Wetlands in the Puget Sound region provide habitat for songbirds, raptors, waterfowl, aquatic invertebrates, small and large mammals, fish, reptiles, and amphibians. Wetlands can act as important sources of food and habitat for both commercial and sport fish, as well as maintaining water quality and streamflow within streams. Although individual wetlands may not provide fish habitat per se, they may play an important role in maintaining habitat within associated streams. Wetlands serve to carry nutrients, purify water, and regulate streamflows. Commercial and sport fisheries are highly dependent upon wetlands. The wetlands at this site probably provide refuge and habitat for urban and urbanizing species such as starlings, sparrows, robins, garter snakes, mice, voles, raccoons, and salamanders. The wetlands do not provide habitat for threatened or endangered species. The hydrologic support function of the wetlands maintains water flows in lower streams, protecting valuable fish habitat. Cultural Values A variety of societal values associated with wetlands are based on cultural perceptions. Socioeconomic values include commercial fisheries, timber, and agriculture. Other cultural values include active and passive recreation, education, aesthetics, historical and archaeological resources, and other special values. (Reppert 1979, Tiner et al. 1984). The wetlands at this site do not provide fisheries, timber, agriculture, recreation, or educational benefits. The historical and archaeological functions of the wetlands are unknown. The wetlands do provide visual relief in an urbanized area. Additionally, the wetlands provide slope stabilization and help maintain water flows in lower streams. Functional Values of Buffers Buffer areas around wetlands can enhance their functional values by increasing vegetative diversity, thereby increasing the tolerance of vegetation to variations in WLI&CALDWEL /T,KWIU 07i08/93e 7 hydroperiods. This tolerance enhances the ability of a wetland to persist over time (Willard and Hiller 1990). Densely vegetated, structurally diverse buffers also act to reduce opportunities for human intrusion and noise, minimize impacts from surrounding activities, and provide valuable habitat for wildlife. The area immediately adjacent to Wetlands A and B includes dense blackberries along 42nd Avenue South to the west, a gravel driveway to the north, grass field to the east, and dense blackberries to the south. A small forested upland area in the northwest corner of the property provides additional vegetative diversity, but it is not large enough to be considered significant. The blackberries to the south and west reduce human intrusion and noise to the wetland but, because of the small size and minimal vegetative diversity, do not __provide_important wildlife habitat. The grass field to the east provides only minimal buffer functions. _ --- REGULATORY IMPLICATIONS Several local, state, and federal regulations apply to wetlands. Agencies having jurisdiction over wetlands include, but may not be limited to, the City of Tukwila, the Washington Department of Ecology, and the U.S. Army Corps of Engineers. Delineated and surveyed wetlands are subject to verification and approval by the City of Tukwila and the Corps. Local Regulations Wetlands and steep slopes are regulated under Chapter 18.45 of the City of Tukwila Zoning Code pertaining to environmentally sensitive areas. The regulation protects environmentally sensitive areas and their functions by regulating use and management within these areas and their buffers. The purpose of the sensitive areas regulation includes protecting water quantity and quality, minimizing turbidity and pollution of wetlands and fish- bearing waters, and preventing erosion and landslides. Wetlands are rated to reflect their relative function, value, and uniqueness. The city uses a three - tiered approach to wetland rating. The ratings are based on a combination of factors, including size, diversity of habitat, types of plant communities present, associations with streams, and the presence of endangered, threatened, or protected species. The criteria for rating wetlands are outlined in Section 18.45.020 of the City of Tukwila Zoning Code. Type 1 wetlands are those wetlands that provide habitat for endangered or threatened species, have large amounts of open water, or are greater than 5 acres. Type 2 wetlands are those wetlands that are forested, are larger than 1 acre, have three or more wetland vegetation classes, or contain heron rookeries. Type 3 wetlands are all other wetlands that are not Type 1 or 2. WL14 CALD W ELL/7U KW I LA m /08 /ve 8 Buffers retained in their natural condition around wetlands are required under the Sensitive Areas Ordinance. Wetland Types 1, 2, and 3 require native vegetation buffers of 100, 50, and 25 feet, respectively. Buffers are measured horizontally from the edge of the wetland and extend into the upland. In addition to the buffer, a building setback of 10 feet from the buffer edge may be required for residential development. The wetlands at this site would probably be assigned a rating of Type 2 based on the forested wetland vegetation class. The City of Tukwila requires a 50 -foot buffer and an additional 10 -foot building setback for Type 2 wetlands. The City of Tukwila may reduce the standard wetland buffer on a case -by -case basis, provided the buffer does not contain steep slopes (15% or greater). The approved buffer width will not be reduced by more than 50% of the standard. Buffer reduction proposals must demonstrate that they will not result in adverse impacts to the wetlands and that the buffer is vegetated. Final wetland boundary determinations, wetland ratings, and buffer requirements are made by the City of Tukwila. The City of Tukwila does not generally allow use or development in Type 2 wetlands or their buffers. However, the city does have a reasonable use exception process that may allow some use of the wetlands if the applicant can demonstrate that all reasonable use of the property containing wetlands is denied as result of the sensitive areas regulations. Applications for a reasonable use exception are available at the Department of Community Development. The reasonable use exception may require a State Environmental Policy Act environmental checklist or environmental impact statement. The city may also require a geotechnical study to determine the stability of the steep slopes on which the wetlands are located. State Regulations Water Quality Certification Section 401 of the federal Clean Water Act directs each state to certify that proposed in -water activities (Le., activity in wetlands) will not adversely affect water quality or violate state aquatic protection laws. Ecology is responsible for administering the state certification program. Discharges of dredge or fill material in wetlands that are authorized under Nationwide Permit 26 require an application for water quality certification from Ecology. Ecology has established two separate procedures for water quality certification: (1) for discharges that require Corps notification (discharges of dredge or fill material of 1 acre or more), and (2) discharges that do not require Corps notification (discharges or dredge or fill material less than 1 acre). See the Federal Regulations Section below for more information on Corps permitting. For discharges of dredge or fill material that require Corps notification, the Corps will indicate if the applicant needs to apply for water quality certification from Ecology. For WLI&CAIDWEL /T,KW►LA 07i08i93e 9 discharges that do not require Corps notification, Ecology requires project proponents to submit an application directly to Ecology. Applications are subject to a 20 -day public and agency comment period. Water quality certification is generally denied for discharges in waters that support anadromous fish; discharges in wetlands more than 0.99 acre that are sphagnum bogs, fen wetlands, or mature forested wetlands; discharges in wetlands designated as regionally or nationally significant for migratory species; and discharges in documented habitat for state - listed endangered, threatened, or sensitive animal species. Discharges of dredge and fill material affecting more than 2 acres of wetland require individual certification by the Corps. Water quality certification is incorporated into the individual permit process. (Washington Department of Ecology 1992). Hydraulic Project Approval A Hydraulic Project Approval (HPA) is required by the Washington Department of Fisheries or the Department of Wildlife for any work within the ordinary high water mark of fresh waters of the state (Chapter 75.20 RCW). The protection of fish life is the only ground upon which an approval may be denied or conditioned. An HPA is required for channelization or realignment of streams, culvert installation, dredging, water diversions, bank protection, bulkheads, construction projects involving runoff from more than 5,000 square feet of impervious surface within a stream basin, and other activities within waters of the state. It is the goal of the Department of Fisheries to achieve no net loss of productive capacity of the habitat of food fish and shellfish resources. Toward this goal, the Department of Fisheries will condition project approval in a manner consistent with no net loss (Washington Department of Fisheries 1990). HPA applications are subject to a 45 -day review and, in western Washington, should be made to the Department of Fisheries. State Environmental Policy Act The State Environmental Policy Act (SEPA) was established to analyze the environmental impacts of development (Chapter 43.21C RCW). The SEPA process is triggered when a project proponent applies for a permit, or when an agency takes some official action. Projects that are determined by the agency to have a probable significant adverse environmental impact are required to undergo environmental review. During SEPA environmental review, various agencies and the public have the opportunity to review and comment on development proposals. If the City of Tukwila Department of Community Development determines that the project will have significant adverse environmental impacts, an environmental impact statement (EIS) is required. The purpose of an EIS is to analyze reasonable alternatives to the proposed project and to evaluate probable significant adverse environmental impacts. The complete SEPA process can take from 3 months to 2 years or more, depending on the environmental impacts of the proposed project. The discharge does not occur in documented habitat for state - listed endangered, threatened, or sensitive animal species. 3. The discharge is part of a single and complete project. The Corps determines if wetlands are isolated, adjacent, or above the headwaters. While it is not required that notification be filed for fills of less than 1 acre in isolated wetlands or those above the headwaters, the Corps recommends that an application be submitted for its review for projects involving fills approaching 1 acre. The Corps does require notification under Nationwide Permit 26 of wetland fills between 1 and 2 acres. Notification of wetland fill should be made 30 days in advance. After notification, the Corps will coordinate with appropriate federal and state agencies, and either issue an authorization to proceed under a nationwide permit, or give notice that an individual permit is required. The Corps may require mitigation for wetland impacts under a nationwide permit. (U.S. Army Corps of Engineers, Seattle District Office 1992.) An individual permit is required for discharges that would cause a loss of more than 2 acres of isolated wetlands, or those above the headwaters, or any discharge into wetlands adjacent to waters of the United States. The individual permit process requires an alternatives analysis which must show either that there are no suitable alternatives to the discharge, or that the proposed project is water - dependent. Mitigation would be required for impacts to wetlands. The U.S. Environmental Protection Agency has the authority to veto discharge permits. Because the wetlands at this site are probably less than 1 acre, any proposed fill would not require a Section 404 Permit from the Corps. However, if 1 or more acres of wetland fill is proposed, a Section 404 Permit would be required. For Section 404 Permit approval, the Corps requires the use of the 1987 U.S. Army Corps of Engineers Wetlands Delineation Manual (Environmental Laboratory 1987), rather than the 1989 Unified Federal Methodology required by the City of Tukwila and used for delineation of wetlands at this WL1&:CA DWL./ruKWILA 07i08i93e 11 site. If a Section 404 Permit is pursued, a delineation using the 1987 Corps methodology would be required. It is our professional opinion that the wetland edge delineated under the 1989 federal methodology would not change using the 1987 Corps methodology. CONCLUSIONS Evaluation of this site using the 1989 Unified Federal Methodology shows that two palustrine forested and scrub -shrub wetlands are present. The wetlands' primary functions include groundwater discharge, wildlife habitat, and cultural values. The wetlands would likely be considered Type 2 by the City of Tukwila and would require a minimum 50 -foot buffer and an additional 10 -foot building setback. Buffer reductions may be allowed. Development is generally not allowed in Type 2 wetlands; however, the city may allow a reasonable use exception. In addition to the City of Tukwila, state and federal regulations may apply to the wetlands at the site. Summary of Federal Wetland Delineation Methodology Exhibit A. Summary of Federal Wetland Delineation Methodology Wetlands at the site were delineated using the methodology described in the Federal Manual for Identifying and Delineating Jurisdictional Wetlands (FICWD 1989). The 1987 manual is applied by the U.S. Army Corps of Engineers and the 1989 manual is applied by the City of Tukwila. The 1989 Unified Federal Methodology, as it is also known, represents an interagency effort whereby the U.S. Fish and Wildlife Service (USFWS), U.S. Soil Conservation Service (SCS), U.S. Army Corps of Engineers, and U.S. Environmental Protection Agency (EPA) present a unified approach to wetland delineation. For regulatory purposes, the federal agencies define wetlands as follows: Those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas. The methodology for wetland delineation requires examination of three wetland parameters: soils, hydrology, and vegetation. These are discussed below. For an area to be considered a wetland, a positive indicator for all three of these parameters must be present. The 1989 methodology provides additional delineation techniques for assessing particular types of disturbed areas, such as actively farmed agricultural areas. Wetland Hydrology Areas possessing wetland hydrology are inundated either permanently or periodically, or the soil is saturated to within 1 foot of the surface for a week or more during the growing season. Direct observations of hydrology, including ponding and soil saturation, may be limited during the dry season or may be misleading during the winter rainy season. However, indicators which confirm the presence of wetland hydrology during the growing season may be present throughout the year. Indicators include water - stained leaves, oxidized root channels associated with living roots and rhizomes, visible sediment deposits, and exposed mud. In areas where no positive indicators of wetland hydrology are observed, WLI &CALDWE L/flJKWIu 07/08/93e A -1 but positive wetland indicators are present for soils and vegetation, wetland hydrology may be assumed to be present. Hydrophytic Vegetation Hydrophytic plants are those plants adapted to life in water, soil, or on a substrate that at least periodically lacks oxygen. Commonly occurring plant species have been assigned a plant indicator status by the USFWS based on their frequency of occurrence in wetlands. Plant indicator status categories are described in Table A -1. For a vegetation community to be considered hydrophytic, 50% or more of the dominant species in that area must be rated as facultative or wetter. In the case where half of the dominant species are hydrophytic and half are non - hydrophytic (upland), the determination is made based on the total percent areal coverage of each of the two groups. For example, if more than 50% of the total areal coverage is comprised of hydrophytic plants, the community is determined to be hydrophytic. Hydric Soils Hydric (wetland) soils are defined as those soils which are saturated, flooded, or ponded long enough during the growing season to develop anaerobic conditions that favor the growth and regeneration of hydrophytic (wetland) vegetation. Hydric indicators include low soil chroma, mottles, gleying, and high organic content. Chroma is a measure of the intensity of grayness of the soil color. A chroma of 1, occurring with or without mottles, or a chroma of 2, occurring with mottles, is considered to be low and an indicator of hydric soils. Mottles are spots or blotches of contrasting color occurring within the soil matrix. Gleyed soils are predominantly neutral gray in color. Soils are considered to be organic if at least 18 inches of the upper part of the soil profile contains organic material, or if the soil consists of organic material resting on bedrock. Soils were sampled with a hand -held soil auger and examined for hydric indicators. Observed soil characteristics were compared to the SCS descriptions of mapped soils (SCS 1973) to either confirm the mapping or determine if an inclusion is present. Most soils mapped by the SCS include areas of other soils (inclusions) which may compose from 2 to 50% of that unit. Wetland Boundary Determination An overall assessment was made of the site. For the wetland delineation to be valid, the flagged wetland edge must be surveyed by a professional surveyor. The Austin Heights Subdivision was March 18`1993' Both of these had Preps where the water, sewer, drainage and access needs were identified - that a licensed survey of the plat, grades, drainage plan, water & sewer plans would be needed in order to recommend approval and that they are required to be constructed for Final Approval and Recording (Filing)' February 22, 1994 was when the Caldwell Shortplat was received by Public Works for review. A Memorandum identifying the specific needs for access, water, sewer, drainage, and hydrants was provided for DOD and reviewed with Mr' Caldwell. The requirements have remained the same in accord with the TMC. The same as have been required and provided by other shortplat developments. In response to the current request to approve the Caldwell Shortplat, it can be recommended for approval with the following conditions: 1. A water supply plan is needed, must be approved, and oonoruoted prior to Final Approval and Filing; it is to be noted that 42 Ave S is being designed for construction and if no plan is provided that the City will constuct lines to avoid cutting open the new street and the costs of these lines will attached to the Public Works permits. 2. A sewer plan is needed, must be approved, and consructed 1 Caldwell ShortplaL„. June 14, 1994 prior to Final Approval and Filing; it is to be noted that 42 Ave S is being designed for construction and if no plan is provided that the City will constuct lines to avoid cutting open the new street and the costs of these lines will attached to the Public Works permits. 3 A drainage plan in accord with King County standards is needed, must be approved, and constructed prior to Final Plat Approval and Filing. Detention is needed and the plan needs assure that runoff does not intrude on each subsequent downhill lot. 4. A Fire Hydrant (protection) plan in accord with Fire Ordinance 1692 is needed, must he approved, and constructed prior to Final Approval and Filing. 5. An access plan showing driveways not exceeding the 15% grade, providing adequate sight distance, and designed to meet the curb, gutter, and sidewalk shown in the 42 Avenue South Design Report is needed, must be approved, and constructed prior to Final Approval and Filing. It is noted that the Design Report has been previously provided and discussed with Mr. Caldwell. 6. Other requirements that have been previously explained and remain conditions of recommending approval of the shortplat include: a. Undergrounding is required; pending construction of 42 Ave 5 with undergrounding eliminates the ability waive the undergrounding requirement. b. Any easements that are existing or proposed need to be shown and legal descriptions provided. c. Provide a copy of recorded maintenance agreement which runs with the land and covers any common access and utilities if applicable. The previous memos have provided similar information identifying the TMC requirements to recommend approval of the shortplat (step 1 and TMC 17.08.070) and for Final (Filing) approval. The April 26 memo stated essentially the same, that the Caldwell Shortplat could he approved conditioned on these water, sewer, drainage, access, undergrounding, and similar infrastructure requirements. The Stamped Lund Survey dated (revised) June 4, 1994 and received by Public Works on June 9, 1994 can be recommended for approval with the above conditions. It is recommended that the infrastructure plans he prepared by a licensed civil engineer. City of Tukwila John W. The Sensitive Areas Ordinance requires a 10' building setback from a sensitive areas buffer (TMC 18.45.040(c)(3)). To alert future owners to the limits of the potential building area, your survey must be revised to show the "10' Building Setback Line" for Lot 4. Steep Slope: As your property contains "steep slopes," the Sensitive Areas Ordinance requires additional information. In your new proposal, Lot 4 appears to provide adequate space for future home construction away from steep slopes. Therefore, we will not require a geotechnical report nor slope protection easement. However, to verify the location of the slopes, you will need to do the following: 3. Your — application —must include —a- topogr- aphic— surrey -, and exact slope of any area in excess of 15 %, stamped by a licensed surveyor. This topographic survey must accurately reflect your current 4 -lot proposal. Survey format: 4. As required on the APRD application checklist, a scale of 1" = 30' is the maximum allowed for your survey. As your survey is drawn at 1" = 50,' it will need to be revised. 5. As required in the application checklists, please submit a legible copy of your survey on an 8 -1/2 x 14 inch paper sheet. Mylars are not acceptable. Do not include on the survey any owner's declarations or other signatures besides that of the surveyor (refer to the application checklist for map requirements). 6. Through the APRD process, you have the option to reduce the minimum Zoning Code building setbacks. According to your revised concept drawing, you propose to reduce the minimum 30 -foot front yard (42nd Avenue) setback to 20 feet. This reduced front setback is approved. In addition, other setbacks for your revised lots are approved as follows: side yard setbacks (along north & south property lines) must be 10% of the lot width; the rear yard setback must be 10 feet. To alert future property owners to these setbacks, show the setback dimensions on your survey. This can be accomplished with a dashed line labeled as "Building Setback Line." 8. Please complete the legal descriptions page in the short plat application packet. Insert the "before" legal description as noted on your survey, and the "after" legal description. The "after" description can use the form of "Lots 1 -4 of Tukwila Short Plat #L93 -0060. Have the surveyor stamp the legal descriptions. 9. Revise your legal descriptions to include the wetland easement for Lot 4 (or describe in a separate document). 10. Any necessary utilities easements should be included in your legal descriptions (see "Utilities," below). Utilities: The Public Works Department's revised requirements are noted below: 11. Your short plat must provide for storm drainage for all lots. This will require a storm drainage plan, drawn by a licensed engineer, showing existing and proposed storm drainage improvements and easements, including detention or conveyance systems. Detention must be adequate to meet pre - development conditions, and must be designed consistent with the King County Surface Water Design Manual and Tukwila drainage basin studies. Show on your survey any necessary storm drainage easements. Please note that the minimum easement width is 10 feet. If utility easements are needed, a Joint Maintenance Agreement is required to identify which of the properties will have responsibility for maintaining commonly used utilities. This Agreement can be written into your easement descriptions, or included as a separate document. A sample form was included in my letter of 3/29/94. To complete your application and obtain preliminary approval, the items listed above must be completed, and the requested revisions submitted to me. Once these requirements are satisfied, your application will be forwarded to the Short Subdivision Committee for preliminary approval. The Committee will review your application at a public meeting, and may approve, approve with modifications or deny the application (TMC 17.08.060(d)(2)). The decision of the Short Subdivision committee is final, unless an appeal is filed. Any appeal must be made in writing to the Department of Community Development within 10 (ten) days of the Committee decision date, and should include an explanation of the basis of the appeal. The Planning Commission will review the appeal within 40 days (TMC 17.08.060(d)(3)). REQUIREMENTS FOR-FINAL-APPROVAL After preliminary approval by the Short Subdivision Committee, you must demonstrate that all required site improvements are complete. To do this, you will need to do the following: 1. Install any necessary storm drainage elements. 2. Obtain all required permits prior to beginning any construction or demolition. 3. Notify me when all of these items have been completed, so that the City can conduct a final inspection. Alternatively, you may provide assurances for future construction of these improvements through posting of a bond (or Assignment of Account, or Letter of Credit) for 150% of the construction cost. This requires a contractor's written estimate of work to be completed. If you choose this option, please contact me for information regarding necessary forms. Mr. D. Caldwell Short Plat /APRD 5/3/94 Page 5 While not required for short plat approval, please note the following items which will apply to future construction: 1. Your future driveway construction should be consistent with improvements planned for the 42nd Avenue Street upgrade project. Please contact the project manager, Ross Heller of Public Works at 433 -0179 to ensure coordination. The Fire and Public Works Departments require that driveways be a minimum of 20 feet wide, with a grade not to exceed 15 %, and with a paved "apron" for a distance of 20 feet from the back of the 42nd Avenue sidewalk line. 2. The Tree Ordinance and Sensitive Areas Ordinance require that trees and other vegetation be replaced if you clear steep slopes. Also, you may need to obtain a Tree Removal Permit. Standards for protection and replacement can be found in the Zoning Code (TMC 18.54, Tree Regulations, and 18.45,. Sensitive Areas). I can assist you with more specific requirements if you anticipate tree clearing in the future. When these items have been completed to required standards, the Chairman of the Short Subdivision Committee can give final approval to your short plat. This usually occurs within approximately one week of notice that conditions are completed. REQUIREMENTS FOR RECORDING The signature of the Chairman of the Committee certifies that your short plat application is ready for recording. You will then need to submit your approved short plat to the King County Department of Records (296- 1570). Your survey shows only a 25' buffer. You have two options in addressing the buffer: a) Revise your survey to show the required 50' buffer. b) Request a reduction in the required wetland buffer. Under the Sensitive Areas Ordinance, the Director of Community Development may reduce the required buffer up to 50% or, in this case, up to 25 feet, if you satisfy certain conditions (TMC 18.45.040(c)(4)). These conditions are: i. There are slopes greater than 15% located within 50' of the wetland. Your application does not provide enough topographic information to determine where steep slopes are located relative to the buffer. You will need to submit additional information to show how you meet this first condition (See Item #5, below). ii. There is no existing significant vegetation which would be lost due to buffer reduction. iii. The reduced buffer remains vegetated. iv. You submit a mitigation plan which meets the standards in the Sensitive Areas Ordinance. Your mitigation plan must include a planting plan prepared by a landscape architect, which shows how plantings in the reduced buffer will improve the buffer function and value (TMC 18.45.040(c)(4). To guide you in establishing a special easement, sample wording is included in an attachment. As an alternative, you may wish to create a sensitive areas tract. As a tract, the area would become a separate property under joint ownership (an easement area remains part of the underlying lot). Creation of a tract would require revisions to show a new "Sensitive Areas Tract X" with new lot lines and lot areas. An advantage of this is that the King County Assessor may provide assessment relief for areas designated for sensitive areas open space. Prior to creating your tract or easement, you may wish to check with the Assessor (296- 7300). 3. The Sensitive Areas Ordinance requires a 10' building setback from a sensitive areas buffer (TMC 18.45.0.40(c).(3)). To alert future owners to the limits of the potential building area, your survey must be revised to show the "Building Setback Line" for Lot 4. This building setback line must meet the current Zoning Code requirements for front, side and rear yards. Steep Slope: Our maps indicate that your property contains "steep slopes" with grades over 15 percent, as defined in our Sensitive Areas Ordinance. To meet the requirements of the Ordinance, please complete the following: 4. Your application included a contour map with 5 -foot contour intervals superimposed on a 9 -lot subdivision. As noted in the application checklists and Sensitive Mr. D. This topographic survey must accurately reflect your current 4 -lot proposal. 5. The slopes on your site are considered Class 2 slopes in our Sensitive Areas Ordinance. The Ordinance requires a study by a geotechnical engineer to determine whether a permanent buffer (i.e. setback) is needed between the slope and future structures (TMC 18.45.040(d)). Prior to approval of your short plat, you will need to submit a geotechnical report. If the geotechnical report indicates that the slope has been instable in the past, or that future development or surface water discharge will increase instability, an additional building setback may be required (TMC 18.45.080(e)). An APRD requires that we send notice of the application to surrounding property owners. Your application included the required mailing labels. As required in 'the APRD checklist, please submit this Assessor's (section) map, showing the 300' distance from your property lines. Trees 13 The Subdivision Code requires you to "prepare a tree inventory of the significant vegetation on site" (TMC 17.20.020). Therefore, your survey must include identification of existing trees 6" in diameter or larger, on the existing parcel and on the adjacent parcel where the easement is located. Identify any trees to be removed. If no significant trees exist on the site, add this as a notation on the survey. The Tree Ordinance and Sensitive Areas Ordinance require that trees and other vegetation be replaced if you clear the steep slopes. Standards for protection and replacement can be found in the Zoning Code (TMC 18.54, Tree Regulations, and 18.45, Sensitive Areas). Fire protection /service: To ensure adequate fire protection of future homes, our Fire Department requires the following revisions to your application: 15. )Your survey must be revised to include the location of ��_� the nearest existing fire hydrant, as required on the short plat application checklist. Any future homes in your plat which are not located within 250' (by line of vehicular travel) of the existing hydrant will need to be sprinkled. If this is the case, your survey must include the following notation: "Sprinkler systems which meet City codes must be installed as a condition of building permits for any home located more than 250' from a fire hydrant." Sample Joint Maintenance Agreement • CITY OF TUKWILA Areas of Potential Geologic Instability Development and Report Criteria All development applications on property having slopes greater than or equal to 15% are subject to the Zoning Code - Sensitive Areas Ordinance. Three primary factors that influence slope stability were incorporated into the geologic classification system. Important characteristics of the site are topographic relief, stratigraphy of subsurface soils, and local ground or surface water environment related to potential slippage and massive soil movement. Areas of Potential Geologic Instability are considered sensitive areas and classified as follows: - Class 2 areas, where landslide potential is moderate, which slope between 15 and 40 percent and which are underlain by relatively permeable soils. - Class 3 areas, where landslide potential is high, which include areas sloping between 15 to 40 percent and which are underlain by relatively impermeable soils or bedrock, and which also include areas sloping more than 40 percent. - Class 4 areas, where landslide potential is very high, which include sloping areas with mappable zones of ground water seepage, and which also include existing mappable landslide deposits regardless of slope. - Areas of potential seismic instability, with soft soils, loose sand and a shallow groundwater table. - Areas of potential coal mine hazard, ie. subsidence from subsurface excavation and tunneling. In order to identify the extent of sensitive slopes, the applicant must submit a survey of existing topography, drawn in two -foot contour intervals accurate to within one foot of elevation. The topographic survey must be stamped by a professional.land surveyor licensed in the State of Washington. Mapped slope areas exceeding 15 percent should be designated on the site plan for potential geotechnical site review. Professional Qualifications The applicant is required to submit a geotechnical report appropriate to both the site conditions and the proposed development. A geotechnical investigation will generally not be required for development of Class 2 slopes when: 1) any portion of the site is a minimum of 200 feet from a Class 3 or 4 area and 2) the proposed alteration remains outside the sloping area. Development of Class 3 and 4 areas and any identified seismic or coal mine hazard areas requires a geotechnical investigation and associated report. All geotechnical studies must be conducted by a geotechnical engineer. TMC 18.06.323 defines this individual as a professional civil engineer licensed with the State of Washington who has at least four years of professional employment as a geotechnical engineer with experience in landslide evaluation. Geotechnical engineers performing work within the City must submit professional qualification statements in addition to work history and references. Geotechnical Analysis The geotechnical report analyzes the site for overall stability and makes recommendations on the need for and width of buffer setbacks necessary to protect post - development site stability. The investigated geologic, hydrologic, and topographic conditions of the site will be used to confirm or revise the City's geologic classification. The scope of the investigation should comply with the specific requirements presented below. 1. Landslide Hazards Class 2: Geotechnical reports for Class 2 areas are required to have, at a minimum, a review of available geologic site data and a surface reconnaissance of the site and adjacent areas. Subsurface exploration of the site is at the discretion of the geotechnical consultant and the City. Class 3: Geotechnical reports for Class 3 areas are required to have a review of the available geologic site data, a surface reconnaissance of the site and adjacent areas, and a subsurface exploration program suitable to the site conditions and the proposed development. Class 4: Geotechnical reports for Class 4 areas are required to perform the tasks listed for Class 3 areas. In addition, detailed slope stability analysis should be performed based on the information obtained during the field investigation. 2. Erosion Hazards Class 2, 3, and 4 landslide hazard areas are also potential erosion hazard areas. Geotechnical reports regarding proposed development in these areas will include erosion and sediment control recommendations that are appropriate to the site conditions and the proposed development. +.. 3. Seismic Hazards Proposed development within areas of significant seismic hazards should include an evaluation of site response and liquefaction potential relative to the proposed development. For one or two story single- family dwellings, this evaluation may be based on the performance of similar structures under similar foundation conditions. For proposed developments of other occupied structures, this evaluation should include sufficient subsurface exploration to provide a site coefficient (S) for use in the static lateral force procedure described in the Uniform Building Code. 4. Coal Mine Hazards Proposed development within areas of historical coal mine activities or mapped subsurface coal formations will require a detailed site reconnaissance by a geologist or a geotechnical engineer. Site specific information regarding the presence of mine entrances or workings is needed prior to permitting new construction in these areas. Permitting Requirements Prior to permitting any development of an area of potential geologic instability, the applicant must demonstrate one of the following: 1. There is no past or present evidence of slope instability and quantitative analysis indicates no significant risk to the proposed development or surrounding properties. OR 2. The potentially instable area can be modified or the project can be designed so that proposed impacts to the site and surrounding properties are eliminated, slope stability is not decreased, and the increase in surface water discharge or sedimentation will not affect slope stability. CITY OF TUKWILA Wetland and Watercourse Special Studies Report Criteria A development proposal that is within 50 feet of a sensitive area will submit appropriate studies to adequately identify and evaluate the sensitive area and it's buffer. Projects proposing sensitive area impacts will require specific studies to assess the impacts and propose mitigating measures. Professional Qualifications Wetland and stream specialists performing work for City review will, upon request, submit professional qualification statements. A project list with references should be included to verify work history and performance. Wetland and Watercourse Analysis The exact location of wetland and watercourse boundaries will be determined by the applicant's consultant. Wetland delineations, performed by wetland specialists, will apply the wetland definition in TMC 18.06.938 and the methodology in the "Federal Manual for Identifying and Delineating Jurisdictional Wetlands" (1989). Watercourse analysis will be performed by qualified stream or wetland specialists to characterize and classify the watercourse according to the watercourse definition in TMC 18.06.395 and the City's Water Resource study (1990). All buffers will be measured from the ordinary high water mark (OHWM), if field delineation is possible, or from the top of bank. Wetland and watercourse reports submitted to the City should contain the following: 1. A plant species list or description with scientific names (nomenclature), relative abundance and distribution of species, and the major habitat types of vegetation. 2. Data plot forms, according to the Federal Manual method, to substantiate wetland study findings. 3. Report site maps should include: a. Vicinity map b. Public resource document maps including City's Sensitive Area inventory mapping, if applicable. c. Accurate topographic mapping, if required, showing contours at the smallest available interval. d. Field delineated and professionally surveyed wetland and /or watercourse boundary mapping. 4. The written report should discuss the following: a. Site description and general observations of habitat value related to wildlife use. b. Study methodology. c. Soil types mapped on the site including on -site verification and analysis. d. Vegetation description according to the classification system outlined in "Classification of Wetlands and Deepwater Habitats of the United States ", Fish and Wildlife Service, U.S. Department of the Interior, 1979 (FWS /OBS- 79/31). e. Wetland or watercourse rating and associated buffer width according to the Sensitive Areas Ordinance of the Zoning Code. Mitigation Proposals A mitigation proposal of wetland or watercourse relocation and /or buffer.reduction should include the standard report format plus the following: 1. Conceptual mitigation or enhancement plan to describe and illustrate what impacts and compensatory actions are proposed. a. Include hydrology aspects, vegetation composition, and wildlife habitat details. b. Describe how water quality and flood storage potential would be improved. 2. Upon approval of conceptual plan, a final mitigation or enhancement plan will be required to include the following components: a. Detailed planting and grading plan including species to be used for revegetation. b. Performance standards. c. Construction management. d. Monitoring program to ensure success of the plan. e. Contingency plan to correct performance standards or unanticipated impacts. f. Performance security in the form of a monetary bond or other means to guarantee the successful completion of the plan.
