Pierog, PW Development Engineer Date: NovAmber 19, 1993 Subject: Ormiston Boundary Line Adjustment 13726 53rd Avenue South Review Comments In reference to the subject boundary line adjustment, it appears that the intent is to eliminate encroachment by the garage struc- ture and provide adequate setback. It should be verified that there are no utilities serving the house on Lot A that cross through the adjustment area. Please be advised that the current right -of -way width (40') on 53rd Avenue South is substandard for a collector arterial which normally requires 60' (Ord. No. 1616). Also, there has never been any dedi- cation of right -of -way on this side of the projected right -of -way centerline for South 139th Street. Since this is considered to be a local access street, the total width of right -of -way required is 50'. This means that the half -width dedication required from this property is 25'. Any substantial redevelopment of this property or significant re- configuration of property lines in the future will trigger the ne- cessary dedications. This will not only provide for street upgrades but will also provide for the elimination of potential safety prob- lems along South 139th Street due to the narrow street width and limited sight distances associated with the existing topography. The next step is to record the BLA with King County. You will need to file the attached original forms with the King County Department of Records (Room 311, King County Administration Building, 500 4th Avenue, Seattle, WA, 98104, 296- 1570). The recorded BLA documents are to be returned to the City of Tukwila Dept. of Community Development. The County will mail to us the recorded original in approximately 4 -6 weeks; or, you can hand -carry a recorded copy to us. For your convenience, I have enclosed a copy of the BLA which you can have recorded by the County. After we receive the recorded documents (original or copy) , your BLA is considered complete. Rants, Mayor Department of Community Development Rick Beeler, Director December 29, 1993 Mr. Stephen Ormiston 13726 53rd Avenue South Tukwila, WA 98168] RE: Boundary Line Adjustment #L93 -0075 Dear Mr. Ormiston: The Department of Community Development (DCD) has completed a preliminary review of your Boundary Line Adjustment (BLA) application. This review included compliance with the requirements of the Sensitive Areas Ordinance and other Tukwila codes, as noted below. 1. Sensitive Areas Ordinance requirements Your property appears on our maps and in your survey as having a steep. slope (slopes greater than 15% grade). Under our Sensitive Areas Ordinance, development of property with a steep slope typically requires an Administrative Planned Residential Development Permit (TMC 18.45.060(2)). In addition, the Ordinance requires that the location of steep slopes be shown on your plans (i.e. topographic survey) (TMC 18.45.060, TMC 18.45.080(e)(4)), and that you submit a geotechnical report (TMC 18.45.040(d)(1)), TMC 18.45.080(e)(4)). However, DCD has waived these requirements as provided for in the Ordinance (TMC 18.45.060, TMC 18.45.020(f)(2)). This waiver has been granted because the slope appears as an isolated Class 2 slope, because your parcel has been previously cleared and developed, and because no development is proposed which will affect the slope. As you stated in our earlier discussion, the purpose of this BLA is to correct the encroachment of your garage onto your neighbor's property line. 2. Utilities requirements It is not clear from your application whether utilities serving your neighbor's Lot A will be affected by the lot line relocation. Prior to approval of your BLA, we need to confirm this with you. If any utilities easements or lines are located within or cross the adjusted area ( "Area of Exhibit A" on your survey), you will need to revise your survey map to show these utility locations. In addition, you will need to submit any new or revised easements necessary for utility service to Lot A. B. If utilities will not be affected, you will need to confirm that in writing. For your convenience, you may use the attached form letter which we have prepared. Please sign and date the letter, and return it to me. Once we receive your revised survey /utility easements, or utilities letter described above, your application will be forwarded to the Director for approval. Review by the Director requires approximately one week. After approval, your BLA will be ready for you to record at King County Dept. of Records.
