DESCRIPTION OF PROPOSAL:
Construction of a 783 space parking lot with
landscaping as shown in attachments A -I. The lot
is partially developed. Developing the final 5.5
acres of this 8.35 acre lot will leave it fully
used, with an impervious surface coverage of about
95 percent. Portions of landscaping will be
located on adjacent lots to the east and west.

The City has determined that the proposal does not have a probable
significant adverse impact on the environment. An
environmental impact statement (EIS) is not required under RCW 43.21c.030(2)(c). This
decision was made after review of a completed environmental checklist
and other information on file with the lead agency. This information
is available to the public on request. The conditions to this SEPA
Determination are attached.

Mitigating Conditions to the Environmental
Determination of Non - significance for
L93 -0081 (Segale Business Park Parking Area)
January 10, 1994
(i) The property owner will provide King County a
permanent right of entry for inspection, repair and
maintenance by King County and its agents, of the left
bank of the Green River within the property owner's
land in Section 35, Township 23 North, Range 4 East, WM
in King County. This right of entry shall be provided
to King County in recordable form prior to final
approval of the construction.
The basis for this easement is a previous agreement
between the property owner and King County during
construction of certain flood control work (e.g., the
dike). Execution of this easement will complete the
earlier agreement within a specific time frame.
(ii) The City and County plan to provide a levee
repair and improvement project design in 1994, with
construction in 1995, within the dike maintenance
easement area (see above). If the property owner
desires to fill over the levee drainage material prior
to construction of the project by the City and King
County, the property owner will build the levee
drainage collection facility (pipe) and place filter
fabric on top of the facility in accordance with City
of Tukwila specifications prior to any grading /fill
construction. Should the City and King County fail to
construct the levee drainage collection facility prior
to December 31, 1995, the property owner may fill over
the levee drainage material by placing filter fabric
(no pipe) on top of the facility in accordance with
City of Tukwila specifications.
(iii) A portion of the proposed construction
encroaches into the northern easement area tacit
). This and any other materials placed within the
dike easement area as a result of the proposed
construction, shall be removed by the property owner
within thirty days of written request of the City to
allow installation of the levee drainage collection
facility. Construction of this facility is anticipated
in 1995.

Additional traffic mitigation may be required if the
Simulcast facility, which this parking lot supports,
generates more traffic than anticipated, and /or
unanticipated traffic safety or capacity problems are
created that are directly attributable to the separated
783 stall parking lot. The traffic analysis and
mitigation from the associated simulcast wagering
facility from Tukwila file number L93 -0067 is herewith
incorporated into this environmental determination.
(i) The property owner shall submit a letter of
agreement to provide landscaping as shown in ;it?
A, within 60 days of a written request by the City of
Tukwila following completion of the dike levee repair
and improvement project (see B.3.d.(ii)), or
determination by the City of Tukwila that the dike
levee repair and improvement project will not be funded
or built prior to December 31, 1995.
The applicant is willing to provide required
landscaping now. However, installation at this time
would result in needless costs, since the plants would
have to be taken out and replaced as part of the 1995
levee maintenance project. This letter shall be
provided prior to final construction approval.
(ii) Plantings on the dike bank may be modified or
removed upon a clear demonstration of compelling safety
needs (e.g., to ensure dike stability) and no feasible
alternatives.
(iii) The following landscape easements shall be
recorded prior to final approval of the construction in
order to provide the landscaping as proposed in
(1) A 5 ft. width along the western project site
property line from Lot 2 of Tukwila Boundary Line
Adjustment file L93 -0085
(2) An area of varying width between the project
site's eastern property line and the western edge of
the top of the left bank dike, from Lot 352304 -9018

C. Grantor desires to establish a landscape easement over portions of Lot 2 for the benefit
of Lot 4.
NOW THEREFORE, there are hereby created, declared and established, the following
easements:
1. A nonexclusive easement is hereby reserved over the easterly five (5) feet of Lot 2 as
it adjoins Lot 4 (hereinafter the "Easement Area ") for the purpose of providing landscaping to benefit
Lot 4.
2. The easement hereby created and imposed upon Lot 2 shall run with the land, and shall
inure to the benefit of and be binding upon said Lot 2 and the owners thereof, and their heirs,
successors and assigns.
3. All maintenance of the landscaping within the easement established herein shall be
undertaken by Grantee, its heirs, successors and assigns.
4. Grantee, its heirs, successors and assigns shall save, defend indemnify and hold Grantor
its heirs, successors and assigns harmless from all liability or damage arising out of any act or acts of
Grantee within the easement area.

SEPA Comments for Dike Drainage Easement
Dear Ross:
We have reviewed Public Works comments with regards to the SEPA review for the temporary parking
lot for the simulcast facility and request that the following clarifications be made:
o The City and County plan to provide a levee repair and improvement project design in 1994 and
construction in 1995. If the property owner desires to fill over the levee drainage material prior
to construction of the project by the City and King County, the property owner will build the
levee drainage collection facility (pipe) and place filter fabric on top of the facility in accordance
with City of Tukwila specifications prior to any grading /fill construction.
o If required by the City of Tukwila the materials already placed within the dike maintenance
easement over the existing dike drainage system will be removed by the property owner within
thirty days of written request of the City to allow installation of the levee drainage collection
facility. Construction of this facility is anticipated in 1995.

The property owner will provide King County a permanent right of entry for inspection, repair
and maintenance by King County and its agents, of the left hank of the Green River within
property owner's land in Section 35,Township 23 North, Range 4 East, W.M., in King County.
This right of entry shall he provided to King County in recordable form prior to issuance of the
Certificate of Occupancy.
