Development pursuant to this permit shall be undertaken pursuant to the
attached terms and conditions.
This permit is granted pursuant to the Shoreline Management Act of 1971 an
nothing in this permit shall excuse the applicant from compliance with any
other Federal, State or local statutes, ordinances or regulations
applicable to this project, but not inconsistent with the Shoreline
Management Act(Chapter 90.58 RCW).
This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the
permittee fails to comply with the terms or conditions hereof.
CONSTRUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS NOT AUTHORIZED
UNTIL THIRTY (30) DAYS FROM THE DATE OF FILING WITH THE DEPARTMENT OF
ECOLOGY AS DEFINED IN RCW 90.58.140(6). AND WAC 173 -14 -090, OR UNTIL ALL

Conditions to the
Shoreline Substantial Development Permit for
L93 -0081 (Segale Business Park Parking Area)
January 27, 1994
SEPA conditions for this project (file L93 -0081) are incorporated
as conditions to this shoreline permit. These SEPA conditions
are shown below and referenced to the attachments in the SEPA
file.
B.3.d.
(i) The property owner will provide King County a
permanent right of entry for inspection, repair and
maintenance by King County and its agents, of the left
bank of the Green River within the property owner's
land in Section 35, Township 23 North, Range 4 East, WM
in King County. This right of entry shall be provided
to King County in recordable form prior to final
approval of the construction.
The basis for this easement is a previous agreement
between the property owner and King County during
construction of certain flood control work (e.g., the
dike). Execution of this easement will complete the
earlier agreement within a specific time frame.
(ii) The City and County plan to provide a levee
repair and improvement project design in 1994, with
construction in 1995, within the dike maintenance
easement area (see above). If the property owner
desires to fill over the levee drainage material prior
to construction of the project by the City and King
County, the property owner will build the levee
drainage collection facility (pipe) and place filter
fabric on top of the facility in accordance with City
of Tukwila specifications prior to any grading /fill
construction. Should the City and King County fail to
construct the levee drainage collection facility prior
to December 31, 1995, the property owner may fill over
the levee drainage material by placing filter fabric
(no pipe) on top of the facility in accordance with
City of Tukwila specifications.
(iii) A portion of the proposed construction
encroaches into the northern easement area ( ? ;a:

). This and any other materials placed within the
dike easement area as a result of the proposed
construction, shall be removed by the property owner
within thirty days of written request of the City to
allow installation of the levee drainage collection

facility. Construction of this facility is anticipated
in 1995.

B.14.g. Additional traffic mitigation may be required if the
Simulcast facility, which this parking lot supports,
generates more traffic than anticipated, and /or
unanticipated traffic safety or capacity problems are
created that are directly attributable to the separated
783 stall parking lot. The traffic analysis and
mitigation from the associated simulcast wagering
facility from Tukwila file number L93 -0067 is herewith
incorporated into this environmental determination.
B.4.d.
(i) The property owner shall submit a letter of
agreement to provide landscaping as shown in 1t
0, within 60 days of a written request by the City of
Tukwila following completion of the dike levee repair
and improvement project (see B.3.d.(ii)), or
determination by the City of Tukwila that the dike
levee repair and improvement project will not be funded
or built prior to December 31, 1995.
The applicant is willing to provide required
landscaping now. However, installation at this time
would result in needless costs, since the plants would
have to be taken out and replaced as part of the 1995
levee maintenance project. This letter shall be
provided prior to final construction approval.
(ii) Plantings on the dike bank may be modified or
removed upon a clear demonstration of compelling safety
needs (e.g., to ensure dike stability) and no feasible
alternatives.
(iii) The following landscape easements shall be
recorded prior to final approval of the construction in
order to provide the landscaping as proposed in
(1) A 5 ft. width along the western project site
property line from Lot 2 of Tukwila Boundary Line
Adjustment file L93 -0085
and

(2) An area of varying width between the project
site's eastern property line and the western edge of
the top of the left bank dike, from Lot 352304 -9018

until Vernon Umetsu verifies SERA conditions have been completed by
the property owner. Vernon will inform you.
The attached utility permit application and plans are ready for
issuance of permits upon the above authorization through DCD. Permits
to be issued are as follows:
1. Flood Control Zone Permit
2. Land Alterning Permit
The Flood Control Zone Permit is conditioned to the requirements
in MDNS L93 -0081 (including providing King County with a permanent
right of entry [Refer to Item B.3.d(i) in the MDNS).
I have informed Vernon Umetsu the Blue Atlas Ceder and ground
cover S�� y, �W;1,14- not *be llowed because these plantings aren't
compatible with `the -- standards''for -dike construction by the CORPS.
If new drain facilities are required to meet the attached 1/26/94
DOE letter NPDES requirements, then the property owner will submit

Notification of persons of certain types of pending applications is required in order to encourage
citizen participation in the land use process. Applicants are required to submit a mailing matrix
and one photocopied set of labels which show:
1. The name and address of all owners of property lying within 300 feet of the boundaries of
the property for which a permit is sought; and
2. The address of all residents of property within 300 feet of the boundaries of property.
Property owner names and addresses can be obtained from the King County Department of
Assessments located on the 7th floor of the King County Administration Building, Room 700,
500 Fourth Avenue, Seattle. To compile the information:
1. Obtain the assessor's map(s), which contains your property and all abutting property
within 300 feet. (See diagram.) You may use the maps on file in the Assessor's Office or they
can be purchased from the King County Department of Public Works Map Counter on the
9th floor of the Administration Building. It is suggested that assessor's maps be ordered
several hours in advance of the time you would like to pick them up.

2. Then, obtain a computer batch order form from the Department of Assessments, list on the
batch order form the property tax account numbers shown on the assessor's map(s) and
submit the batch order form to the Department of Assessments together with the required
fee for a printout of the information. Assistance with the tax account numbers may be
obtained through the Assessor's Office or the City of Tukwila Department of Community
Development (DCD). King County labels are not acceptable because they cannot be
duplicated.
Resident names and addresses are researched by the applicant. Kroll maps located in the DCD

This RELEASE AND HOLD HARMLESS AGREEMENT ( "Agreement ") is made by
and between MARIO A. SEGALE, a married man, acting with respect to his separate property
and estate d /b /a SEGALE BUSINESS PARK ( "Owner ") and the CITY OF TUKWILA ( "the
City ").
RECITALS
Owner owns property consisting of approximately 8.35 acres and located at 18120
Andover Park West, in Segale Business Park, Tukwila, Washington (the "Premises "). Owner
has received SEPA approval, file #93 -0081, issued by the City January 27, 1994 and Shoreline
Permit approval, file #93 -0082, issued by the City January 27, 1994, to construct a 783 stall
parking lot. The Shoreline Permit is currently being processed through the Washington State
Department of Ecology's 30 -day appeal period.
Owner desires to obtain construction permits and construct the 783 stall parking lot prior
to the end of said DOE 30 -day appeal period.
Owner desires to release and hold harmless the City from certain claims which may arise
from Owner's construction of the parking lot prior to expiration of said DOE 30 -day appeal
period.
THEREFORE, the parties agree as follows:
1. Release and Hold Harmless. Owner shall release, indemnify, promise to defend,
and hold harmless the City from and against any and all liability, loss, damage, expense, actions
and claims incurred by the City arising directly or indirectly on account of Owner's construction
of the parking lot, including specifically obligations which may be imposed upon Owner by the
Department of Ecology ( "DOE ") in connection with the Shoreline Permit (File #93 -0082)
currently being processed by DOE.
2. Acceptance /Agreement not to Prosecute. The City hereby accepts the foregoing
release and hold harmless. The City shall not prosecute or criminally cite Owner for
constructing the parking lot prior to the expiration of the DOE 30 -day appeal period.
3. Authority. Each individual signing this Agreement on behalf of a corporation
or local government represents that he or she has the necessary authority to execute this
Agreement on behalf of such entity and that, in the case of a corporation, all necessary corporate
action has been taken approving the execution of this Agreement.
4. Counterparts. This Agreement may be signed in one or more counterparts, each
of which shall be deemed an original but all of which shall constitute one and the same
instrument.

Thank you for the opportunity to comment on the determination of
nonsignificance for the construction of a 783 space parking lot
proposed by Dana Warren ( #193- 0081). We reviewed the
environmental checklist and have the following comments.
The owner of a construction site which disturbs five acres or
more of total land area, and which has or will have a discharge
of storm water to a surface water or to a storm sewer, must apply
for coverage under Ecology's Baseline General Permit for Storm
Water Discharges Associated with Industrial Activities. Owners
of sites where less than five acres of total land area will be
disturbed must also apply if the construction activity is part of
a larger plan of development or sale in which more than five
acres will eventually be disturbed. Discharge of storm water
from such sites without a permit is illegal and subject to
enforcement action by the Department of Ecology.
Application should be made at least 30 days prior to commencement
of the construction activities. A storm water permit application
form, referred to as a Notice of Intent, can be obtained by
calling (206) 407 -7156.
