Yesterday, Dave McPherson and I met with your surveyor, Tim Schriever regarding
resolving some of the outstanding issues with the above short plat application. The items
discussed included some minor typographical errors with the legal descriptions and the
need to install an address post along 44 Ave South. The installation of the address post
was a specific condition listed in the City's preliminary approval letter dated June 16,
2006.
The following needs to occur in order for final approval to be given for the short plat
application:
1. A revised plat map needs to be submitted to the City: The plat map needs to
include all original signatures. This plat map will be reviewed by the City and if
deemed meeting City requirements will be signed by the Short Plat Committee.
2. Documents correcting the legal descriptions for the easements that have been filed
with King County need to be recorded.
3. The address post needs to be installed.

On February 15, 2007 the City received a transmittal from Alliant Engineering and Land
Surveying, Inc for final approval of the above short plat. The City has completed its
review and there are several items that need to be addressed. The main item that needs to
be addressed is that some of legal descriptions are incorrect both on the plat map and the
easement documents which have already been recorded.
The City has attempted on two separate occasions to schedule a meeting with you and
your surveyor to go over the City's comments, Please call me at (206) 431 -3684 at your

The Short Subdivision Committee has completed their review of the above -
referenced short plat application. Based on the City's review of your short plat
submittal, short plat preliminary approval is granted subject to the conditions stated
below.
There are three basic steps in the approval process, Preliminary Approval, Final
Approval and Recording. These three steps and their requirements are described
as follows:
I. Preliminary Approval
The site layout as shown on the survey document prepared by Alliant Engineering
and Land Surverying, Inc. dated April 1, 2006 is granted preliminary short plat
approval.

1. All work related to the common improvements, the utilities, and the frontage
improvements, shall be reviewed, approved and inspected under a Public

3. "No Parking" signs shall be installed along the private access drive and Fire
Department turnaround.
4. A fire hydrant, providing 1,000 gpm must be located on the west side of 44
Avenue South. The fire hydrant must be located within 250 feet, by path of
travel to all proposed homes on the site.
5. An address post is required to be placed along 44 Avenue South. The post
must show the address for all the homes that access via the private drive.
6. Water, sewer, and electrical utilities must be stubbed to all lots in the short
plat. The installation of any required utilities shall be completed and the
work approved by the City of Tukwila and other providers prior to final
approval. All utilities are to be placed underground.
7. The applicant is responsible for obtaining all required permits for all
infrastructure improvements.
GENERAL FINDINGS:
Granting of this preliminary approval is based on the following findings of fact:
1. The subject parcel is addressed as 12044 44 Avenue South. The King
County Parcel Number of the site is 3347401120.
2. The comprehensive plan designation of the subject property is Low Density
Residential (LDR).
3. The subject property is zoned Low Density Residential (LDR) by the City of
Tukwila. The LDR permits 6.6 units per acre with a minimum lot size of
6,500 square feet.
4. Upon completion the property will be divided into four lots. The lots will
range in size from 6,512 square feet to 6,540 square feet.
5. When completed the short plat will include one access point which will be a
private drive.
6. There are no existing uses on the property.
7. The completed project will allow for a total of four new homes on the
property. The project is exempt from SEPA review.
Appeals
This short plat approval or any condition placed in decision is appealable to the
Hearing Examiner. One administrative appeal of the decision on the short plat is
permitted. If no valid appeals are filed within the time limit the decision of the
Department will be final.
In order to appeal the decision a written notice of appeal must be filed with the
Department of Community Development within 21 days of the issuance of the
Notice of Decision (6/16/06). The requirements for such appeals are set forth in
Tukwila Municipal Code 18.116.
Appeal materials shall include:

2. The address and phone number of the appealing party; and if the
appealing party is a corporation, association or other group, the
address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged
errors in the decision. The Notice of Appeal shall state specific errors
of fact or errors in application of the law in the decision being
appealed; the harm suffered or anticipated by the appellant, and the
relief sought. The scope of an appeal shall be limited to matters or
issues raised in the Notice of Appeal.
Any appeal shall be conducted as an open record hearing before the Hearing
Examiner. The Hearing Examiner's decision on the appeal is the City's final
decision. A party who is not satisfied with the outcome of the administrative appeal
process may file an appeal in King County Superior Court from the Hearing
Examiner's decision pursuant to the procedures and time limitations set forth in
RCW ch. 36.70C.
Final Approval
The next step is to install the necessary improvements and submit the necessary
short plat documents in compliance with the conditions of approval. After the
documents have been found to be in order and all requirements of the short plat
have been met, the Chairman of the Short Subdivision Committee signs your
short plat final plat which constitutes a grant of final approval.
In addition, all inspections relating to public works improvements must be
completed by the time of final approval.
Required Documents for Final Approval
1. A new title report will be required when you submit for final approval. The
title report must be within 45-day of submitting for final approval and must
show that the individuals on the signature blocks have title to the property
subject of the short plat application.
2. Four copies of the final plat must be submitted. One of the copies must bear
original signatures of the property owners and surveyor. Additionally, this
copy must include the surveyor's original stamp. DO NOT FOLD THE
FINAL SHORT PLAT MAP.
3. Public Works requires recordable documents, separate from the short plat,
for easements, property dedications, surface water maintenance and other
documents affecting the use of real property. Your submittal must include
separate documents to be recorded with the short plat. Public Works has
sample easements.

1. The final short plat document shall meet the recording requirements of the
King County Recorder's Office.
2 The original notarized signatures of all property owners must be on the face
f of the plat.
3. All lots shall be assigned an address and shown on the final plat. The
address are as follows:
Lot 1: 12042 44 Ave S
Lot 2: 12044 44 Ave S
Lot 3 12046 44 Ave S

4. Add the following note to the short plat, "The City of Tukwila has no
responsibility to build, improve, maintain or otherwise serve the private road
or stormwater facilities located within this short plat area ".'
5. Add the following note to the short plat, "Lots one and four of this short plat
have no right to access directly to 44 Avenue South ".
6. Show all easements on the short plat.
7. Please proof read the short plat documents, most specifically under the
"Declaration ":
Recording
It is your responsibility to record the City approved short plat documents with the
King County Department of Records. The short plat is not complete until the
recording occurs and copies of the recorded documents are provided to the
Department of Community Development.
After recording, the County returns the recorded originals to the City within four to
six weeks at which time your short plat is considered complete and you can obtain
individual building permits for each lot. You can shorten this process by hand
delivering a copy of the recorded short plat to the Department.
Do not fold or bend the final short plat map that will be recorded with King
County.
Expiration
The final short plat must be filed with the King County Department of Records by
June 16, 2007, exactly 12 months from the date of this preliminary approval or the
application will expire. Please keep this date in mind in the coming months. The
City is in no way obligated to remind you of this expiration date.
The City may grant one extension of not more than twelve months. The request
for an extension must be made in writing and must be submitted to the City prior
to the expiration of the short plat.

If the short plat approval expires, subsequent development permits that are related
to the short plat shall also expire and any vesting will be lost.

1. All three legs of the hammerhead turn- around are required to be a minimum 65 feet
in length from center as noted in red on sheet three.

1. As noted, the fire hammerhead does not meet Fire Department requirements. The
additional 35 feet required for both ends of the turnaround would have to an
easement in order to allow the lots to meet minimum lot width requirements.
2. Public works has noted that access for lots one and four must be from tract A. This
would likely require a reconfiguration of the homes on the lots. Please note that the
front setback will still be from 44 Avenue South. The plan needs to be revised to
show where parking will be provided for lots one and four. Parking is not permitted
along the access tract A.

On behalf of the Cultural Resources Committee, I have reviewed the information sent on
01/30/06 regarding the Palwinder Multani Short Plat and have the following comments. The
12044 44th Ave South property is an area the Tribe has flagged as high potential for
archaeological discovery. This project is near several known archaeological sites and a traditional
cultural property important to the Muckleshoot Indian Tribe. For this reason, we request a
thorough archaeological review and field survey prior to construction in the project area. This
Study should be conducted by a professional archaeologist. We also request the opportunity to
send a cultural monitor during the field survey, and a copy of the final report. Information
regarding previous surveys and recorded archaeological sites is available from the Office of
Archaeology and Historic Preservation, in Olympia.
The Cultural Resources Program does not represent the Wildlife Program and the
Fisheries Program which are separate departments under the Muckleshoot Indian Tribe. Please
contact these departments separately for their input on this project.
We appreciate the effort to coordinate with the Muckleshoot Tribe prior to site
preparation. The destructive nature of construction excavation can often destroy a site and cause
delays and unnecessary expense for the contractor. If you have any questions, please contact me

Due to the relatively flat topography for the new lots one of our main concerns would be the elevation
of the new houses going in and where the new owner /builder would ensure in the planning process,
there would be enough slope away form the house or crawl spaces (should there be crawl spaces),
where water shall adequately drain away from the new houses to an approved drainage system.
Elevations and method of drainage shall be shown on plan submittals.
There are no other concerns at this time.

For the Public Works Permit to Install Infrastructure
1. First choice to handle surface water from impervious surfaces is infiltration. Most
development in this area is on soils that will percolate. Provide dry wells for the roof
downspouts for each structure. Consider pervious pavement or other low impact
development management practices for the paved drives. Refer to the latest
Department of Ecology Manual for Western Washington, the latest King County
Surface Water Design Manual, and/ or the Public Works Development and Permits
website for help with low impact development management practices.
2. This project is in the Allentown Flood Prone Area so designated by PW Policy 2000-
1, approved by FEMA. Please visit the following website for information regarding
the flood design requirements for this site.

3. The plans show three accesses to this site. This will make five accesses on one side
of the street, three of which are 20' wide, in approximately 160' of frontage.
Considering the likelihood that neighboring properties, including across the street,
will develop, all four lots for this short plat shall use the existing access (Tract A).
4. Tract A will needs to be dedicated by a separate recording document. The document
must state who owns and maintains the Tract. It should also state how maintenance

1. The subject short plat is zoned Low Density Residential (LDR). The area included
in each proposed lot exceeds the minimum lot area of 6500 sq. ft. and is equal to
or greater than the required 50' minimum lot width.
2. Residences on the proposed site will be provided public water and sewer service
by the City of Tukwila. A storm drainage conveyance system will be constructed
to provide direct discharge to the Duwamish River. Water quality and erosion
control facilities will be installed at the time of any site disturbance.

PRIVATE DRIVEWAY EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned,
owner(s) in fee simple of real property described in the attached Exhibit A ( "Grantor" herein),
and owner(s) in fee simple of real property, described in the attached Exhibits B and C,
( "Grantee" herein).
WHEREAS Grantor intends to establish an easement across its land for driveway access,
underground utilities, and drainage facilities for the benefit of Grantee.
WHEREAS Grantor intends that all improvement costs and maintenance costs of the
driveway access, utilities, and drainage facilities within said easement will be borne solely by
Grantee, unless otherwise agreed in writing.
NOW THEREFORE, for and in consideration of the mutual covenants and agreements
hereinafter expressed and other good and valuable consideration, in hand paid, receipt of
which is hereby acknowledged, Grantor hereby defines, declares, grants and conveys to
Grantee, a non - exclusive, perpetual private driveway easement, over, under, across, along and
through the real property described in the attached Exhibit D.
The herein Private Driveway Easement is granted and accepted subject to the covenants,
reservations and conditions described as follows:
1. This easement is for the sole purpose of ingress, egress, utilities, and drainage
facilities, together with the right for Grantee to enter said private driveway easement
for the purpose of installation, operation and maintenance of a private driveway, public
or private utilities and storm drainage facilities.
2. All costs for construction, operation and maintenance of the driveway and other
improvements within said easement shall be borne by Grantee, their heirs, successors
or assigns, unless otherwise agreed in writing.

3. The amount and type of maintenance to be performed on the drainage facilities shall
be determined by majority vote of the lot owners. Each lot shall have one vote
regardless of the number of owners owning any lot. For the purpose of maintaining the
drainage facility within said easement, each fee simple owner using the drainage
facility shall be assessed a proportional share of the actual cost of such maintenance.
Such assessment, together with interest thereon, and costs of collection as herein
provided, shall be a charge and become a continuing lien on the owner(s) land on
which assessment is made and shall be the personal obligation of said owner(s) at the
time the costs are incurred which form the basis of the assessment. If any assessment
is not paid within thirty (30) days after it is due, the assessment shall bear interest from
the due date at the rate of twelve percent (12 %) per annum and any of the said
owner(s) may bring an action at law against the person or persons obligated to pay the
assessment and interest, costs and reasonable attorneys fees of any such action shall be
added to the amount of such assessment and all such costs shall be included in any
judgment. The lien of the charges provided for in this instrument shall be subordinate
to the lien of any bonafide mortgage or deed of trust.
4. This Private Driveway Easement is subject to a utilities easement in favor of any
electric, telephone, television cable, gas, water, or sewer company, public or private, or
their permittees or assigns to install, construct, operate, maintain, alter, and repair their
respective utilities for servicing grantee properties, together with the right of ingress
and egress for said purposes.
The herein easement and covenants may be amended only upon the written agreement of the
Grantor and Grantee herein.
This easement shall run with the land and shall be binding on all parties having or acquiring
any right, title, or interest in the land described herein or any part thereof.

easement shall be borne by Grantee, their heirs, successors or assigns, unless otherwise
agreed in writing.
3. Said easement is subject to a utilities easement in favor of any electric, telephone,
television cable, gas, water, or sewer company, public or private, or their permittees or
assigns to install, construct, operate, maintain, alter, and repair their respective utilities
for servicing grantees property, together with the right of ingress and egress for said
purposes.
4. Routine maintenance and repair costs of the utilities constructed within said Utility
Easement shall be the sole responsibility of the owner of the lot(s) serviced by the
utility or in the case if the utilities that are jointly shared, the cost shall be equally
shared.
The herein easement and covenants may be amended only upon the written agreement of the
Grantor and Grantee herein.
This easement shall run with the land and shall be binding on all parties having or acquiring
any right, title, or interest in the land described herein or any part thereof.

Step 1: You and your wife need to have signatures notarized on the above items #1, 4, 5
and 6. You should sign both copies of the easements in case the city loses their original.
Step 2: Have 5 copies of the Mylar made at Digital Reprographics or a Post -net store.
Step 3: Submit the following to the City:
1. 1 Original Mylar plus 4 copies rolled together.
2. 2 copies of the Lot Closure Calculations.
3. 2 copies of the title report.
4. 1 original signed private Road Easement. J
5. 1 original signed Lot 4 Utility Easement.
6. 1 original signed Lot 2 & 3 Utility Easement. V
7. 1 copy of the Site Development Plans.
You should have one copy of items 1-6 left for your use.
The city should allow you to complete the final short plat recording process
before completing the site improvements by getting a performance bond to guarantee the
work will be completed. Due to the potential for clogging the porous pavement, I
recommend that the private road not be installed until after the house foundations are
completed and backfilled. If it is installed before, you would need to cover it with tarps to
keep the dirt from plugging up the drainage pores. The storm, sanitary sewer and other
utilities could be installed anytime.
You should talk to the city regarding the bond dollar amounts and forms they
want used.

AN ORDINANCE ESTABLISHING WATER CONNECTION FEES FOR AL.
LI3NTOWN AND RYAN HILL, SEWER CONNECTION PEES FOR ALLEN -
TOWN PHASE I; PROVIDING FOR SEVERABILITY; AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, a sewer plan identifying 7 residential and 2 commercial areas has been pre-
pared with a prioritized construction schedule, and
WHEREAS, water and sewer infrastructure construction will be initially paid for with
utility funds; and
WHEREAS, water and sewer lines meet Washington State Department of Health stan-
dards including mbtimum water pipe diameter of 8 inches; and
WHEREAS, any new water or any sewer connection will be assessed a connection
c charge that is determined by the infrastructure construction cost and total number of potential
connections, and

• WHEREAS, a SEWER connection charge will be paid at the time of connecting or before
r- f inal building permit approval for new facilities, and
WHEREAS, a WATER connection charge will be paid before final building permit ap-
proval, and
WHEREAS, total Allentown construction costs have been projected based on the con-
struction bid costs for 189 of the approximate 400 total connections, and
WHEREAS, Ryan Hill connection costs are based on the construction of new lines to
serve the existing 78 homes and 69 potential future connections, and
WHEREAS, early connections are desired to recover construction costs and accelerate
neighborhood revitalization so that a 10% reduction in connection charges will be offered
through January 31, 1998.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHING-
TON, HERGf)Y ORDAIN AS FOLLOWS:

Section 1. Allentown Phase I Sewer Connection Charges.
A. Allentown Phase I homes existing on September 1, 1996 will be required to con-
ned to the sewer and pay associated connection charges if any portion of any
building is situated within 250 feet of a sanitary sewer line or lateral and if:
1. septic or health problems are Identified by King County Health Department
that require repair of the septic tank system, or
2. the home changes ownership, or
3. remodeling occurs adding a bathroom or bedroom.
B. Homes north of S. 124th St. on 43rd Ave. S. and on 44th Ave. S. existing on March
1,1996 are exempt from connection charges as the sewer was constructed as part
of the Metro project at no charge to the City or the property owners.

C. Allentown sewer connection charges by year will be given a 10% reduction for
connecting before January 31,1998 to encourage early connections and the base

AN ORDINANCE ESTABLISHING WATER CONNECTION FEES FOR A4
LENTOWN AND RYAN HILL, SEWER CONNECTION PEES FOR ALLEN-
TOWN PHASE 4 PROVIDING. FOR SEVERABILTI'Y; AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, a sewer plan identifying 7 residential and 2 mmrnercial areas has been pre-
pared with a prioritized construction schedule, and
WHEREAS, water and sewer infrastructure construction will be initially paid for with
utility funds; and
WHEREAS, water and sewer lines meet Washington State Department of Health stan-
dards including Mhti rum water pipe diameter of 8 inches; and
WHEREAS, any new water orany sewercorunection will be assessed a connection
charge that is determined by the infrastructure construction cost and total number of potential
tl connections, and
WHEREAS, a SEWER connection charge will be paid at the time of connecting or before
final building pennit approval for new f tiliti s,, and
WHEREAS, a WATER connection charge will be paid before final building permit ap-
proval, and
WHEREAS, total Allentown construction costs have been projected based on the con-
struction bid costs for 189 of the approximate 400 total connections, and
WHEREAS, Ryan Hill connection costs are based on the construction of new lines to
serve the existing 78 homes and 69 potential future connections, and
WHEREAS, early connections are desired to recover construction costs and accelerate
neighborhood revitalization so that a 10% reduction in connection charges will be offered
through January 31, 1998.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHING -
TON, HEREBY ORDAIN AS FOLLOWS:
Section L Allentown Phase I Sewer Connection Charges,
A. Allentown Phase I homes existing on September 1,1996 will be required to con-
nect to the sewer and pay associated connection charges if any portion of any
building is situated within 250 feet of a sanitary sewer line or lateral and if:
1. septic or health problems are identified by King County Health Department
that requite repair of the septic tank system, or
2. the home changes ownership, or
3. remodeling occurs adding a bathroom or bedroom.
11. Homes north of S. 124th St. on 43rd Ave. S. and on 44th Ave. S. existing on March
1,1996 are exempt from connection charges as the sewer was constructed as part
of the Metro project at no charge to the City or the property owners.

SIDE SEWER EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned,
Palwinder Multani and Balwinder Kaur, owners ( "Grantor" herein) in fee simple of the land
described in the attached Exhibit A and commonly known as Lot 1 of Tukwila Short Plat
Number L06-004, and Palwinder Multani and Balwinder Kaur, owners ( "Grantee" herein) in
fee simple of the land described in the attached Exhibit B and commonly known as Lot 2 of
Tukwila Short Plat Number L06 -004.
For and in consideration of the mutual covenants and agreements hereinafter expressed and
other good and valuable consideration, in hand paid, receipt of which is hereby
acknowledged, the parties hereto agree as follows:
Grantor hereby defines, declares, grants and conveys to Grantee, their heirs, successors and
assigns, a non - exclusive perpetual Side Sewer Easement over, across, along, in, upon and
under that portion of said Grantors land described as follows:
The north 5.00 feet of the east 114.00 feet of the west 132.00 feet of Lot 23, Block 5, C.D.
Hillman's Meadow Gardens Addition to the City of Seattle, Division No. 1, according to the
plat thereof; recorded in Volume 12 of Plats, Page 64, in King County, Washington;
TOGETHER WITH the north 18.00 feet of the west 18.00 feet of said Lot 23.
1. This easement is for the sole purpose of the construction, use, and maintenance of a
sanitary side sewer pipeline, together with the right of ingress and egress for such purposes.
2. Maintenance costs of the side sewer constructed within said easement shall be the sole
responsibility of Grantee, except the maintenance costs of any portion of the side sewer that is
jointly used by both Grantor and Grantee will be shared equally by such parties.
3. During the initial construction and in the event of repair or maintenance, all affected
landscaping and other improvements shall be substantially returned to their condition existing
prior to any construction, repair or maintenance of said sanitary sewer facilities. If no
landscaping or improvements exist at the time of installation or repair, all disturbs soils shall
be seeded with native grasses to prevent erosion.
4. Any condition of said side sewer which may permit water or odors to escape therefrom to
the surface shall be immediately repaired.
5. Grantor also grants a temporary 10' wide easement along and adjoining said side sewer
easement for the initial construction of the side sewer line. Said temporary easement shall be
null and void after installation of the side sewer line.
6. At the time of construction of Grantee's side sewer stub within the herein easement,
Grantee shall also install a side sewer stub for use by Grantor at a mutual agreed location.
7. The herein easement and covenants may be amended only upon the written agreement of
the Grantor and Grantee herein and shall be binding on all parties having or acquiring any
right, title, or interest in the land described herein or any part thereo£

SIDE SEWER EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT is made and entered into by and between the undersigned,
Palwinder Multani and Balwinder Kaur, owners ("Grantor" herein) in fee simple of the land
described in the attached Exhibit A and commonly known as Lot 4 of Tukwila Short Plat
Number L06 -004, and Palwinder Multani and Balwinder Kaur, owners ( "Grantee" herein) in
fee simple of the land described in the attached Exhibit B and commonly known as Lot 3 of
Tukwila Short Plat Number L06 -004.
For and in consideration of the mutual covenants and agreements hereinafter expressed and
other good and valuable consideration, in hand paid, receipt of which is hereby
acknowledged, the parties hereto agree as follows:
Grantor hereby defines, declares, grants and conveys to Grantee, their heirs, successors and
assigns, a non - exclusive perpetual Side Sewer Easement over, across, along, in, upon and
under that portion of said Grantors land described as follows:
The south 5.00 feet of the east 114.00 feet of the west .132.00 feet of Lot 25, Block 5, C.D.
Hillman's Meadow Gardens Addition to the City of Seattle, Division No.1, according to the
plat thereof, recorded in Volume 12 of Plats, Page 64, in King County, Washington;
TOGETHER WITH the south 18.00 feet of the west 18.00 feet of said Lot 25.
1. This easement is for the sole purpose of the construction, use, and maintenance of a
sanitary side sewer pipeline, together with the right of ingress and egress for such purposes.
2. Maintenance costs of the side sewer constructed within said easement shall be the sole
responsibility of Grantee, except the maintenance costs of any portion of the side sewer that is
jointly used by both Grantor and Grantee will be shared equally by such parties.
3. During the initial construction and in the event of repair or maintenance, all affected
landscaping and other improvements shall be substantially returned to their condition existing
prior to any construction, repair or maintenance of said sanitary sewer facilities. If no
landscaping or improvements exist at the time of installation or repair, all disturbs soils shall
be seeded with native grasses to prevent erosion.
4. Any condition of said side sewer which may permit water or odors to escape therefrom to
the surface shall be immediately repaired.
5. Grantor also grants a temporary 10' wide easement along and adjoining said side sewer
easement for the initial construction of the side sewer line. Said temporary easement shall be
null and void after installation of the side sewer line.
6. At the time of construction of Grantee's side sewer stub within the herein easement,
Grantee shall also install a side sewer stub for use by Grantor at a mutual agreed location.
7. The herein easement and covenants may be amended only upon the written agreement of
the Grantor and Grantee herein and shall be binding on all parties having or acquiring any
right, title, or interest in the land described herein or any part thereof.

reservations and conditions described as follows:
1. This easement is for the sole purpose of the construction, use, and maintenance of
utilities, together with the right of ingress and egress for such purposes.
2. All costs for construction, operation and maintenance of the utilities within said
easement shall be borne by Grantee, their heirs, successors or assigns, unless otherwise
agreed in writing.
3. Said easement is subject to a utilities easement in favor of any electric, telephone,
television cable, gas, water, or sewer company, public or private, or their permittees or
assigns to install, construct, operate, maintain, alter, and repair their respective utilities
for servicing grantees property, together with the right of ingress and egress for said
purposes.
4. Routine maintenance and repair costs of the utilities constructed within said Utility
Easement shall be the sole responsibility of the owner of the lot(s) serviced by the
utility or in the case if the utilities that are jointly shared, the cost shall be equally
shared.

PRIVATE ROAD EASEMENT AGREEMENT, continued
The herein Private Road Easement is granted and accepted subject to the covenants,
reservations and conditions described as follows:
1. This easement is for the sole purpose of ingress, egress, utilities, and drainage
facilities, together with the right for Grantee to enter said private road easement for the
purpose of installation, operation and maintenance of a private road, public or private
utilities and storm drainage facilities.
2. All costs for construction, operation and maintenance of the road and other
improvements within said easement shall be borne by Grantee, their heirs, successors
or assigns, unless otherwise agreed in writing.
3. The amount and type of maintenance to be performed on the road, utilities and
drainage facilities shall be determined by majority vote of the lot owners. Each lot
shall have one vote regardless of the number of owners owning any lot. For the
purpose of maintaining the facilities within said easement, each fee simple owner
using the facilities shall be assessed a proportional share of the actual cost of such
maintenance. Such assessment, together with interest thereon, and costs of collection
as herein provided, shall be a charge and become a continuing lien on the owners)
land on which assessment is made and shall be the personal obligation of said
owners) at the time the costs are incurred which form the basis of the assessment. If
any assessment is not paid within thirty (30) days after it is due, the assessment shall
bear interest from the due date at the rate of twelve percent (12 %) per annum and any
of the said owner(s) may bring an action at law against the person or persons obligated
to pay the assessment and interest, costs and reasonable attorneys fees of any such
action shall be added to the amount of such assessment and all such costs shall be
included in any judgment. The lien of the charges provided for in this instrument shall
be subordinate to the lien of any bonafide mortgage or deed of trust.
4. This Private Road Easement is subject to a utilities easement in favor of any electric,
telephone, television cable, gas, water, or sewer company, public or private, or their
permittees or assigns to install, construct, operate, maintain, alter, and repair their
respective utilities for servicing grantee properties, together with the right of ingress
and egress for said purposes.
5. The private road is paved with a porous asphalt surface that must be maintained to
prevent clogging by keeping the surface free of leaves, dirt and other debris at all times
and also by blowing or pressure washing the surface at lease two times a year. Surface
sweeping is not recommended because it may clog the surface.
The herein easement and covenants may be amended only upon the written agreement of the
Grantor and Grantee herein.
This easement shall run with the land and shall be binding on all parties having or acquiring
any right, title, or interest in the land described herein or any part thereof.
