Mullet, Mayor Steve Lancaster, Director SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application to construct an 8 feet by 20 feet drive -up espresso building does comply with applicable City and state code requirements and has approved that application based on the findings and conclusions contained in the staff report and subject to the following conditions: 1. A separate sign permit is required to install any sign and the proposed sign shall meet all sign code requirements and shall be consistent with the architecture of the building. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Board of Architectural Review of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Board of Architectural Review decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by June 30, 2006. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. • • 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Board of Architectural Review based on the testimony and documentary evidence presented at the open record hearing. The Board of Architectural Review's decision on the appeal is the City's final decision. Any party wishing to challenge the Board of Architectural Review's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Minnie Dhaliwal, who may be contacted at 206 -431- 3685 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. COMPREHENSIVE PLAN/ ZONING DESIGNATION: Regional Commercial (RC) STAFF: Minnie Dhaliwal VICINITY /SITE INFORMATION Project Description The project is to construct a drive -up espresso building. The proposed building is 8 feet by 20 feet. Surrounding Land Uses FINDINGS Steven M. Mullet, Mayor The project site is located along Military Road. The subject site has two residential structures on site. There is no new development in the vicinity of the project site and the general nature of the development around the site is commercial mixed in with residential. The properties west of Military Road have mostly residential uses and are within City of Seatac. The area east of Military Road is in City of Tukwila and is zoned Regional Commercial (RC). 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206 - 431 -3670 • Fax: 206 - 431 -3665 DESIGN REVIEW CRITERIA • • This project is subject to Administrative Design Review under Tukwila Municipal Code (TMC) Section 18.24.070. Per TMC 18.60.050 (D), the design criteria and guidelines of the Tukwila International Boulevard Design Manual shall be used for Design Review. 1. Site Design: There are two residential structures on the property. The proposed espresso stand is proposed to be located in front of one of the residential structure. The applicant had originally proposed to locate the espresso building closer to the paved portion of Military Road. The west property line of the subject site is approximately 45 feet from the paved edge of the road. The applicant was asked to get the property surveyed to avoid locating the new building within public right -of -way and to meet the minimum 20 feet setback requirement of RC zone. The revised location of the proposed building meets the minimum setback of 20 feet from the property line. The building code requires a minimum setback of 6 feet from the existing residential structure. The proposed 8 feet by 20 feet structure is proposed to be 7 feet from the residential structure. There is room for at least five cars to queue before backing into the public street. A. Site Design Concept The project is to add an espresso stand building to an existing developed site. The proposed location of the espresso stand building meets the 20 feet front setback and provides adequate room for cars to queue. B. Relationship to Street Front The proposed building is an addition to an already developed site and the proposed building is located to meet 20 feet minimum front setback. C. Street Corners. The site is not a corner site with streets on two sides. D. Continuity of Site with Adjacent Sites The proposed location of the espresso stand building will maintain a visually continuous building line from the existing building on the property immediately to the south of the subject site. E. Shared Facilities The proposal is to add an 8 feet by 20 feet building on an existing developed site. The area around the subject site is already developed. Although there is a large potential for redevelopment of the area, there are no opportunities for joint development of sites that would apply to current proposal. F. Site Design for Safety The proposed location of the building does not reduce the site surveillance from the public right of way. 2 G. Siting and Screening of Service Areas N/A H. Natural Features and Sensitive Areas N/A I. Surface Stormwater Detention Facilities N/A J. Pedestrian Circulation There are no sidewalks along Military Road. The current proposal to add an 8'x20' building on an already developed site. The building is proposed to be located on existing paved area. K. Pedestrian Amenities The proposal is to build a drive -up espresso stand building on an already developed site. There is no opportunity to add any site furnishings since there is only 20 feet from the front property line that will function as drive aisle and fire access road. L. Vehicular Circulation The project is for a drive -up espresso stand building and there are two existing access driveways from Military Road. No changes are proposed to the existing vehicular circulation. M. Parking There are 10 parking spaces between the two existing residential structures on the site. 2. Building Design: The proposed building is 8 feet by 20 feet with a drive -up service window on the west side. The proposed building is 20' 6" high and meets the height and setback regulations of the RC zone. The building has a pitched roof and is consistent with the residential structures on the subject site. The building materials proposed are horizontal siding on the walls and asphalt shingles on the roof. The exterior paint colors are proposed to be light grey with white trim. The sign is proposed to be yellow /green. A &B Architectural Concept and Architectural Relationships The site has two existing residences. The proposed building is consistent with the architectural design since it has pitched roof and has similar residential scale. C. Building Elements, Details and Materials The design and scale of building elements and details is related to he building's overall form and massing. The pitched roof, horizontal siding and asphalt shingles as roofing material are appropriate to the character of the proposed building and the existing development on the site. 3 D. Pedestrian Oriented Features The proposed building is only 8'x20' and has opening on all facades. E. Mechanical Equipment N/A 3. Landscaping Design: No additional landscaping is proposed. There is an existing grassy lawn area which is part of the public right -of -way. Per TMC 18.70.090, at the time of design review application, a landscape plan which conforms to the requirements of this title shall be submitted for approval along with the design review application. DCD Director in the case of an administrative design review may modify the standards when in their judgment strict compliance with the landscaping standards would create substantial practical difficulties, the existing and proposed additional landscaping and screening materials together will adequately screen or buffer possible use incompatibilities, soften the barren appearance of parking or storage areas, and/or adequately enhance the premises appropriate to the use district and location of the site. The site layout presents difficulties to add additional landscaping areas. The proposed building is located 20 feet from the front property line to meet the minimum setback requirements of the RC zone. There is existing paving within the front 20 feet and it is minimum width for a drive aisle required by the Fire Department. There is an existing grassy lawn area which is helps break up the large paved area but it is located in the public right -of -way, which is owned by City of Seatac and therefore we are unable to allow any additional plantings within the public right -of -way. It is possible to add some plantings in containers near the proposed building. A & B Landscaping Design and Planting Design Due to site constraints, it is not possible to add landscaping on the site. However adding some plantings in containers with evergreen plant materials will provide some relief and greenery to the paved area. 4. Signs A separate sign permit is required for the installation of any signs. A maximum of two signs are allowed for this business. The proposed sign shall meet all sign code requirements and shall be consistent with the architecture of the building. A. Signage Concept: The elevations submitted for Design Review show one sign on the north facade. The detailed sign dimensions will be submitted with the sign permit application. B. Sign Placement: The proposed business is allowed two signs. The sign details will be reviewed as part of the sign permit application. C. Sign Design: The proposed sign shall be consistent with the architecture of the proposed building. 4 w • RECOMMENDATIONS Staff recommends approval of the Design Review application with the following conditions: 1. Applicant shall provide plantings in containers with evergreen plant materials around the proposed espresso stand building. 2.
