Mullet, Mayor Notice is Hereby given that Cingular has submitted for a Variance and Conditional Use Permit application to construct and operate a wireless communication facility on an existing City of Seattle transmission tower. The tower is located directly west of the United States Postal Facility and just east of State Route 99. The nearest City street is S. 112 Street. King County Parcel 042304 -9130. The applicant has proposed to install the antennas higher than the maximum permitted height. Pursuant to WAC 197- 11 -800 this project is exempt from SEPA review. You are invited to comment on the project at a public hearing scheduled for 7:00 PM March 23, 2006 before the Planning Commission. The hearing will take place at City Hall in City Council Chambers, 6200 Southcenter Blvd. To confirm the time and date before the hearing, call the Department of Community Development at 206 -431 -3670. For this site, Cingular is proposing to replace the existing 6 antennas that currently exist at the site (on a Seattle City Light transmission line tower) with 9 antennas, along with changing out the supporting radio cabinets. Because of changes in OSHA regulations on the tower, the antennas will have to be moved to the top, which requires a 5 foot extension to the tower to meet the separation requirements between the antennas and the transmission lines. The review criteria for various types of projects are shown below. Please discuss development consistency with each criterion. Then, refer to the Tukwila Comprehensive Plan for project consistency with the policies. Please note that more than one category of policies may apply Criteria for Conditional Uses (TMC 18.64.030) 1. RESPONSE: Cingular Wireless Upgrade to Roxbury (WA 15 8) Proposal REVIEW CRITERIA With the acquisition of AT &T Wireless by Cingular, the FCC mandated that Cingular modify their equipment and antennas to accommodate customers of both Cingular and AT &T. The proposed modifications to this existing unmanned site will include remove existing six antennas (two per sector) and replace them with nine antennas (three per sector). In addition, the existing equipment will be change and modified. This is a commercial area zone MIC/H, and is compatible with other uses in the area. In the Utilities Section of the Tukwila Comprehensive Plan there is a Telecommunications Section. Goal 12.1 states: "Utility services and facilities that meet the community's current and fixture needs in a safe, reliable, efficient, economic and environmentally responsible manner. " Cingular is meeting the General Policies as stated in 12.1.35 by improving an existing site, and not building a new one: Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. This minimizes visual impacts on adjoining parcels. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district in will occupy. RESPONSE: Cellular Stations and towers are permitted in a Commercial Zone with a Conditional Use Permit - Title 18.30.040. The existing unmanned telecommunications site was previously approved by the City of Tukwila through the Conditional Use Permit process. The proposed replacement of antennas still meets the same standards used in the previous approval. The distance from the property line will remain the same. 3. The proposed development shall be compatible generally with the surrounding land uses. RESPONSE: As stated above, this is an existing unmanned telecommunications site. It has been determined with the previously approved CUP approval to be a compatible use. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan.
