FINDINGS
The applicant is requesting to install three panel and two dish antennas to be used for
wireless internet service on an existing Seattle City Light transmission tower. The
antennas will provide a service similar to Wi -Max. The antennas will extend five feet
from the top of the existing 120 foot transmission tower. The associated cabinet
equipment will be placed within an existing fence enclosure that was previously approved
by the Planning Commission for another wireless provider. Three BTS units will be
located at the 57, 60, and 63 foot levels of the tower. Cables will be attached to one of the
legs of the transmission towers. The cables will connect the cabinet equipment to the to
the BTS units and antennas (both panel and dish).
The applicant submitted for the Conditional Use Permit application on February 17, 2006.
The application was subsequently deemed complete on March 13, 2006. The Notice of
Application was distributed on April 7, 2006. The Notice of Application was posted on
the site and mailed to surrounding tenants and property owners. The City received no
comments regarding the proposed facility.
Pursuant to Washington Administrative Code (WAC) 197 -11 -800 (25) the proposed
project is exempt from SEPA review.
The location of the proposed antennas and BTS units is on an existing Seattle City Light
transmission tower. The tower is approximately 120 feet in height and includes six high

voltage electrical lines. Antennas for Qwest Wireless have been installed at an height of
50 feet on the tower. The City approved these antennas in 1998 (L98- 0011). The cabinet
equipment for Qwest is located directly under the transmission tower.
Surrounding Land Uses
All surrounding properties are zoned Low Density Residential. The transmission tower is
surrounded by single family homes and 51 Avenue South which at this location is a two
lane County street (Beacon Ave South does actually border the site, however, at this
location Beacon Ave South is unimproved and all direct access is from 51 Avenue
South).
Other uses located in the general area include a mini - market and a City Light substation.
CONDITIONAL USE CRITERIA
The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning
Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff
report as Attachment D. Staff makes the following findings under the city's Conditional Use
Permit criteria (TMC 18.64.050):
(1) The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity of the proposed use or in the
district in which the subject property is situated.
The applicant has chosen to locate the wireless antennas (three panel and two dish) and
BTS units on an existing tower. In order to provide the required clearance between the
high voltage lines and the proposed antennas the transmission tower will be extended five
feet. An existing cabinet enclosure will be used by Clearwire for their necessary
equipment. The site will have access via a small gravel driveway that connects to 51
Avenue South. A warning light for aircraft will be placed on the top of the antennas.
This warning light is required for Federal Aviation Administration (FAA) requirements.
(2) The proposed use shall meet or exceed the performance standards that are required
in the district it will occupy.
The Development Standards for uses in the LDR zoned include a maximum height of 30
feet and the following setbacks:

The existing transmission tower meets the setbacks of the zone. The City's height
standards do not apply to Seattle Light or Puget Sound Energy Transmission towers due
to the fact that the construction or alteration of such facilities does not trigger a building
permit (Definition of Development, TMC 18.06.210).
The proposed use does not trigger any additional landscaping on the property.
Telecommunication facilities generally generate only a small parking demand.
Technicians usually visit such facilities once a month. There is sufficient area off - street to
provide parking for any workers visiting the site.
(3) The proposed development shall be compatible generally with the surrounding land
uses in terms of traffic and pedestrian circulation, building and site design.
As with similar uses, the proposed facility will generate trips during the construction
period and, following the completion of construction, up to one trip per month for
maintenance. No other impacts to pedestrian or transportation movements are
anticipated.
The applicant has chosen to attach to an existing transmission tower, instead of
constructing a new monopole.
(4) The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan
This project must comply with the following Comprehensive Plan policies and meet
necessary Zoning Code regulations.
12.1.36. Encourage utilities to consolidate facilities and minimize visual
impacts of facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure and use
of existing structures. The applicant is proposing antennas that will be located on an
existing electrical transmission tower. Upon completion the tower will provide
infrastructure for one power utility (City Light), one wireless communication provider
(Qwest) and one wireless internet provider (Clearwire).

5) All measures have been taken to minimize the possible adverse impacts, which the
proposed use may have on the area in which it is located.
The applicant has applied for a location on an existing tower instead of constructing a
new freestanding pole and the associated cabinet equipment has been located within an
existing equipment enclosure that the Planning Commission approved in 1998.
CONCLUSIONS
1. The proposal to install antennas (both panel and dish) and BTS units on a City Light
transmission tower will not be materially detrimental to the public welfare or injurious to
property or improvements in the vicinity.
By locating the operating equipment within the existing enclosure, potentially hazardous
operating equipment has been made inaccessible to the public.
The proposed location of the cables allows them to blend with the existing tower.
2. The proposed project meets the applicable performance standards that are required in the
LDR zone.
3. The proposed project is compatible with the surrounding land uses in terms of traffic and
pedestrian circulation, building and site design.
The traffic generated from the facility will be minimal and will not have an impact on
surrounding properties.
4. No significant noise will be generated from the new antennas, BTS units, cables or
ground equipment associated with this application.
5. The wireless interne facility has been designed in a way to minimize any visual impact
from the project. This has been accomplished by locating the facility on an existing
electrical transmission tower and by using an equipment enclosure that the Planning
Commission previously approved in 1998.
6. The proposed project is in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan. Most specifically Comprehensive Plan Goal 12.1.36 which
encourages utility providers to co- locate and share facilities.

Staff recommends approval of the Conditional Use Permit as presented with one condition.
1. All equipment attached to the City Light transmission tower shall be painted to match the
tower.

Clearwire proposes to place 3 panel antennas and 2 microwave dishes on an existing electrical
transmission tower that will not be detrimental to the public welfare and do not cause an increase
in the area.
2. The proposed use shall meet or exceed the same standards for parking, landscaping,
yards and other development regulations that are required in the district it will occupy.
The equipment is proposed inside an existing utility area and would not require a dedicated
parking spot or landscaping.
3. The proposed development shall be compatible generally with the surrounding land
uses.
The existing electrical transmission tower is one of many towers that comprise the Seattle City
Light transmission lines and will not impact the surrounding land uses.
4. The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan.
The 3 panel antennas and 2 microwave dishes are proposed on an existing electrical transmission
tower, the addition of antennas to an existing facility is in keeping with the policies of the
Comprehensive Land Use Policy Plan.
5. All measures shall be taken to minimize the possible adverse impacts which the
proposed use may have on the area in which it is located.
Attachment H
Clearwire proposes to attach its antennas (3 panel/2 microwave) to an existing tower and is not
requesting a new use in the area.

At the April 25, 2006 public hearing, the Planning Commission approved the applicant's
Conditional Use Permit (CUP) application. The Planning Commission approved the applicant's
Conditional Use Permit to install three panel antennas, two dish antennas, three BTS units and

APPEALS

The period for administrative appeals is 14 -days, starting from the issuance of this Notice of
Decision. The administrative body hearing the appeal is the City Council. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials shall
contain:

land use approval from the City pursuant to TMC 18.58.040 (J). The proposed work is also exempt from having
to obtain a building permit. For future reference the original permit number for the site is L06 -017.

Hello Brandon,
The project meets all applicable sections of the Tukwila Zoning Code regarding Wireless Communication
Facilities. By replacing antennas on a transmission tower used my multiple wireless carriers, Clearwire is
collocating and meets the highest priority for type of sites per TZC 18.58.050.C.

Attached is the site plan and elevation plan for the project we discussed on the phone. Clearwire is replacing
existing antennas located on a Seattle City Light transmission tower on parcel #6874201170. This is located in
the LDR zone. The number of antennas will not be increased, the height of the antennas will not be increased,
and no new ground equipment cabinets are proposed.
No new ground equipment will be added therefore no new noise will be created by this project. No new signs
are proposed. No changes to parking are proposed. No new lighting is proposed. No advertising will occur at
the site. No changes are proposed to the equipment enclosure. The project meets all applicable section of TZC
18.58.070 General Requirements.

Section 18.58.080 specifically addresses this type of site - co- location on transmission tower. The replacement
antennas will match the existing unpainted tower and existing unpainted antennas. Additional feed lines will be
attached to tower legs. No changes will be made to the ground cabinets or enclosure.
I could not find the original Tukwila approval number in Clearwire's records.

regarding this request for a Minor Modification approval to replace antennas.

Notice is Hereby given that Clearwire has submitted for a Conditional Use Permit
application to install three panel antennas and two dish antennas on an existing City
Light transmission tower. The tower is located on King County parcel, 687420 -1170
and is adjacent to 10821 Beacon Ave South. The purpose of the antennas is to provide
wireless internet service. Pursuant to WAC 197 -11 -800 this project is exempt from
SEPA review.
You are invited to comment on the project at a public hearing scheduled for 7:00 PM April
27, 2006 before the Planning Commission. The hearing will take place at City Hall in City
Council Chambers, 6200 Southcenter Blvd. To confirm the time and date before the
hearing, call the Department of Community Development at 206 -431 -3670. For further
information on this proposal, contact Brandon J. Miles at 206 - 431 -3684 or visit our offices

written comments on the application or desiring to receive notification of the final decision on the application may do so
within 30 days of the notice of application. If a hearing will be held on the application, the hearing notice must include the
information that written comments may be submitted, or oral presentation made at the hearing.

The Department of Community Development received your Conditional use application on February 17,
2006 for the installation of a wireless internet facility within City Light right of way adjacent to 10821
Beacon Ave S.
Based on a review of your application for submittal requirements for Conditional Use Permit, your
application is deemed complete as of March 13, 2006. A notice of land use application will be
distributed on March 23, 006. The next step is for you to install the notice board on the site by
December 15, 2005. You received information on how to install the sign with your application packet.
If you need another set of those instructions, you may obtain them at the Department of Community
Development (DCD). Also, you must obtain a laminated copy of the Notice of Application to post on
the board. This notice is also available at DCD. After installing the sign with the laminated notice, you
need to return the signed Affidavit of Posting to our office.
This determination of complete application does not preclude the ability of the City to require that you
submit additional plans or information, if such information is necessary to ensure the project meets the
substantive requirements of the City or to complete the review process.
Planning staff has conducted an initial review of the application and as I noted on the phone the existing
tower is considering non - conforming with regards to height. The current proposal to extend the height of
the tower is not permitted under the City's non - conforming regulations. The City's non - conforming
regulations do permit the antennas to be attached to the existing tower, provided the height is not
increased.

weeks you will receive a formal comment letter regarding the CUP application.

SHORELINE MAILINGS:
Notice of Application for a Substantial Development Permit must be mailed to owners and to property owners within 500
feet of subject property, comments are due 30 days after the notice of application is mailed/posted. The notice of
Application for Shoreline Substantial Development Permit must include a statement that any person desiring to submit
written comments on the application or desiring to receive notification of the final decision on the application may do so
within 30 days of the notice of application. If a hearing will be held on the application, the hearing notice must include the
information that written comments may be submitted, or oral presentation made at the hearing.
Shoreline Permit Notice of Decision:

I don't believe SCL can sign Tukwila's affidavit of ownership as SCL
doesn't have knowledge of details of the application and the City of
Seattle doesn't hold entities harmless for "sole" negligence. I'm
attaching SCL's permit authorization, modified for this site. I can

a signed copy or mail the hard copy. Please call or e -mail any

necessary to complete that purpose, and holds Tukwila harmless for any loss or damage to persons

The undersigned, being the authorized representative of the City of Seattle City Ligbt Department
(City Light), the owner transmission tower #DU 2/7 S and of the portion of City of Seattle
Duwarnish Transmission Line Right of Way, at approximately 10801 Beacon Ave. S., Tukwila,
Washington (Property), on which Cicarwire, LLC ( Clearwire) is proposing to construct a radio
telecommunications facility (RTF) for broadband radio service, hereby authorizes Clearwire or its
authorized agent(s), CLS Group, to prepare and file all necessary applications for permits required
by the City of Tukwila for the proposed facility.
City Light has reviewed the Clearwire proposal for use of tower #DU 2/7 S for an RTF site, found
it to be a potential candidate for this use and advised Clearwire that it may proceed to design the
project and provide a structural analysis of the tower for further City Light review. The design
and analysis must comply with City Light's construction standards, policies and procedures,
guidelines and all applicable codes, including the National Electric Safety Code (NESC). City
Light grants this authorization to apply for permits under the condition that City Light incurs no
obligation to approve Clearwire's proposal to install this telecommunications facility at the
subject site.
City Light hereby authorizes the employees of Clearwire, CLS Group and/or affiliates of each
(herein individually and collectively referred to as Clearwire), to enter upon the Property during
normal business hours, as necessary, to inspect the Property for the purpose of preparing permit
applications, subject to the following conditions:
1. Cleat-wire agrees to protect and save harmless the City of Seattle (City) from all claims,
actions or damages of every kind and description, including any demand, claim, suit or
judgment for damages to property or injury to or death of persons, including officers, agents
and employees of Clearwire to include payment made under or in connection with any
Worker's Compensation Law or any plan for employees' disability and death benefits, which
may accrue . &orn or be suffered by reason of Clearwire's presence on the Property, or the
performance of any work in connection with its presence or its permit application(s); and in
