PROJECT INFORMATION Project File Number: L06 -044 CRITICAL AREA Sensitive Area Special Permission Applicant: Sabey Corporation Project Description: The Sabey Corporation, owners of the International Corporate Campus East (ICCE) business park have applied for special permission Director approval pursuant to TMC 18.45.070 B 9 a (2) to perform stream dredging, repair or replacement of existing gabion walls and enlargement of a sediment pond for a segment of Riverton Creek. This will maintain the stability of the side slopes and reduce flooding. Water will be temporarily by- passed through the work area and the work will be completed by means of a suction dredge. The dredge will not leave the adjacent paved area to conduct the work. The sediment pond will allow settlement of heavier sediments above an existing barrier to fish. Stream restoration is proposed as mitigation for the effects of this work. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that the project, as proposed, does not create a probable significant environmental impact and issued a Determination of Non - Significance (DNS) Decision on Substantive Permit: The Community Development Director has determined that the application for a Director Special Permission complies with applicable City and state code requirements and has approved that application, based on the findings and conclusions contained in the staff report. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Planning Commission of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of this Decision, that is by September 20, 2006. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Planning Commission decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Nora Gierloff, who may be contacted at 206 - 431 -3670 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. PERMITTED USES SUBJECT TOADMINISTRATIVE REVIEW — The following uses may be permitted only after administrative review and approval by the Director: 9. Dredging, Digging or Filling a. Dredging, digging or filling within a sensitive area or its buffer may occur only with the permission of the Director and only for the following purposes: (2) Maintenance of an existing watercourse; b. Any dredging, digging or filling shall be performed in a manner that will minimize sedimentation in the water. Every effort will be made to perform such work at the time of year when the impact can be lessened. The site is a 600 foot length of Riverton Creek that will be dredged to reduce the risk of flooding. A segmented temporary bypass system will be used to allow stream flows to pass through the work areas. This is to consist of a method of blocking the stream with sand bag headwalls penetrated by a 12" temporary culvert. In stream work will be completed by means of a suction dredge. The dredge will not leave the adjacent paved area to conduct the work. Temporary drainage by -pass and erosion control devices such as silt fences, temporary holding/siltation ponds and straw bales will be installed and monitored according the TESCP. The work will progress in a sequential manner from one end of the work zone to the other. The plan will have to meet the criteria and standards in Tukwila's Sensitive Areas Overlay District as well as the timing conditions of the HPA and JARPA permits. c. Upon completion of construction, the area affected must be restored to an appropriate grade, replanted according to a plan approved by the Director, and provided with care until newly planted vegetation is established. The method of dredging will minimize disturbance to existing vegetation. The stream restoration plan by Altmann Oliver Associates identifies the mitigation/restoration areas along with the planting plan and specifications. Areas disturbed due to removal of invasive species or expansion of the settlement pond will be replanted with native species. The site will be monitored twice a year for five years to ensure survival of restoration plantings and less than 20% cover by invasive or exotic plant species. CONCLUSIONS The proposed dredging of Riverton Creek, reconstruction of adjacent gabion walls and enlargement of the sedimentation pond is properly classified as maintenance of an existing watercourse. The methods proposed will minimize the risk of sediments entering the creek water. All areas of disturbance will be revegetated and monitored for plant survival for a period of five years. RECOMMENDATION Staff recommends approval of the request to dredge a portion of Riverton Creek and enlarge the sedimentation area. I believe the current of Riverton Creek is too strong and the slope too high to warrant use of herbaceous plantings at the sed pond, which is why we incorporated woody cuttings at 1' oc into the plan for bank stabilization. Currently, vegetation along the edge of the sed pond is reed canarygrass. What are you thoughts? . This detail should be changed to require that all of the burlap be removed and the root ball be inspected to ensure roots are healthy. Roots should be pruned as necessary to ensure there are no circling roots. 2. Container planting detail. This detail should be modified. Instead of stating that the rootball should not be disturbed, it should state that root balls shall be examined and loosened throughout at least the outer 2 inches of root ball. This work is necessary to prevent potential flooding and to repair /replace existing gabion and block walls within the corridor that are failing (see stream plans prepared by David Evans and Associates, Inc. — Sheets 1- 7, dated May 15, 2006). 1.0 Project Description Riverton Creek is a tributary to the Green /Duwamish River and is considered a Type 2 Stream by the City of Tukwila. Minimal impacts to the existing vegetation are anticipated from most of the dredging activities and will be avoided wherever possible. Restoration will, however, be required east of the excavated sediment pond (see Restoration Area 5 on Sheet 51.1). In addition, enhancement plantings are also proposed just upstream from the existing enhancement area associated with Phase 2 (see Restoration Area A). This enhancement was recommended during a site visit on June 7, 2006 with Larry Fisher of the Washington Department of Fish and Wildlife. Nora Gierloff July 17, 2006 Page 2 • • Enhancement /restoration will consist of planting a variety of native tree and shrub species to: 1) increase the habitat value of the riparian corridor by increasing the plant species and structural diversity, 2) provide shade, and 3) provide a visual and physical screen to the stream channel. 2.0 Construction Management Prior to commencement of any work by contractors in the restoration area, the construction limits will be staked and any existing vegetation to be saved will be clearly marked. A pre - construction meeting will be held at the site to review and discuss all aspects of the project with the contractor. A wetland /stream consultant will supervise plan implementation during construction to ensure that specifications of the restoration plan are met. Any modifications to the design that may be necessary clue to unforeseen site conditions will be jointly approved by the City of Tukwila and the consultant prior to their implementation. 3.0 Monitoring Man The monitoring program will be conducted twice a year for a period of five years, with annual reports submitted to the City of Tukwila. 3.1 Goal, Objectives, and Performance Standards for Restoration Area The primary goal of the restoration plan is to increase the plant species and structural diversity. To meet this goal, the following objectives and performance standards have been incorporated into the design of the plan: Objective A: Increase the structural and plant species diversity within the restoration area. Performance Standard: Following every monitoring event for a period of at least five years, the restoration area will contain at least 10 native plant species. In addition, there will be 100% survival of all woody planted species throughout the restoration area at the end of the first year of planting. Following each monitoring event after the first year of planting, there will be at least an 85% survival rate of all planted tree and shrub species or equivalent replacement of a combination of planted and re- colonized native species. Objective B: Limit the amount of invasive and exotic species within the restoration area. Performance Standard: After construction and following every monitoring event for a period of at least five years, exotic and invasive plant species will be maintained at levels below 20% total cover in all planted areas. These species include, but are not limited to, Himalayan and evergreen blackberry, reed canarygrass, purple loosestrife, Scot's broom, morning glory, Japanese knotweed, English ivy, thistle, and creeping nightshade. Nora Gierloff July 17, 2006 Page 3 • • 3.2 Monitoring Methodology Due to the relatively small size of the restoration area, the entire site will be reviewed and no sampling plots will be created. Photo - points will be established from which photographs will be taken throughout the monitoring period. These photographs will document general appearance and progress in plant community establishment in the restoration area. Review of the photos over time will provide a visual representation of success of the plan. 4.0 Maintenance Plan Maintenance will be conducted on a routine, year round basis. Additional maintenance needs will be identified and addressed following each twice- yearly maintenance review. 4.1 Weed Control Routine removal and control of non - native and invasive plants (e.g., Scot's broom, reed canarygrass, Himalayan and evergreen blackberry, purple loosestrife, Japanese knotweed, English ivy, morning glory, birdsfoot- trefoil, thistle and creeping nightshade) shall be performed by manual means. No chemicals may be used within the Riverton Creek corridor. Undesirable and weedy exotic plant species shall be maintained at levels below 20% total cover at all times during the 5 -year monitoring period. Reed Canarygraee Areas with reed canarygrass patches 3' x 3' or smaller need to be hand - grubbed. Patches greater than 3'x 3' shall be weed- whacked and staked with cuttings. 5couler willow (5a /ix 5couler /ana) and black twin berry (Lonicera invo /ucrate) cuttings shall be used in the wetter areas and black cottonwood (Popu /u5 trichocarpa) cuttings shall be used in drier areas. During April 1 through November 30, one - gallon plants (minimum height of 18 ") shall be used in place of cuttings. Cuttings can be purchased or gathered from approved on -site mature sources. Cuttings shall be installed at 1' 0.C. spacing over the infested reed canarygrass areas and extending 2' in each direction, unless otherwise specified. Cuttings shall be 2 -year old wood, 4' length, 'h" diameter, with all side branches removed and installed to a minimum depth of 12 inches. Himalayan and Evergreen Blackberry Control Small patches (areas <3' x 3') need to be grubbed out, large areas ( >3' x 3') need to be cut down. When shoots (approx. 6" in height) appear, they should be grubbed out by hand to ensure complete removal of bulb. 4.2 General Maintenance Items Routine maintenance of planted trees shall be performed. Measures include resetting plants to proper grades and upright positions. Tall grasses shall be weeded at the base of plants to prevent engulfment. If weed - whacking is performed, great care shall be taken to prevent damage to desired native species either planted or re- colonized. 5.0 Contingency Plan All dead plants will be replaced with the same species or an approved substitute species that meets the goal of the restoration plan. Plant material shall meet the same specifications as originally - installed material. Replanting will not occur until after reason for failure has been identified (e.g., moisture regime, poor plant stock, disease, shade /sun conditions, wildlife damage, etc.). Replanting shall be completed under the direction of the wetland consultant, City of Tukwila, or the owner. 6.0 As -Built Plan Following completion of construction activities, an as -built plan for the restoration area will be provided to the City of Tukwila. Our hope is to secure a SEPA Threshold Determination no later than the end of July, as it is necessary to obtain a Hydraulic Project Approval from DFW by September 1, 2006. This is necessary to complete the work within the fish window set by DFW. The attached plans specify how the work is to be conducted and identifies areas to be replanted.
