The home with attached garage will be approximately 1,735 square feet. A small dispersion trench will be installed to the west of the house. Existing Development FINDINGS The property is currently vacant land. There are a large number of significant trees on the site. TMC 18.06.775 defines a significant tree as a tree (cottonwood excluded) which is four inches or more in diameter as measured 4.5 feet above ground. The project will require the removal of approximately 24 significant trees. Site Conditions The City's sensitive area maps indicate that the property contains class two slopes. The site map provided by the applicant conforms the presence of the steep slopes. The property slopes away from 55 Avenue with an average down slope of 25 percent. Surrounding Land Uses The surrounding area is zoned Low Density Residential. The property is bordered by single - family homes. SPECIAL PERMISSION CRITERIA TMC 18.54 requires the issuance of a Tree Clearing permit for the removal of any significant trees located on a class two slope. TMC 18.54.130 lists the criteria in which tree clearing permits will be evaluated: As noted the property currently slopes away from 55` Avenue. However, the area adjacent to the site is relatively flat and is appropriate to build. The construction of the house, driveway, and dispersal trench will require the removal of 24 significant trees. The applicant has proposed to retain a small number of trees located outside of the foundation area of the existing house. 2 Tree Protection Measure Tree Replacement Surrounding Environment Not Applicable Tree Relocation CONCLUSION • • City code requires that the applicant also retain the understory which surrounds the trees to be retained on the site. Should the need arise to remove the understory, the applicant must use methods that are non - damaging to the tree and replace the removed understory with compatible species to the protected tree. TMC 18.54.130 (2) requires that tree protection measures be in place around trees that will be retained on the site. The purpose of these tree protection measures is to protect the trees and their root systems from damage by construction activities (i.e. land altering). The applicant will be removing 22 trees that are between four to eight inches in diameter and four trees that are between 8 -12 inches in diameter. TMC 18.54.130 (3) (b) provides the replacement ratio that must be followed for the trees removed on the site. As noted, 22 trees will be removed and the applicant will provide 26 replacement trees on the property. The replacement trees on the site are required to be 2.5- inches in caliper for deciduous trees and six to eight feet tall for evergreen trees. A majority of the replacement trees will be located along the edge of the property near the property lines. The trees location will help to minimize the impacts associated with those trees that were removed from the site. The trees will provide a visual screen from adjacent properties and provide other amenities such as shade to the newly constructed house. The applicant's tree clearing permits meets the code requirements of TMC 18.54. The applicant's construction activities require the removal of a large number of significant trees. The house has been situated in a location that meets City setbacks while at the same time limiting the construction activities on the slope. The replacement trees that will be planted on the site meet the City's replacement ratio outlined in TMC 18.54.130 (3) (b). The Tree Clearing Permit is approved subject to the following conditions: 1) The replaced trees must be planted during the fall to increase the trees chances of survival. 2) Prior to removal of any trees on the site the applicant will tag those trees that are to be retained. 3 Trees that are to be retained must have tree protection fences installed along the drip line of the tree. 3) Prior to the removal of any trees the contractor removing the trees must provide a certificate of insurance against claims and damages involving personal injuries and property in the following amounts: APPEALS A. Bodily injury liability: $1 million per occurrence B. Property damage liability: $1 million per occurrence Additionally, all insurance policies obtained in accordance with these provision shall name the City of Tukwila as an "additional insured" and shall be written by a company licensed to do business in the State of Washington. This decision may be appealed to the Planning Commission within 14 days from the issuance of this Notice of Decision. All appeal material must be submitted to the Department of Community Development. The tree clearing and replacement plan is acceptable, subject to the following conditions: 1. Trees to be retained must be surrounded by fencing located at the drip line to protect them from damage during clearing, grading and construction. Fencing must be installed before any land altering activity is started. 2. The resubmitted plan contains a table like that found in TMC 18.54.130 indicating the number of significant trees of each diameter to be removed and the number of trees to be replaced in accordance with the ratios indicated in the ordinance. 3. The resubmitted plan contains more trees being equally distributed around the upper portion of the site. This is done so that it will help not disturb the native vegetation that already exists on the lower half of the site. It is also done so that the new trees can be clustered in with the existing trees to help support each other and promote a diverse urban habitat. 4. The plan has been resubmitted with measures to be used for protecting the trees being retained in a note. This note states that all existing significant trees (4" cal. and up) are to be marked with tape and noted to all contractors before working on the site begins. Any tree damaged will be replaced at the contractors own expense at the ratio of 2 to one or with the table found in TMC 18.54.130 witch ever is greater. Sincerely, 1. The City has the following comments: 1. The clause that allows the use of tree canopy over approach (TMC 18.53.140) applies when the cost of identification and measurement of sizes of individual trees is inordinate relative to the project. Since the applicant has surveyed and measured the diameter of the individual significant trees on the property the tree species should be indicated on the plan. 2. Using the standard method of calculating tree replacing, planting on six trees does not meet code. A tree replacement table should be shown on the plant, like that in TMC 18.54.130, that indicates the number of significant trees of each diameter to be removed and the number of trees to be replaced in accordance with the rations indicated in the ordinance. 3. Replacement trees are only shown along 55 Avenue South. The applicant should consider tree replacement on the slope behind the house as well. Planting of native species on this slope is recommended, as one of the purposed of the Tree Regulations is to promote retention of native vegetation in sensitive areas. 4. The plan should indicate measures to be used for protecting the trees being retained. The landscaping plan needs to be updated to address the above comments.
