DECISION July 11, 2005 SEPA Determination: The City SEPA Responsible Official has previously: X determined that this application does not require a SEPA threshold determination because it is categorically exempt. 0 determined that the project, as proposed, does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. Decision on Substantive Permit: The Community Development Director has determined that the application for a Special Permission — Director for a sensitive area buffer reduction does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in the staff report. The condition of approval is listed below: The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Planning Commission of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by 5:00 p.m. Monday, July 25, 2005. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Planning Commission decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Carol Lumb, who may be contacted at 206 -431 -3661 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. One of the trails in the garden lies within the 100 foot buffer of a Type 1 wetland and within the 50 foot buffer of a Type 3 wetland. Construction of the trail will involve removal of numerous significant trees, land clearing and planting of non - native vegetation as part of the plan for the winter garden development. As a result of this work in the buffers the Parks Department has requested a reduction in both buffers to 50 and 25 feet respectively. MITIGATION PLAN CL I Cizy of Tukwila • Steven M. Mullet, Mayor Department of Community Development Steve Lancaster, Director TMC 18.45.080 G. provides guidance on the reduction of standard wetland buffer widths. A buffer reduction may be allowed if: 1. Additional protection to wetlands will be provided through the implementation of a buffer enhancement plan; and 2. The existing condition of the buffer is degraded. The City's Urban Environmentalist has made several site visits to evaluate the condition of the wetland and buffer area in the vicinity of the garden trail. The wetland buffers understory vegetation consists mostly of invasive, non - native plants such as Himalayan blackberry, Japanese Knotweed and Herb Robert. These plants inhibit the function of the wetland as a healthy environment for wildlife and crowd out native plant species . The project has since been revised to exclude any removal of trees in the wetland buffer and to reduce the scale of work in the wetland buffer. As a result, the original conditions of approval for the land use applications are revised as follows below. The fence should be installed well outside of the drip line of the tree (allow 1 foot of protective radius for every inch of trunk diameter). 3. Trees slated for removal that are in close proximity to trees being retained should be cut to the ground level and not pushed over with equipment. 4. One thing that is always important to include in wetland and buffer enhancement projects is so- called "large woody debris (LWD)" - trunks and limbs of trees, which is good for wildlife. It occurred to me that some of the trunks and limbs from the trees that will be cut down at the site could be used in the enhancement. They are not the ideal type of wood, but it would be economical as it would save on some of the cost of chipping /hauling them away and we wouldn't need to get them somewhere else. We would need a place to store them until we were ready to install them in the buffer because the invasive species would have to be cleared out first. I wasn't sure when you were planning to take down the trees, but I thought I would bring up this possibility now so you can think about it. Also, if the Parks Dept has other types of LWD stored somewhere, we could maybe use it instead of or as well as the material from the site. Let me know what you think! As soon as the tree cutting permit is approved, then I can move on to the building permit. We still need the Special Permission - Director application to be submitted. This is the vehicle for requesting the buffer reduction. I understand Sandra will prepare the mitigation plan for you and this plan can come later as it isn't the right time of year to be implementing the planting plan. I am not able to route the resubmittal until Carol has finished her review and has made a favorable decision for the Tree Permit. Carol has indicated to me that by the first part of next week she should be finished with her review of the tree permit. Once I receive her decision and there will not be any changes required to the building permit plans, I will route the submittal I received today to building and public works. I also showed him the survey that was submitted with the building permit for the entry trellis for the Winter Garden. I understand now where the wetland boundaries are - it would have been helpful to have the survey submitted as part of the Tree Cutting permit, but I'll make a copy for the Tree Cutting permit file. Now that I understand where the wetland boundaries are, what will need to be submitted to complete the Tree Cutting permit application is the request for a buffer reduction, which is the Special Permission Director application and an enhancement plan for the reduced buffer area. This is different from the planting plan that has been submitted for the Winter Garden. An enhancement plan is prepared by someone who has expertise in wetlands and who can make recommendations on the appropriate actions to take to improve the remaining buffer area, both through removing of invasive plant material like blackberries as well as plantings to improve the habitat value of the remaining buffer. I will put the Special Permission Director application in Inter - office mail to you so you'll have it next week when you return. In order to complete the application, please provide the following: 1. Please revise the Existing Tree Plan to identify the wetland edge and clarify the buffer location. A wetland buffer area of 100 feet has been identified, but there is also what appears to be a wetland marker with a distance of 25 feet identified to the clearing limit. If you are working within the 100 foot buffer area, a Special Permission Director Application to request a buffer reduction must be completed. Please be aware that the maximum reduction that can be permitted is 50 %, if a mitigation plan is provided. It is not clear whether any work is taking place within the first 50 feet of the wetland edge. The application should include a short description of the proposed Winter Garden and any wetland enhancements proposed for the buffer area etc. 2. Is there a wetland study that has been prepared for the site? If so, please provide 2 copies for the file. Upon receipt of these items, the City will re- review them and determine within 14 days whether the application is complete. The applications will expire if we do not receive the additional information within ninety days of the date of this letter unless an extension is granted pursuant to Section 18.105.070(E). She shared with me a memo that she prepared back in June on some questions that came up at a meeting with Parks on the Winter Garden. I noticed that she had suggested that SEPA be prepared at this stage even though the first phase of the park would likely not trigger SEPA because later phases would require SEPA. So I need to correct what I told you last week (or the week before ?) when we talked. SEPA is required now. If you need any guidance on filling out the SEPA forms please let me know and I'll help as much as I can. I also volunteered to take on this project as she is way overloaded and this relates so much to the work I'm doing on the SAO. So, any future questions, meetings etc. please send my way. I don't know that we have an interest in getting KC to correct their error when the property owners want to keep things the way they are recorded now. 1. Paul Surek - stopped by to ask about SEPA for the Macadam Wetland project and then followed up with a call to Jack. I told him that unless he triggered one of the items listed on the cover sheet for the SEPA checklist the Macadam Wetland project wouldn't have to do SEPA. He didn't think they were moving more than 500 cu. yds. of dirt around, which seemed like the only criteria that would apply to this project since they are not doing parking. Is this a project you want me to track? You have a pretty full plate right now, so I'd be happy to take this one on. 2. I had a phone call from Jerry Buccola, the realtor for the Zeiger property in Tukwila that had the lot consolidation that we approved in 1999 (L99 -0035) but King County somehow failed to record (they recorded the BLA portions of the application). He wanted to know if we got the letter from the property owner and what might be happening as far as a decision. I'm hoping I gave you that letter when it came in, as I don't find it here in my office (no surprise there). MEMORANDUM TO: Bruce Fletcher, Parks Director FROM: Nora Gierloff, Planning Supervisor RE: Development of the Winter Garden at Macadam Wetland DATE: June 24, 2004 After our meeting yesterday I wanted to follow up and outline the Community Development approval process that would be required to develop both the Winter Garden and the larger park. Public Works will be sending you a separate memo with their requirements. This information is based on the June 2003 landscape concept drawings by Johnson Braund. I have roughly sketched in the paths proposed as part of the Winter Garden onto the attached orthophoto with the approximate wetland boundary and buffer outlines, see attached. Sensitive Area Ordinance We will be adopting a new SAO this fall, however at this point it does not look like the proposed changes would have any significant impact on your project. Public use and access provided through trails and boardwalks is a permitted use in both wetlands and their buffers. The alterations within the wetland and buffer that you have proposed (clearing lawn areas, installing granite trails and a boardwalk) will require a Type 2 Special Permission approval from the DCD Director. This will require a mitigation plan prepared by a qualified professional as defined in the SAO. It is likely that much of the removal of invasive plants and replacement with native species would count toward the mitigation requirements. You may proceed with hand clearing of the blackberries within the buffer prior to the Type 2 approval. Please provide us with a site plan showing the areas to be cleared relative to the wetlands and buffers. Tree Permit You are proposing to remove selected trees from the wetland buffer. This will require a tree permit, another Type 2 approval. To apply you must locate the trees in your area of work by species and diameter breast height. Trees identified by an arborist as hazardous may be removed at any time without replacement. Healthy trees over 4" in diameter within the buffer must be replaced according to the ratio in the Tree Ordinance. SEPA As we discussed yesterday the scope of work for the Winter Garden may not trigger an environmental checklist if the land altering is less than 500 cubic yards. However the C:\DOCUME -1 \Carol -L \LOCALS 1 \Temp \WINTER -1. DOC C: \DOCUME— I \Carol - L\LOCALS —I \Temp \WINTER 1.DOC plan for the larger park will definitely trigger SEPA due to the work within the wetland. It is our preference to have the checklist filled out up front with all potential work identified, even if you plan to phase it over several years. A determination, once issued, does not expire and can be treated as a master plan for the park. Parking Determination The number of spaces required for the park will be set by the Planning Commission at a public hearing. Again, you may want to address the ultimate plan for the park so that you don't have to revisit this decision for each phase. If you are ready to move forward quickly there is still space on the July and August agendas. Building Permit When I described the entry trellis structures to a building inspector he thought that they would likely trigger a building permit. If you provided the Building Department with a more detailed sketch they could give you a definitive answer.
