One of these borings will be in the area shown on the attached photo within 200 feet of the ordinary high water mark of the Green River. We concur that the work you have proposed would qualify for an exemption under RCW 90.58.030 (3) (e) (xi): (xi) Site exploration and investigation activities that are prerequisite to preparation of an application for development authorization under this chapter, if: (A) The activity does not interfere with the normal public use of the surface waters; (B) The activity will have no significant adverse impact on the environment including, but not limited to, fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values; (C) The activity does not involve the installation of a structure, and upon completion of the activity the vegetation and land configuration of the site are restored to conditions existing before the activity; (D) A private entity seeking development authorization under this section first posts a performance bond or provides other evidence of financial responsibility to the local jurisdiction to ensure that the site is restored to preexisting conditions; and (E) The activity is not subject to the permit requirements of RCW (Oil or natural gas exploration in marine waters); NG Q:' L ETTE RS1405ShoreExempt.DOC Paue 1 of 2 05104/2005 10:36 AM Steven M. Additional geotechnical information in the form of geotechnical test borings is required to complete the geotechnical baseline condition and design documents. The data collected will be used to assess the load - bearing stability of the material where new structures would be located. One of the proposed borings (SRX -5c) is located in the Green River Trail Park within 200 feet of the Ordinary High Water Mark of the Green River on a parcel owned by the City of Tukwila (see attached boring location map). 1-405 staff have researched the property in question and determined that the property does not have a parcel number; however, a legal description and an aerial photo of the property are attached to this letter. WSDOT requests an exemption from a Shorelines Substantial Development Permit (SSDP) from the City of Tukwila to perform this geotechnical boring. WSDOT believes it qualifies for this permit exemption based on RCW 90.58.030(3)(e)(xi), which details the following activity is not considered a "Substantial Development": Site exploration and investigation activities that are prerequisite to preparation of an application for development authorization under this chapter, if: A. The activity does not interfere with the normal public use of the surface waters; B. The activity will have no significant adverse impact on the environment including, but not limited to, fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values; C. The boring will have no significant adverse impacts on the environment as sediment control Best Management Practices (BMPs) will be installed as appropriate prior to the boring occurring and will be removed afterward, all drilling slurry and cuttings will be stored in lockable drums and disposed of off -site, and the drilling crew will have at least one emergency spill response kit on site at all times. No structure will be installed as part of this project and the vegetation and land configuration of the site will be restored to the condition that existed before the boring. Based on these criteria, WSDOT believes this geotechnical boring meets the requirements for exemption from a SSDP. Please accept this letter as an official request from WSDOT for an exemption from a Shorelines Substantial Development Permit for this geotechnical boring. We look forward to your reply.
