At the August 25, 2005, 2005 public hearing, the Planning Commission approved the applicant's Conditional Use Permit (CUP) application. The application is for the installation of 12- wireless communication antennas on an existing wireless monopole The Planning Commission approved the application with the following condition: 1. The applicant shall submit proof of final electrical inspection by Washington State Department of Labor and Industries. A building permit is not required for the scope of work for this facility. Typically, when a building permit is issued, the City will not conduct a final building inspection until the State Electrical Inspector has a signed off on the project. Staff Report to the Planning Commission L05 -045 NEXTEL at 44 Ave S Page 3 of 6 Vicinity /Site Information Project Description The applicant is requesting approval of a Conditional Use Permit (CUP) to install 12 antennas on an existing 120 -foot tall wireless communication monopole at 13134 44` Avenue South. Existing Development There is an existing 120 -foot tall wireless communication monopole on the site. There is also a 432 square foot equipment building on the site. The existing facility was originally approved in 1991 (91 -3 -CUP). The Planning Commission approved additional antennas at the location in 2000 (L2000 -050). Surrounding Land Uses Q: \CUP \NEXTEL 44TH AVE \staff report.doc The surrounding properties are zoned Commercial Light Industrial (C/LI). Land uses in the immediate vicinity are predominately light industrial and warehouses. There are some residences in the vicinity, primarily to the south and west. State Route 599 interchanges are on the south and east side of the subject property. BACKGROUND FINDINGS The existing monopole was approved with conditions by the Planning Commission on September 30, 1991. The existing site is zoned C/LI and the maximum permitted height in that zoning district is 45 -feet. The existing monopole is 120 feet high and the new antennas are proposed to be attached at 57 feet and 30 feet. Based on the fact that the existing monopole does not meet current maximum height requirements of the C/LI zoning district and the fact that it was legally permitted under 91 -03 -CUP, it is considered a nonconforming structure. The current proposal does not increase the degree of nonconformity of the existing monopole and does not trigger any thresholds listed under TMC 18.70.050 for bringing it into compliance with current code. The site is also located within the buffer of a type II stream. CONDITIONAL USE CRITERIA • • The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment E. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated The applicant has proposed to co- locate 12 antennas on an existing monopole that has various antenna arrays. The proposed 12 antennas will be located in two elevations on the pole. The new antennas will the lowest in height compared to the antennas on the pole. The applicant will place the associated ground equipment in the existing equipment enclosure compound. The area of the equipment compound will be unchanged. The applicant has provided documentation that the proposed facility will be within FCC standards for maximum exposure to radio frequency energy (See Attachment (D)). (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the C/LI zoned include a maximum height of 45 feet and the following setbacks: Front: 25 feet Second Front: 12.5 feet Side: Five Feet As noted, the applicant will utilize the existing equipment area, which meets setbacks. The two antenna arrays will be placed at approximately 57 feet and 30 feet. As noted, the existing monopole does not meet the City's height requirements. However, the structure is vested non - conforming and the proposed work is permitted under TMC 18.70. As noted, the existing facility is located within the buffer of a type II stream. Since the , Staff Report to the Planning Commission L05 -045 NEXTEL at 44t Ave S Page 5 of 6 • • applicant will be locating the new equipment within the existing enclosure, staff does not see any additional impacts from the new facility. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. There are no new buildings proposed for this project, instead the applicant is installing antennas on an existing monopole and will place the ground equipment in an existing equipment enclosure. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing monopole. The applicant will also utilize the existing equipment enclosure for the placement of their ground equipment. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located The applicant has applied for a location on an existing monopole instead of constructing a new freestanding pole. All ground equipment will be placed in an existing facility. The applicant is not proposing to utilize a generator, which means the site will not have any impact on noise. CONCLUSIONS 1. The proposal to install an antenna on an existing mono -pole will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. By locating the operating equipment within an existing fenced equipment enclosure, potentially hazardous operating equipment has been made inaccessible to the public. 2. The proposed project meets the performance standards that are required in C /LI zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 4. No noise will be generated the new antennas or ground equipment associated with this application. 5. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit as presented with one condition: 1. The applicant shall submit proof of final electrical inspection by Washington State Department of Labor and Industries. A building permit is not required for the scope of work for this facility. PLANNING COMMISSION PUBLIC HEARING CASE NUMBER: L05 -043: Housing Options Program APPLICANT: City of Tukwila REQUEST: A City wide demonstration program that would allow up to 9 projects of cottage, compact and/or attached homes in residential neighborhoods, subject to design review and relevant review processes and approvals. Projects could range in size from 8 to 36 homes. LOCATION: City Wide Moira Bradshaw gave a slide show presentation. There were illustrations of various housing projects around the region and the country, which showed some of the potential concepts of the proposed project. The proposed project is a result of some Tukwila Comprehensive Plan Policies, which addresses and encourages a variety of housing stock. Currently all of the housing built in the City is single family homes that are averaging about 2900 sq. ft. in floor area. The Comprehensive Plan suggested a demonstration program for cottage housing, which is something that the community has an interest in seeing developed in the City. There is also an interest in a greater variety of housing. Currently, in the medium and higher density properties, the minimum lot sizes would prevent the development of fee simple attached housing. The housing options program allows for both cottage housing, as well as, attached housing in an ownership format to be developed on a demonstration basics. There will be a limited number of projects allowed, and spread amongst the community. The project criterias are: Limited to projects that range between 8 to 36 homes. Only one project will be allowed in the neighborhood. Neighborhoods are defined in the program. There will be a separation standard. There is no time limitation for completion of the program. As soon as the housing projects are built, the project is over. House will be limited to 18 feet in height. Planning Commission Minutes July 28, 2005 Page 2 of 3 • • After the projects are developed the results of the projects will be analyzed and discussed at a community and legislative level. It would be determined whether any changes to the Zoning Code would occur. If so, the projects would be allowed to precede with variances from the code without making changes to the code, subject to design review. In order for a project to be considered it must go through a selection process. The criteria in the selection process will look at the overall goals of the program, which are established at the beginning of the program. Also, the compatibility of developing a different type of housing will be evaluated. There would be a public meeting and property owners and citizens within 500 sq. ft of the project can provide comments or discuss their concerns. The comments and the concerns of the neighborhood would need to be reflected and discussed in the application that will go to the DCD Director when the selection process occurs. If the project is approved it will increase density, which will allow more housing to be developed on a parcel. A question and answer session transpired between the Commissioners and Moira. A question was raised whether the garage is included in the overall floor space. Moira will look into the issue and provide some clarification. Matt Martel with Homesight, an organization that develop homes, spoke in support of the project. He said if the project is approved, allowing smaller lot sizes will give Homesight the ability to build their homes in Tukwila. Homesight is interested in the Riverton Park parcel as a potential sight for developing. Homesight has developed 265 homes since their organization was formed in 1990. Mr. Martel explained Homesight is a community corporation, which means their job is to create communities and help out buyers. A question and answer session transpired. Nora Lu with Homesight explained that their organization is also a community bank. They provide second and third mortgages and down payment assistance. Their organization has helped over 500 first time homebuyers with down payment assistance. Ms. Lu addressed a question that was raised concerning turnover in the housing, saying that there has been 1 foreclosure and less than 10 people have sold their homes. Ms. Lu stated that the approval of the project would help to make their homes more affordable. Ms. Lu talked about the Riverton Park project calling it the perfect demonstration project, 25 to 30 homes would be developed on the parcel. Ms. Lu concluded by thanking the Commissioner for being willing to take a look at the proposed project. Chris Libby from DJL Architects in Seattle stated he was wholeheartedly in support of this project and the idea of adding density to the community. He called the program a great, painless and efficient way to add density to the community and create the neighborhoods that people want in the area. Mr. Libby spoke positively about Homesight. He offered some advice from an Architect's perspective, suggesting flexibility, and that the ordinance not be over legislated. He also suggested not creating impairments, and that the City works with the developers to use the flexibility in the code to develop a nice size and scale of development. Mr. Libby also answered questions. Mary Lane, a member of the Riverton Park United Methodist Church, spoke in favor of the project. Ms. Lane stated the church parcel would be perfect for the demonstration program, saying the project would be a great asset to the whole area. Although some of the members are concerned with giving up too much open space, most of the members think it would be a great service to have the project on their parcel. Thomas Foster, a property owner from the Ryan Hill neighborhood, also spoke in favor of the project. Mr. Foster spoke of the project as an opportunity to offer some flexibility that Tukwila has lacked in the past regarding residential zoning. He encouraged flexibility be given to developers to make as many decisions as they can, suggesting that increasing the maximum square footage would allow the developer more flexibility. Planning Commission Minutes July 28, 2005 Page 3 of 3 Nadine Morgan a member of the Homesight board echoed words of support for the project and stated she would like to see the project happen. There was no further comment. The Planning Commission deliberated. Commissioner Ekberg asked Ms. Bradshaw to explain what a type 2, 3, and 4 modification decision means. He also asked for some additional clarification on other information provided in the draft ordinance. Commissioner Meryhew supported Mr. Foster's suggestion of increasing the maximum square footage. The Commissioners voted on whether the maximum size of compact houses and duplex/triplex should be increased to 1,750 square feet or if they should be limited to the proposed 1,500 square feet. There was a split decision, three for and three against. Some Commissioners stated they were interested in keeping the 1,500 square feet to make the housing more affordable. Other Commissioners were of the opinion that increasing the square feet would provide more flexibility to the developer. The increase occurred by allowing one project in each of the following neighborhoods: Allentown, Duwamish, Foster Point and Foster, which were initially combined. This report addresses three sectors of 806 to 821 MHz wireless service at 0 azimuth (Sector A), 120 azimuth (Sector B), and 240 azimuth (Sector The proposed installation is co- located on an existing monopole. The zoning in the immediate area is Commercial /Light Industrial. The immediate terrain is relatively flat. There are commercial buildings to the north and south, scattered residences to the west, and relatively open space to the east incorporating road right -of -way. Measurements were made in the area immediately adjoining the site and around the residences. The equipment used was a Narda Model 8716 Electromagnetic Monitor and with a Model 8722B Isotropic Probe. No perceptible levels were observed. The attached spreadsheet shows the calculated signal levels for both the signal in the main beam and the on- ground power density levels for the new antennas. Calculations are made using the methods outlined in OET 65 and take into account the worst -case levels due to ground reflections. The height above ground level for the center of radiation is reduced by 6 ft. to account for head height. The ERP used is the maximum allowed for two base stations per sector. From the attached composite spreadsheet, the maximum street -level exposure would occur at about 186 ft from the monopole with a total value of 6.854550 uW /cm which is 1.276% of the FCC standard for uncontrolled areas. The proposed facility includes a 3 sector antenna array with a total of 12 antennas. Sectors 1 and 3 are proposed at an elevation of 30' while sector 2 is proposed at 57'. Associated radio equipment within an outdoor cabinet is proposed within the existing communication compound. Please see the accompanying drawings for details. Nextel is currently undergoing a re- banding effort in cooperation with the FCC from their current frequency band (800 megahertz) to a much higher frequency (approximately 1900 megahertz). The main objective of the proposed facility is to fulfill a coverage gap that will exit between existing sites. RF signals within high frequency bandwidths do not travel as far as they do within a lower frequency. Thus re- banding will result in the need for a number of "in -fill" sites to both provide coverage and offer capacity to nearby high - traffic sites. A much more detailed explanation regarding the issues surrounding Nextel's re- banding efforts can be found at http://www.911dispatch.com/information/nextel/nextel_plan.html The proposed facility will provide both coverage and capacity of wireless voice and data service. Indoor and in- vehicle coverage will be provided to surrounding office and business customers, and nearby arterials as well. The facility is also needed to "hand -off' and receive signal from surrounding sites as a caller travels through the area. Nextel Communications operates under an FCC license and guidelines, and complies with all federal, state, and local regulations including the FAA. The project is exempt from SEPA environmental review under WAC 197- 11- 800(27)(a)(ii). Criteria for Conditional Uses (TMC 18.64.030): 1. By utilizing the existing monopole & screened equipment area, the facility will blend with the surrounding environment ensuring compatibility. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Comprehensive Plan Policy 12.1.36: encourages utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. RECEIVED ►JUL' 1 2005 COMMUNITY DEMI:ME T July 11, 2005 City of Tukwila Department of Community Development 6200 Southcenter BV Tukwila, WA 98188 Subject: Nextel Communications Wireless Telecommunication Facility Project Description Dear Reviewing Parties: • • Nextel Communications is proposing to collocate a wireless telecommunication facility onto an existing monopole located at 13134 44 within a C/LI zoning district. The proposed facility includes a 3 sector antenna array with a total of 12 antennas. Sectors 1 and 3 are proposed at an elevation of 30' while sector 2 is proposed at 57'. Associated radio equipment within an outdoor cabinet is proposed within the existing communication compound. Please see the accompanying drawings for details. Nextel is currently undergoing a re- banding effort in cooperation with the FCC from their current frequency band (800 megahertz) to a much higher frequency (approximately 1900 megahertz). The main objective of the proposed facility is to fulfill a coverage gap that will exit between existing sites. RF signals within high frequency bandwidths do not travel as far as they do within a lower frequency. Thus re- banding will result in the need for a number of "in -fill" sites to both provide coverage and offer capacity to nearby high - traffic sites. GPS 1 and CPS 2 Sweep Tests Caution: Sweep only the GPS 1 and GPS 2 antennas' coax lines. Do not connect the GPS antennas during the sweep tests or the antennas will be damaged. NOTE: The GPS 1 antenna coax line is marked with one band of yellow tape, and CPS 2 antenna coax line is marked with two bands of yellow tape. a. Set up the sweep generator to sweep from 1400 to 1600 MHz. Calibrate any test cables and connectors. Connect the sweep generator with test cable /connector into the GPS 1 coax line at the top of the EBTS Controller rack. b. Connect o coaxial short to the end of the GPS 1 Antenna coax line. Measure and plot the return loss in dB. c. Calculate the Insertion Loss by dividing the "average return loss" by two. The "average return loss" is calculated by averaging at least five of the lowest return loss values with at least five of the highest return loss values. The Insertion Loss should be less than or equal to 3.0 dB. Record the Insertion Loss value for GPS 1 antenna on the Antenna Specification Sheet. Also record the Cable Length of the GPS 1 antenna coax line on the Antenna Specification Sheet. d. Connect a coaxial 50 —ohm load to the end of the GPS 1 antenna coax line. Measure and plot the return loss in dB. Also plot the return loss VSWR. e. The highest return loss value from the plot is the Return Loss and the highest VSWR value from the plot is the VSWR. Record the Return Loss, VSWR and the associated Frequency on the Antenna Specification Sheet. The Return Loss value should be less than or equal to — 20.83 dB and the VSWR value should be less than or equal to 1:2:1. f. Repeat steps 1a through le for GPS 2 antenna. NOTE: If the Return Loss or VSWR values do not meet the — 20.83 dB or 1:2:1 respective requirements then there is a problem in the coax line, poly phasor or connectors. Troubleshoot and fix the source of the mismatch (defective connector /connection, defective poly phosor or defective /damaged coax line). If the Insertion Loss values do not meet the 3.0 dB requirement then there is a problem in the coax line, poly phasor or connectors. Troubleshoot and fix the source of the excessive loss. If the excessive loss is due to the coax line being too long, report this problem to Nextel Construction. 2. BMR Antenna Sweep Tests NOTE: The sweep test is run in two parts. The first part is a sweep test of the coax lines, connectors and lightning arrester (poly phasor) without the BMR antenna connected. This is called the "Coax Line" test. The second part is a sweep test with the BMR antenna connected. This test is called the "System" test. The BMR antenna coax line is marked with o white bond of tape. a. Set up the sweep generator to sweep from 800 to 900 MHz. Calibrate any test cables and connectors. Connect the sweep generator with the test cable /connector into the BMR coax line at the top of the EBTS Controller rack. b. Connect a coaxial short to the end of the BMR Antenna jumper coax line. The highest return loss value from the plot is the Return Loss and the highest VSWR value from the plot is the VSWR. Record the Return Loss, VSWR and the associated Frequency for the BMR "system" on the Antenna Specification Sheet. The Return Loss value should be less than or equal to — 13.98 dB and the VSWR value should be less than or equal to 1:5:1. NOTE: If the Return Loss or VSWR values do not meet the — 13.98 dB or 1:5:1 respective requirements then there is a problem in the BMR antenna or connectors. Troubleshoot and fix the source of the mismatch. 3. EBTS Antenna Sweep Tests NOTE: The sweep test is run in two parts. The first port is a sweep test of the coax lines, connectors and lightning arrester (poly phasor) without the EBTS antenna connected. This is called the "Coax Line" test. The second part is a sweep test with the EBTS antenna connected. This test is called the "System" test. The EBTS antennas' coax lines are marked with red, blue, green, and orange bands of tape; therefore EBTS R1 antenna coax line will have one red band of tape and EBTS R2 antenna coax line will have two red bands of tape and etc. a. Set up the sweep generator to sweep from 800 to 900 MHz. Calibrate any test cables and connectors. Connect the sweep generator with the test cable /connector into the EBTS R1 coax line at the top of the EBTS Primary RF Distribution rack. b. Connect a coaxial short to the end of the EBTS R1 Antenna jumper coax line. Measure and plot the return loss in dB. c. Calculate the Insertion Loss by dividing the " average return loss" by two. The "average return loss" is calculated by averaging at least five of the lowest return loss values with at least five of the highest return loss values. The Insertion Loss of the EBTS R1 coax line will depend on the length of the coax line and type of coax line, but should be less than or equal to 2.5 dB for o 100 foot coax line, 3.5 dB for a 200 foot coax line, and 4.5 dB for a 300 foot coax line. Record the Insertion Loss value for EBTS 121 "coax line' on the Antenna Specification Sheet. Also record the Cable Length of the EBTS RI "coax line" on the Antenna Specification Sheet. d. Connect a coaxial 50 —ohm load to the end of the EBTS R1 antenna jumper coax line. Measure and plot the return loss in dB. Also plot the return loss VSWR. e. The highest return loss value from the plot is the Return Loss and the highest VSWR value from the plot is the VSWR. Record the Return Loss, VSWR and the associated Frequency for EBTS R1 "coax line" on the Antenna Specification Sheet. The Return Loss value should be less than or equal to — 20.83 dB and the VSWR value should be less than or equal to 1:2:1.
