REQUEST: The original SEPA and Shoreline permits were issued for the installation of
10 -inch water main within 200 feet the Duwamish River and attaching the
water line to the 66 Ave Bridge. The revised proposal included installation
of 4" conduits for fiber optic cable within the existing trenches laid for the
water line. The fiber optic conduits are also proposed to be attached to the
66 Ave Bridge.
LOCATION: The project is located in the City of Tukwila along Southcenter Boulevard
and across the 66 Avenue Bridge and along the Green River to Tukwila Parkway.
This notice is to confirm the decision reached by Tukwila's SEPA Official to adopt an
addendum to the Determination of Non - significance (DNS) for the above project and
approving the revision to the Shoreline Substantial Development Permit.

Original Project Description: The project involved construction of a 10 -inch water main for
about 1900 linear feet in order to upgrade the City of Tukwila's
water system. The Water line was also proposed to cross the
Duwamish River by attaching it to the 66 Ave Bridge. The original
decision on the shoreline permit was made on February 14, 2006
with an expiration date of February 14, 2008.
Description of the Revision: In addition to the water line installation the scope of work is
expanded to include installation of 4" conduit for Time Warner's
fiber optic cable in the City's open cut trench laid out for the water
line. The conduit for fiber optic cable will also be attached to the
underside of the 66 Ave Bridge.

II. DECISION
SEPA Determination: The City's SEPA Responsible Official issued the original Determination of
Non - Significance (DNS) on December 14, 2005. A SEPA addendum for the revised scope of work
that included Time Warner's conduits was issued on August 10, 2007.
Decision on proposed revision to the permit: The revised scope of work is considered within the
"scope and intent of the original" Shoreline permit consistent with the criteria for listed under
WAC173 -27- 100(2). Following is the discussion how the proposed revision meets the criteria:
1) No additional over water construction is involved. The original proposal included
installation of water line within 200 feet of the Duwamish River and attaching the water line
to the 66 Ave Bridge. Time Warner is proposing to use the same trench used for the water
line to lay their 4" conduit within the shoreline area and then attaching their conduit to the
66 Ave Bridge.
2) There is no increase in the ground area coverage or height.
3) The revised permit does not authorize development to exceed height, lot coverage, setback,
or any other requirements of the applicable master program.
4) No changes are proposed to the landscaping.
5) The original proposal was to install water line and the revised proposal is to include conduits
for fiber optic cable in the same trench. The use authorized pursuant to the original permit
has not changed.
6) No adverse environmental impact will be caused by the project revision.

Decision on Substantive Permit: The City Community Development Director has determined that the
application for a Shoreline Substantial Development Permit does comply with applicable City and state code
requirements and has approved that application based on the findings and conclusions contained in the staff
report and subject to the following condition:
If any artifacts are encountered during any of the excavation activities, all work will be stopped and the
State Office of Archaeology and Historic Preservation and the concerned tribes cultural committees and the
City of Tukwila staff must be notified.

The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
III. YOUR APPEAL RIGHTS
One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person
appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the
Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings
Board for details.
The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW
90.58 and WAC 461.08.
Project materials including the application, any staff reports, and other studies related to the Shoreline
Substantial Development Permit are available for inspection at the Tukwila Department of Community
Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday

Property owners affected by this decision may request a change in valuation for their property tax purposes.

This permit may be rescinded pursuant to RCW 90.58.140(8) in the event the permittee fails to comply with the project as
approved and any conditions thereof.
CONSTRUCTION PURSUANT TO THIS PERMIT MAY NOT BEGIN AND IS NOT AUTHORIZED UNTIL TWENTY -ONE (21)
DAYS FROM THE DATE OF FILING WITH THE DEPARTMENT OF ECOLOGY (D.O.E.) AS DEFINED IN RCW 90.58.140(6)
AND WAC 173 -14 -090, OR UNTIL ALL REVIEW PROCEEDINGS INITIATED WITHIN TWENTY -ONE (21) DAYS FROM THE
DATE OF SUCH FILING HAVE TERMINATED; EXCEPT AS PROVIDED IN RCW 90.58.140(5)(a)(b)(c).
Pursuant to RCW 90.58.180 the decision by the City of Tukwila to issue this Shoreline Substantial Development Permit may only
be appealed to the Shoreline Hearing Board. Appeals must be filed with the Shorelines Hearing Board within 21 -days from the
filing of this permit with D.O.E. as defined in RCW 90.58.140. For more detail information on appeals, refer to RCW 90.58 and

The project is located in the City of Tukwila along Southcenter
Boulevard and across 66` Ave bridge and along Green River to
Tukwila Parkway. See attached map for the exact location.
The current zoning for the adjacent properties in the vicinity of the
project area is Tukwila Urban Center (TUC), Low Density
Residential (LDR) and Commercial /Light Industrial (C /L1).
The current Comprehensive Plan depicts the areas adjacent to the
project site as Tukwila Urban Center (TUC), Low Density
Residential (LDR) and Commercial /Light Industrial (C /LI).
The project involves construction of a new 1900 linear feet of a 10-inch water
main for the upgrades to the City of Tukwila's water system.
III. Policies of the Shoreline Management Act /Shoreline Master Program
The project is subject to Tukwila Shoreline Master Program.

IV. Shoreline Regulations
Shoreline Substantial Development Permit (18.44.80)
Any substantial development within 200 feet of any shoreline must receive a
shoreline substantial development permit prior to issuance of any local permits
by the City.
The construction of the proposed water main is within the paved portion of
Tukwila Parkway and then it follows under the paved trail along the Green River.
Further along it is attached to the bridge crossing the Green River and then it is
follows along the paved portion of the Southcenter Boulevard. The project area is
within 200 feet of the Green River.
General Shoreline Regulations (18.44.110)
1. The use is in conformance with the regulations of the underlying district
The project location is within City of Tukwila right of way. Adjacent
zoning designations include Tukwila Urban Center (TUC), Low Density
Residential (LDR) and Commercial /Light Industrial (C /LI). No specific
development regulations govern the installation of a water main. The
proposed water main would not cause any foreseeable conflicts with the
adjacent TUC, LDR and C /LI zoning and thus would conform to
applicable zoning regulations.
2. The use does not conflict with the goals and policies of the shoreline
master program or the provisions of the Shoreline Act and shoreline
regulations:
The proposed project to construct a 10" water main line includes working
within paved portions of the existing streets. A portion of the proposed
line is under the paved trail along Green River and then it is attached to the
bridge that crosses the Green River. The proposed project would cause no
impacts to the shoreline environment. The use is consistent with the goals
and policies of the shoreline master program and the provisions of the
Shoreline Act and shoreline regulations.
3. No structures or accessory facilities shall be located over the river unless
such structure protects or promotes the public interest.
The proposed water line is attached to an existing bridge over the Green
River. No structures will be constructed over the Green River. No impacts
are anticipated to the river as a result of this project.

4. There shall be no disruption of existing trees or vegetation within the
river environment unless necessary for public safety or flood control, or
if allowed as part of an approved shoreline substantial development
permit.
The water line will be installed in paved or landscaped areas only. After
the line is installed, the areas will be restored to the original condition.
S. No effluent shall be discharged into the Green River, which exceeds the
water quality classification as established by the State for the adjacent
portion of the river.
No discharge of effluent will occur due to proposal.
6. All States and federal water quality regulations shall be strictly complied
with.
Applicant is responsible for meeting all state and federal water quality
regulations.
7. Wildlife habitat in and along the river shall be protected
Wildlife should not be impacted by this project.
8. All perimeters of landfills and other land forms susceptible to erosion
shall be provided with vegetation, retaining walls, or other satisfactory
mechanism for erosion prevention.
Erosion and sedimentation controls will be used to ensure minimal
disturbance to the river. Much of the area adjacent to right -of -way is
developed. If any areas are disturbed, they shall be restored and re-
vegetated immediately.
9. All necessary permits shall be obtained from Federal, State, County or
municipal agencies.
The project was issued a SEPA Determination of Non - Significance (DNS)
by the City of Tukwila. Applicant is responsible for obtaining any
applicable Federal or State approvals.
10. Dredging for purposes other than for navigational improvements or
flood control is prohibited.

All work is proposed within existing right -of -way or existing easements.
14. Landfilling is prohibited within the river channel, unless such landfall is
determined by the Planning Commission to protect or promote the
public interest.

15. Notwithstanding any provisions of the Code to the contrary, removal of
any cottonwood tree within the river environment, or the low impact
environment, which tree is 12 inches or greater in diameter as
measured 4.5 feet above grade, shall be subject to the requirements of
TMC Chapter 18.54, Tree Regulations.
No removal of vegetation is proposed for this project.
Specific Shoreline Regulations
The project falls within river impact, low impact and high impact environments.
There are no anticipated impacts to the shoreline as the project is located within
the existing developed right -of -way and under the paved trail along the Green
River.
Specific use regulations -river impact environment (18.44.130)
This portion of the code requires that `utility easements where necessary shall be
landscaped with live ground cover or natural grass cover ". The project is to
construct a 10" sanitary sewer within the paved asphalt trail. No other
disturbances are anticipated as a result of this project.
Specific use regulations -low impact environment (18.44.140)
Utilities are permitted in the low - impact environment.
Specific use regulations -high impact environment (18.44.150)
All uses allowed in the underlying zoning district are allowed in the high impact
environment.

V. Comments

A letter was received from Muckleshoot Cultural Resources Program stating that
the area along South Grady Way to Southcenter Boulevard is an area that they
have flagged as high potential for archaeological discovery. The letter also
requested an archaeological field study by a professional archaeologist. The
project engineer, Mike Cusick talked to Laura Murphy, Tribal Archaeologist and
explained that the project includes working only in the area that has been
previously disturbed and that the water line will be attached to an existing bridge.
Further if any artifacts are encountered during any of the excavation activities, all
work will be stopped and the State Office of Archaeology and Historic
Preservation and concerned tribes cultural committees and staff will be notified.
A comment letter was also received from City of Seattle, Public Utilities
requesting a copy of the plans and informing that Seattle Public Utilities operates
60" concrete cylinder pipeline. The Project Engineer provided them with a copy of
the plans and will co- ordinate with them during construction.
V. SEPA and other approvals
The project was also subject to SEPA review and was issued a Determination of
Non - Significance by the City of Tukwila on December 14, 2005.
VI. Recommendations
Approval of the shoreline substantial development permit.
If any artifacts are encountered during any of the excavation activities, all work
will be stopped and the State Office of Archaeology and Historic Preservation and
the concerned tribes cultural committees and the City of Tukwila staff must be
notified.

Purpose: Notification of Receipt and Local Approval of Revised Substantial Development
Permit (SDP).
On August 14, 2007 the Department of Ecology received notice that City of Everett approved
your application for a revised SDP. Your permit is for installing of 4 inch conduit for fiber optic
cables within existing construction trenches within shoreline jurisdiction of the Green River.
(Chapter 90.58 RCW).
By law, local governments must review all SDPs for compliance with the following:
• The Shoreline Management Act (Chapter 90.58 RCW)
• Ecology's Substantial Development Permit approval criteria (Chapter 173 -27 -150 WAC)
• The City Of Tukwila Local Shoreline Master Program
Local governments, after reviewing the SDP for compliance, are required to submit the SDPs to
Ecology for filing.
Your approved application for a revised SDP has been received and subsequently filed with
Ecology.
Before you begin activities authorized by this permit, the law requires you to wait at least 21
days from the date we received the decision letter from City of Tukwila on August 14, 2007.
This waiting period allows anyone (including you) who disagrees with any aspect of this permit,

We have reviewed the materials forwarded to our office for the proposed project referenced above. The
water main installation as described appears to pass through or near site 45 -KI -6, and this plus the
location near the Duwamish River indicates the project area has the potential for archaeological resources.
Further, the scale of the proposed ground disturbing actions would destroy any archaeological resources
present. We recommend a professional archaeological survey of the project area, including subsurface
testing through trenches or boreholes, be conducted prior to implementing the project. We also
recommend consultation with the concerned Tribes' cultural committees and staff regarding cultural
resource issues.
If any federal funds or permits are involved Section 106 of the National Historic Preservation Act, as
amended, and its implementing regulations, 36CFR800, must be followed. This is a separate process
from SEPA and requires formal government -to- government consultation with the affected Tribes and this
agency.
These comments are based on the information available at the time of this review and on behalf of the
State Historic Preservation Officer. Should additional information become available, our assessment may

cylinder pipeline within Southcenter Boulevard to Andover Park East in the vicinity of this

On behalf of the Cultural Resources Committee, I have reviewed the information sent on
8/19/05 regarding the Southcenter Boulevard Water Main Replacement and have the following
comments. The along South Grady Way to Southcenter Boulevard property is an area the Tribe
has flagged as high potential for archaeological discovery. Information regarding previous
surveys and recorded archaeological sites is available from the Office of Archaeology and
Historic Preservation, in Olympia. If the project area has been previously surveyed, then the
following requests can be disregarded.
Due to the project's ground disturbing activities and the potential for archaeological
discovery, the Cultural Committee is requesting:
1. An archaeological field study of the project APE by a professional archaeologist.
2. The option of sending a tribal monitor during the field survey
3. To review the draft survey for completeness and accuracy
4. A copy of the final technical report for our files
The Cultural Resources Program does not represent the Wildlife Program and the
Fisheries Program which are separate departments under the Muckleshoot Indian Tribe. Please
contact these departments separately for their input on this project.
We appreciate the effort to coordinate with the Muckleshoot Tribe prior to site
preparation. The destructive nature of construction excavation can often destroy a site and cause
delays and unnecessary expense for the contractor. If you have any questions, please contact me

The City of Tukwila's Planning Department received your application for shoreline permit
approval on August 17, 2005. On August 26, 2005 it was deemed to be incomplete because
certain requirements of the application were not provided:

2. King County Assessor's map(s), which shows the location of each property within 500
feet of the proposed work.
3. Two sets of mailing labels for all property owners and tenants (residents and businesses)
within 500 feet of the subject property. Note: Each unit in multiple family buildings e.g
apartments, condos, trailer parks must be included.
4. Vicinity map with site location
5. A written discussion of the project consistency with decision criteria (See Application).
Check with a planner if you are unsure of what criteria to apply to your project.
6. If additional impervious surface is proposed provide a Technical Information Report
(TIR) including feasibility analysis per King County Surface Water Design Manual
(KCSWDM).
7. Provide sensitive area studies as needed per Tukwila's Sensitive Areas Ordinance (TMC
18.45). Provide a geotechnical analysis of river bank stability if alteration is proposed.
8. Landscaping planting plan by a Washington State licensed landscape architect. One set
of all plans and analyses shall have the original Washington State registered Landscape

Architect stamp and signature. Plans must include the type, quantity, spacing and
location of all plantings. Maximum size 24" by 36 ".
a. Show all existing trees to be retained and any tree protection measures required
(for example fencing at drip lines).
b. Location of all sensitive areas (e.g. streams, wetlands, slopes over 15 percent, coal
mine areas and important geological and archaeological sites). For stream
frontage provide existing and proposed top of stream bank, stream bank toe,
stream mean high water mark, and base flood elevation (i.e. 100 year flood plain).
Maximum size is 24 inches by 36 inches.
c. Location of all required sensitive area buffers, setback tracts and protection
measures.
d. Show all trees over four inch caliper, indicating those to be retained.
9. One set of all civil plans and analyses shall be stamped, signed and dated by a licensed
professional engineer. Include a graphic scale and north arrow. Maximum size is 24
inches by 36 inches.
a. Vertical datum NAVD 1988 and horizontal datum NAD 83/91. Conversion
calculations to NGVD 1929, if in a flood zone or flood -prone area.
b. Existing (dashed) and proposed (solid) topography at 2 inch intervals.
c. Construction limit lines, areas of clearing/grading /filling and volume and type of
expected cut and fill.
d. Existing and proposed utility easements and improvements, on site in street
(water, sewer, power, natural gas, telephone, cable). Schematic designs to be
provided regardless of purveyor. No capacity calculations, invert depth, valve
locations, or the like are needed.
e. If additional impervious surface is proposed provide a storm drainage design at
least 90 percent complete, which meets TIR and KCSWDM. Include all storm
drainage maintenance access and safety features. Call out total existing and
proposed impervious surface in square feet.
f. Show the 100 year flood plain boundary and elevation as shown on FEMA maps.
g. Footprints of all existing and proposed buildings.
h. Fences, rockeries, and retaining walls.
10. Shoreline site map showing the following
a. Existing and top of bank, landward catch point toe of levee, riverbank toe, mean
high water mark and base flood elevation.
b. For work riverward of the mean high water mark show the distance the work
extends into the river and distance to Federal projects and navigation channels.
c. If the project is within the Tukwila shoreline master program show the limitis of
the 40 foot river, 100 foot low impacts and 200 foot high impact environments.
d. Dike /riverbank maintenance easements if applclable.
e. Public access and/or trails.
f. Construction limit lines, areas of clearing /grading /filling
g. Parking lots, loading service areas.
h. Street furniture such as benches and bike racks.
11. Shoreline Cross Sections showing the following:
a. Provide shoreline cross sections at a maximum 75 feet intervals along the project
river site.
b. Show all existing and proposed improvements.
c. If the project is within the Tukwila Shoreline Master Program show the limit of
the 40 -foot river, 100 -foot low impact, and 200 -foot high impact environments.
d. Existing top of bank, landward catch point toe of levee, riverbank toe, mean high
water mark and base flood elevation.
Please note that the Department shall cancel an incomplete application if the applicant fails to
submit the requested information within 90 -days following notification from the Department that
the application is incomplete. The Department may extend up to 120 days if the applicant
submits a written request for an extension prior to cancellation. The request must clearly,
demonstrate that the delay is due to circumstances beyond the applicant's control (such as the
need for seasonal wetland data) or unusual circumstance not typically faced by other applicants,
and that a good faith effort has been made to provide the requested materials (TMC 18.104.070).

Response to 18.44.110 General Shoreline Regulations
for the installation of the water line
from SW Grady Way to Andover Park East
1. The use is in conformance with the regulations of the underlying zone district.
The installation of the water line is in conformance with the regulations of the underlying
zone district.
2. The use does not conflict with the goals and policies of the shoreline master program
or the provisions of the Shoreline Act and shoreline regulations.
The installation of the water line is not in conflict with the goals and policies of the
shoreline master program or provisions of the shoreline act and shoreline regulations.
3. No structures or accessory facilities shall be located over the river unless such
structure protects or promotes the public interest.
The installation of the water line under the existing bridge and m the river dike protects and
promotes the public interest by providing domestic and fire water to the people of Tukwila.
4. There shall be no disruption of existing trees or vegetation within the river
environment unless necessary for public safety or flood control, or if allowed as a part
of an approved shoreline substantial development permit.
The water line will be installed in paved or landscaped areas only. After the line is
installed, the areas will be restored to the original condition. The project will obtain all
State and federal permits for installation of the water line.
5. No effluent shall be discharged into the Green River which exceeds the water quality
classification as established by the State for the adjacent portion of the river.
The project will not discharge effluents into the Green River. The line will carry domestic
water.
6. All State and federal water quality regulations shall be strictly complied with.
The project will comply with all State and federal water quality regulations.
7. Wildlife habitat in and along the river should be protected.
The project will protect all wildlife habitat in and along the river during the installation of
the water line.
8. All perimeters of landfills or other land forms susceptible to erosion shall be provided
with vegetation, retaining walls or other satisfactory mechanisms for erosion
prevention.
The project will provide erosion control during the installation of the water line. The plan
will prevent sediments from entering the Green River.

9. All necessary permits shall be obtained from federal, State, County or municipal
agencies.
The project will obtain all necessary permits from federal, State, County and municipal
agencies.
10. Dredging for purposes other than for navigational improvements or flood control is
prohibited.
The project will not be doing any dredging for the installation of the water line.
11. Mining is prohibited along the river shoreline.
The project will not be doing any mining along the riverbank for the installation of the
water line.
12. Solid waste disposal is prohibited along the river shoreline.
No solid waste will be disposed of in the shoreline area during the installation of the water
line.
13. No property will be acquired for public use without dedication by or just
compensation to the owner.
The water line will be installed in existing right -of -ways and easements. No property will
be acquired.
14. Landfilling is prohibited within the river channel unless such landfill is determined by
the Planning Commission to protect or promote the public interest.
No landfill will be installed during installation of the water line.
15. Notwithstanding any provisions of this Code to the contrary, removal of any
cottonwood tree within the river environment or the low- impact environment, which
tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be -
subject to the requirements of TMC Chapter 18.54, Tree Regulations.
No cottonwood trees will be removed for the installation of the water line. If any trees are
disturbed, they will be replaced in kind and size.

ANY PAINT SPLATTERS SHALL BE REMOVED FROM THE BRIDGE.
EXTEND RIGID CONDUIT 10' MINIMUM BEYOND THE BRIDGE STRUCTURE.
INSTALL EPDXY ANCHOR BOLT TO CLEAR REINFORCING STEEL IN BRIDGE DECK SOFFIT. USE REBAR SCANNING DEVICE TO LOCATE REBAR
BEFORE DRILLING. IF REINFORCING STEEL IS HIT WHEN DRILLING, THE DRILLED HOLE SHALL BE ABANDONED AND FILLED WITH NONSHRINK
GROUT CONFORMING TO THE REQUIREMENTS OF SECTION 6-02.3(20). THE DRILLED HOLE SHALL BE MOVED TO CLEAR REINFORCING STEEL.
THERE SHALL BE A MINIMUM EDGE DISTANCE OF 3" FROM THE EDGE OF BRIDGE DECK TO THE CENTER OF DRILLED HOLE.
VERIFICATION: CONTRACTOR SHALL VERIFY ALL EXISTING AND PROPOSED DIMENSIONS, MEMBER SIZES AND CONDITIONS PRIOR TO
FABRICATION AND COMMENCING ANY WORK. NOTIFY THE ENGINEER ABOUT ANY DISCREPANCIES. ALL DIMENSIONS OF EXISTING
CONSTRUCTION SHOWN ON THE DRAWINGS ARE INTENDED AS GUIDELINES ONLY AND MUST BE VERIFIED. THE EXISTING CONDITIONS
