Due to recent administrative interpretations you now have the option of withdrawing your lot consolidation application. The property you own is located at 12064 44 Avenue South. The legal description of the lot is as follows, Tots 28 and 29, Block 5, Hillmans Meadow Gardens Division 1. A house is currently located on the property and the home overlays the lot line between lots 28 and 29. In order to determine the total number of lots present for a particular property, the City uses the regulations that were in place by King County at the time of annexation. The property owner shall demonstrate to the satisfaction of the department that, a lot was created, in compliance with applicable state and local land segregation statues or codes in effect at the time the lot was crated, including, but no limited to, demonstrating that the lot was crated: 1. Show the center line that splits the two between as one dashed line from the top of the lot to the bottom, clearly show that the line goes through the existing house. Provide a statement on the map noting that the dashed line is to be removed. 2. There is a line a line on the map just east of the home, this lines serves no purpose it needs to be removed. 3. In the owner's declaration remove the reference to the BLA and only leave in the reference to the lot consolidation. Also remove the brackets in the statement. 4. Remove the statement line from the land use application asking for each owner to be provided on the recording document. 5. Armando Leyva PO Box 3928 Kent, WA 98089 RE: Notice of Incomplete Application Application for Boundary Line Adjustment Rondos Residence, L05 -059 Dear Mr. Leyva: • City of Tukwila Department of Community Development Steve Lancaster, Director The Department of Community Development received your application for a Boundary Line Adjustment (BLA) for the Rondos Residences located at 12064 44 Avenue South, King County Parcel Number 3347401140. The Department has reviewed the items submitted material and has deemed the application incomplete on September 29, 2005 because certain application materials were not provided. However, before listing the items that are required you should be aware that a BLA will not be approved given the history of the property. The current property owner, Sam N. Rondos, purchased the property in 1998 from Patricia Ada Reed. The instrument used to convey the property was a Quit Claim Deed In Lieu of Foreclosure. The following was the description of the property listed on the instrument: "Lots 28, and 29, Block 5 CD Hillman's Meadow Gardens Addition to the City of Seattle, Division No 1, According to the Plat Thereof Recorded in Volume 12 of Plats, Page 64, Records of King County, Wash ". Hillmans Meadow Gardens Addition was a plat that was recorded with King County in 1905. Lots 28 and Lots 29 were conveyed as one lot. In 1943 a single- family house was constructed on the property. The house was constructed over the lot line that separates lots 28 and 29. Steven M. As noted, the plat that created the two lots was filed with King County in 1905. When this plat was filed, there were no subdivision regulations and anyone could file a plat with no review by the local government. In 1937, the Legislature adopted the first subdivision code which allowed local governments to review and approve subdivision in order to protect the public welfare. The 1937 subdivision applied to all lands in the states and did not exclude those plats that had already been filed with the County Recorder's Office. Tukwila Municipal Code (TMC) 18.06.500 defines a lot as: A. "Lot" means a physically separate and distinct parcel of property which 1. was created by plat, short plat or binding site plan; or 2. was bought or sold as a separately owned parcel of property prior to the requirement that lots be created by plat, short plat or binding site plan; or 3. was created by a transaction which was exempt from the requirement that lots be created by plat, short plat or binding site plan. B. "Lots" may be bought or sold as separate parcels of property but the fact that a parcel of property is defined as a "lot" does not necessarily mean that it may developed as a separate building site. Mr. Rondos' property has historically been used as one building site and thus a BLA cannot be done to allow for a second building site. In order to permit a second building site it would be necessary to have a short plat approved. A short plat will insure that both lots meet the City's development standards. The City understands that Mr. Rondos wishes to add onto his existing house, yet since the house does not meet setback from the center line that separates lots 28 and 29, the building permit application cannot be approved. Staff has the following suggestion: 1. Resubmit the BLA application as a lot consolidation. This would officially eliminate the lot line between lots 28 and 29 and will allow Mr. Rondos to proceed with his addition. The City will refund you the difference between the Boundary Line Adjustment application and Lot consolidation application. 2. At a future date, submit for a short plat application to divide the property into two lots. Another option would be to submit for a short plat application now. The City will apply the BLA fee to the short plat fee. RECORDING DOCUMENT: a template is available from the City in AutoCAD format 12 (a) The recording document must meet the King County Assessor's recording format requirements (letter, legal or record of survey format). (b) Drawing must include a graphic scale, space for the City of Tukwila file number and north arrow. It shall include the elements listed at TMC 17.08.030 B. (c) Provide legal descriptions of all lots before and after the proposed changes. (d) The recording documents must include signature blocks for the owner(s), Short Subdivision Committee, Assessor, and Recorder. COMPLETE APPLICATION CHECKLIST The materials listed below must be submitted with your application unless specifically waived in writing by the Public Works Department and the Department of Community Development. Please contact each Department if you feel that certain items are not applicable to your project and should be waived, or should be submitted at a later date for use at the public hearing (e.g. colored renderings). Application review will not begin until it is determined to be complete. ADDITIONAL MATERIALS MAY BE REQUIRED. The initial application materials allow starting project review and vesting the applicant's rights. However, they in no way limit the City's ability to require additional information as needed to establish consistency with development standards. (b) Vertical datum NAVD 1988 and horizontal datum NAD 83/91. Conversion calculations to NGVD 1929, if in a flood zone or flood -prone area. (c) Existing and proposed utility easements and improvements, on site and in street (water, sewer, power, natural gas, telephone, cable). Schematic designs to be provided regardless of purveyor (e.g. site line size, location, and size of public main). No capacity calcs, invert depth, valve locations or the like are needed. (d) Storm drainage design at least 90% complete, which meets the TIR and KCSWDM. Call out total existing and proposed impervious surface in square feet.
