PROCEDURES AND TIME FOR APPEALING This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project and permit approval. I. PROJECT INFORMATION Project File Number: L05 -065 Applicant: Robert Betts for PetsMart Type of Permit Applied for: Conditional Use Permit for a PetsHotel boarding facility. Project Description: The operation of an indoor kennel within the existing PetsMart retail store. The kennel, called a PetsHotel, will serve up to 130 dogs and 20 cats on both a day and an overnight basis. SEPA Determination: The Planning Commission has approved the Conditional Use Permit. The City SEPA Responsible Official has determined that the project, as proposed, does not create a probable significant environmental impact and issued a Determination of Non - Significance (DNS) The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Planning Commission Decision is permitted: No administrative appeal of a DNS or an EIS is permitted. The name of the appealing party. • op In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by January 24, 2006. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Conditional Use Permit for a PetsHotel facility within the existing PetsMart retail store on Southcenter Parkway. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206 - 431 -3670 • Fax: 206 - 431 -3665 PROJECT DESCRIPTION PetsMart is proposing to operate an indoor kennel at its existing store in the Tukwila Urban Center. The kennel, called a PetsHotel, will serve up to 130 dogs and 20 cats on both a day and an overnight basis. The facility will require a conversion of approximately 7600 square feet of space within the 26,980 square foot freestanding store. The design incorporates methods and materials that mitigate the transfer of noise from barking dogs (see attachment F). VICINITY /SITE INFORMATION Existing Development The 11.85 -acre site contains two one -story community shopping center buildings, the 26,980 square foot PetsMart store, and the 136,649 square foot, four - tenant structure immediately to the north and was subject to design review. Surrounding Land Uses • • FINDINGS Staff Report to the Planning Commission L05 -065 All adjoining properties are zoned Tukwila Urban Center (TMC) and consist of regional retail uses. BACKGROUND The applicant is requesting to locate an indoor kennel within the existing PetsMart store. There will be no expansion of the footprint of the structure and there are no tenants who share a common wall. Noise from pets, especially barking dogs, will be contained within the building. Acoustic insulation will be installed in the walls and ceilings of the kennel area In addition PetsMart requires separation walls between the kennel and adjoining retail space to be constructed of 6 -inch metal studs at 24 -inch centers, flanked by full height 5/8 -inch gypsum board on both sides. Ceilings throughout the kennel area will have acoustic tiles. Air circulation within the kennel will range from a minimum of 10 up to 30 changes per hour. By way of comparison, the standard for retail stores is four to six changes per hour. Zoning Code Amendments City Council has amended the zoning code to allow kennels as a conditional uses in Tukwila Urban Center. PUBLIC COMMENTS None Q:\L05 -0065 PetsMart Staff Report.doc Page 2 11/29/2005 • • DECISION CRITERIA - CONDITIONAL USE PERMIT Staff Report to the Planning Commission L05 -065 The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment D. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The proposed PetsHotel will be located entirely within the existing retail store. There are no outdoor activities such as pet runs. Noise and odors are controlled with soundproofing and enhanced ventilation (see attachment F). There is no residential development within, at least, 500 feet of the project. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. Existing landscaping, external lighting and parking will remain unchanged. The only external, visible change to the facility may be an additional sign on the facade of the building. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed PetsHotel will be compatible with surrounding uses, as its operations are entirely within the existing structure. No changes to the existing number or layout of the parking lot would occur. The PetsHotel requires conversion of approximately 6,700 square feet of retail space, which is a high generator of traffic, into kennel space, which is a lower generator of traffic. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 10.2.10: Actively promote development in the Tukwila Urban Center by supporting existing uses and expanding the range of allowable uses. The facility expands the range of allowable uses by adding to the diversity of services in Q:\L05 -0065 PetsMart Staff Report.doc Page 3 11/29/2005 the Urban Center. • • Staff Report to the Planning Commission L05 -065 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The construction of the indoor kennel will require modifying the existing HVAC in order to separate the air handling systems between the kennel and the retail space. Noise from barking dogs will be contained within the building and mitigated by construction standards tested and reported by Acoustical Consulting Services (see attachment F.) There will be no additional impact on the existing storm water system. CONCLUSIONS - CONDITIONAL USE PERMIT The proposed PetsHotel will be contained entirely within the existing PetsMart building and will not impact any surrounding properties. The existing PetsMart building was subject to a design review. The proposed PetsHotel will not change or compromise the approved site design and is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. It can be stated that all measures have been taken to minimize the possible adverse impacts this project may have on the area in which it is located. RECOMMENDATIONS - CONDITIONAL USE PERMIT Staff recommends approval of the Conditional Use Permit. Then, refer to the Tukwila Comprehensive Plan for project consistency with the policies. Please note that more than one category of policies may apply. Already- approved landscaping, external lighting and parking will remain unchanged as a result of approval of this proposed conditional use. The only external, visible change to the facility may be an additional sign on the facade of the building that identifies the PetsHotel. Its review and approval will be the subject of a separate, subsequent application from this conditional use. 3. The proposed development shall be compatible generally with the surrounding land uses. The proposed PetsHotel will be compatible with surrounding uses, as its operations are entirely within the existing structure, enhanced by 24- staffing and video surveillance. Pets remain indoors from check -in to check -out 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The facility conforms -or implements two comprehensive Plan Policies, and is not in conflict with any others. Policy 2.1.12: the facility promotes Tukwila as a regional crossroads for commerce. Policy10.2.10: the facility expands the range of allowable uses in the Tukwila Urban Center. In general the Hotel adds to the diversity of services in the Urban Center, supports a stable economy and provides a service to residents. 5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the in area which it is located. In addition to the measures mentioned above in order to minimize impacts, the PetsHotel is secured with double doors with pass -code security, complemented by 24 -hour staffing and video surveillance. An on -site veterinarian will provide care if needed, but prior to being accepted for boarding, all cats and dogs must be current on their vaccinations. All pets wear customized identification. Exterior walkways are power- washed weekly. Elliot, Tempe) to the adjacent Staples (1275 W. Elliot, Tempe). To help determine the potential noise impact, ACS recorded the sound of approximately 100 dogs . barking at Pets Hotel Pius (4001'E. Speedway Blvd, Tucson). This facility is a fully enclosed, indoor kennel. During the recording the dogs were purposely incited to •bark in order to represent maximum conditions. The recording was then replayed within the Tempe facility at approximately 100 dB. The barking was not audible in the adjacent Staples. During testing, a Noise Isolation Class (NIC) test was attempted. Pink/white noise was played in the Tempe PetsMart at levels in'excess of 100'dS. The source noise was not measurable in the adjacent 'space. Therefore, an NIC rating could not be determined. The kennel, called a PetsHotel, will serve up to 130 dogs and 20 cats on both a day and an overnight basis. The facility will require conversion of approximately 7600 square feet of space within the 26,980 square foot freestanding store. Its design eliminates items that otherwise could be considered to be a nuisance. In doing so, PetsMart believes its facility will exceed the City's conditional use standards and be a positive service for the community. o Tukwila's PetsHotel will be located entirely within the present freestanding PetsMart store, meaning that there will be no expansion of the footprint of the structure, and that there are no tenants who share a common wall, as might be the case if a kennel was proposed within a strip mall complex. o Noise from pets, especially from barking dogs, will be contained within the building. Acoustic insulation will be installed in the walls and ceilings of the kennel area, to the point that a study of another PetsHotel reported that measurements outside the facility could not detect a 100dB simulation of 150 dogs barking from within the facility. For comparison purposes 100dB is slightly less than the noise level associated with a jet aircraft engine at take off. To achieve this standard in reducing noise, the company requires separation walls between the kennel and adjoining retail space to be constructed of 6 -inch metal studs at 24 -inch centers, flanked by full height 5/8 inch gypsum board on both sides. In addition PetsMart requires 6 -inch sound batt insulation to be installed within the stud walls. Ceilings throughout the kennel area will have acoustic tiles as well. PetsMart's standard for air circulation within the kennel will range from a minimum of 10 changes per hour (relief room) to 30 (training room). By way of comparison, the standard for retail stores is four to six changes per hour. o Animal waste will be disposed of using a separate flushing system into lines that connect directly to the main sewer. All dog rooms and suites have an additional system of waste trenches and hose reels that allow staff to regularly wash down these areas. o The facility will be staffed 24 hours a day, assisted by video monitoring throughout the PetsHotel facility. The presence of both staff and electronic surveillance will act as a deterrent to vandalism and theft, and to that extent, will make the facility a safer neighbor. The .recording was then replayed within the Tempe facility at approximately 100 dB. The barking was not audible in the adjacent Staples. During testing, a Noise Isolation Class (NIC) test was attempted. Pink/white noise was played in the Tempe PetsMart at levels in'e.xcess of 100'dB.
