The applicant is not asking the Hearing Examiner to provide any specific remedy. The City seeks the following: 1. The Appeal should be dismissed. The item is not ripe for review by the Hearing Examiner. The appellant is asking the Hearing Examiner to approve a short plat. The appellant has never submitted a short plat application for DCD for review. 2. Affirm the City's Code Interpretation issued on November 4, 2005. FINDINGS OF FACT • • SCOPE OF HEARING 1. The property in question is located at 12258 48 Avenue South, Tukwila, Washington, King County Parcel Number 017900 -1435. The property consists of the following lots of record 18, 19, 20, 21, and 22 of Block seven of the Allentown Addition. 2. According to King County Assessor records the appellant purchased the property from the Secretary of Housing and Urban Development in 2005. The property had always been conveyed as one single tract of land. 3. The property in question is zoned Low Density Residential (LDR). The minimum lot size in the LDR zone is 6,500 square feet (TMC 18.10). 4. Allentown Addition was a plat that was recorded with King County in March of 1906. The Alltentown Addition was platted prior to any requirements that properties be divided by a formal platting process. Platting requirements went into affect in 1937. Many of the Allentown lots do not meet the City's minimum lot size requirements. 5. On June 14, 2001, Keith Harris the former owner of the property in question, submitted a Lot Consolidation application with DCD (L01- 041)(KC Recording Number 20011101001930). The lot consolidation application was recorded with King County on November 1, 2001. The application reduced the total number of lots on the property from five to two total lots. Mr. Harris needed the lot consolidation for the property in order to locate a modular home on the property (Attachment B). 6. The property currently contains the following lots of record: ❑ Lot A which previously included lots 18, 19, 20, and 21 of Block seven of the Allentown Addition (These were the lots that were combined as part of LO1 -041). ❑ Lot 22 of block seven of the Allentown Addition. 7. Tukwila Municipal Code (TMC) 18.06.500 defines a lot as: A. "Lot" means a physically separate and distinct parcel of property which 1. was created by plat, short plat or binding site plan; or 2. was bought or sold as separately owned parcel of property prior to the requirement that lots be created by plat, short plat, or binding site plan; 3. was created by a transaction which was exempt from the requirement that lots be created by plat, short plat or binding site plan. 8. The Code Interpretation concluded that the property in question, Lot A and Lot 22 fell under TMC 18.06.500 (2) and was one legal lot and thus could only contain one dwelling unit. Any additional building sites would have to be created via a legal short plat. 2 Staff Report Bui Appeal, L05 -069 DISCUSSION • • 1. The appeal should be dismissed; the matter is not ripe for review by the Hearing Examiner. The appellant notes in the Notice of Appeal that he is asking the Hearing Examiner to approve a short plat. However, the City has never received an application by the appellant to short plat the property in question. The proper decision making body for a short plat/boundary line adjustment is the City's Short Plat Committee. The appellant must exhaust these administrative remedies before proceeding on an appeal to the Hearing Examiner. If the appellant is unhappy with the decision of the Short Plat Committee he can appeal that decision to the Hearing Examiner. 2. The Code Interruption issued by the Director was based on a fair review of the facts regarding the property and City regulations. The appellant wants the City and the Hearing Examiner to disregard the fact that the previous property owner consolidated the lots and legally recorded the lot consolidation and that the City's definition of lot only recognizes that there is currently one building site on the property. The lot consolidation that was done in 2001 reduced the number of legal lots on the property to two lots. However, the City regulations do not allow for an additional dwelling to be located on the property without going through a formal short plat. The record clearly shows that the property consists of pre -1937 lots and has been conveyed as one single piece of property. Thus under TMC 18.06.500 (2) the two remaining lots are considered one legal lot of record. CONCLUSION The City's Code Interpretation was based on a fair review of the relevant facts and regulations governing the appellant's property. The appellant has never provided any facts that that dispute the City's facts regarding this matter, nor does the appellant contend that the City's code provisions are being incorrectly applied to his situation. I bought this property one and half year ago, with the intention it will short plat into 3 lots. On October 26, 2005. We went to King County assessor office spoke with Catherine to give her information of what we intend to do. On November 1 I received a call from Catherine refer me to talk to Brandon Miles from City of Tukwila Department of Community Development for our short plat. On November 2, 2005 I went to see Mr. Miles, one in the mourning and one in the afternoon, and have been told from Mr. Miles that the zone code just changed in August 2005. which was in the newspaper. It is unfair for me as a single parent that is raising three children. I have to work long hours and almost everyday. I have a language barrier, and I can barely speak English, and I can not read and write. Therefore there is no way I will know about the code change. Please consider my situation. Even though the code has just been changed, it should give some lead way or time frame before enforce. What I am asking is very reasonable: Lot 18 is one lot which is 4,000 s.f Lot 19 & 20 combines to be one lot which is 5,000 s.f Lot 21 & 22 combines to be one lot which is 5,000 s.f I am willing to do any requirements and improvements required by the City of Tukwila Department of Community Development. You wanted to determine how many building sites the subject property had. Mr. Miles suggested that you submit a letter requesting a Code Interpretation to determine the total number of building sites for the subject property. Your letter does not specifically request a code interpretation but given the nature of the letter and your conversation with Mr. Miles the City will presume you are requesting a formal Code Interpretation and thus preserving your appeal rights under Tukwila Municipal Code (TMC) 18.90. Background The lots that you have inquired about are lots 18 -22, Block 7 of the Allentown Addition. There is currently a mobile home on the subject property. The property has historically been under single ownership and had been conveyed as one large tract when the current property owner, Mr. Yen Le purchased the property in December of 2004. The previous property owner, Keith Harris recorded a lot consolidation (L04 -041) combining lots 18, 19, 20, and 21 as one lot (KC Recording Number 20011101001930). Thus, only two separate lots still exist on the property. Lot 22 is one separate lot, while lots 18, 19, 20, and 21 were combined under one lot. The Allentown plat was filed with King County in 1905. This was before the introduction of the first subdivision laws, which were adopted by the State in 1937. In 1937, the State allowed local governments to regulate the division of land in order to protect the public welfare. Each lot or group of lots under a single ownership was "grandfathered" as a single building site. TMC 18.06.500 defines a lot as: A. "Lot" means a physically separate and distinct parcel of property which 1. was created by plat, short plat or binding site plan; or 2. was bought or sold as a separately owned parcel of property prior to the requirement that lots be created by plat, short plat, or binding site plan; 3. was created by a transaction which was exempt from the requirement that lots be created by plat, short plat or binding site plan. Therefore, subject property may only be used as one building site. If you wish to add additional building sites to your property you will need to have a short plat approved by the City. The lots created through the short plat will have to meet the City's minimum development standards in the Low Density Residential Zone such as lot size, setbacks, and lot width. According to King County Assessor's data you may be able to get two legal lots on the subject property. You have asked that you be exempted from the City's current definition of lot that was adopted in August of 2005. However, even if you were exempt from the City's code changes it does not change the fact that the previous property owner formally combined the lots on the property, and thus there still would only be two building sites, the same that you would get through a formal short plat. The regulations that govern your property are the same citywide. Please understand that the City is not singling you out and applying land use regulations that are not equally applied to other property owners in the City. This Code Interpretation by the Director is a type II decision and may be appealed to the Hearing Examiner. The appeal shall be processed pursuant to TMC 18.108.020 and TMC 18.116. Mr. Bui asked that the City determine the number of permitted building sites on the property. On November 4, 2005, the Director issued a code interpretation for the subject property. The interpretation concluded the following: 1. The previous property owner had approved and recorded a lot consolidation which limits the number of building sites on the property. 2. The remaining lots contain pre -1937 lots and thus special restrictions exist as to how many building sites are available on the property. 3. The applicant had enough square footage to do a short plat to create two lots. The applicant is not asking the Hearing Examiner to provide any specific remedy. The City seeks the following: 1. The Appeal should be dismissed. The item is not ripe for review by the Hearing Examiner. The appellant is asking the Hearing Examiner to approve a short plat. The appellant has never submitted a short plat application for DCD for review. 2. Affirm the City's Code Interpretation issued on November 4, 2005. FINDINGS OF FACT 1. The property in question is located at 12258 48`" Avenue South, Tukwila, Washington, King County Parcel Number 017900 -1435. The property consists of the following lots of record 18, 19, 20, 21, and 22 of Block seven of the Allentown Addition. 2. According to King County Assessor records the appellant purchased the property from the Secretary of Housing and Urban Development in 2005. The property had always been conveyed as one single tract of land. 3. The property in question is zoned Low Density Residential (LDR). The minimum lot size in the LDR zone is 6,500 square feet (TMC 18.10). 4. Allentown Addition was a plat that was recorded with King County in March of 1906. The Alltentown Addition was platted prior to any requirements that properties be divided by a formal platting process. Platting requirements went into affect in 1937. Many of the Allentown lots do not meet the City's minimum lot size requirements. 5. On June 14, 2001, Keith Harris the former owner of the property in question, submitted a Lot Consolidation application with DCD (1,O1- 041)(KC Recording Number 20011101001930). The lot consolidation application was recorded with King County on November 1, 2001. The application reduced the total number of lots on the property from five to two total lots. Mr. Harris needed the lot consolidation for the property in order to locate a modular home on the property (Attachment B). 6. The property currently contains the following lots of record: • Lot A which previously included lots 18, 19, 20, and 21 of Block seven of the Allentown Addition (These were the lots that were combined as part of LO1 -041). • Lot 22 of block seven of the Allentown Addition. 7. Tukwila Municipal Code (TMC) 18.06.500 defines a lot as: A. "Lot" means a physically separate and distinct parcel of property which 1. was created by plat, short plat or binding site plan; or 2. was bought or sold as separately owned parcel of property prior to the requirement that lots be created by plat, short plat, or binding site plan; 3. was created by a transaction which was exempt from the requirement that lots be created by plat, short plat or binding site plan. 8. The Code Interpretation concluded that the property in question, Lot A and Lot 22 fell under TMC 18.06.500 (2) and was one legal lot and thus could only contain one dwelling unit. Any additional building sites would have to be created via a legal short plat. Staff Report Bui Appeal, L05 -069 DISCUSSION 1. The appeal should be dismissed; the matter is not rive for review by the Hearing Examiner. The appellant notes in the Notice of Appeal that he is asking the Hearing Examiner to approve a short plat. However, the City has never received an application by the appellant to short plat the property in question. The proper decision making body for a short plat/boundary line adjustment is the City's Short Plat Committee. The appellant must exhaust these administrative remedies before proceeding on an appeal to the Hearing Examiner. If the appellant is unhappy with the decision of the Short Plat Committee he can appeal that decision to the Hearing Examiner. 2. The Code Interruytion issued by the Director was based on a fair review of the facts regarding the property and Cityregulations. The appellant wants the City and the Hearing Examiner to disregard the fact that the previous property owner consolidated the lots and legally recorded the lot consolidation and that the City's definition of lot only recognizes that there is currently one building site on the property. The lot consolidation that was done in 2001 reduced the number of legal lots on the property to two lots. However, the City regulations do not allow for an additional dwelling to be located on the property without going through a formal short plat. The record clearly shows that the property consists of pre -1937 lots and has been conveyed as one single piece of property. Thus under TMC 18.06.500 (2) the two remaining lots are considered one legal lot of record. CONCLUSION The City's Code Interpretation was based on a fair review of the relevant facts and regulations governing the appellant's property. The appellant has never provided any facts that that dispute the City's facts regarding this matter, nor does the appellant contend that the City's code provisions are being incorrectly applied to his situation. We went to King County assessor office spoke with Catherine to give her information of what we intend to do. On November 1 I received a call from Catherine refer me to talk to Brandon Miles from City of Tukwila Department of Community Development for our short plat. On November 2, 2005 I went to see Mr. Miles, one in the mourning and one in the afternoon, and have been told from Mr. Miles that the zone code just changed in August 2005. which was in the newspaper. It is unfair for me as a single parent that is raising three children. I have to work long hours and almost everyday. I have a language barrier, and I can barely speak English, and I can not read and write. Therefore there is no way I will know about the code change. Please consider my situation. Even though the code has just been changed, it should give some lead way or time frame before enforce. What I am asking is very reasonable: Lot 18 is one lot which is 4,000 s.f Lot 19 & 20 combines to be one lot which is 5,000 s.f Lot 21 & 22 combines to be one lot which is 5,000 s.f I am willing to do any requirements and improvements required by the City of Tukwila Department of Community Development. This was before the introduction of the first subdivision laws, which were adopted by the State in 1937. In 1937, the State allowed local governments to regulate the division of land in order to protect the public welfare. Each lot or group of lots under a single ownership was "grandfathered" as a single building site. TMC 18.06.500 defines a lot as: A. "Lot" means a physically separate and distinct parcel of property which I. was created by plat, short plat or binding site plan; or 2. was bought or sold as a separately owned parcel of property prior to the requirement that lots be created by plat, short plat, or binding site plan; 3. was created by a transaction which was exempt from the requirement that lots be created by plat, short plat or binding site plan. Therefore, subject property may only be used as one building site. If you wish to add additional building sites to your property you will need to have a short plat approved by the City. The lots created through the short plat will have to meet the City's minimum development standards in the Low Density Residential Zone such as lot size, setbacks, and lot width. According to King County Assessor's data you may be able to get two legal lots on the subject property. You have asked that you be exempted from the City's current definition of lot that was adopted in August of 2005. However, even if you were exempt from the City's code changes it does not change the fact that the previous property owner formally combined the lots on the property, and thus there still would only be two building sites, the same that you would get through a formal short plat. The regulations that govern your property are the same citywide. Please understand that the City is not singling you out and applying land use regulations that are not equally applied to other property owners in the City. This Code Interpretation by the Director is a type II decision and may be appealed to the Hearing Examiner. The appeal shall be processed pursuant to TMC 18.108.020 and TMC 18.116. All appeals shall be filed with the Department within 14 -days from the date of this letter. The Notice of Appeal must include the following (TMC 18.116.030): 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in that decision. The Notice of Appeal shall state specific errors of fact or errors in application of the decision being appealed; the harm suffered or anticipated by the appellant; and the relief south.
