DCD Planning Page 2 12/30/2005 Q: \CUP \Clearwire \staff report.doc Vicinity /Site Information Project Description • • FINDINGS The applicant is requesting approval of a Conditional Use Permit (CUP) to install an eight -foot tall wireless internet antenna on the southeast corner of an existing industrial building. The antenna will be placed 32 feet away from the edge of the roofline. The associated ground equipment will be located within the building. The applicant submitted for the Conditional Use Permit application on November 30, 2005. The application was subsequently deemed complete on December 6, 2005. The Notice of Application was distributed on December 14, 2005. The Notice of Application was posted on the site and mailed to surrounding tenants and property owners. The City received no comments regarding the proposed facility. Pursuant to Washington Administrative Code (WAC) 197 -11 -800 (25) the proposed project is exempt from SEPA review. Existing Development The location of the proposed antenna is on an existing industrial building. The building is approximately 107,357 square feet and was constructed in 1986 with a major renovation completed in 1995. The building is part of the Intergate West III industrial complex. The following business are licensed at the property, McLeod USA Telecommunications, WTS, Inc, HopOne Internet Corp., and Prometheous Energy Co. Surrounding Land Uses All surrounding properties are zoned MIC /H. To west of the subject property is a steep embankment, which is part of the limited right of way for State Route 99. Large industrial buildings border the property to east and south. A trucking operation is located to the north of the project site. Other uses located in the area included Group Health, Department of Homeland Secruity, and State Route 599. DCD Planning Page 3 12/30/2005 Q: \CUP \Clearwire \staff report.doc CONDITIONAL USE CRITERIA • • The proposed facility will be approximately 600 feet from East Marginal Way. East Marginal Way is the main City arterial that provides access to the project property. The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment D. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated The applicant has chosen to install the proposed antenna on an existing industrial building within an industrial zone of the City. The antennas have also been located approximately 30 feet from the edge of the roof's building. The building is 28 feet tall, 431 feet in length, and 250 feet in width. Additionally, there is a large amount of mechanical equipment located on the roof of the building. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the MIC/H zoned include a maximum height of 125 feet and the following setbacks: Front: 20 feet Second Front: ten feet Side: None Rear: None The existing building meets the City's setback requirements and since the applicant will be installing the equipment on the existing building setbacks are not an issue. The roof top antenna will be well below the maximum height requirements for the MIC /H zone. The proposed use does not trigger any additional landscaping on the property. Telecommunication facilities generally generate only a small parking demand. Technicians usually visit such facilities once a month. There is an abundant of parking stalls available on the site for when the facility will need maintenance and thus the proposed use does require that additional parking stalls be provided. DCD Planning Page 4 12/30/2005 Q: \CUP \Clearwire \staff report.doc • • (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to one trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. There are no new buildings proposed for this project, instead the applicant is installing antennas on an existing building. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing building. Given the small scale of the project is comparison with the subject site there will be only minimal visual impacts. The project site is in an industrial zone and thus the need to mitigate any visual impacts is not necessary. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing building instead of constructing a new freestanding pole and the associated cabinet equipment has been located within an existing building. During Staff review of the project, the Fire Department expressed concern over possible interference of Fire Department communication equipment if they were on the site. The Fire Department will require as part of the building permit, that an emergency shut off be provided. DCD Planning Page 5 12/30/2005 Q: \CUP \Clearwire \staff report.doc CONCLUSIONS • I . The proposal to install an antenna on an industrial building will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. By locating the operating equipment within the building, potentially hazardous operating equipment has been made inaccessible to the public. 2. The proposed project meets the performance standards that are required in the MIC /H zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 4. No noise will be generated the new antennas or ground equipment associated with this application. 5. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit as presented with no conditions.
