Photosimulations Staff Report to the Planning Commission L05 -045 NEXTEL at 44th Ave S Page 3 of 6 Vicinity /Site Information Project Description The applicant is requesting approval of a Conditional Use Permit (CUP) to install three antennas on an existing 120 -foot tall wireless communication monopole at 13134 44` Avenue South. Existing Development There is an existing 120 -foot tall wireless communication monopole on the site. There is also a 432 square foot equipment building on the site. The existing facility was originally approved in 1991 (91 -3 -CUP). The Planning Commission approved additional antennas at the location in 2000 (L2000 -050) and in 2005 (L05 -045). Surrounding Land Uses BACKGROUND Q: \CUP \CLEARWIRE, L05- 078 \staff report .doc • • FINDINGS The surrounding properties are zoned Commercial Light Industrial (C/LI). Land uses in the immediate vicinity are predominately light industrial and warehouses. There are some residences in the vicinity, primarily to the south and west. State Route 599 interchanges are on the south and east side of the subject property. The existing monopole was approved with conditions by the Planning Commission on September 30, 1991. The existing site is zoned C /LI and the maximum permitted height in that zoning district is 45 -feet. The existing monopole is 120 feet high and the new antennas are proposed to be attached at 105 feet and the future microwave dishes will be located directly below the antennas. Based on the fact that the existing monopole does not meet current maximum height requirements of the C/LI zoning district and the fact that it was legally permitted under 91 -03 -CUP, it is considered a nonconforming structure. The current proposal does not increase the degree of nonconformity of the existing monopole and does not trigger any thresholds listed under TMC 18.70.050 for bringing it into compliance with current code. The site is also located within the buffer of a type II stream. Staff Report to the Planning Commission L05 -078 CLEARWIRE at 44th Ave S Page 4 of 6 CONDITIONAL USE CRITERIA 1 • The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment E. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has proposed to co- locate three antennas on an existing monopole that has various antenna arrays. The proposed antenna will be painted to match the color of the existing monopole. The applicant will place the associated ground equipment in the existing equipment enclosure compound. The area of the equipment compound will be unchanged. The applicant has provided documentation that the proposed facility will be within FCC standards for maximum exposure to radio frequency energy (See Attachment (D)). (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the C/LI zone include a maximum height of 45 feet and the following setbacks: Front: 25 feet Second Front: 12.5 feet Side: Five Feet As noted, the applicant will utilize the existing equipment area, which meets setbacks. The antennas will be placed on the existing monopole. As noted, the existing monopole does not meet the City's height requirements. As noted, the existing facility is located within the buffer of a type II stream. Since the applicant will be locating the new equipment within the existing enclosure, staff does not see any additional impacts from the new facility on the stream or buffer area. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. There are no new buildings proposed for this project, instead the applicant is installing antennas on an existing monopole and will place the ground equipment in an existing equipment enclosure. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing monopole. The applicant will also utilize the existing equipment enclosure for the placement of their ground equipment. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing monopole instead of constructing a new freestanding pole. All ground equipment will be placed in an existing facility. The applicant is not proposing to utilize a generator, which means the site will not have any impact on noise. The proposal to install antennas on an existing mono -pole will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. The applicant has submitted documentation that the antennas will meet Federal regulations for frequency emissions. By locating the operating equipment within an existing fenced equipment enclosure, potentially hazardous operating equipment has been made inaccessible to the public. 2. The proposed project meets the performance standards that are required in C /LI zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 4. No noise will be generated the new antennas or ground equipment associated with this application. 5. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit as presented with one condition: 1. The applicant shall submit proof of final electrical inspection by Washington State Department of Labor and Industries. A building permit is not required for the scope of work for this facility. Typically, when a building permit is issued, the City will not conduct a final building inspection until the State Electrical Inspector has signed off on the project.
