The Draft Environmental Impact Statement (EIS) was issued on June 21, 2004 and the Final EIS on October 7, 2004. Based upon the plans and information submitted in connection with this application; the finding and conclusions contained in the staff report dated April 19, 2007; the public hearing on April 26, 2007; and subject to the conditions recited below; the Tukwila Board of Architectural Review (BAR) has determined that the application for exterior signage for Westfield Southcenter meets the BAR criteria, satisfies the relevant condition of L04 -049 and has approved this design review application. Design Review Conditions: 1. Create landscape areas at the base of freestanding signs in the north half of the site and landscape with an appropriate plant palette. 2. Adequately screen the base / pole of the chosen freeway interchange sign. 3. Setback the face of the AA1 and AA2 freestanding signs a minimum of five feet from the back of any walkway and setback the side edge or angled face of these signs a minimum of 3 feet from the back of any walkway. The decision on this Permit Application is a Type 4 decision pursuant to the Tukwila Municipal Code (18.104.010 TMC.) One administrative appeal to the City Council of the Board of Architectural Review Decision is permitted. No administrative appeal of the EIS is permitted. A party, who is not satisfied with a City Council decision on an appeal, may file an appeal of the Council's decision in King County Superior Court. In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of this Decision, which is by May 18, 2007. Notice of Decision • • L07 -007 Westfield Southcenter Comprehensive Exterior Signage Plan The requirements for such appeals are set forth in the Appeal Processes Chapter of the Tukwila Municipal Code (18.116.) All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. Appeal Hearings Process Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the City Council based on the testimony and documentary evidence presented at the open record hearing. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal of the EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue an EIS for this approval and any other pending permit applications for the development of the subject property is final. VI. I was making my first pass through our 4/26/07 packet and have the following question about L07 -007. On page 4 of the staff report, there is a type of sign referred to as a "Brand Alliance" sign. Based on attachment B and Attachment C (Drawing Number 02, detail image "AZ 1 "), these signs appear to be the size of traditional Billboards. I think I've seen interior signage for products /services (car dealer ad, movie posters, etc) not sold/rented on the immediate premises, and if this was carried forward to these exterior "Brand Alliance" signs, would that content turn these into Billboards as defined 19.08.050 (Note: page 9 of the staff report does say that it will only be for stuff sold in the mall, but I could see some product placement like in movies of stuff not at the mall (say a sports car in the background))? If so, are these allowed under 19.32.040, 19.32.150, and/or 19.32.155? If allowed, what would keep all other TUC businesses from following suit once a precedent was set for "Brand Alliance" signs and is that a direction we would want to encourage? Westfield Southcenter Site Signage Plan • Staff Report to the Board • p Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan VICINITY INFORMATION PROJECT INFORMATION FINDINGS The site encompasses for the most part several large City blocks, measuring approximately 1,950 feet per side and exceeding a quarter mile along each block face. The bank property in the northeast corner of the block however is not managed by Westfield. City streets of various widths surround the site. Beyond the City streets are interstate freeways and Gilliam creek on the north and west and retail and commercial service uses on the east and south. Background on project Southcenter, which encompasses approximately 85 acres, was constructed in the late 1960's about the time that the adjacent interstate freeways were completed and it has been improved and modified at various times over the last three and a half decades. The proposed expansion is a major departure from the existing configuration and character of the mall — the main building on the site. This proposed expansion "fills in" the space between J.C. Penney and Sears on the south side of the mall. A new connection or mall corridor will be created between these two anchors thereby allowing customers to walk in a circular pattern between the existing common corridor and the new corridor as well as on two levels in this new section. A number of new tenants with distinctive exteriors and entrances are to be located along the new south facade and face out towards the parking lot. The mall addition will generally be two stories, with a third story devoted to a new 16 screen movie theater. The project also includes two separate parking structures — a two level parking deck adjacent to Sears and a two level parking deck adjacent to J.C. Penney. The parking garages are connected via the roof of the expanded mall building where there will be additional parking and entrances to the theater and the mall itself. At this time two additional separate small building sites are proposed along Strander Boulevard. In the future, expectations are that additional structures will be built throughout the site and that there would be tenant infill in the ground floor of the garages. The Board of Architectural Review (BAR) held a public hearing in December 2004 and approved the project subject to conditions, one of which was return to the BAR Page 3 of 14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan with a comprehensive signage proposal for the site. The expansion project is under construction and is scheduled to be completed by the summer of 2008. Westfield Signage Plan Westfield submitted a comprehensive sign package that proposes both freestanding and wall signs. Their proposal is encompassed in Attachment C. Sheet references below refer to the sheet numbers within this Attachment C. There will also continue to be separate tenant signage at the mall that is not a part of this review. Westfield's sign proposal includes a wide combination of signs that serve to market the Company identity, to provide direction, and to generate income. There are six different types of freestanding signs illustrated on Sheet 2, they are: 1. the freeway interchange sign — AA8 2. the large scale entry monument sign — AA1 3. the smaller scale entry monument sign — AA2 4. the totem sign-AB1 5. the "street" sign -AF 6. the directional sign - AD1 There are two primary types of wall signs, illustrated on Sheet 2, they are: 1. "Westfield" signs — AA3, AA6 and AA7 2. "Brand Alliance" signs - Attachment B is a photo of a Brand Alliance sign in another Westfield location. There are over 50 signs proposed as part of this design package whose installation will coincide with the expansion and revitalization of the 85 acre site. Due to the large size of the site and the scale of the proposal, findings, conclusions and recommendations will be programmatic. For example, instead of a review of plant specific materials there is a review of the type of landscaping. At the time of the administrative review of the actual sign permit application, the applicant will present drawings that include specific site plan dimensions, planting details and compliance with the sign area allowance for Westfield and allowable individual business signage. This review is focused on materials, colors, lines, massing, layout and general location and orientation. Tukwila Sign Code General Regulations "No sign, the message of which is discernible from the public right of way, adjacent properties or adjacent businesses, shall hereafter be erected ... (without) a permit .... (being) issued" (Required section of the Permits Chapter of the Tukwila Municipal Code (19.12.010 TMC) Page 4 of 14 Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan There are two important tenants of the above Code section that affects the Westfield signage proposal. The Bank of America parcel is the only parcel within the block that is not managed by Westfield. Because the subject site is so large, and because there are multiple buildings, there are locations on the site and building elevations where signs will not be visible from public rights of way. Secondly, staff has assumed that the term "adjacent businesses" from the above code section, does not include any businesses that are Westfield tenants. Planned Shopping Centers (Mall) The Tukwila Sign Code has a specific section to address signage at the mall. The Code allows the mall to have up to 1,200 square feet of mall related sign area, with no restriction on size or number. Individual business related signage is considered separately and is based upon a percentage of the exposed building face. PUBLIC COMMENT No comment has been received. DESIGN REVIEW CRITERIA 1. Relationship of Structure to Site. • • The applicant's response to the criteria is contained in the applicant's Project Description, which is Attachment A. Below is the staff analysis and response to the applicant's sign plan. a) The site should be planned to accomplish a desirable transition with streetscape and to provide for adequate landscaping and pedestrian movement; b) Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas; c) The height and scale of each building should be considered in relation to the site. A number of concepts from above the design guidelines are specific to the signage plan — how do the freestanding signs relate to the streetscape and is there adequate landscaping and pedestrian movement around the signs. There are five different types of signs that are freestanding structures, they are: 1. the freeway interchange sign — AA8 1. the larger entry monument sign — AA1 ( approximately 9 feet wide by 7.5 feet high) Page 5of14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan 2. the smaller scale entry monument sign — AA2 ( approximately 7 feet wide by 6 feet high) 3. the totem sign -AB 1 (approximately 2 feet wide by 12 feet high) 4. the circulation directional sign -AD 1 (approximately 3.5 feet wide by 9 feet high) The applicant shows two freeway interchange signs. Staff's interpretation of the Tukwila Sign Code is that one is allowed. The proposed height of 125 feet will make the freeway interchange sign unobservable to motorists and pedestrians on City streets. The base of the sign will be the most important streetscape element and the applicant proposes landscaping the base. The size of the base is not known. The depth of the landscape area that exists at either location is approximately one foot or will be one foot after street improvements. Sheet 3 shows the general locations of the freestanding signs. The larger entry monument sign (AA1) is shown at seven locations — the five signalized entrances, the corner of Southcenter Parkway and Strander Boulevard, and at the south end of the 61 Av. South bridge over I -405, along Tukwila Parkway. There are three different orientations to the street for the entry signs - perpendicular, a 45 degree angle at the corners, and parallel where there is no intersection. The height of the signs will determine the required setback from property lines along the public street. Signs need to be setback from a property line a distance that is equal to their height. The location of the sidewalk relative to property lines is not consistent throughout the site and there are no Code required setbacks on the internal drives. In addition, the monument signs at street and driveway intersections will be subject to a vision triangle standard that is established by the curb location so that the sign placement does not interfere with motorists turning visibility. The nonsignalized locations for an AA1 are at the south end of the 61 Avenue S. bridge over I -405 and at the corner of Strander Boulevard and Southcenter Parkway. The applicant proposes placing this nine foot tall sign parallel and setback 9.5 feet from the curb at the south end of the bridge and at a 45 degree angle to the street corner. Narrow sidewalks of 4 -5 feet exist between the curb and the proposed signs. The remaining locations for the AA1 signs are perpendicular to the adjacent public street and sidewalk. The narrow profile of the sign would be perpendicular to the public streetfront/public sidewalk. The long side of the sign will be parallel to any internal sidewalks that extend from the street to the mall building. The smaller entry monument sign AA2, which is approximately six feet tall by seven feet wide, is proposed to be placed perpendicular to the unsignalized entrances. (Sheet 3) There is an approved landscape plan for the south half of the site, where the signs will be placed; however, the AA8, AA1, AA2 and AD1 signs from the Signage Plan are proposed for locations in the north half of the site. Page 6 of 14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan The totem signs, which are two faced signs, are placed along the pedestrian oriented streetfront. The depth of the streetfront on the north side of Lupine Drive varies in from 6 feet to over 20 feet. There are street trees planted in tree pits, landscape pots, low bollards, and pedestrian poles. The five 12 foot tall totem signs will be placed along this drive among the similarly scaled pedestrian light fixtures. Eleven directional signs (AD1 - Sheet 23) are located on the interior of the site, adjacent to interior drives. They are not public streetfront elements but are in some locations adjacent to a walkway. These signs are approximately 3.5 feet wide by 9 feet tall. In depth they are a half a foot. Four are located adjacent to walkways, three of which are oriented perpendicular to the walkway. The signs will be visible below the adjacent tree canopies. The fourth location will be parallel to the northwest corner of Garage B, (J.C. Penney.) The sidewalk width is seven feet at this location, there is no landscaping at this location in the approved landscape plan, a handicap ramp provides exiting of the garage on the west north corner, and pedestrians will be exiting from the garage around the corner on the north side. The final freestanding sign is the "street" sign for Lupine Drive. The clearance under the sign is close to eight feet and its four locations are on the south side of drive along the new south mall streetfront. 2. Relationship of Structure and Site to Adjoining Area. — Findings combined with guideline below. a) Harmony in texture, lines and masses is encouraged; b) Appropriate landscape transition to adjoining properties should be provided; c) Public buildings and structures should be consistent with the established neighborhood character; d) Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged; e) Compatibility of on -site vehicular circulation with street circulation should be encouraged. 3. Landscaping and Site Treatment. a) Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced; b) Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance; Page 7 of 14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan c) Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade; d) In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken; e) Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged; f Screening of service yards, and other places that tend to be unsightly, should be accomplished by use of walls, fencing, planting or a combination; g) In areas where general planting will not prosper, other materials such as fences, walls and pavings of wood, brick, stone or gravel may be used; h) Exterior lighting, when used, should enhance the building design and the adjoining landscape. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. The existing landscape plan for the mall expansion has a plant palette that includes grasses, low shrubs, evergreen shrubs that could act as screens as well as granite boulders and river rock. The extent of the existing plan does not include the entire mall site. 4. Building Design. a) Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings; b) Buildings should be to appropriate scale and in harmony with permanent neighboring developments; c) Building components such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure; d) Colors should be harmonious, with bright or brilliant colors used only for accent; e) Mechanical equipment or other utility hardware on roof ground or buildings should be screened from view; f) Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design; Page 8 of 14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan g) Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. The proposed wall signs are relevant to this guideline. How does the proposed sign relate to the building in terms of proportion, placement, materials? Is the sign hardware adequately screened? As an accessory to the building's design is the sign harmonious? There are two types of wall signs proposed for the project. The "Westfield" name in red with a distinctive font style such as AA3, AA6 and AA7 and the "brand alliance" signs as shown on Sheet 2. Design details for these wall signs are on Sheets 16, 17, 18, 19, and 20. The "Westfield" signs are placed on all sides of the mall building including the garage sections. The signage consists of red channel internally illuminated letters with hidden mounting. The new red letters will replace the white lettering on the north, east and west mall entrances. The "Westfield" sign will also be placed over the three entrances on the south side, on the bridges connecting the garages to the retail shops, and the garages themselves. Sheet 11 indicates in plan view where there are existing "Westfield" signs. Sheets 12 and 13 are photographs of the north, east, and west entrances, where the new red "Westfield" lettering will be replace the existing white letters. The brand alliance signs consist of an aluminum frame that will hold the changeable copy. An uplight attaches to the frame to illuminate the graphic at night. The graphic itself will be a vinyl Sunbrella -like material. There will be two types of orientation — vertical and horizontal. The City will issue a permit for the frame location and size and Westfield will be allowed to change the display when they choose. The parameters for the sign are that it advertise businesses that are located on site or goods that are sold on site. The details on illumination and framing for the "brand alliance" signs are on Sheets 25 and 26. 5. Miscellaneous Structures and Street Furniture. a) Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale. b) Lighting in connection with miscellaneous structures and street furniture should meet the guidelines applicable to site, landscape and buildings. All of the freestanding signs have the vertical tubing components that are then paired with the larger horizontal mass of the sign area. Painted, round, aluminum tubes used for poles and sign background mimic the vertical accent elements on the windows of the mall and the vertical tile accents on the mall south wall. A two thirds to one third relationship is designed Page 9 of 14 • • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan into the larger freestanding signs. The horizontal orientation of the major freestanding signage reflects the horizontal massing and banding on the mall's exterior elevations. Color and typeface are consistent throughout the applicant's proposal. The "Westfield" name is consistently red with the duplicate font used on all signage. The two monument signs - AA1 and AA2 - used at the entries vary only in size. The channel letters spelling "Westfield" are internally illuminated and have a matte finish. Both signs incorporate a sign cabinet on the lower third of the sign using push through letters with the "Southcenter" name. The two faced AF1 and AD1 signs (Sheets 23 and 24) that are used on the circular internal street use reflective vinyl graphics rather than external or internal lighting. Color and materials are the same with modified layout and shapes. The five totem signs are two feet wide by 12 feet tall and arrayed along "Lupine Drive," which is the area along the mall driveway immediately in front of the expansion area that is generally between the two garages. A sandblasted glass box is wrapped in an aluminum frame that will have various spacing and horizontal sized muntins. Sign cabinets are placed on the totem. The five totem signs are sited along "Lupine Drive." In addition to the specific criteria of the Board of Architectural Review, proposed development must show consistency with adopted plans and regulations (18.100.030 TMC.) Below are the specific policies from the adopted Comprehensive Plan that relate to the location of the proposal. COMPREHENSIVE PLAN POLICIES 6. Commercial Areas - Goal 1.7: "Commercial districts that are visually attractive and add value to the community, are visitor and pedestrian friendly, are designed with pride and constructed with quality workmanship, are secure and safe with adequate lighting and convenient access, are uncongested with smooth - flowing traffic patterns, are well- maintained with adequate streetscape landscaping, and are wholesome and in harmony with adjacent uses ". Rocks and low groundcover are indicated at the base of the signs that are not a part of the pedestrian streetfront along Lupine Drive. Landscaping exists or will be placed in most sign locations. Some of the signs along Southcenter and Tukwila Parkway will need plans that show the creation of landscape islands to incorporate plantings around their base. The totem signs (Sheet 22) are constructed of a sandblasted glass box wrapped in an aluminum frame and placed on a stone base to match the building exterior. Tukwila Urban Center (TUC) - Goal 10.2 "Encourage and allow a central focus for the Tukwila Urban Center, with natural and built environments that are attractive, functional, and distinctive, and supports a range of mixed uses promoting business, shopping, recreation, entertainment, and mixed use residential opportunities:" a) Wherever possible, the development provides an interior vehicular connection between adjacent parking areas (10.2.4). b) The development should be designed with an appropriate scale and proportion; pedestrian- oriented features and street front activity areas, such as ground floor windows, modulated facades, rich details in materials and signage; quality landscaping; an appropriate relationship to adjacent sites; an overall building quality; and with sensitivity to important features such as Green River and Tukwila Pond (10.2.7). c) Parking areas should be designed with appropriate screening, landscaping and corner site /parking relationships (10.2.6) d) The development should achieve a high - quality design; contribute to the creation of hospitable pedestrian environments through site design techniques, such as integration of architectural /site design /landscape elements and co- existence of auto /transit /pedestrian traffic; should be designed to maximize pedestrian safety and convenience; and should incorporate physical and natural elements that enhance the area's overall aesthetic, including street orientation (10.2.3). Modulation in the signage exists because of the layering quality in most of the signs and the offsets within the signs. For example on the entry signs there are the horizontal bands the frame "Southcenter" that extend beyond the cabinet. The top two thirds are setback Y4 inch from the bottom cabinet. The entry signs have letters that are pushed through the background material creating relief. The directional signs appear to be woven onto the vertical poles. Page 11 of 14 • Staff Report to the Board of Architectural Review L07 -007: Westfield Southcenter Exterior Sign Plan The Board of Architectural Review, pursuant to Tukwila Municipal Code (TMC) Section 18.108.040, and upon finding of the facts above, hereby makes the following conclusions under the city's Design Review Criteria (18.60.050 TMC) and Determination of Consistency with Adopted Plans and Regulations for type 4 approvals (18.100.030 TMC.) DESIGN REVIEW CRITERIA 1. Relationship of Structure to Site. Whichever freeway interchange sign is chosen by the applicant, it will be unobservable in the City's streetscape, if the pole is adequately landscaped. Additional landscape areas will need to be created in the parking area in order to accommodate new signs on the north half of the site. When the entry signs are placed parallel to a sidewalk or facing a corner, the setback of each sign becomes an important pedestrian scale element. The face of the signs should be setback at least five feet from the back of any sidewalk. Any side or angled portion of these signs should be a least three feet from the back edge of a sidewalk. 2. Relationship of Structure and Site to Adjoining Area. Appropriate landscape transitions to adjacent areas can be maintained. Additional landscape areas will need to be created in the north half of the site. 3. Landscaping and Site Treatment. The proposed plant palette in the approved landscape plans can provide screening of the freeway interchange sign base and allow appropriate transitions on the remaining freestanding signs. 4. Building Design. CONCLUSIONS As has been discussed under project description, the character of the suburban mall is changing. The Southcenter expansion includes parking garages and storefronts along the exterior walls, which is different from the original model. The 85 acre site is filling in with buildings. Monument signage that is well designed, situated and landscaped is an attractive model for typical suburban setting where there are significant landscape areas. In this type of setting, wall signs or well designed "pole" signs that have attractive and distinctive bases become more important and useful. The wall signs are well designed, balanced, scaled appropriately and situated harmoniously on the walls. 5. Miscellaneous Structures and Street Furniture. The applicant has created a comprehensive signage plan for the project. Materials colors and design motifs are carried throughout the variety of signs that are proposed. When proposed for illumination, internal illumination is included, except for the brand alliance signs. The lighting for the brand alliance signage are restrained and integrated with the framing around the signs. The lighting on the illuminated signs is multi - dimensional. The bottom half illuminates the letters from behind and the top half has a softly lit background of the white plastic with the Westfield name in relief, similar to the lettering on the lower third. COMPREHENSIVE PLAN GUIDELINES. 6. Commercial Areas Goal The proposed signs will be visually attractive and add value to the community. Typical landscaping should be in keeping with the proposed plant palette of the approved landscape plan. 7. Tukwila Urban Center Goal All of the signs are multi - dimensional and contain common elements between them. The scale of the AA1 and AA2 monument signs are large enough that the siting of the signs will affect the quality of the pedestrian environment along the streetfront and any adjacent walkway. Sufficient distance from the sidewalk with appropriate landscape transition will be important. A central feature of the Southcenter design is the creation of a vibrant, retail oriented, pedestrian friendly street, oriented to the south of the project. The composition of the south facade as a series of buildings, the articulation of the massing, the use of a variety of materials and extensive glazing are critical to successfully realizing this goal. Equally critical is the signage. The quantity of site and building signage is very restrained relative to the scale of the project. The scale of the signs in relation to the site and building are modest and respectful of the architecture and aesthetic treatment of the building compositions. The signage is an important layer of detail and articulation to the buildings, conveying an appropriate level of festivity, and accent. Signage materials and colors were chosen to complement the architecture as well as the surrounding environment. The forms developed for the signage were designed to be abstract representations of elements found in the natural world. The composition of these forms change from the exterior to the interior of the mall to coincide with the project's theme of a journey through a metaphoric landscape that transitions from shore to land. For example, the irregular repetition of vertical poles, incorporated into the entry monument at the project's perimeter, represents reeds found near the shore while the glass sign panel references water. Our analysis is set forth below. I. Applicable Signage Code. Pursuant to Section 3.3 of the Development Agreement Between the City of Tukwila, WEA Southcenter LLC, and Prudential Financial Inc., For the Expansion and Renovation of Westfield Southcenter Mall dated December 23, 2005, Westfield is vested to the provisions of the City's Signage Code that were in effect on October 6, 2004, the issuance date of the EIS for the project (referred to herein as the "2004 Code" or the "Code "). The analysis set forth in this letter is based on the text of the 2004 Code. II. TMC §19.32.140 Does Not Apply to Southcenter Mall. TMC §19.32.140 of the 2004 Code is set forth within the portion of the code addressing "Commercial Zones." It is entitled "Commercial Zones Where Signs Will Face or Abut Other Commercial or Industrial Zones, Except as Provided in Section 19.32.150 through Section 1 Your email cites to TMC §19.32.140(E) of the current code. Because of Westfield's vesting, this code section does not apply. However, we have confirmed that the text of TMC §19.32.140(D) of the 2004 Code is identical to TMC § 19.32.140(E) of the current sign code. As such, our analysis herein addresses TMC § 19.32.140(D) of the 2004 Code. Southcenter Mall is one of these specific types of commercial uses. As a planned shopping center, Westfield's mall is governed by TMC § §19.32.150 and 19.32.155. Accordingly, it is expressly excluded from the application of TMC§ 19.32.140. TMC §19.32.150 establishes provisions for wall mounted signs for individual business at a mall. TMC §19.32.155 governs identification signs for the shopping center. It provides that a shopping center may have a total of 300 square feet of signage per abutting street. TMC §19.32.155 recognizes that these signs may be freestanding signs. There is no limit established for the number of free standing signs for a shopping center!' In sum, the provisions of TMC §19.32.140(D) are inapplicable and do not govern Westfield. III. Southcenter Mall is Also Entitled to Up to Three Freeway Interchange Business Signs. In addition to being allowed shopping center identification signs pursuant to TMC §19.32.155, Southcenter Mall is also a "freeway interchange business" as defined in TMC §19.08.080. As such it is also entitled to install freeway interchange business signage pursuant to TMC §19.32.180. TMC §19.08.080 defines a "freeway interchange business" as follows: "Freeway interchange business" means a business located within the areas designated on Exhibit A of this ordinance, situated within a radius of 1,000 feet from the freeway entry/exit point or industrial zone but not separated by a physical barrier from the entry/exit inter - section. The freeway interchange sign is primarily oriented to the passing motorist on the adjacent freeway, and shall identify businesses such as regional shopping malls, eating, lodging or service station facilities that serve the traveling public. No wall- mounted sign can be classified as a "freeway interchange business" sign. This provision states that "the freeway interchange sign is primarily oriented to the passing motorist on the adjacent freeway." This Code language associates a freeway interchange sign with the adjacent freeway. It therefore follows that a business facing two freeways and located within two separate freeway entry/exit points on two freeways is entitled 2 These specific uses include Planned Shopping Centers (Mall) (§ §19.32.150 and 155), Service Stations ( §19.32.160), Industrial Zones 019.32.170), Freeway Interchange Businesses ( §19.32.180), and Hotels 019.32.190). 3 The only application of TMC §19.32.140 for malls is that a business located on the perimeter of a mall, in a separate building, is allowed its own freestanding sign and that sign is governed by TMC §19.32.140E. Exhibit A to TMC §9.08.080 (copy attached) designates the areas that fall within a 1,000 -foot radius of a freeway entry/exit point. 5 Page three of Exhibit A zooms in on the area surrounding Southcenter Mall and shows portions of three independent overlapping circles. Each of these circles corresponds to a separate freeway entry/exit point off of 1 -405 and I -5. Because Exhibit A identifies a separate 1,000 -foot radius for each of the three freeway entry/exit points, it demonstrates legislative intent that a business located within any one of these areas is entitled to install a freeway interchange business sign oriented to travelers adjacent to that entrance /exit. Accordingly, since a portion of Southcenter Mall is located within each of these three 1,000 -foot areas, Westfield is entitled to install three separate signs. As indicated in its signage application dated February 7, 2007, Westfield has currently sought only two freeway interchange business signs, one on the north side of the mall near the entry/exit point off of 1 -405 and one on the west side of the mall north of Exit 154 -B off of 1 -5. Because these signs will be oriented to passing drivers on two different adjacent freeways and are located in proximity to these two separate freeway entry/exit points, Westfield is entitled install both of these signs under the applicable regulations. TMC §19.32.180 addresses the message area and height for each freeway interchange sign. It contains no limitation on the number of freeway interchange signs that any one business may install. From our meeting it has been stated that Westfield's position on freeway interchange signage is that we should be allowed up to 3 freeway interchange signs at the sizes authorized by TMC 19.32.180 and that those signs should not be counted against the identification signs for the Center as a Whole under TMC 19.32.155. I appreciate your explanation as to why you disagreed with our position. We are considering the 3 options that you outlined for us regarding freeway signs. If one of these options is acceptable, we will have resolved this issue. We are reviewing the three options internally and may identify another option and trust that you will remain willing to work with us to seek a mutually acceptable solution. However, part of my responsibility to Westfield is to be sure that Westfield preserves it legal rights to challenge a city decision in the unlikely event that we cannot find a mutually acceptable solution. I will therefore need to understand the City's position on the April 27, 2007 BAR decision on our sign package which included the following condition: "Adequately screen the base / pole of the chosen freeway interchange sign." My understanding is that the scope of the BAR's review was for design review only and not sign code compliance. The focus of the above condition was clearly on design -- screening at the sign base. However, by the use of the term "chosen" it could be interpreted that the BAR was also making a decision to grant only one freeway interchange sign. I do not read the condition in this way, but if the City's reading of the BAR decision is to limit the number of freeway interchange signs to only one sign, Westfield may need to appeal that condition to preserve its options while we review the options presented yesterday as well as other possible alternatives. The BAR decision states that an appeal must be filed by May 18, 2007, however, my understanding of the code indicates that the deadline is May 11, 2007. My preference is not to appeal the BAR decision. If you can confirm in writing by tomorrow afternoon that the BAR decision did not decide the number of allowed freeway interchange signs but only that the base of any such signs would need to be screened, then there would be no need to appeal the decision. This email follows up on some of the questions that were raised at our meeting. 1. The AD1 signs without the "Westfield" will not qualify as internal information signs because they would have business names and are too big. (19.22.040 TMC) I don't know of any other way to not count them as signs. The issue here was not that the signs don't count as freestanding signs (we would still indude them in the calculation for freestanding signs), it was to find a way to not count them as a "Westfield ID" sign. If the Westfield name does not occur on these signs, it would seem illogical to count them as Westfield ID signs. 2. The pedestrian light standard that Westfield is installing is about 12 feet, so I think the restaurant totem should not be more than 12 feet. We will reduce the pylon to 12 feet. 3. When I look at the site plan, the angled north wall of Garage B is not visible from the western perspective nor does it appear to be part of the west wall and therefore it's area should not be included in the calculation for that wall. That being said, you may also install signage there that is not visible from Baker BL. OK, but see above for discussion of combined wall area. 4. I am researching what I was told regarding appealing a Sign Code interpretation. It is not discussed in the Sign Code itself - so the City must decide if by extension there is some process that makes sense that should be allowed. The EBF will be calculated in one of two ways, depending on the location of the public entrance(s) available to a given business. 1. Tenants with Individual Exterior Public Entrances Those tenants having one or more exterior public entrances fronting public streets (serving as either the only public entrances for that business or in addition to common area entrances) may treat each of their exterior walls as individual EBF's. The allowable sign area for each EBF will equal the area of a given exterior wall of their particular tenant space, as shown in an elevation drawing, multiplied by 6 %. No allowable sign area may exceed 500 square feet per exterior wall and no one sign may be more than 50% of the allowable area of that exterior wall without approval under a Type 2 decision. If the allowable sign area for a given EBF is maximized, no additional signage will be permitted on that EBF. Allowable sign area for an EBF may not be counted more than once or transferred from one EBF to another. Each tenant is permitted a maximum of four signs with not more than one sign for any particular tenant on any one EBF. 2. Tenants Having No Individual Exterior Public Entrances Tenants having public entrances which are only accessible from interior common areas are eligible for signage on certain portions of exterior walls. The available sign area for such a business is determined as follows: The entire building face in question (as shown in an elevation drawing) shall be measured to obtain its total area or EBF. This EBF may also include common area walls covering public entrances. The total exterior wall area of all tenants having individual exterior public entrances (in that elevation) shall be subtracted from that EBF. The balance remaining, in square feet, shall be multiplied by 6 %. Confusion has existed regarding the method for calculating EBF and allowable sign area for Planning Shopping Centers. The implementation of the Amortization Program has created a need for clarity in this part of the Sign Code. Specifically, the definition of EBF provides a choice regarding its application, stating that EBF represents "that portion of the building exterior wall or tenant space wall area of the building" (TMC 19.08.060). Additionally, that portion of the Sign Code dealing with Planned Shopping Centers (TMC 19.32.150) states that "the total allowed signage for any building face shall be equal to 6% of the exposed building face area on which the signs are to be placed . . ." What is the iustification of the interpretation? The definition of Exposed Building Face provides three different options (for calculation purposes) from which to choose: 1. That portion of the building wall fronting on the principal public street from which the building has access; or 2. Given the size, location and function of the major anchor tenants at Southcenter (Nordstrom, The Bon, Mervyn's, JC Penny and Sears) they enjoy separate exterior public entrances from the rest of the tenants. Due to their location at the perimeter of the mall, a few smaller tenants also have separate exterior public entrances. In these instances, Option 3 above applies. The public access for the remaining tenants is provided from the common mall areas. Some of these tenants do not have any exterior walls bounding their tenant space. Additionally, only a few of these tenants have exterior wall signage. In these instances, Options 1 and 2 above apply.
