The subdivision title only allows for one extension of not more than one year; therefore, your application for a three lot short plat has expired as of June 20, 2009. The City of Tukwila Public Works Department recently received an application for the permit to construct short plat infrastructure including utilities and access (Tukwila file number PW09 -087). The construction permit cannot be reviewed for the property without an active short plat that has received preliminary approval. In order for us to review your Public Works infrastructure permit; you will need to obtain preliminary approval for the underlying short plat. Please note that the City of Tukwila will be adopting new stormwater regulations in 2010 that may change the stormwater requirements under which the previous preliminary approval was obtained for the GHR short plat. The Notice of Decision for this Short Plat preliminary approval was dated June 20, 2007. Preliminary approval conditions have been worked on and many of them completed. The existing home has been demolished and will not be shown on the survey map. A geotechnical report for onsite infiltration was completed and field information analysis resulted in not recommending individual onsite storm water drainage infiltration system for each lot. Engineering construction plans towards final plat approval are being worked on and should be submitted to the city within several weeks. The requested one year extension would allow sufficient time to complete and submit the engineering construction plans for approval leading to plat construction and final city approval and subsequent recording. Mullet, Mayor Department of Community Development Steve Lancaster, Director The Short Subdivision Committee has completed review of your short plat application (No. L07- 010), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. 2. Apply for traffic concurrency certificate prior to the final plat approval. Utilities and undergrounding of power shall be constructed/installed as part of the building permit for each lot. The extension of sewer and water lines to the lots shall be approved by the appropriate utility district and conform to the Civil Plans prepared by R.N. Parnell Company received by the city on February 14, 2007. A Street Use Permit will be part of the building permits and require bonding, insurance, and a Hold Harmless Agreement; for work within the Public Right -of -Way. The applicant shall obtain sanitary sewer stubs to individual future lots. Applicable fees shall be paid to Valley View Sewer District at the time of construction. The applicant shall obtain a permit from Water District 125 for tapping into the water main to install water service /water meter to each of the future lots. Applicable fees shall be paid to WD #125 at the time of construction. 4. Due to pavement disturbance for installation of utilities (sewer, water, power, telecommunications) a pavement mitigation fee will be assessed by Public Works as part of Public Works Type C construction permit. 5. Please submit easement legal description/maintenance agreement or separate tract legal description (metes and bounds) with maintenance agreement for joint driveway area, as a separate 81/2x 11 document with a 1" margin all the way around. It is preferred that you set it up as an easement. Please reevaluate the existing topography, flat area in the immediate vicinity of the existing driveway might be more suitable for joint access. 6. Please submit geotechnical information/perc test to verify the future homes can have individual infiltration systems. If not a joint storm drainage system shall be constructed prior to final approval. 7. The final grading plan must show a flat area below rescue windows for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses please contact the Tukwila Fire Marshal's office. 8. Any significant trees that shall be removed from areas that have 15% slope or more are subject to replacement trees according to the ratio stated under TMC 18.54.130. Any replacement trees that shall be planted to meet Tree Ordinance requirements shall be shown on the site plan along with the building permit submittal. 9. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: 1. A survey map as described in the application checklist that is consistent with all of the conditions of approval and revised per the attached redlined map. The surveyor's original signature must be on the face of the plat. 2. Separate easement/maintenance agreement document with legal descriptions for any common access /utility infrastructure. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (07/11/2007). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $105. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval APPEALS The next step is to install the required site improvements, comply with the conditions of approval and submit the necessary short plat documents (survey, legal descriptions, and other required paper work). You may apply to delay installation of the site improvements up to six months beyond final approval subject to the approval of the Public Works Director. A financial guarantee must be provided to ensure installation. All taxes and fees assessed against the property must be current prior to final approval. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by July 20, 2008, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. Notwithstanding any specific assurances which are provided In Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the following: (a) Defects, fens. encumbrances, adverse claims or other matters effecting the title to any property beyond the Ines of the lend expressly described in the description set forth in Schedule (A), (C) or in Pert 2 of this Guaentee, or title to streets, roads, avenues, lanes, ways or waterways to which such land abuts, or the right to maintain therein vaults, tunnels, ramps or arty structure or improvements, many tights err easements therein, unless such properly, rights or easements are expressly and specifically set bah in said description. (b) Deleds, lens, encumbrances, adverse claims or other fishers, whether or not shown by the public records; (1) Mich are created, suffered, assumed or agreed to by one or ogre of the Assureds; (2) which result in no loss to the Assured; or (3) which do not result in the i veidity or potential invafdiy of any Juiota or nor-judicial proceeding which is within the scope and purpose of the assurances provided. GUARANTEE CONDITIONS AND STPULATIONS 1. Definition 4fTorms. The following terms when used in he Guarantee mean: (a) the Assured: the party or parties named as the Assured in Iris Guarantee, or an a supplemental railing executed by the Company. An Assured stall notify the Company promptly in writing in case lmowledge shell cane to an Assured hereunder of arty claim of title or interest which is adverse to the title to the estate or interest as stated herein, and which might cause loss or damage for which the Company may be fable by virtue of uis Guarantee. No Duty to Defend or Prosecute. The Company shall have no duty to defend or prosecute any action or proceeding to which the Assured is a party, nobsdhstardn gg the nature of arty allegation in such action or proceeding. Company's Option to Defend or Prosecute Actions; Duty of Assured Claimant to Cooperate. Even though the Company has mo duty to defend or prosecute as set forth in Paragraph 3 above: (a) The Company shell have the right at is sole option and cost, to institute and prosecute any scion or proceeding. interpose a defense, as limited in (b), or to do any other act which in its opinion may be necessary or desirable to estabish the title to the estate or interest as slated herein, or to estabish he lien rights of the Assured, or to present or reduce loss or damage to the Assured. The Company may lake any appropriate action under the terms of this Guarantee, whether or not it shall be liable hereunder. and shall not thereby concede tiebzty or waive any provision of this Guarantee. If the Company shell exercise its rights under his paragraph, it shat do so dfgerfy. If the Company elects to exercise its optics as staled in Paragraph 4(e) the Company shat have the right to select counsel of its choice (subject to the right of such Assured to object for reasonable cause) to represent the Assured and shell not be table for and wiII not pay the fees of any other counsel, nor will the Company pay any lees, costs or expenses incurred by an Assured in the defense of those causes of action which allege matters not covered by this Guarantee. Whenever the Company shall have brought an action or interposed a defense as permitted by the provisions of this Guarantee, the Company may pursue any litigation to final determination by a court of competent jurisdiction and expressly reserves the right, in its sole discretion, to appeal from an adverse judgment or order. (d) in all cases where this Guarantee permits the Company to prosecute or provide for the defense of any action or proceeding, an Assured shall secure to the Company the right to so prosecute or provide for the defense of any action or proceeding, and all appeals therein, and permit the Company to use, at its option, the name of such Assured for this purpose. Whenever requested by the Company, an Assured, et the Company's expense, shall give the Company all reasonable aid in any action or proceeding, securing evidence, obtaining witnesses, prosecuting or defendng the action or lawful act which in the opinion (b) (c) CLTA Guarantee Conditions and Stipulations (Revised 12/15/95) of the Company may be necessary or desirable to establish the title to the estate or interest as stated herein, or to establish the lien rights of the Assured. If the Company is prejudiced by the failure of the Assured to lumish the required cooperation, the Company's obigations to the Assured under the Guarantee shell terminate. 6. Proof of Loss or Damage. In addition to and oner the notices required under Section 2 of these Conditions and Stipulations have been provided to the Company, a proof of loss or damage signed and sworn to by the Assured shall be furnished to the Company within ninety (90) days after the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe the matters covered by this Guarantee which constitute the basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. It the Company is prejudiced by the failure of the Assured to provide the required proof of loss or damage, the Company's obligation to such assured under the Guarantee shall terminate. In addition, the Assured may reasonably be required to submit to examination under oath by any authorized representative of the Company and shall produce for examination, inspection and copying, at such reasonable times and places as may be designated by any authorized representative of the Company, all records, books, ledgers. checks, correspondence and memoranda, whether bearing a date before or after Date of Guarantee, which reasonably pertain to the loss or damage. Further, if requested by any authorized representative of the Company, the Assured shall grant its permission, in wilting, for any authorized representative of the Company to examine, inspect end copy at records, books, ledgers, checks, correspondence and memoranda in the custody or control of a third party, which reasonably pertain to the loss or damage. All information designated as canidenial by the Assured provided to the Company pursuant to this Section shed not be disclosed to others unless, in the reasonable judgment of the Company, it is necessary in the edndrisbaion of the claim. Failure of the Assured to submit for examination under oath, produce other reasonably requested information or grant pernw.sion to secure reasonably necessary information from third parties as required in the above paragraph, unless prohibited by law or governmental regulation, shell terminate any lability of the Company under this Guarantee to the Assured for that claim. 6. Options to Pay or Otherwise Settle Claims: Termination of Liability. In case of a claim under his Guarantee, the Company shall have the blowing additional options: To Pay or Tender Paymert of the Amount of Liability or to Purchase the Indebtedness. The Company stall have the option to pay or settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured wiiin the coverage of Ills Guarantee, or to pay the full amount of his Guarantee or, if this Guarantee is issued for the benefit of a holder of a mortgage or e lenholder, the Company shall have the option to purchase the indebtedness secured by said mortgage or said fen for the amount owing thereon, together with arty costs, reasonable attorneys' fees and expenses inured by the Assured claimed which were authorized by the Company up to the time of purchase. Such purchase, payment or lender of payment of the full amount of the Guarantee shall terminate all fabilty of the Company hereunder. In he event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness, the owner of such indebtedness shall transfer and assign said indebtedness, together with any collateral security, to the Company upon payment of the purchase price. Determination and Extent of Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of realms upon the assurances set forth in his Guarantee and oily to the extent herein described. and subject to the Exclusions From Coverage of This Guarantee. Limitation of Liability. If the Company establishes the title, or removes the alleged defect, lien or encumbrance, or cures any other matter assured against by this Guarantee in a reasonably diligent manner by any method, including litigation and the completion of any appeals therefrom, it shall have fully performed its obligations with respect to that matter and shall not be liable for any loss or damage caused thereby. Reduction of Liability or Termination of Liability. (a) No payment shall be made without producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. Subrogation Upon Payment or Settlement. ArbtratIon. Unless prohibited by applicable hew, either the Company or the Assured may demand arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration Association. Area of the total parcel is 21,130 square feet (0.48 acres). Assessors Tax Lot No. is 3365900765. An existing home and driveway will be removed for the development located at 5708 S. 142 Street, Tukwila, WA 98168. The proposed development being reviewed for drainage is less than 5,000 square feet of new impervious area. These figures were prepared for this drainage report. FIGURE 1. CONDITIONS AND REQUIREMENTS SUMMARY: Drainage requirements include meeting the core requirements listed below CORE REQUIREMENTS 1. Discharge at the Natural Location: The attached site plan shows the existing and proposed drainage discharge points for the property. There will be no change to the discharge location(s) or adverse downstream impacts. The parcel is less than 22,000 square feet (21,130 sf),. Topography is generally rolling and is considered sloping for drainage considerations. Soil type is Alderwood Series (AgC) and has hydrologic soil characteristics of °C" which is acceptable for infiltration of roof downspout storm water. 2. Offsite Analysis: The Level 1 Offsite Analysis is provided in Section 3. 3. Flow Control: Flow control for the three new lots is proposed by onsite infiltration of roof downspouts. There is no public stormwter system located downslope of 2 this parcel. Driveway runoff from the residences would sheet flow and be dispersed into grass areas with a minimum of 25 feet length prior to offsite flow. 4. Conveyance System: No formal public stormwater conveyance system exists onsite or downslope for this parcel to gravity flow to. The access driveways are private. 5. Erosion and Sediment Control: A TESCP will be prepared during preparation of final engineering plans. Features include clearing limits, sediment fence, construction entrance, protection of stock piled soil material, mulch exposed surfaces, and a construction sequence. 6. Maintenance and Operation: Private roodf downspout infiltration or dispersion systems will be provided for each lot. 7. Financial and Guarantees and Liability: Bond form information for private drainage facilities will be provided during theengineering design approva. 8. Water Quality: There will be less than 5,000 square feet of new impervious area subject to water quality such as driveways and new roads; therefore, water quality facility is not required, however, BMP's will be provided. 3. OFF-SITE ANALYSIS (LEVEL - 1 DOWNSTREAM /OFFSITE): Proposed developments that will have more than five thousand square feet of new impervious surface area requires offsite analysis. A Level ;1 Offsite Analysis is included in this Technical Information Report. The analysis is a qualitative survey of each downstream drainage system leaving a proposed site. This submittal includes an Off -site Analysis Report that evaluates drainage system problems, if problems exists, such as ponding water, high/low flows, siltation, erosion, etc. for the areas defined as upstream, on -site, and downstream of the proposed site. The report provides qualitative information that the proposed project neither aggravates an existing drainage problem nor creates a new drainage problem considering acceptable engineering practices and the normal maintenance on existing public and private drainage systems. TASK 1: STUDY AREA DEFINITION AND MAPS The existing 0.48 acre parcel is located within the SW %, Section 14, Township 23N, Range 4E, W.M. and is accessed off paved South 142 " Sttreet onto a private driveway and is within the urban limits of City of Tukwila, WA. The 0.48 acre parcel is developed with a single family residence which will be removed for the three lot short plat.. Maps and drainage system data used in this off -site analysis included the following: 3 Figure A : Site Map and shows (lot corner elevations) topography with property lines. Figure 2 is a location map, Thomas Bros., showing site location Figure 3 is a copy of the topographic map showing the drainage boundaries. Figure 4 is the Off -Site Analysis Drainage System Table TASK 2: RESOURCE REVIEW A review of existing and available documents that would contain information regarding existing /potential flooding and erosion problems was undertaken for the study. See the enclosed drainage complaint reports received from King County. The city of Tukwila storm drainage map shows the city stormwater infrastructure . There is no downslope public or private stormwate system to serve this parcel. TASK 3: FIELD INSPECTION The site was physically inspected for the existing on and off site drainage system of the study area for each discharge location. The investigation did not find any evidence of known existing or expected potential drainage problems.The location of existing city stormwater infrastructure was field verified. TASK 4: DRAINAGE SYSTEM DESCRIPTION AND PROBLEM SCREENING No existing problems with flooding or erosion were found. No future major problems were identified when standard construction procedures and site stabilization are followed. TASK 5: MITIGATION No special mitigation is recommended at this time based on known and available information when normal /traditional erosion best management practices (BMP) applicable to the site conditions, as noted, are followed. 4. FLOW CONTROL AND WATER QUALITY ANALYSIS AND DESIGN: The total new impervious area is less than 5000 square feet. Area subject to vehicular use is less than 5,000 square feet. There are no known off site flows to be by- passed. The stormwater generated from impervious roofs downspouts run -off will be handled by on -site disposal by infiltration /dispersion. Run off from the private driveways would sheet flow into vegetation for dispersion /infiltration. The drainage intent is to infiltrate impervious areas as much as possible and disperse driveway surfaces. 4 5. CONVEYANCE SYSTEMS ANALYSIS AND DESIGN : Formal public conveyance system will not be needed. Roof downspouts will be tight lined to onsite infiltration /dispersion systems and flows would naturally infiltrate into the Alderwood soils. 6. SPECIAL REPORTS AND STUDIES: Special reports or studies known for this project include this Technical Information Report TIR, and the site topographic map. A SEPA checklist is not required for this three lot short plat. No sensitive areas of streams, wetlands, or slopes over 40% were found on site. 7. OTHER PERMITS: There are no known approvals, besides the City of Tukwila permits. Water and snitary sewer service will be provided by the city of Tukwila. 8. EROSION/SEDIMENTATION CONTROL (ESC) ANALYSIS AND DESIGN: Temporary Erosion Sedimentation Control Plans (TESCP) will be required and will be shown for the existing home removal, construction of the driveways, and installtion of the roof downspout infiltrtion system.
