Investigated with Sandra Whiting and confirmed. Photos. Pre - Notice will be issued. While investigating, we were approached by Julie Thompson, Levitz, 253 -335 -8067, who was involved in hiring the tree cutters. She stated that the sign is not owned by Levitz. ? 2: 10 -06 -06 Mailed Pre - citaiton notice for tree removal without permit. Also received call from Greg Munger of Levitz. I explained the process and the letter he will be receiving. He will cooperate. 3: 10/12/06 Received a call from Greg McKitrick of All Pro Tree Care who did the work at Levitz. He was concerned about not getting paid due to the issue the City has regarding the tree - clearning. I faxed him a copy of the Pre Notice so that he could see the language - and reinforced that any issues regarding his contract to remove the trees (payment thereof) is strictly between he and Levitz. His phone is (253) 569 -7807. 4: 10/17/06 Greg from All Pro Tree Care called (253) 569 -7807, and talked with Sandra about the types of trees that were cut down (doesn't believe any mitigation is required). She suggested Levitz provide a letter from an arborist stating the nature /type of trees, and an expert opinion on whether or not the root system is still in place and the foilage will return (and when). Sandra believes that even if trees are not required on this slope (due to the return of what was cut back), that mitigation should be required by the replating of trees at another site in Tukwila. Greg asked about timing for removal of "rubbish" and I told him he could start cleaning up now, and that more time could be provided, as long as we know he's making progress. Advised him to call when the clean up is completed - extending file two more weeks, tickle for 11/10/06 5: 10/19/06 Received call from Janine Martinez at Visible Graphics asking about the file and status. Told her we had talked with Greg (contractor) yesterday, and she asked for a faxed copy of the tree permit info. Her phone is (818) 455 -5297. told her the file had been extended for two weeks, that Greg was to remove the cuttings /tree branches, etc. and clean up the area, also advised her of the need for a letter from a certified arborist regarding type of trees, etc. so that City could determine mitigation steps. File is already tickled for 11/10/06 6: 11 -1 -06 Received call from Greg (All Pro Tree) asking if we had received a letter from the arborist regarding the number and types of trees removed. Have not received yet. He will contact them and have them fax the letter to me. 7: 11 -3 -06 Received faxed letter from consulting arborist with sketch regarding trees removed. Spoke to Sandra Whiting who indicated that a formal site plan, with contours and notations of each tree and its size that was removed. 8: 11 -6 -06 Spoke to Greg at All-Tree and Janine from Visible Graphics (owner of sign). Explained that the City requires an application be submitted with site plan showing contours, all trees removed, their species and size. Have issued new letter to owner, with copies to Levitz locally, Janine and Greg. Included Notice and Order with compliance date of May 6, 2007 (code allows six months), copy of entire Tree Regulation ordinance, copy of application form and copy of letter from consulting arborist. Tickle for six months. 9: 11 -15 -06 Spoke to Bob Swierbut (Levitz owner representative in New York). They will be submitting for the tree permit by end of this week. 11: 1 -25 -07 Spoke to Christina of Visible Graphics. Property owner is balking at signing the affidavit permitting Visible Graphics to submit the tree clearing permit application. They are still working on it, but apologize for the delay. Compliance date is May 6, 2007. Suggested that she have the owner call me to discuss the issues. 12: 2 -19 -07 Received emal from Christina asking that I help intervene with the property owner to obtain their signature on the affidavit. 13: 2 -23 -07 Sent email to Mr. Brown, Mr. Webber, Robert Swierbut (all representatives of property owner) with copy to Christina at Visible Graphics. Explained the need to obtain property owner's permission to inspect the property (purpose of the affidavit). Mr. Swierbut asked for emailed copy of affidavit for his review. 14: 2 -26 -07 Email from Swierbut expressing concerns about the property owner being unjustly implicated in an illegal matter that their tenant did without property owner's permission. Explained that since the tenant's representative was willing to "make right" by obtaining the permit, it is probably in the best interest of the property owner to allow them to do that. Signature on the affidavit gives the City a limited right to inspect the tree - clearing to make sure that all violations are properly addressed. 15: 3 -2 -07 Swierbut emailed signed affidavit to me. (Crossed out item 2). I notified Christina by email that the affidavit had been signed and submitted. Asked that she let me know when to expect the remaining documentation. 16: 3 -06 -07 Received completed application from Visible Graphics. Forwarded to planning for review and processing. 17: 5 -3 -07 Email request for one 30 -day extension to complete. Granted. No more extensions. New compliance date is 6 -6 -07. 18: 5 -10 -07 Received emailed plan of tree replanting from Christina at Visible Graphics. Will inspect the site to determine if compliance is achieved. 7 97 - 517..)7 Sandra Whiting inspected the hillside and determined that the trees have been properly placed. This file can be closed. Your arborist, Bruce Mac Coy, has proposed to simply leave the tree stumps to resprout. Unfortunately that does not meet the requirements of our Tree Ordinance for steep slope areas. Cottonwood trees are excluded from our defmition of significant tree and therefore do not require replacement. However the other eight trees would require replacement according to the chart at TMC 18.54.130 3 b. I calculate that sixteen replacement trees are needed, assuming that tree 27 is actually 12 inches in diameter rather than the 12 feet shown on the plan. In order to be a complete application a tree replacement planting plan showing the size, species and location of each of the replacement trees must be submitted. In addition a plan for temporary irrigation and a one year survival guarantee will be required.
