Dear Mr. Nieder,
The City of Tukwila received your letter dated November 27, 2007 requesting that the
Department of Community Development (DCD) place a 90 -day hold on issuing decisions
for permits including a 9 lot boundary line adjustment (L07 -026) and SEPA
environmental review (E07 -007).
It is my understanding that a 90 -day hold is requested as the result of negotiations with
the current property owner and Burlington Northern Santa Fe (BNSF) to sell the property
that is the subject of the above listed land use applications. You have expressed that
placing a hold on issuance of a decision for pending land use applications would allow
you the time you need to determine whether you would like to either continue to pursue
the 9 -lot boundary line adjustment and associated environmental review, or to formally
withdraw these applications.
Washington state law requires that a decision on a land use application by issued within
the time period established by local ordinance. The time period established by the City of
Tukwila is 120 days from the date the applicant is notified that the application is
complete. By making a request to place a 90 -day hold on the above mentioned
applications, thus preventing the City of Tukwila from meeting the 120 day time
requirement, you agree to release the City of Tukwila from liability for any damages
related to your request. With this understanding, I will put a 90 -day hold on pending
applications L07 -026 and E07 -007 as of the date of your letter of request (November 27,
2007).

As we discussed via telephone earlier today, we would like to Request a 90 Day
Hold on our 9 lot boundary line adjustment (BLA) request.
As you know, we are currently in negotiations with Burlington Northern Santa Fe
(BNSF) to sell them the subject property. At this . point in time, should BNSF
purchase our property, they would prefer that the BLA application be left in it's
current position — on the doorstep of being approved but not yet approved.
I am confidant that in 90 days from the date of this letter we will have either
completed the sale to B NSF or the deal will be dead and we will choose to
complete the BLA.

Dear Mr. Nieder,
Due to recent meetings held related to your property located at 12522 51 Place S, the
City of Tukwila is requesting clarification as to whether you would like the Department
- of Community Development to move forward and issue decisions including SEPA and a
request for a Boundary Line Adjustment.
On September 27, 2007, City of Tukwila staff met with you and Jason Legat to discuss
the possibility of a rezone of the property from Low Density Residential (LDR) to
Manufacturing Industrial Center/Heavy (MIC/H). On October 30, 2007, City staff met
with representatives from BNSF to discuss the potential rezone of the property as well.
It was staff's opinion during both meetings that a rezone for the property in question is
unlikely, given the site's location within an LDR zone and the significant change in use
that would be permitted with a rezone of the property to MIC/H.
Please provide a written response by November 28, 2007, stating whether you would like
the Department of Community Development to either proceed with issuing a decision on
applications pending for 12522 51 Place South, or whether you would like to withdraw
your applications. If no response is received by November 28, 2007, we will proceed
with processing your applications. If you decide to withdraw your applications please

Enclosed please fmd four copies of the BLA plans and supporting documents. The BLA plans and supporting
documents have been revised in accordance with your August 20, 2007 comment letter as follows:
Planning Division of DCD
1. The SEPA checklist has been revised (the items circled in red) to reflect the foreseeable impacts of the nine
future Building Permit activities.
SEPA E -07 -007
The SEPA checklist Environmental Elements section was revised to include the statement regarding the Pacific
Flyway.
Boundary Line Adjustment — L07 -026
1. The owner is submitting the Transportation Concurrency Test Fee.
2. The owner is providing a completed Traffic Concurrency Certificate Application
3. As discussed with David McPherson, the private sanitary side sewer easements shown on the BLA plan
redlines are unnecessary because the side sewers can be constructed within the 10' easement fronting the
lots (see Davido Consulting Group, Inc. civil engineering plans submitted previously).
4. The owner is submitting the completed Joint Side Sewer & Hold Harmless Agreements for the necessary
Lots (Lots 1 and 2, Lots 3 and 4, and Lots 8 and 9).
5. The Private Utilities Easements have been revised per the redlined comments and the owner has signed the
easements with a notary.
Boundary Line Adjustment Survey Site Plans
1. The Boundary Line Adjustment Survey Site Plan sheets have been revised per the redlined comments
except the additional private easements were not necessary (see above).

Your application for a 9 -lot Boundary Line Adjustment located at 12522 51 Pl S has been found to
be incomplete. In order to be a complete application, the following must be submitted to the permit
center:
a. Recording Document, including all items (a) — (j) as outlined in the Complete Application
Checklist for a Boundary Line Adjustment.
b. Storm drainage design at least 90% complete, which meets the King County Surface Water
Design Manual (KCSWDM). Include a Technical Information Report (TIR) including
feasibility analysis if required by the Manual. Call out total existing and proposed
impervious surface in square feet. Include all storm drainage conveyance systems, water
quality features, detention structures, maintenance access and safety features. For additional

Upon receipt of these items, the City will re- review them for completeness and will mail you
written notification of completeness or incompleteness within 14 days.
These applications will expire if we do not receive the additional information within ninety days of

Upon notice of a complete application, a 4' x 4' public notice board must be provided on site within

the building will be within 150 feet from the nearest fire hydrant.

Dear Jack Paco and Jamie Reavis,
Thank you for your time this week dealing with the demo permit for our house at 12522 51st
P1 South in Tukwila. As I mentioned on the phone our house is a safety hazard and needs to
be torn down immediately. A few months ago, a hot water pipe had burst filling the house
with a fine mist. Because the house was vacated, this was not detected for weeks. As a
result, the entire house started to sweat, and was filled with black mold on the outside
and deep within the walls. It would be too costly to repair the damage so we have no
choice but demo the house.
Even though we boarded up the house and had the power shut off, we have had many break -ins
by teenagers. with the toxic mold issue and parts of the floor removed, we are afraid
someone is going to get hurt and /or sick because of the house.
With all of this said, we would ask you to allow the demo permit # D07157 to coo through
under the WAC emergency guide line 197 -11 -880.
"WAC 197 -11 -880 Emergencies. - Actions that must be undertaken immediately or within a
time too short to allow full compliance with this chapter, to avoid an imminent threat to
public health or safety, to prevent an imminent danger to public or private property, or
to prevent an imminent threat of serious environmental degradation, shall be exempt.
Agencies may specify these emergency actions in their procedures."

This Agreement made and entered into this day of , 2007, by and
between the GRANTOR, 12522 51' PI S, LLC, a Washington State limited liability company,
owner of Parcel 1, and GRANTEE, 12522 51 P1 S, LLC, a Washington State limited liability
company, owner of the Parcel 2 and their heirs, successors and assigns. Hereinafter referred to as
the GRANTOR and the GRANTEE respectively.
WHEREAS, the GRANTEE has requested a variance to Tukwila City Code 14.12.150, for
the establishment of a single side sewer to service two buildings; and
WHEREAS, the City of Tukwila has granted this variance conditioned upon the recording
of a joint side sewer and hold harmless agreement between the GRANTOR and the GRANTEE,
owners of Parcels 1 and 2 as described above; and
WHEREAS, Parcel 1 and Parcel 2 share a common side sewer located within the City Right -
of -Way of 51 ST PL South, and
WHEREAS, Parcel 1 and 2, have the potential to impact the flow of wastewater from the
structures located upon three parcels, such that damages may result to either parcel from the other.
The GRANTOR and the GRANTEE do hereby agree as follows:
JOINT SIDE SEWER
The GRANTOR and the GRANTEE shall be solely responsible for the maintenance and
repair of the sewer line running from the structures on their parcels to the joint hookup
connection , located within the City Right -of -Way of 51s` PL South. Site location map
attached as Exhibit `A -1', and sketch of sanitary side sewer location attached as
Exhibit `A -2' and incorporated herein by this reference.
Both the GRANTOR and the GRANTEE shall be jointly responsible on an equal 50/50 basis
for the maintenance, operation, and repair of the shared side sewer lateral that extends sewer
service from the City of Tukwila's sanitary sewer main to and including the joint hookup
connection of the two parcels' private side sewers.
Both the GRANTOR and the GRANTEE shall be jointly responsible on an equal 50/50 basis
for damages that may occur upon said properties due to improper maintenance, operation or
repair of the shared side sewer lateral that extends sewer service from the City of Tukwila's
sanitary sewer main to and including the joint hookup connection of the two parcels' private
side sewers.
The GRANTEE and the GRANTOR shall have the right to establish a backwater valve upon
their private individual side sewer to protect against sewage backups.
This Section is an appurtenant to this Agreement and shall run with the land; and the terms
thereof shall be for the benefit of the GRANTEE, GRANTOR, its heirs, successors and
assigns, and shall be binding upon, GRANTEE, GRANTOR, its heirs, successors and assigns.

HOLD HARMLESS
The GRANTEE agrees to hold harmless, indemnify and defend the CITY OF TUKWILA, its
officials, members, employees, and agents from all liabilities, penalties, costs, losses, damages,
expenses, causes of action, claims, demands, or judgments, including reasonable attorney's
fees, arising from or in any way connected with any claim or cause of action including, without
limitation, the properties to the fullest extent permitted by law. Furthermore, GRANTEE
agrees to indemnify, hold harmless and defend the CITY OF TUKWILA from and against any
liabilities, penalties, costs, losses, damages, expenses, causes of action, claims demands or
judgments, including, reasonable attorney's fees, arising from or relating to any third party
claim which challenges GRANTEE'S and GRANTOR'S right to execute and deliver this
Agreement.
THIS AGREEMENT is given without cash consideration, and is for the purpose of legally
establishing an understanding for the use of a single side sewer to serve two parcels.
THIS AGREEMENT shall be a covenant running with the above - described real properties and
burden said real estate, and shall be binding on the successors, heirs and assigns of all parties
hereto.

agrees to indemnify, hold harmless and defend the CITY OF TUKWILA from and against any
liabilities, penalties, costs, losses, damages, expenses, causes of action, claims demands or
judgments, including, reasonable attorney's fees, arising from or relating to any third party
claim which challenges GRANTEE'S and GRANTOR'S right to execute and deliver this
Agreement.
THIS AGREEMENT is given without cash consideration, and is for the purpose of legally
establishing an understanding for the use of a single side sewer to serve two parcels.
THIS AGREEMENT shall be a covenant running with the above - described real properties and
burden said real estate, and shall be binding on the successors, heirs and assigns of all parties
hereto.

ADDITIONAL PROTEC'T'ION ENDORSEMENT FOR HOME OWNERS
1. This endorsement shall be effective only if at date of policy there is located on the land described in the policy a
one -to -four family residential structure, in which the insured owner resides, either at date of policy or within one
year of the date of policy, as the insured owner's principal residence. For the purpose of this endorsement the term
"residential structure" is defined as the principal dwelling structure located on the land, together with a garage or
carport used for storage of noncommercial vehicles. The term "residential structure" shall not include detached
outbuildings (other than a garage or carport as defined herein), driveways, walkways, boat ramps, docks,
recreational facilities of any kind, subsurface lines, pipes, tanks, septic systems and /or drainfields, plantings of any
nature, perimeter fences or perimeter walls, or any other improvements which are not an integral part of the
residential structure.
2. The Company hereby insures the insured owner against loss or damage which the insured owner shall sustain by
reason of:
A. The existence at Date of Policy of any unrecorded statutory liens for labor or materials attaching to the estate or
interest arising out of any work of improvement on the land in progress or completed at the date of policy,
except those liens arising out of a work of improvement for which the insured has agreed to be responsible.
B. The removal of the residential structure or interference with the use thereof for ordinary residential purposes as
the result of a final court order or judgment, based upon the existence at the Date of Policy of:
(1) Any encroachment of the residential structure or any part thereof onto adjoining lands, or onto any
easement shown as a special exception in Schedule B of the policy, or onto any unrecorded subsurface
easement;
(2) Any violation on the land of enforceable covenants, conditions or restrictions provided that this coverage
shall not refer to or include the terms, covenants and conditions contained in any lease, sub -lease or contract
of sale referred to in this policy;
(3) Any violation of applicable zoning ordinances to the extent that such ordinances regulate (a) area, width or
depth of the land as a building site for the residential structure; (b) floor space area of the residential
structure; (c) setback of the residential structure from the property lines of the land; or (d) height of the
residential structure.
C. Damage to the residential structure resulting from the exercise of any right to use the surface of the land for the
extraction or development of the minerals shown as an exception in Schedule B, or excepted from the
description of the land.
For the purposes of this endorsement, the words "covenants," "conditions" or "restrictions" shall not be deemed to refer
to or include any covenants, conditions or restrictions relating to environmental protection, except to the extent that a
notice of violation or alleged violation affecting the land has been recorded in the public records at Date of Policy and is
not excepted in Schedule B.
This endorsement is made a part of the policy and is subject to all of the terms and provisions thereof and of any prior
endorsements thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the

HOMEOWNER'S INFLATION PROTECTION ENDORSEMENT
The Company, recognizing the current effect of inflation on real property valuation and intending to provide additional
monetary protection to the Insured Owner named in said Policy, hereby modifies said Policy as follows:
1. Notwithstanding anything contained in said Policy to the contrary, the amount of insurance provided by said
Policy, as stated in Schedule A thereof, is subject to cumulative annual upward adjustments in the manner and
to the extent hereinafter specified.
2. "Adjustment Date" is defined, for the purpose of this Endorsement, to be 12:01 a.m. on the first January 1 which
occurs more than six months after the Date of Policy, as shown in Schedule A of the Policy to which this
Endorsement is attached, and on each succeeding January 1.
3. An upward adjustment will be made on each of the Adjustment Dates as defined above, by increasing the
maximum amount of insurance provided by said policy (as said amount may have been increased theretofore
under the terms this Endorsement) by the same percentage, if any, by which the United States Department of
Commerce Composite Construction Cost Index for the month of September immediately preceding exceeds
such index for the month of September one year earlier; provided, however, that the maximum amount of
insurance in force shall never exceed 150% of the amount of insurance stated in Schedule A of said Policy, less
the amount of any daim paid under said policy, which, under the terms of the Conditions and Stipulations,
reduces the amount of insurance in force. There shall be no annual adjustment in the amount of insurance for
years in which there is no increase in said Construction Cost Index.
4. In the settlement of any daim against the Company under said Policy, the amount of insurance in force shall be
deemed to be the amount which is in force as of the date on which the insured claimant first learned of the
assertion or possible assertion of such claim, or as of the date of receipt by the Company of the first notice of
such claim, whichever shall first occur.
PROVIDED, HOWEVER, this endorsement shall be effective only if one of the following conditions exists at Date of
Policy:
A. The land described in this policy is a parcel on which there is only a one -to -four family residential structure,
including all improvements on the land related to residential use, in which the Insured Owner resides or intends
to reside; or,
B. The land consists of a residential condominium unit, together with the common elements appurtenant thereto
and related to residential use thereof, in which the Insured Owner resides or intends to reside.
This endorsement is made a part of the policy and is subject to all the terms and provisions thereof and of any prior

and important geological and archaeological sites). For stream frontage provide existing and
proposed top of stream bank, stream bank toe, stream mean high water mark, and base flood
elevation (i.e., 100 yr. flood). Maximum sheet size 24" x 36 ".
(b) Location of all required sensitive area buffers, setbacks, tracts and protection measures.

purveyor (e.g. site line size, location, and size of public main). No capacity calcs, invert depth,
valve locations or the like are needed.
(d) Storm drainage design at least 90% complete, which meets the King County Surface
Water Design Manual (KCSWDM). Include a Technical Information Report (TIR) including
feasibility analysis if required by the Manual. Call out total existing and proposed impervious
surface in square feet. Include all storm drainage conveyance systems, water quality features,
