The Short Subdivision Committee has completed review of your short plat application (No. L07-
0028), and determined that it complies with all applicable City code requirements. The City SEPA
Responsible Official has previously determined that this application does not require a SEPA
threshold determination because it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project
submittal, preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the short plat approval process:
1. Preliminary Approval

This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Subdivision Committee and approved with conditions. The conditions
imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval
listed at TMC 17.12.020 C in the Tukwila Subdivision Code.
PRELIMINARY APP ROVAL_CONDITIONS
1. The dog house must be moved or removed to meet the 10 feet minimum setback
requirement. The survey map must be updated to show the new location along with a
setback dimension.
2. Owner shall sign with Notary, a Private Sanitary Sewer Easement and Maintenance
Agreement (within a portion of the Southeast corner of proposed Lot 2.) This document
shall be recorded prior to recording of the Final Short Plat Map, and the recording
number be shown on the short plat map. (See sample enclosed.)

3. Owner shall sign with Notary, a Sanitary Sewer Agreement — Joint Side Sewer & Hold
Harmless Agreement (between future Lots 1 & 2).
4. Owner shall sign with Notary, a Sensitive Areas Ordinance Hold Harmless agreement, to
be recorded at King County Office of Records.
5. Revise the survey plat map as redlined and provide note on short plat map, to comply
with the Geotechnical Engineering Report, by Bruce S. MacVeigh, P.E.., dated May 7,
2007 and subsequent geotechnical reports.
6. All utilities for future houses, including power, are required to be underground, per City
of Tukwila ordinance.
7. Transportation Impact Fee and Transportation Concurrency Test Fee, both apply to the
future Building Permit(s).
8. The final grading plan must show a flat area in the rear yards for Fire Department ground
ladder placement. If unable to provide a suitable flat area adjacent to the houses please
contact the Tukwila Fire Marshal's office.
9. Utilities and undergrounding of power shall be constructed/installed as part of the
building permit for each lot. The extension of sewer and water lines to the lots shall be
approved by the appropriate utility district and conform to the Civil plans prepared by
Bruce Mc Veigh dated May 7, 2007.
s. Submit a set of recording documents in either legal or record of survey format that meet the
King County Recorder's requirements and contain the following items:
1. A survey map as described in the application checklist that is consistent with all of
the conditions of approval and revised as per redlined copy. The surveyor's original
signature must be on the face of the plat.
2. Existing and proposed legal descriptions for all lots.
3. Separate easement document with legal descriptions for utility infrastructure.
APPEALS
This short plat approval decision is appealable to the Hearing Examiner. One administrative
appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid
appeals are filed within the time limit the decision of the Department will be final.

In order to appeal the decision a written notice of appeal must be filed with the Department of
Community Development within 21 days of the issuance of the Notice of Decision (07/20/2007).
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision,
including any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of
the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant,
and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised
in the Notice of Appeal.
5. Appeal fee of $105 .
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The
Hearing Examiner's decision on the appeal is the City's final decision. A party who is not
satisfied with the outcome of the administrative appeal process may file an appeal in King County
Superior Court from the Hearing Examiner's decision pursuant to the procedures and time
limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may
be included in such an appeal.
2. Final Approval
The next step is to install the required site improvements, comply with the conditions of
approval and submit the necessary short plat documents (survey, legal descriptions, and
other required paper work). You may apply to delay installation of the site improvements
up to six months beyond final approval subject to the approval of the Public Works
Director. A financial guarantee must be provided to ensure installation.
All taxes and fees assessed against the property must be current prior to final approval.
Please check with the King County Assessor's Office and the City of Tukwila Finance
Department prior to submitting final documents. After the documents have been found to
be in order, and the all of the requirements of the short plat have been met, the Chair of the

Short Subdivision Committee signs your short plat which constitutes a grant of final
approval.
Expiration
The final approved short plat must be filed with the King County Department of Records by
June 29, 2008, one year from the date of this preliminary approval or the application will
expire. The City may grant a single one year extension if requested in writing prior to the
expiration date.
3. Recording
The signature of the Chairman of the Short Subdivision Committee certifies that your short
plat application is ready for recording. It is your responsibility to record the City approved
short plat documents with the King County Department of Records. You will need to pay
the recording fees and submit your approved original short plat to King County. The short
plat is not complete until the recording occurs and copies of the recorded documents are
provided to the Department of Community Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6
weeks, at which time your short plat is considered complete. You can shorten this
processing time by hand- delivering a copy of the recorded short plat to the project planner.
In many circumstances, building permits on the short platted property may not be issued
until a copy of the recorded short plat (or original) is returned to the Department of
Community Development.

SENSITIVE AREA COVENANT AND HOLD
HARMLESS AGREEMENT
This covenant and hold harmless agreement is entered into between James Dunaway, an
individual ( "Grantor), and the City of Tukwila, a Washington municipal corporation ( "Grantee ").
RECITALS
WHEREAS, Grantor owns and has applied for necessary permits to develop certain real
property (the "Property ") legally described in Exhibit A, which is attached and incorporated by
reference.
WHEREAS, a portion of the Property contains sensitive areas and the Property is
adjacent to sensitive areas of potential geologic instability (potential slide areas).
WHEREAS, as a condition of the issuance of short subdivision approval, land use
permits, and/or construction permits for the Property, the Grantee required the Grantor to execute
and record this "Sensitive Area Covenant and Hold Harmless Agreement" to hold the City of
Tukwila harmless from all loss incurred as a result of any landslide or seismic activity, or soil
disturbance.
WHEREAS, Grantor assumed this obligation in order to obtain said short subdivision
approval under permit no. L07 -028, and/or construction permits for the Property.

WHEREAS, Grantor has performed geological reports and evaluations, prepared by
Bruce S. MacVeigh, P.E., dated May 7, 2007.
WHEREAS, the parties agree that this agreement constitutes an arms length, bargained -
for agreement, which includes a waiver of liability that runs with the land for risks created by the
proposed use of property because of the shape, composition, location or other characteristic
unique to the Property sought to be developed.
NOW, THEREFORE, the parties agree as follows:
AGREEMENT
1. In consideration of Grantee issuing development permits, which constitutes good and
valuable consideration, the receipt of which and the sufficiency of which the Grantor hereby
acknowledges, the Grantor shall defend, indemnify, and hold the Grantee, its officers, officials,
employees, agents, and assigns harmless from any and all claims, injuries, damages, losses, or
suits, whether brought by grantor or third parties, including all legal costs and reasonable
attorney fees, arising out of or in connection with any injuries or damages to persons or property
caused in whole or in part by any landslide or seismic activity or soil disturbance on the
Property, legally described in Exhibit A, which is attached and incorporated by reference.
2. Grantor on its own behalf and on behalf of its heirs, successors and assigns hereby
waives any right to assert any claim against the Grantee, its officers, officials, employees, agents,
and assigns for any loss, or damage to people or property either on or off the site resulting from
any landslide or seismic activity or soil disturbance on said Property by reason of or arising out
of the issuance of the permit(s) by the City for development on said Property except only for
such losses that may directly result from the sole negligence of the City.
3. Grantor will inform its successors and assigns of said Property that the Property is in
an area of potential geologic instability (potential slide area), of the risks associated with
development thereon, of any conditions or prohibitions on development imposed by the City of
Tukwila, and of any features in this design which will require maintenance or modification to
address anticipated soils changes.
4. Grantee's inspection or acceptance of any of the Grantor's construction or other work
either during construction or when completed shall not be grounds to avoid any of these
covenants of indemnification.
5. This covenant and hold harmless agreement shall be a covenant running with the land
and the rights and obligations contained herein shall run with and burden the Property, including
each parcel comprising the Property and shall inure to the benefit of and be binding upon the
Grantor and Grantee, their successors and assigns.

WHEREAS, the GRANTEE has requested a variance to Tukwila City Code 14.12.150, for
the establishment of a single side sewer to service two buildings; and
WHEREAS, the City of Tukwila has granted this variance conditioned upon the recording
of a joint side sewer and hold harmless agreement between the GRANTOR and the GRANTEE,
owners of Parcels 1 and 2 as described above; and
WHEREAS, Parcel 1 and Parcel 2 share a common side sewer located within the City Right -
of -Way of 57 Ave. South, and
WHEREAS, Parcel 1 and 2, have the potential to impact the flow of wastewater from the
structures located upon both parcels, such that damages may result to either parcel from the other.
The GRANTOR and the GRANTEE do hereby agree as follows:
JOINT SIDE SEWER
The GRANTOR and the GRANTEE shall be solely responsible for the maintenance and
repair of the sewer line running from the structures on their parcels to the joint hookup
connection , located within the City Right -of -Way of 57th Ave. South. Site location map
attached as Exhibit `A -1', and sketch of sanitary side sewer location attached as
Exhibit `A -2' and incorporated herein by this reference.
Both the GRANTOR and the GRANTEE shall be jointly responsible on an equal 50/50 basis
for the maintenance, operation, and repair of the shared side sewer lateral that extends sewer
service from the City of Tukwila's sanitary sewer main to and including the joint hookup
connection of the two parcels' private side sewers.
Both the GRANTOR and the GRANTEE shall be jointly responsible on an equal 50/50 basis
for damages that may occur upon said properties due to improper maintenance, operation or
repair of the shared side sewer lateral that extends sewer service from the City of Tukwila's
sanitary sewer main to and including the joint hookup connection of the two parcels' private
side sewers.
The GRANTEE and the GRANTOR shall have the right to establish a backwater valve upon
their private individual side sewer to protect against sewage backups.
This Section is an appurtenant to this Agreement and shall run with the land; and the terms
thereof shall be for the benefit of the GRANTEE, GRANTOR, their heirs, successors and
assigns, and shall be binding upon, GRANTEE, GRANTOR, their heirs, successors and
assigns.

HOLD HARMLESS
The GRANTEE agrees to hold harmless, indemnify and defend the CITY OF TUKWILA, its
officials, members, employees, and agents from all liabilities, penalties, costs, losses, damages,
expenses, causes of action, claims, demands, or judgments, including reasonable attorney's
fees, arising from or in any way connected with any claim or cause of action including, without
limitation, the properties to the fullest extent permitted by law. Furthermore, GRANTEE
agrees to indemnify, hold harmless and defend the CITY OF TUKWILA from and against any
liabilities, penalties, costs, losses, damages, expenses, causes of action, claims demands or
judgments, including, reasonable attorney's fees, arising from or relating to any third party
claim which challenges GRANTEE'S and GRANTOR'S right to execute and deliver this
Agreement.
THIS AGREEMENT is given without cash consideration, and is for the purpose of legally
establishing an understanding for the use of a single side sewer to serve two parcels.
THIS AGREEMENT shall be a covenant running with the above - described real properties and
burden said real estate, and shall be binding on the successors, heirs and assigns of all parties
hereto.

to maintain and shall continue to bear all cost of repair and maintenance or repair of said
Sanitary Sewer Line.
4. Grantee shall hold Grantor harmless from and against any and all claims which may be made
against Grantor arising out of the installation, operation, maintenance or repair or said Sanitary
Sewer Line.
5. The herein easement and agreement may be amended only with the written agreement of the
Grantee herein.

1. Owner shall sign with Notary, a Private Sanitary Sewer Easement and
Maintenance Agreement (within a portion of the Southeast corner of proposed
Lot 2.) This document shall be recorded prior to recording of the Final Short Plat
Map, and the recording number be shown on the short plat map. (See sample
enclosed.)

Project Overview:
The purpose of this report is to evaluate the soils on the above property for
suitability for on -site infiltration, as well as stability and erosion characteristics.
The parcel is approximately 0.90 acres, with an existing one story wood frame
residence, driveway and surrounding lawn with landscaping shrubs and small
trees. The existing house is approximately 40 years old, and will be retained.
The lot is bordered on all sides by single family residences, some with larger
parcels. It is located on the west side of the street at 14117 57th Avenue S.
This report will evaluate the suitability of the site for on -site infiltration. Based on
the topography of the site, only light to moderate earthwork will be required to
install the new residences.
Erosion control measures will be use the Small Site Criteria of the KCSWM
Manual Appendix C methodology.
Off Site Analysis:
Conditions and Requirements Summery:
The KCSWM Manual requires infiltration where feasible. Soil studies of the site
indicate infiltration is not feasible for disposing of flows collected from new
impervious surfaces.
The site will use the perforated tightline connection to dispose of collected flow
from the two new residences. Flows will be led to the streetside system.
The flows enter the street system on 57th Avenue S. From there they continue
by City system to the Duwamish River approximately one quarter mile to the
east.
Flow Control and Water Quality Facility Analysis and Design:

Tees in all catch basins will remove oil, floating debris and silt from the runoff
water prior to the water entering the trenches.
Conveyance System Analysis and Design:
Due to the short nature of the drainage lines serving the site, the lines capacity
are considered adequate by inspection.
Special Reports and Studies:
None.
Other Permits:
Other permits associated for this project are clearing, grading and road
construction permits. Residential permits will be required for the
construction /remodel of residences on the four lots.
ESC Analysis and Design:
As noted above, the ESC measures required,for this site will consist of a
stabilized construction entrance and down slope silt fencing. Criteria will be per
Appendix C.
Bond Quantities, Facility Summery and Declarations of Covenant:
Bond quantity worksheets are not required since no construction will occur at a
direct part of the short plat.
Operation and Maintenance Manual

Subject: Geotechnical Evaluation for Proposed 3 -Lot Single Family Residential Short
Plat, 14117 57th Avenue S., Tukwila, WA 98168 (James Dunaway)
The purpose of this report is to evaluate the soils on the above property for stormwater
infiltration, stability and erosion characteristics. The property is located on the east side
of 57th Avenue S. just north of S. 142nd Street. The parcel is approximately 0.90 acres,
with an existing one story residence, driveway and surrounding lawn with landscaping
shrubs and small trees. The existing house is approximately 40 years old, and will
retained on Lot 1. The lot is bordered on all sides by single family residences on similar
parcels.
This report will evaluate the existing stability of the site, along with identifying potential
problems or specific design recommendations relating to the removal of the existing
house and the construction of the new house. Based on the topography of the site, only
moderate earthwork will be required to construct the new house on Lot 2, and moderate
earthwork for Lot 3. The total balanced cut and fill for the two new residences is
estimated at 400.
The existing lot coverage is approximately 4,300 SF, with the house being approximately
2,000 SF and driveways being a total of 2,300 SF. The new houses will be of
approximately the same size, with 4,000 SF estimated for impervious surface for each
new residence. The total future resulting total coverage would be 12,300 SF. An
abbreviated One- Quarter Mile Downstream Evaluation has been prepared for this project,
and no adverse conditions were noted downstream from the site.
The site slopes generally downward to the north and east, following the general
topography of the neighborhood. The total drop across the site is approximately 40 to 50
feet.
Site Geology Information - Topographic Data:
Concurrently submitted is the site improvement plan for the short plat. Shown are the
locations of the proposed new house and driveways. Note that the drainage layout
reflects the poor infiltrative soils, and uses a Perforated Tightline Connection leading
collected future site flows to the streetside storm system. The map shows the elevations
of the existing site and as proposed. The typical slope for the site is approximately 10 to
20 percent.
Site Geology Information - Subsurface Data:
The source of information to evaluate subsurface soil information were two soil logs on
the site.
It is unknown if the existing house has footing drains, however it is a shallow foundation,
and the new residences will have footing drains. The existing crawl space area was
reported free of intrusive water damage.
Soils observed were a dense silty loam in an upper layer, with a consistent sandy clay
below. Attached are the soil logs showing the depths in the various logs. The presence
of the clay layer makes on site infiltration unfeasible for the site.
Site Geology Information - Site History:
The site is part of long developed residential neighborhood, with houses in the area being
as old as 100 years. Some surface leveling and minor cuts and fills occurred during the
original house's construction. The siting of the new houses will not significantly alter the
site, except for some cut to allow the new driveway on Lot 3. It is believed that the
existing house was the first developed use of the site.
The mass topography was in place at the recession of the last ice sheet coverage
approximately 12,000 years ago. The site lies on the west side of the Duwamish Valley,
which was largely shaped during the glacial movement across the area.
The topography observed during the site visit indicates no evidence of catastrophic slope
failure in any portion of the hillside. Long term very slow surface movement has
probably occurred historically, but is probably not a factor in the existing fully developed
neighborhood. Significant movement of the surface soils down the hillside, even in an
undeveloped condition, would be measured in decades or centuries. No areas of obvious
surface erosion or tell tale exposed surface soils were observed on the site or on
neighboring site.
Site Geology Information - Seismic Hazard:
Seismic hazards for slopes may be comprised of either general soil saturation or classic
seismic liquefaction. With general saturation, failure occurs in either a direct diagonal
slippage (shear failure) or at a saturated layer of loose silts which semi - liquefy and "pour"
out of their original location in the hillside. The soils of this area do not appear
susceptible to this mode of failure due to the generally dense impervious nature of the
soils and positive slopes which prevent surcharged saturation. While the above cause of
hillside failure is not limited to seismic movement, a seismic event could possibly trigger
a failure which would not otherwise have occurred, however this is unlikely. As noted
above, there is no indication on the site of this mode of failure occurring previously on
this site or in the surrounding area. Based on the above, the possibility of hillside failure
by this mode of seismic failure is low.
The second mode of failure is caused by a water saturation of a uniformly graded larger
grained non - cohesive soil, which in this condition is subject to seismic movement. For
the slope areas in question, the possibility of full saturation of any layer is not present. In
addition, the soils as noted are not of the type allowing this type of movement. The

possibility of seismic movement is, of course, more significant with a sloping site,
however, the possibility of seismic liquefaction failure for this hillside is negligible.
Geotechnical Engineering Information - Slope Stability Studies and Opinions of Slope
Stability:
No previous slope stability studies are known to have been prepared for this site.
As noted above, the site appears stable and not subject to long term erosion or
catastrophic failure. Reference slope stability, it is the opinion of this office, based on
considerations discussed above, that the existing slopes are geologically stable for the
intended use.
Geotechnical Engineering Information - Proposed Angles of Cut and Fill Slopes and Site
Grading Requirements:
Only moderate to light construction affecting the site soils is proposed as part of the new
house construction. The following are provided for general information.
It is recommended that the footing bases for the new residence be placed at or below a
2:1 slope from the lowest level of the site.
During temporary excavations for basements and foundations, a vertical cut face is
acceptable. Long term permanent cuts and fills involving native soils should be at a
maximum of 2:1 unless otherwise approved by a licensed engineer familiar with the site.
Site grading should follow standard practice as regards erosion control, stockpiling of
soils, and minimizing the areas to be cleared and ,disturbed to that necessary for approved
construction.
Significant structural fill is not required for the proposed new residence. Should it be
required due to unforeseen circumstances, the following guidelines should be followed.
Cut horizontal steps into the slope (for fills over 3 feet total), place non -clay materials in
maximum 6" lifts, and mechanically compact to 95 percent. Note that for non - structural
fill in yard areas, the 6" lifts and mechanical compaction may be omitted, although some
settling will occur over time. Revegetation of finished slope areas should follow good
landscaping practice.
Geotechnical Engineering Information - Structural Foundation Requirements and
Estimated Foundation. Settlement:
A foundation bearing pressure of 2,000 PSF is suitable for undisturbed soils for these
sites. All foundations should be placed on undisturbed soils a minimum of 18" below
finished grade. All foundations should be placed at a 2:1 backslope or farther from the
toe of any slope.
Based on observed soils, a lateral resistance factor of 0.40 for lateral loading may be
safely used for design of structural retaining walls and basement walls. Note that the
basement floors will be cast concrete and will provide additional long term lateral
resistance to movement of the walls and their footings. It is recommended that the inside
of the basement wall footings be backfilled against prior to exterior backfilling as a good
general construction practice.

Based on experience with similar soils used for wood frame residential construction, a
settlement of less that 1/4 inch would be expected within a 50 foot length of foundation.
It should be noted that during the site visit by this office, the existing concrete
foundations, which have been in place for up to 50 years, showed very little settlement.
Geotechnical Engineering Information - Soil Compaction Criteria:
Soils on site are suitable only for shallow structural backfill, which would be
characterized as one foot or less. Deeper fills, if required, should use an imported select
granular pit run. Compaction in foundation and vehicular traffic areas should be to 95 %,
uniformly and mechanically compacted. The need for structural backfill for this site,
except in utility trenching, is minimal. Backfilling of minor trenches with existing
material is acceptable, provided it is mechanically compacted in 6 inch lifts, and that it is
done in only damp or dry weather. Questions relating to the adequacy of compacted
material should be evaluated by a licensed engineer inspection on site.
Geotechnical Engineering Information - Proposed Surface and Subsurface Drainage:
Surface runoff from impervious surfaces will be collected and routed to the adjacent
street drainage system. No runoff will be infiltrated on site. All foundations and
retaining walls will be protected by piped footing drains which lead to the street drainage
system.
Geotechnical Engineering Information - Lateral Earth Pressures:
Due to the dense nature of the in place soils, an active design lateral pressure for retaining
walls of 35 PCF is suitable, with an at rest lateral pressure for foundation walls of 60 PCF
recommended. All walls over 4 feet in total height must be designed by a licensed
engineer and use the 1.5 safety factor per accepted practice.
Geotechnical Engineering Information - Vulnerability of Site to Erosion:
Undisturbed bare soils on site are moderately subject to erosion. Disturbed soils are
subject to significant erosion. Disturbed soils on or near the slope areas are subject to
heavy erosion. For the above reasons the exposure of disturbed soils on or near the slope
areas should be protected with straw or tarping if left exposed for more than one week
during the wet season. All disturbed areas must have properly installed silt fencing on
their downhill side. A standard stabilized rock construction entrance will be used on site
to prevent mud and silt from the site entering the street drainage system.
With the use of erosion control measures, as mentioned above, the proposed construction
should be able-to take place without significant erosion to the site, or the transporting of
silts off site.
Geotechnical Engineering Information - Suitability of On -Site Soils for Use as Fill:
The native materials on -site are suitable for shallow fill in damp or dry weather, with
mechanical compaction required in structural fill areas, as noted above. Note minor
quantities of clay in the existing soils prevents their use for deep structural fills, except
for minor trenching.

Geotechnical Engineering Information - Laboratory Data and Soil Index Properties:
Field testing was done of soil samples encountered. The soils were found to be a dense
medium loam, with possibly some clay content.
Formal laboratory testing of soil samples was not deemed necessary for the evaluation of
site soils for this site and type of construction.
Geotechnical Engineering Information - Building Limitations:
The construction of the above new residence may take place during wet weather provided
the above specified erosion control measures are strictly employed. Arbitrary wet
weather restrictions based on specific dates for this site and its development are not
recommended.
Providing the above recommendations and construction criteria are adhered to in the
design and placement of the residential structure and related site work, no site related
building limitations are recommended for these sites.
Summery:
The site is suitable for conventional residential construction. Drainage of impervious
surfaces, including roof and driveways must be collected and led to the adjacent street
system.
Statement of Risk: (Intended to comply with TMC Risk Statement Requirements)
While the general slope of the site is typically about 10 percent in the construction areas,
some significant areas will have slopes up to 20 percent, with an existing cut area on site
at 1:1. The total difference in elevation of these areas is up to 30 or 40 feet, however they
are not projected for disturbance. The level of projected disturbance, combined with the
stable soils noted above, indicate that the site, and the surrounding properties (which are
all similar), is not by definition a geologic hazard area and that additional studies and
construction restrictions relating to geologic hazard areas do not apply to this project.
In addition, the construction as proposed is so minor as to not pose a threat to public
health, safety and welfare. The construction may occur with no greater threat to the site
or to adjacent properties than if the site were level.
In summery, the plans and specifications submitted for the proposed new residence have
been reviewed and conform to the conditions and recommendations in this evaluation,
specifics noted above, and provided that the conditions and recommendations are
satisfied, the construction and development will not increase the potential for soil
movement; and the risk of damage to the proposed development, and from the
development to adjacent properties, from soil instability will be minimal (essentially zero
possibility of risk).

construction of the new residences may be directed to this office.

This Policy insures You against actual loss, including any costs, attorneys' fees and expenses provided under this Policy, real from the
Covered Risks set forth below, if the Land is an improved residential lot on which there Is located a one -to -four family residence and each
insured named In Schedule A is a Natural Person. Your insurance is effective on the Policy Date. This Policy covers Your actual Toss from
any risk described under Covered Risks if the event creating the risk exists on the Policy Date, or, to the extent expressly
stated, after the Policy Date. Your Insurance is limited by all the following:

The Covered Risks are:
1. Someone else owns an interest in Your Title.
2. Someone else has rights affecting Your Title arising out
of leases, contracts, or options.
3. Someone else claims to have rights affecting Your Title
arising out of forgery or impersonation.
4. Someone else has an easement on the Land.
5. Someone else has a right to limit Your use of the Land.
6. Your Title is defective.
7. Any of Covered Risks 1 through 6 occurring after the
Policy Date.
8. Someone else has a lien on Your Title, including a:
a. Mortgage
b. judgment, state or federal tax lien, or special
assessment;
c. charge by a homeowner's or condominium
association; or
d. lien, occurring before or after the Policy Date, for
labor and material furnished before the Policy Date.
9. Someone else has an encumbrance on Your Title.
10. Someone else claims to have rights affecting Your Title
arising out of fraud, duress, incompetency or incapacity.
11. You do not have both actual vehicular and pedestrian
access to and from the Land, based upon a legal right.
12. You are forced to correct or remove an existing violation
of any covenant, condition or restriction affecting the
Land, even if the covenant, condition or restriction is
excepted In Schedule B. However, you are not covered
for any violation that relates to any obligation to perform
maintenance or repair on the Land, or relates to
environmental protection of any kind or nature, including
hazardous or toxic conditions or substances, unless
notice of the violation is recorded in the Public Records.
13. Your Title is lost or taken because of a violation of any
covenant, condition or restriction, which occurred before
You acquired Your Title, even If the covenant, condition
or restriction is excepted in Schedule B.
14. Because of an existing violation of a subdivision law or
regulation affecting the Land:

Your Deductible Amount and Our Maximum Dollar Limit of Liability
shown in Schedule A.
15. You are forced to remove or remedy Your existing structures,
or any part of them - other than boundary walls or fences —
because any portion was built without obtaining a building
permit from the proper government office. The amount of Your
Insurance for this Covered Risk is subject to Your Deductible
Amount and Our Maximum Dollar Limit of Liability shown in
Schedule A.
16. You are forced to remove or remedy Your existing structures,
or any part of them, because they violate an existing zoning
law or zoning regulation. If You are required to remedy any
portion of Your existing structures, the amount of Your
insurance for this Covered Risk is subject to Your Deductible
Amount and Our Maximum Dollar Limit of Liability shown In
Schedule A.
17. You cannot use the Land because use as a single- family
residence violates an existing zoning law or zoning regulation.
18. You are forced to remove Your existing structures because
they encroach onto Your neighbor's Land. If the encroaching
structures are boundary walls or fences, the amount of Your
insurance for this Covered Risk is subject to Your Deductible
Amount and Our Maximum Dollar Limit of Liability shown In
Schedule A

19. Someone else has a legal right to, and does, refuse to perform a
contract to purchase the Land, lease it or make a Mortgage loan
on it because Your neighbor's existing structures encroach onto
the Land.
20. You are forced to remove Your existing structures because they
encroach onto an easement or over a building set-back line, even
if the easement or building set-back line is excepted in Schedule
B.
21. Your existing structures are damaged because of the exercise of
a right to maintain or use any easement affecting the Land, even
if the easement Is excepted in Schedule B.
22. Your existing improvements (or a replacement or modification
made to them after the Policy Date), including lawns, shrubbery
or trees, are damaged because of the future exercise of a right
to use the surface of the Land for the extraction or development
of minerals, water or any other substance, even if those rights
are excepted or reserved from the description of the Land or
excepted In Schedule B.
23. Someone else tries to enforce a discriminatory covenant,
condition or restriction that they claim affects Your Tide which
We will defend Your Title in any legal action only as to that part of the
action which is based on a Covered Risk and which Is not excepted or
excluded from coverage in this Polley. We will pay the costs,
attomeys' fees, and expenses We incur in that defense.
We will not pay for any part of the legal action which Is not based on

1. Governmental police power, and the existence or vloladon of any
law or government regulation. This Includes ordinances, laws and

This Exclusions does not apply to violations or the enforcement of
these matters If notice of the violation or enforcement appears in
the Public Records at the Policy Date.
This Exclusion does not limit the coverage described in Covered
Risk 14, 15, 16, 17 or 24.
2. The failure of Your existing structures, or any part of them, to be
constructed in accordance with applicable building codes. This
Exclusion does not apply to vloladons of building codes if notice
of the violation appears in the Public Records at the Policy Date.

24. A taxing authority assesses supplemental real estate taxes not
previously assessed against the Land for any period before the Policy
Date because of construction or a change of ownership or use that

25. Your neighbor builds any structures after the Policy Date other than
boundary walls or fences -- which encroach onto the Land.
26. Your Title Is unmarketable, which allows someone else to refuse to
perform a contract to purchase the Land, lease It or make a
Mortgage loan on it.
27. A document upon which Your Title is based is invalid because it was
not properly signed, sealed, acknowledged, delivered or recorded.
28. The residence with the address shown in Schedule A is not located
on the Land at the Policy Date.
29. The map, If any, attached to this Policy does not show the correct
location of the Land according to the Public Records.

We can end Our duty to defend Your Tide under paragraph 4 of the

3. The right to take the Land by condemning It, unless:
a. a notice of exercising the right appears in the Public Records at

You if You bought the Land without Knowing of the taking.
4. Risks:
a. that are created, allowed, or agreed to by You, whether or not
they appear in the Public Records;
b. that are Known to You at the Policy Date, but not to Us, unless
they appear in the Public Records at the Polley Date;
c. that result in no loss to You; or d. that first occur after the
Policy Date - thls does not limit the coverage described in
Covered Risk 7, 8.d, 22, 23, 24 or 25.
5. Failure to pay value for Your Tide.
6. Lack of a right:
a. to any Land outside the area specifically described and referred
to in paragraph 3 of Schedule A; and
b. In streets, alleys, or waterways that touch the Land.

1. Definitions:
a. Easement- the right of someone else to use the Land
for a special purpose
b. Known- things about which You have actual
knowledge. The words `Know" and "Knowing" have
the same meaning as Known
c. Land- the Land or condominium unit described in
paragraph 3 of Schedule A and any improvements on
the Land which are real property.
d. Mortgage- a mortgage, deed of trust, trust deed or
other security instrument.
e. Natural Person a human being, not a commercial or
legal organization or entity. Natural Person includes a
trustee of a Trust even if the trustee Is not ahuman
being.
f. Policy Date the date and time shown in Schedule A.
If the Insured named in Schedule A first acquires the
Interest shown in Schedule A by an instrument
recorded in the Public Records later than the date and
time shown in Schedule A, the Policy Date is the date
and time the instrument is recorded.
g. Public Records- records that give constructive notice
of matters affecting Your Title, according to the state
statutes where the land is located
h. Tide - the ownership of Your interest in the land, as
shown in Schedule A.

estate planning.

(3) The trustee or successor trustee of a Trust to
whom You transfer Your Title after the Policy
Date; or
(4) The beneficiaries of Your Trust upon Your death,
c. We may assert against the Insureds identified in
paragraph 2.b. any rights and defenses that We have
against any previous insured under this Polity.

3, How To Make A Claim
a. Prompt Notice Of Your Claim
(1) As soon as You Know of anything that might be
covered by this Policy, You must notify Us
promptly in writing
(2) Send Your notice to OId Republic National Title
Insurance Company, 400 Second Avenue South,
Minneapolis, Minnesota 55401 (612) 371-1111
Attention: Claims Department. Please Include the
Policy number shown In Schedule A, and the
county and state where the Land is located.
Please enclose a copy of Your policy, if available.
If You do not give Us prompt notice, Your
coverage will be reduced or ended, but only to the
extent Your failure affects Our ability to resolve
the daim or defend You.
b. Proof Of Your Loss
(1) We may require You to give Us a written statement
signed by You describing Your Toss which indudes:
(a) the basis of Your claim;
(b) the Covered Risks which resulted In Your Toss;
(c) the dollar amount of Your Toss; and
(d) the method You used to compute the amount of
Your Toss.
(2) We may require You to make available to Us records,
checks, letters, contracts, insurance policies and
other papers which relate to Your daim. We may
make copies of these papers
We may require You to answer questions about Your
daim under oath.
(4) If You fail or refuse to give Us a statement of loss,
answer Our questions under oath, or make available
to Us the papers We request, Your coverage will be
reduced or ended, but only to the extent Your failure
or refusal affects Our ability to resolve the daim or
defend You.

(5) End the coverage of this Policy for the claim by
paying You Your actual loss resulting from the
Covered Risk, and those costs, attorneys' fees and
expenses incurred up to that time which We are
obligated to pay.
(6) End the coverage described in Covered Risk 14,
15, 16 or 18 by paying You the amount of Your
insurance then in force for the particular Covered
Risk, and those costs, attorneys' fees and
expenses incurred up to that time which We are

(7) End all coverage of this Policy by paying You the

time which We are obligated to pay.
(8) Take other appropriate action.
b. When We choose the options in paragraphs 4.a. (5),

c. Even if We do not think that the Policy covers the
daim, We may choose one or more of the options
above. By doing so, We do not give up any rights.
5. HandlingA Calm Or Legal Action
a. You must cooperate with Us in handling any daim or
legal action and give Us all relevant Information.
b. If You fail or refuse to cooperate with Us, Your
coverage will be reduced or ended, but only to the
extent Your failure or refusal affects Our ability to
resolve the claim or defend You.
c. We are required to repay You only for those
settlement costs, attorneys' fees and expenses that
We approve In advance.
d. We have the right to choose the attomey when We
bring or defend a legal action on Your behalf. We can
appeal any decision to the highest level. We do not
have to pay Your daim until the legal action is finally
decided.
e. Whether or not We agree there Is coverage, We can
bring or defend a legal action, or take other
appropriate action under this Policy. By doing so, We
do not give up any rights.
6. Limitation Of Our Liability
a. After subtracting Your Deductible Amount if it applies,

We will pay no more than the least of
(1) Your actual Toss;
(2) Our Maximum Dollar Limit of Liability then In force
for the particular Covered Risk, for claims covered
only under Covered Risk 14, 15, 16 or 18;
or
(3) the Policy Amount then in force;
and any costs, attorneys' fees and expenses which
We are obligated to pay under this Policy.
b. (1) If We remove the cause of the daim with
reasonable diligence after receiving notice of it, all
Our obligations for the claim end, including any
obligation for loss You had while We were removing
the cause of the claim.
(2) Regardless of 6.b. (1) above, if You cannot use the
Land because of a daim covered by thls Policy:
(a) You may rent a reasonably equivalent
substitute residence and We will repay You for
the actual rent You pay, until the earlier of:
(1) the cause of the daim is removed; or
(2) We pay You the amount required by this
Polley. If Your claim Is covered only under
Covered Risk 14, 15, 16 or 18, that
payment is the amount of Your Insurance
then in force for the particular Covered
Risk.
(b) We will pay reasonable costs You pay to
relocate any personal property You have the
right to remove from the Land, including
transportation of that personal property for up
to twenty -five (25) miles from the Land, and
repair of any damage to that personal property
because of the relocation. The amount We will
pay You under this paragraph Is limited to the
value of the personal property before You
relocate it.
c. All payments We make under this Policy reduce the
Polley Amount, except for costs, attorneys' fees and
expenses. All payments we make for daims which are
covered only under Covered Risk 14, 15,16 or 18 also
reduce Our Maximum Dollar Limit of Liability for the
particular Covered Risk, except for costs, attomeys' fees
and expenses.
d. If We issue, or have issued, a Policy to the owner of a
Mortgage on Your Tile and We have not given You any

coverage against the Mortgage, then:
(1) We have the right to pay any amount due You
under this Policy to the owner of the Mortgage
to reduce the amount of the Mortgage, and any
amount paid shall be treated as a payment to
You under this Policy, including under
paragraph 4.a. of these Conditions;
(2) Any amount paid to the owner of the Mortgage
shall be subtracted from the Policy Amount of
this Policy;
and
(3) If Your claim Is covered only under Covered
Risk 14, 15, 16 or 18, any amount paid to the
owner of the Mortgage shall also be subtracted
from Our Maximum Dollar limit of Liability for
the particular Covered Risk.
e. If You do anything to affect any right of recovery
You may have against someone else, We can -
subtract from Our liability the amount by which You
reduced the value of that right.
7. Transfer Of Your Rights To 115
a. When We settle Your daim, We have all the rights
You have against any person or property related to
the claim. You must transfer these rights to Us
when We ask, and You must not do anything to
affect these rights. You must
let Us use Your name in enforcing these rights.
b. We will not be liable to You if We do not pursue
these rights or if We do not recover any amount that
might be recoverable
c. We will pay any money We collect from enforcing
these rights in the following order:

This Policy, with any endorsements, is the entire contract between
You and Us. To determine the meaning of any part of this Policy,
You must read the entire Policy. Any changes to this Policy must
be agreed to in writing by Us. Any daim You make against Us must
