The conditions of approval are as follows: Staff recommends approval of the Design Review application with the following conditions: 1) The parking stalls must be adjusted to meet the dimensional standards at Figure 18 -6. 2) The existing freestanding sign must be removed by the property owner prior to building permit final. 3) The artwork proposed may not depict items for sale on the premises unless its area is counted toward the allowable sign area. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Board of Architectural Review (BAR) of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Board of Architectural Review decision. 1. The name of the appealing party. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by July 2, 2007. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. Payment of the $205 appeal fee. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the BAR based on the testimony and documentary evidence presented at the open record hearing. The BAR decision on the appeal is the City's final decision. Any party wishing to challenge the BAR decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the BAR decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The covered transaction area would be enclosed and enlarged with a 637 sf addition. The existing paving and landscape areas would remain with parking striping and a dumpster enclosure added. Surrounding Land Uses The site is bounded by Military Road on the west side and S. 150th Street on the north. The property to the east has recently burned and is vacant. The rest of the area is a mix of residential and small scale commercial uses. DESIGN REVIEW CRITERIA This project is subject to administrative design approval under Tukwila Municipal Code (TMC) Section 18.22.070. This project is subject to the design review criteria listed under Tukwila International Boulevard Design Manual. The manual is organized into four sections; covering Site Design, Building Design, Landscape Design and Signs. Within each section are a number of subject areas, covering such issues as pedestrian circulation, architectural relationships, planting design and sign placement. For each subject areas, there are one or more Design Criteria, which are general in nature. The Design Criteria explains requirements for development proposals. They are the decision criteria by which the City will decide whether to approve, condition or deny a project. The Design Guidelines, which augment each Design Criteria, provide guidance to the project applicant and to City Staff in determining whether the project meets the Design Criteria. I. SITE DESIGN A. Site Design Concept The existing building will remain and changes to the site layout will be minor. The paved area on the interior of the site will be striped for parking and a fence will be added to screen the dumpster. Q:\LETTERS\ZarnDR_Staff.doc • • FINDINGS - 2 - 06/15/2007 10:15:00 AM B. Relationship to Street Front • • No parking is provided between the building and the street. The site has two driveway accesses, one along each street that will be maintained in their current locations. C. Street Corners No changes are proposed to the corner of the existing building. The existing landscape area at the corner will be enhanced with additional landscaping. D. Continuity of site with adjacent sites The existing building is inward looking and the paving is continuous between the adjacent parcels with no access control and this is not proposed to change during this remodel. E. Shared Facilities The site provides the required parking on site and the driveways along the street frontages are already shared with the adjoining sites. F. Site Design for Safety The handicapped stall will be located adjacent to the building with direct access inside. The scale of the project does not warrant frontal improvements. G. Siting and screening of service areas The garbage and recycling area is located behind the building in the parking area and is proposed to be screened by a slatted chain link enclosure and potted landscaping. H. Natural Features and Sensitive Areas The existing tree that is in good health and some shrubs will be retained. There are no environmentally sensitive areas on site. Pedestrian circulation No formal pedestrian paths will be created. K. Pedestrian Amenities Per Design Manual requirement on pg. 64 transparent window areas or artwork will be provided along half of the length of the 150th Street facade. The Military Road facade will be screened with landscaping. Pedestrian weather protection will be provided by the existing overhang. L. Vehicular Circulation There is currently no channelization on the site. The building addition, dumpster area and newly striped parking will act to create drive aisles and direct traffic. M. Parking All required parking is provided onsite and no shared parking is proposed. The size of the regular parking spaces will need to be corrected at the building permit stage. No parking spaces are provided between the building and the sidewalk. II. BUILDING DESIGN A. Architectural Concepts The office building will be reconfigured inside, the columns on the existing drive - through lanes will be filled in with walls and an addition added to the south. The south facade will have roll -up doors to allow for an open air market experience. B. Architectural Relationships There is no high quality architectural context to emulate in this area. Building Elements, Details and Materials The existing building is brick with a composition shingle roof The addition will be primarily T1 -11 wood siding with a corrugated metal roof. To tie the elements together the new south facade will have a brick base course and the doorway will have an awning constructed of corrugated metal. The siding will be painted a reddish brown to harmonize with the brick. There will be roll -up doors on the south side of the building to allow for an open air market display. These will have glass inserts to allow for transparency. D. Pedestrian- Oriented Features Transparent windows, artwork and a small amount of landscaping will be provided along the S. 150th Street frontage. Foundation and parking lot landscaping will be added or maintained. E. Mechanical Equipment A walk -in cooler will be built within the building. No external HVAC equipment is proposed. III. Five feet of Type II landscaping is required along the south and east property lines. A total of 50 sf of interior parking lot landscape island is required. This is a total of 3,070 sf and the existing landscape areas contain a total of 3,165 sf, not including the minor foundation landscaping along the north facade or the potted trees. Averaging of the landscape requirements is allowed under TMC 18.52.020 B if the total square footage will be achieved. One large existing cherry tree will be retained as well as some existing shrubs. Two new maples, three magnolia trees, shrubs and lawn will be added within the landscape islands. - 5 - 06/15/2007 10:15:00 AM IV. Signage A. Signage Concept o 4 The existing freestanding sign will need be removed by the property owner. A new wall sign along the north wall is proposed. B. Sign Placement The existing freestanding sign is located in the front landscape island. C. Sign Design The new wall sign will be a simple non - illuminated rectangle affixed to the wall. I. Site Design This is an existing site and the building footprint will only have a minor addition. The parking area and landscaping will be upgraded with striping and additional plantings. All required parking is provided on site and no parking is proposed between the building and the sidewalk. The parking stall size is not correct and will have to be changed to meet standards at the building permit stage. II. Building Design CONCLUSIONS The applicant has proposed to enclose the drive - through banking area and add a small addition on the south edge of the building. An effort has been made to tie the new structure to the old through materials and color. The pedestrian space requirements have been met through windows, glass within the roll -up doors and artwork. The artwork proposed for the north wall may not depict items for sale (fruits and vegetables). III. Landscape Design The landscape averaging request meets the intent of the code and should be approved. The lack of landscaping along the interior property lines is an existing condition and installing it would interfere with existing circulation patterns. The proposed wall sign is too large at 45 sf. Based on the exposed building face of the north elevation the largest sign allowed is 36 sf. A separate sign permit will be required prior to installation. RECOMMENDATIONS Staff recommends approval of the Design Review application with the following conditions: 1) The parking stalls must be adjusted to meet the dimensional standards at Figure 18 -6. 2) The existing freestanding sign must be removed by the property owner prior to building permit final. 3) The artwork proposed may not depict items for sale on the premises unless its area is counted toward the allowable sign area. - 7 - 06/15/2007 10:46:00 AM June 8, 2007 Aden Aden 22416 88 Avenue South Apt. k306 Kent, WA 98031 RE: Zam Zam Produce Market Dear Mr. Aden, 0 City of Tukwila Department of Community Development Steve Lancaster, Director I have reviewed your application for administrative design review for the proposed produce market located at 15006 Military Road in Tukwila and have the following comments: 1) The area of landscape provided and the number of trees proposed exceed the code requirements and so can be approved through the landscape averaging provision, TMC 18.52.020 B. 2) The materials for the addition, T1 -11 and corrugated metal, are unlike those of the original building and an effort must be made to integrate the addition. Either substituting composition shingles or adding metal detailing such as corrugated awnings over the doorways would tie the two structures together. A paint color should be chosen for the siding that is harmonious with the brick. Since these materials are associated with lower quality construction care must be taken in the detailing and workmanship. Some examples of this are the Starfire soccer building and the Family Fun Center. 3) Per the Tukwila International Boulevard Design Manual pedestrian- friendly facades must be provided along both the north and south elevations of the building, see attached section of the Manual. For the south elevation this requirement could be met using roll -up doors with glass insets. The north elevation would require either additional windows or a decorative treatment. 4) The new parking stalls that you plan to stripe must meet Tukwila's size requirements, see attached Figure 18 -6. 5) The existing freestanding sign does not appear to meet required setbacks and therefore cannot be reused unless it is modified to meet current sign code standards. The maximum size allowed would be 75 square feet per side and the sign must be set back from all property lines as far as it is tall. Development proposals in which parking is placed to the side or in back of the building, or a combination of these solutions, are encouraged. Two or more small parking areas are preferable to one large parking area, particularly if one parking area is located between the building and the public street (Criteria 1.M.1., "Parking. INTENT • To ensure that building access is visible and accessible to pedestrians and drivers from the sidewalk and street. • To ensure that building entrances are a prominent element of the streetscape. GUIDELINES In general, Tukwila International Boulevard is considered the major public street in this area. Developments in which the major building entry faces the major public street are encouraged. Primary entries that are located on a facade not facing the major public street are allowed, provided that the entry is visible from the major public street. Siting and Screening of Service Areas DESIGN CRITERIA 1. Minimize the visual and aural impacts of service areas such as loading docks, trash and recycling collection points, utility maintenance areas, etc., through site design, landscaping and screening. INTENT • To minimize the visual presence of service areas for businesses, customers and surrounding property owners. • To minimize potential conflicts between users of service areas, customers and surrounding property owners. • To ensure continued access to service areas. GUIDELINES Service areas include, but are not limited to, trash dumpsters, compactors, ground level mechanical equipment, utility vaults, loading zones, outdoor storage areas, trash and recycling areas, and other intrusive site features. Locate service areas so that negative visual and auditory (noise) impacts on the street and adjacent properties are minimized. Avoid siting utility equipment where it displaces significant landscaping, or where serving the equipment would be detrimental to existing landscaping. Provide access to equipment that requires regular servicing. Provide sufficient screening around service areas, integrating landscaping with other site and adjacent public landscaping, where possible. Note: See Zoning Code for screening requirements for trash and recycling areas. Utilize durable, high quality building materials that contribute to the overall appearance, ease of maintenance, and longevity of the building. INTENT ■ To upgrade the visual appearance of the Tukwila International Boulevard corridor. ■ To minimize maintenance needs and discourage vandalism. GUIDELINES The selection and use of exterior building materials is a key factor in determining how a building will look. Building materials contribute pattern, scale, color and texture to a structure, and become an important design feature when well used. Some materials, by their nature, impart a sense of permanence. Others are associated with impermanence, or are inappropriate for certain sites or uses due to their tendency to weather, invite misuse, or convey an appearance of neglect. Building materials should be selected for ease of maintenance, and have the same anticipated life -span as the structure. Examples of common contemporary finishing materials in commercial structures are brick, split -face block, scored or molded wood siding, and stucco - finished dryvit. Other exterior finish materials may be appropriate as well, provided they are well detailed and finished (see also Criteria 2.C.3., "Building Elements, Details and Materials. ") Industrial materials such as concrete masonry block and metal siding should be detailed so that the installation exhibits a high degree of workmanship and durability. Stucco and synthetic building materials should be detailed to avoid damage due to weather or use. Some materials, such as mirrored glass, plywood, and corrugated fiberglass, are generally impermanent and/or detract from building design. They are generally discouraged in visible locations. Provide pedestrian - friendly facades (see Appendix A, Definitions) on the ground floor of all buildings that face public streets and entry facades that face parking areas. INTENT ■ To make walking to and among businesses along Tukwila International Boulevard a positive experience. To encourage a successful "downtown" or neighborhood commercial district along Tukwila International Boulevard, and support an active street life. • To encourage attractive and interactive facades that create visual interest. GUIDELINES Building facades that face public streets and entry facades that face parking areas must incorporate one or more of the following measures on the ground floor: a) Transparent window areas or window displays along at least half the length of the length of the ground floor facade (windows need not be contiguous). b) Sculptural, mosaic or bas - relief artwork along at least half the length of the ground floor facade (artwork need not be contiguous). c) "Pedestrian- oriented space," as defined in the Definitions, located adjacent or connected to the sidewalk. At least 500 square feet of pedestrian- oriented space must be provided for every 100 linear feet of ground floor facade, as visible from the public street, in order to fulfill the intent of this Criteria. d) Other methods that meet the intent of this criteria may be proposed.
