Location: 10430 East Marginal Way South Associated Files: E07 -008 Comprehensive Plan Manufacturing Industrial Center/Heavy Designation/Zoning District: SEPA Determination: The City SEPA Responsible Official has previously: IX determined that the project, as proposed, does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Shoreline Substantial Development Permit does comply with applicable City and state code requirements and has approved that application, subject to the condition set forth below based on the findings and conclusions contained in the staff report. The landscaping plan shall be revised to utilize all native plant material. The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. III. YOUR APPEAL RIGHTS One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings Board for details. IV. PROCEDURES AND TIME FOR APPEALING The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58 and WAC 461.08. V. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the Shoreline Substantial Development Permit are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Carol Lumb, who may be contacted at 206 - 431 -3661 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. Manufacturing Industrial Center Carol Lumb, Senior Planner • The applicant is revising the existing entrance to an industrial site located on the east side of East Marginal Way South. The existing landscaping will be removed and replaced with more drought tolerant vegetation. The amount of impervious surface will reduced slightly, with the removal of 19,000 sq. ft. of asphalt to create additional planting area. Portions of the area that is adjacent to the asphalt that will be removed will be reasphalted and re- striped for parking. Policies of the Shoreline Management Act /Shoreline Master Program This area was annexed into the City of Tukwila in 1989. The City of Tukwila is required to administer annexed areas based on the Shoreline Management Plan which was in place at the time of annexation, until such time that a new Master Plan is adopted and approved by the Washington State Department of Ecology. This area is subject to King County's Shoreline Master Program. III. Existing Development The project site is located in the heavy industrial area of Tukwila on the northeast corner of East Marginal Way South and Boeing Access Rd. The site is currently developed with warehousing that serves as a grocery distribution center. King County Airport lies to the north with aircraft manufacturing facilities to the northwest. The site is bordered on the west by East Marginal Way South with the Duwamish River located to the west across the road. IV. Shoreline Regulations King County Shoreline Management Program Applicable regulations of King County Shoreline Master Program: A. Non -water related development and residential development shall not be permitted waterward of the ordinary high water mark. No work will take place waterward of the ordinary high water mark. B. Except in those cases when the height requirement of the underlying zones are more restrictive, no structure shall exceed a height of thirty -five feet above average grade level. This requirement may be modified if the view of a substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying zoning, and if the proposed development is agricultural, water related or water dependent. No structures are proposed for construction as part of this project. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. Prior to construction the applicant is required to obtain the necessary permits from the City's Public Work's Department. These permits will require the submittal of a temporary erosion control plan for construction activities. The plan must be approved prior to construction activities. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. This criterion is not applicable, as the King County shoreline environment designation adjacent to this site as "Urban Environment ". E (1) Parking areas must be located beneath or upland of the development... E (2) Any outdoor parking area perimeter... must be maintained as a planting area with a minimum of five feet. E (3) One live tree...shall be required for each thirty linear feet of planting area. E (4) One live shrub...for each 60 inches of planting area shall be required. E (5) Additional perimeter and interior landscaping of parking areas may be required when large parking areas are proposed. Parking currently exists within the shoreline. The applicant proposes to re- stripe areas that will be disturbed by the removal of asphalt for the additional landscaped area. F. Collection facilities to control and separate contaminants shall be required where storm -water runoff from impervious surfaces would degrade or add to the pollution of receipt waters or adjacent properties. Any water discharged into the Duwamish River will meet all State and Federal water quality standards. The project will remove 19,000 square feet of impervious pavement to install new landscaping, which will reduce the amount of storm water runoff. No other site work is occurring at this time other than re- striping of parking stalls which will not affect storm water run off. G. The regulations of this chapter have been categorized in a number of sections; regardless of the categorization of the various regulations, all developments must comply with all applicable regulations. The proposed project will comply with all applicable Shoreline regulations. H. Development proposed on shorelines of the State shall maintain setbacks, provide easements or otherwise develop the site to permit a trail to be constructed or public access to continue where; 1. There is a proposed trail in the King County Trail system; or 2. Part of the site is presently being used and has historically been used for public access. The site is not part of the King County trail system nor has it been used historically for public access to the shoreline as it is not immediately adjacent to the river. Public Comments • • Comments were received via a telephone call from Karen Walter, Muckleshoot Indian Tribe in response to the Notice of Application. Ms. Walter expressed concern that some non - native plantings were shown in the proposed landscaping plan and asked whether any work on the storm water system was taking place and urged the incorporation of low impact development techniques or rain gardens in the site development. The applicant has responded that the landscaping plan will be revised to use native planting materials and that no work is taking place at this time on the storm water system. At the time development planning is conducted for the site, low impact storm water treatment techniques will be considered. A copy of the e-mails of these comments and applicant responses is attached. VI. SEPA and other City approvals The site is located within the Manufacturing Industrial Center/Heavy Planned Action area and meets the requirements for a SEPA Planned Action (E07 -008), which was issued on July 24, 2007. The applicant will be required to obtain a Public Works permit. VII. Recommendation Approval of the shoreline substantial development permit with the following condition: 1. This permit was issued August 1, 2007 to remove approximately 19,000 sq. ft. of impervious surface and existing landscaping and was due to expire on August 1, 2009. On July 15, 2009 the Sabey Corporation requested a one year extension of this permit. The request was approved and the deadline to begin work was extended to August 1, 2010. At our site visit, you pointed out work on the site that had begun prior to the August 1, 2010 deadline. The work begun under this shoreline substantial development permit must be completed by August 1, 2912. As we discussed on -site, the City has adopted a new shoreline master program. This program will not be in effect until it receives approval from the Department of Ecology. However, the issuance of the shoreline substantial development permit does not vest the project to the current shoreline master program - only issuance of a building or public works permit will do that. The work authorized under the shoreline substantial development permit requires a public works permit. If you would like the project to be vested to the current SMP you may want to apply for the PW permit as soon as possible as it is not clear when the City's new SMP will receive approval from the Department of Ecology. The 21 day appeal period begins when the Department of Ecology receives the material, which I estimate will be on August 3rd I received comments on the project from Public Works staff that will need to be addressed in the materials you submit when you apply for the Public Works permit to carry out the site work. If you have any questions on these comments, please contact Joanna Spencer, Development Engineer at 206 - 433 -0179. 1. The proposed improvements trigger a Public Works Type C construction permit. 2. Vertical and horizontal datum information is missing on the plans submitted for Shoreline Permit. Please provide this information on the plans that are submitted for the Type C permit. Refer to page 26 of City of Tukwila Public Works Development Guidelines and Design and Construction Standards Second Edition for datum requirements. Public Works Bulletins addressing permit fees, requirements for work inside City Right of Way, plan submittal guidelines, standard construction plan notes and erosion prevention/sediment control requirements are enclosed for your use. 4. Please note that plans shall be prepared using an engineer's scale, 1"=20' for horizontal and 1"=2' for vertical shall be used. 5. Basically they are fine with substituting native plants in the landscaping and there is no work going on with the storm water system at this point. The reference to the County's storm water regulations is because this site is governed by the County's SMP and their criteria reference that chapter in the K.C.C. - hence the generic response. In the future, whenever the site is redeveloped they will consider low impact type development (and we would be looking to see it as well - we've got someone looking at climate change issues and what changes are needed to our code to encourage /require LID type development). I mentioned during our conversation that I had talked with Karen Walter, Watershed and Land Use Team Leader for the Muckleshoot Indian Tribe. She called with a question and a concern about the landscaping. Her concern about the landscaping is that some of the proposed plantings are non - native species and that native plantings should be used since some of the area falls within the shoreline. Her second concern was a question related to the reference to King County's code on storm water (the reference to the County's storm water requirements is found in 25.16.030 General Requirements, subsection in the County shoreline criteria that were provided with the shoreline substantial development permit) - she wondered if any storm water work was planned during this phase. If there is any storm water work going on in this phase, she thinks that rain gardens or other types of low impact development should be included in any redevelopment of the site to reduce development impacts. A. Nonwater related development and residential development shall not be permitted waterward of the ordinary high water mark. None of the proposed project or project - related activities are waterward of the ordinary high water mark B. Except in those cases when the height requirements of the underlying zones are more restrictive, no structure shall exceed a height of thirty-five feet above average grade level. This requirement may be modified if the view of a substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying zoning, and if the proposed development is agricultural, water related or water dependent. CRITERIA FOR PROJECTS SUBJECT TO THE CITY OF TUKWILA DEVELOPMENT SHORELINE REGULATIONS General Shoreline Regulations (TMC 18.44.110) All uses within the shoreline overlay district must conform to the following general regulations: 1. The use is in conformance with the regulations of the underlying zone district; The underlying zone district is Manufacturing Industrial Center /Heavy. The proposed project is in conformance with all land use regulations associated with this zone. 2. The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations; The proposed project provides landscaping and sidewalk improvements and does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. 3.
